NEW YORK CITY 911 DIRECT ACCESS LAW - SYNOPSISWHEN IS IT IN FORCE? Effective IMMEDIATELY upon signing by Mayor

WHO MUST COMPLY? Any existing MLTS systems has until May 1, 2019 (2 years)

NEW MLTS Systems – must comply immediately

WHO WILL ENFORCE IT? Mayor will appoint an agency responsible

WHAT IS COVERED? Test calls allowed if scheduled

On site notification REQUIRED

Direct access to 911 without PREFIX Required

CAN A WAIVER BE OBTAINED? YES with documentation of Make and Model and cost estimates to remediate

WHAT IS THE PENALTY? Upon complaint – 30 day grace period to correct

After 30 days $250 fine / $500 fine for second offense

New offense every 10 days


§ 10-176 DEFINITIONS OF IMPORTANT TERMS

4 Administering agency responsible. Offices or agencies designated by the mayor, to administer and enforce the provisions of this section

4 Covered business –Any sole proprietorship, partnership, association, joint venture, corporation or other form of business organization which opens its facilities to the general public for the sale and purchase of goods or services.

4 Multi-line telephone system -A system accessible to the general public comprised of common control units, telephone sets, which enables users to make and receive telephone calls. Includes:(i) network-based, such as Centrex (ii) premises-based, hosted and cloud-based VoIP(iii) private branch exchanges(iv) key telephone systems(v) hybrid key telephone systems.


KARI’S LAW HAS THREE COMPONENTS

ON SITE NOTIFICATION DIRECT ROUTING9-1-1 must be able to bedialed on all telephoneextensions - without theuse of any prefix, postfixor trunk access code.

When an emergency call isoriginated in an MLTS, on-site notification must beprovided.

Calls to 911 cannot beintercepted. They must berouted directly to theauthorized agency thatservices the address.

WHAT THE LAW NYC 911 SAYS

4 [S]hall be configured to allow a person initiating a 911 call on such system to directly access 911 service […]

4 [B]y dialing the digits 911 without any additional code, digit, prefix, postfix or trunk-access code.

4 [S]hall be configured to provide, to a centralized location on such system, notification of any 911 call made on such system.

TESTING 1 – 2 – 3 . . . IS THIS THING ON?

4 A covered business may schedule and conduct a test call for their multi-line telephone system to ensure such system can directly access 911 service by dialing the digits 911 without any additional code, digit, prefix, postfix or trunk-access code.

4 Any such test call must be scheduled with and conducted in conjunction with the police department.

ENFORCEMENT OF THE LAW - PENALTIES

4 Upon receipt of a complaint the administering agency shall investigate such allegation and issue a notice of non-compliance if applicable.

If within 30 days the condition is corrected, then the covered business shall not be subject to a civil penalty.

Failure to correct such condition within 30 days subjects a business to a civil penalty of not less than $250 for the first violation and not less than $500 for each subsequent violation

New fines are possible every 10-days


OBTAINING A WAIVER – 3 REQUIREMENTS

4 Businesses shall not be subject to a civil penaltyfor such violation if – Business establishes that the requirements would be

unduly and unreasonably costly to comply with and – Business identifies the manufacturer and model number

of the MLTS that needs to be reprogrammed or replaced and

– Establishes they made a good faith attempt to reprogram or replace the system
