I became involved in leadership of the Lafayette Bar Association during a transition period. While transitions involve a larger than usual time commitment, the additional work has also been a gi�. As my colleagues and I worked our way through, we had to learn how things worked at a greater depth. A bene�t of the extra work was the opportunity to question why the Association operated the way we did and how the Association had evolved to reach its current identity. We reviewed Board meeting minutes from past years and had numerous conversations with past Board presidents and others to learn the why behind the what. �is process has given me great appreciation for the time and care exercised not only by the Association’s past presidents, but also many others in positions of service with the Association. I appreciate all that has been done before me, and I hope my service honors all of you who have served. I promise to do my best during this year of service.

�e Association is heading into the �nal year of a three-year strategicplan, which was developed during Kyle Gideon’s presidency andcontinued with Danielle Cromwell. �e overriding goal of our plan isto increase the level of engagement of and service to all segments ofour membership. We have made great strides in that regard, includingthe Hall of Fame event, as well as Practice Power Hours, where we hostCLEs that appeal to practice areas that are not traditionally served byour other course o�erings and networking events. Another e�ort hasbeen to include non-Board members on committees so that we havemore members of the Association involved in the events that we host.While the Board of Directors reaches out to engage our members, it isso very nice when members take the initiative and express an interestin serving. If you would like to see a program started or want to beinvolved in an existing program, please give me or any Board membera call. We’ll get you plugged in.

For the �nal year of the strategic plan, I would like to see the Association accept these changes and the goal of broader engagement as the new normal. Instead of an outreach or special initiative, this e�ort will be standard operating procedure−a year of fully embracing the new programs, fully embracing enhanced member service, and fully embracing responsiveness to the needs of all of our members. �is is the year to water and feed these initiatives and watch them grow.

When I have mentioned my new role to friends and colleagues around the state, it has always been met with congratulations, a measure of respect and most signi�cantly, a compliment of the Lafayette legal community. It is truly a privilege to serve as your representative. I look forward to working with and for you, and hope to see you soon!

As 2016 draws to a close, I’d like to thank the many members who have given their time, energy, e�ort and graciously opened their homes and wallets to help those in need. Within hours of the catastrophic �oods in August, members of the Lafayette Bar Association and Foundation Boards gathered here at the LBA to �nd a way to help our sta� and members who were a�ected. Within days, not only had we raised a signi�cant amount of money, but we’d also helped connect attorneys with other members who were able to o�er o�ce space and even housing to those in need. As someone who was personally a�ected and a recipient of the �ood relief donations, I can say with absolute certainty

that these funds made a direct and important impact on those in need.I will be forever grateful to everyone who donated and assisted with the program.

�e generosity has continued with a hugely successful Young LawyersHoliday Giving program. Over $14,000 was raised to adopt familiesa�ected by the �ooding, making it possible for them to have Christmasgi�s for their families as well as much needed furniture and supplies tohelp them return to their homes. Many thanks to Mandi Borne Bucher,Quincy Mouton, Dan Phillips and Travis Broussard for making thispossible.

�e �rst event of 2017 will be Red Mass and Court Opening on Friday,January 13th. We will welcome 28 new lawyers to the 15th JudicialDistrict Court. Please contact the LBA sta� at 237-4700 if you knowany attorneys who are new to Lafayette if not new to the bar.

Also, please be on the lookout for an email in early January with your 2017 dues renewal notice. We’ve made it even easier to pay dues and register for events online. Please let us know if you need any assistance logging into the new member portal, and the LBA sta� will walk you through the process.

Finally, I’d like to thank outgoing LBA President Danielle Cromwell for her leadership, service to the bar, unwavering enthusiasm and endless supply of creative ideas during this past year.

Family Law Section

GREG KOURY, PRESIDENT�e LBA Family Law Section has now completed its business for 2016,and we had an excellent Christmas Party that was expertly hosted byHearing O�cer Maggie Simar at her beautiful new home on December3, 2016.

At our most recent meeting and CLE on November 14, Dr. Luke Elliott provided our members with an overview of the Better Options Initiative.�e BOI is a non-pro�t organization that provides free therapy andeducation to adults in con�ict-oriented parenting situations. �e BOIcollaborates with mental health workers, attorneys, clergy, and educators to resolve problems associated with parental con�ict. �is CLE cappedo� the 9.0 hours of family law specialization credit provided to ourmembers for the year.

Importantly, the FLS is continuing its “Pass the Hat for Avec” campaign for the bene�t of Avec Les Enfants, and will be accepting donations for the rest of the year. Our goal is to further the mission of Avec Les Enfants, which is to provide a safe and secure place for children to visit with non-custodial parents and for exchanges and visitation to occur in a safe manner. Avec is in need at present as it has had to relocate its facility in short order and at great expense. In sum, 2016 was another year of full of fellowship and CLE opportunities for our FLS members. Our organization is widely regarded for the strength, knowledge, and quality of our membership and programs. It has been my pleasure to serve as president for the year. Richard Mere will be taking over for 2017, and he and the new o�cers will continue the mission and tradition of excellence of the FLS. Any lawyer in Acadiana who practices family law at any level should make joining the FLS a priority.

Be a cheerful giver.

As we dash through the holidays and into the New Year, many of us will be contemplating and ultimately setting new year’s resolutions or goals for 2017. A great number of us may be thinking about how to grow our practices or to develop our skill sets as lawyers. Some of us may be transitioning into new careers or still trying to �gure out where we most “belong.” But hopefully all of us are considering how we can continue to serve our community, to foster professionalism within our bar, and to spread goodwill for the practice of law.

Each year the Lafayette Young Lawyer’s Association (LYLA) works in connection with the Lafayette Bar Association to organize and put on dozens of programs that serve our community and our bar association.Beginning as early as January, we host events like CLE programs for the bene�t of our bar. We also host campus outreach events at UL to o�er insight to and answer questions from possible future members ofour bar. In February, aided by more than ��y dedicated volunteers, wehost our annual mock trial competition for the bene�t of approximately eight community high schools and more than 60 students. Each spring,we sponsor a Wills for Heroes program, whereby members dra� willsand other estate planning documents for �rst responders in LafayetteParish.

We could not host these valuable annual events without the scores of volunteers and generous �nancial patrons who populate our bar association. Your contributions are appreciated more than you know.�e simple act of volunteering an hour of time to work at an event ormentor a young attorney makes a world of di�erence. contributions,in addition to those of our community partners, have been vital to ourability to sustain these programs each year. We appreciate all of you who have been committed to helping us advance these important programs,and we look forward to partnering with you again throughout 2017. �ree thoughts spring to mind when I think of Missy �eriot,the incoming president of the Lafayette Bar Association. She is amulti-talented lawyer, a dedicated citizen, and a devoted mother,grandmother, and friend. Not surprisingly, all of these attributes arisefrom one common thread: the desire to serve others — her clients, hercommunity, and her family and friends. Whether working long hourson a brief, volunteering with Downtown Lafayette Unlimited, or takingcare of her new grandson, Beau, Missy has the interest of her client, hercity, or her family at heart. Because of this, she always does her best andalways gives her all, and for these reasons she is amazing at so much ofwhat she does.

Missy’s path to the LBA Presidency began with her graduation as Valedictorian from Acadiana High School in 1985. Missy then went to LSU where she graduated cum laude with a Bachelor of Science degree in 1989, while at the same time managing to get married and have her two sons, Garrett and Kellen. With those two babies in tow, Missy then moved to Texas where she earned a Doctor of Jurisprudence with Honors from the University of Texas School of Law in 1993. While at UT, Missy also interned with Justice Jimmy Carroll, Chief Justice of the Texas �ird Court of Appeals. In her spare time, Missy played �ag footballand taught legal research and writing to �rst year students, bringing her babies along as the team mascots and her students’ cheering up squad(Missy must have �gured since she could not sleep anyway with twolittle ones, she would put her time to good use. In contrast, when I hadmy babies, I just seemed to whine a lot).

A�er graduation, Missy moved back to Lafayette, and much to my delight, began her career at Laborde & Neuner, now NeunerPate, where she is a partner and has practiced for over 22 years. �ere, her abilities were immediately recognized and put to use on a limitation of liability proceeding involving a vessel named the Gulf Miss. Within hours, the case that lasted for years was renamed the Gulf Missy, and it was on this case that Missy and I began working together and commenced a lifelong friendship.

Missy’s legal experience is extensive. It includestrial and appellate work in the �elds of admiralty and maritime personal injury, maritime contract, allision, and seizure, and general commercial litigation. Missy

also handles environmental and toxic tort litigation, general insurance defense and coverage matters, credit card litigation, and contractual disputes. Missy’s caseload includes large complex cases as well as high volume litigation. For example, Missy supervised a team of lawyers and sta� in litigation involving 1200 Hurricane Katrina �rst party actions against a national insurer. In addition to her legal practice, Missy is also fortunate in having spent a year clerking for �e Honorable John M.Duhé, while Judge Duhé was on the United States Court of Appeals for the Fi�h Circuit (Although knowing Missy’s abilities, it is my opinion that Judge Duhé was similarly fortunate in having Missy as his clerk).

Missy has been extraordinarily active professionally, taking on countless responsibilities and earning numerous honors. She has been on the board of the Lafayette Bar Association since 2012. Before serving as president of the LBA, she was president-elect, secretary/treasurer, and chair of the committee to rewrite the LBA bylaws. Missy has also been a frequent speaker at CLE conferences and seminars and has chaired a number of seminars on behalf of the LBA, including the perennial favorite Bench-Bar Conference. Missy was also president of the Lafayette Young Lawyers Association, and has been a member of both the Acadiana Inns of Court and the John M. Duhé Inns of Court, where she served as Treasurer and on the Program Committee. She is presently listed as a Top Lawyer in Admiralty & Maritime Law in Acadiana Pro�le magazine and has Martindale-Hubbell’s AV Preeminent rating.

�is year, the Louisiana Supreme Court appointed Missy to thefourteen-person Louisiana Attorney Disciplinary Board. Missy servesas a chair of one of the Board’s Adjudicative Panels, which functions asthe appellate courts in the disciplinary process. Missy had previouslyserved as a member of the Louisiana Attorney Disciplinary BoardHearing Committee for over ten years and chairperson of the hearingcommittee for more than �ve years.

In addition to her professional activities, Missy also unstintingly gives her time and talents to our community. Missy serves as one of twenty board members of Downtown Lafayette Unlimited, a non-pro�t corporation formed to promote downtown Lafayette. Missy is presently on the DLU Nominating Committee, having previously served on DLU’s Executive Finance Committee. �rough DLU, Missy and other

community leaders work to improve our downtown, the success of which is evidenced by programs such as Downtown Alive, Art Walk, Movies in the Park, and a number of other downtown initiatives.

As if that was not enough, Missy’s dedication to Lafayette and its citizens does not stop with her legal work, the LBA, and the DLU. �e Lafayette City-Parish Council has twice appointed Missy as trustee to the Lafayette Public Trust Financing Authority. LPTFA is a self-supporting public trust created to further and accomplish public functions for the bene�t of citizens of the city and parish of Lafayette. Missy and the other six trustees of LPTFA use the trust’s �nancial resources to bene�t the people of our community, particularly those who are under-served.LPTFA programs include help for �rst time homebuyers and housing support for people in need. LPTFA also supports �e Horse Farm, Acadiana Center for the Arts, Rosa Parks Multi-Model Transportation Center, Cypress Trails, and a host of other worthy programs we all enjoy and upon which we have come to rely.

In short, Missy has a full and demanding career as well as a true commitment to the legal profession and to our community at large.From this, it is easy to see that Missy possesses those particular qualities that we all admire, such as leadership, wisdom, ambition, dedication, talent, commitment, determination, and enthusiasm. However, any one who knows Missy knows that she has qualities that are far more important. She raised her two boys as a single mom, while practicing law full time and volunteering where she saw a need. She is honest and kind, she is compassionate and generous, she has integrity and humility, she is loyal and caring. She is a good person. For all these reasons, the Lafayette Bar Association is lucky to have Missy �eriot as its president and I am lucky to have her as my friend.

Judge Smith took time from his busy schedule to tell us a little more about himself and to o�er valuable advice to attorneys who practice in his court.

Did you always know you wanted to be a lawyer?

Not 100%, but my mom always said I had it in me. I hope she meant that in a good way!

Who has most in�uenced your career and why?

I think my parents have most in�uenced my career. �ey pushed my siblings and I to always do the right thing and to con�dent enough to stand up for what is right.

What is the most rewarding aspect of being a judge? �e most challenging?

�e most rewarding aspect of being a judge is the ability to help othersand see the e�ects of your help.

�e most challenging aspect is that sometimes you really want to helppeople in certain situations, but to be fair requires you to be neutral.

Is there anything that you learned as a judge that you wish you knew as a practicing attorney?

Absolutely! What I have learned could �ll volumes. However, I believe that I have learned how to be much more patient with others.

What are the common mistakes that lawyers make when they appear before you?

We are put in precarious positions o�en on a daily basis. One mistake, as far as I am concerned, is not to tell the judge all of the relevant facts.Quite o�en, attorneys only want the judge to know one side of the story.I like to know the ‘pros and cons’ and make an informed decision based on all the facts.Full disclosure of the facts also creates a relationship of trust between ju dges and lawyers. It certainly goes a long way with me.

What do you do when you’re not presiding on the bench or poring over briefs?

Playing with my �ve (soon to be six!) children, hunting, �shing and cooking.

On Sept 30, nine Northside High School mock trial team members and their coaches departed Lafayette for New Haven, Connecticut to participate in the Yale High School Bulldog Invitational mock trial competition. �e NHS mock trial team was one of sixteen teams from around the United States to compete.

During the competition weekend, our team competed in a total of four rounds, litigating the civil case of “Commonwealth of Pennsylvania v. Maddox Hale”. �e case centered around injuries su�ered by aSecurity Guard during a “�ash mob” that occurred during a studentcouncil rally led by Maddox Hale. �e Commonwealth argued thatHale should have been punished for inciting a riot and causing bodilyinjuries. �e entire weekend was a great experience for the NHSmock trial team, with team members receiving valuable “critiquesand suggestions” on their style and performance. �e weekend wasparticularly special for Christian Duhon, one of our team members,who was presented with a “best witness” award.

�e LBA’s annual Bench Bar Conference started o� with a big bang inNew Orleans at Le Meridien! Guests arrived for a weekend getaway�lled with entertainment and educationally packed CLE coursespresented by highly esteemed judges and attorneys from around thestate of Louisiana.

On October 6th, guests checked into the beautiful Le Meridien Hotel.Later that evening, they went to Big Mama’s Lounge at the House of Blues for a cocktail party.

On October 7th, Maggie Simar, Bench Bar Conference Chair, welcomed a room packed with attorneys and judges to the 2016 Bench Bar Conference.

For lunch, guests dined at Emeril’s. Attorney Dane Ciolino presented a CLE titled “Professionalism and the Public”. Immediately following the lunch, the Judicial Round Robin CLE took place. �is CLE is unique because it gives experienced and young attorneys a chance to spend one-on-one time with judges. �ere were over 12 judges who participated in the Judicial Round Robin, making it a true learning experience for attorneys looking to gain more valuable knowledge in their career �eld.

A�er a day �lled with activities, the conference ended with a relaxing evening at the Blue Room in the Roosevelt Hotel.

Overall, the Bench Bar Conference was a huge success, and all the attendees expressed sincere enthusiasm and excitement for next year’s conference. It could not have been successful without the generous support of our sponsors and members. �e conference had 25 �rm sponsors along with many corporate sponsors. �ank you to everyone who made the Bench Bar Conference possible!

Craig Ryan has been practicing law for over twenty-�ve years. He is a Shareholder at Onebane Law Firm, practicing in the �rm’s Business and Commercial Section, with a focus on business, banking and commercial transactions, contracts, collections and bankruptcy, and realestate matters.

Craig grew up in a large family in Baton Rouge, Louisiana. He worked in the family automobile business and married Kim, his high school sweetheart, in 1980. �ey have three children and six grandchildren.

Serving others is a priority and a passion for Craig. He has traveled extensively in Latin America and Haiti on water well drilling trips to help bring clean drinking water to communities in need. He is also a leader in Youngsville Community Church.

In 2006, Craig went on his �rst trip to Latin America to help build water wells for less fortunate communities. �rough Living Water International, Craig has gone on six such trips. Living Water International is a faith-based non-pro�t organization that facilitates trips to impoverished countries for the purpose of constructing water wells, and supplies both equipment and labor toward this end. Craig recently returned from one of these missions in Cap-Haitien, Haiti, which is along Haiti’s Northeastern border with the Dominican Republic.

Any group can volunteer with Living Water International to participate in the construction of a water well. Typically, there are two teams: a team of well drillers and a health and hygiene team. Teams are composed of volunteers from the United States as well as locals who are experienced in drilling wells and who help to train new volunteers.

It usually takes three days to drill a water well. On the fourth day, there is a dedication ceremony for the well. Upon completion, the well provides an entire community with clean and safe water for drinking, cooking and bathing. Wells are maintained routinely, once every couple of years.

MAIL AND EMAIL, and CLICK BAIT and other annoyances of modern life.

�is is the last in a series on the marvels of modern communication.“Marvels” here is in the eye of the beholder. Unwanted mail, emailand that particularly annoying subset of email, “click bait,” now �llmy mailbox, inbox and web searches, outnumbering wanted mail,email and search results by a frustratingly large factor. I post here my10 favorite attention grabbing subject lines and titles, in an ocean ofinformation (my unspoken response in italics):

1. “Last Chance.” Or its cousin, “Don’t Miss Out.” Or its cousin, “Startsin One Hour.” Or, “You Missed Out, But Have Another Chance: Startsin One Hour.” Please, just start without me.

2. Don’t Miss a Beat. Now, that’s important. Need those heartbeats.

3. Alert: Room Block Expiring. Uh huh, you overbooked and now it’s myproblem?

4. We do not have you signed up. Uh huh, I know. �at is not an accident.

5. Anything with an exclamation point. Worse with multiple exclamation points.

6. Anything in all caps. Please don’t shout at me.

7. �is is just for you. You’ve known me for four seconds, and you alreadyknow what’s just for me?

8. Anything with the word “opportunity” in it.

9. Good news! Good news I get these days, no one already knows it’s goodnews for me.

10. You were selected from an exclusive list. Appealing to my ego.

Try signing up for something under an intentionally misspelled name to track who is selling your name to other solicitors. When an email pops up with that wrong spelling, you’ll know the origin.

When you get solicitations via U.S. Mail, stu� the envelope and the contents of the envelope into the self-addressed stamped envelope enclosed, and into the self addressed stamped envelope enclosed, and put it back in the mailbox. �at way, the trash ends up in their land�ll and not our land�ll. At home, there is a trash can strategically placed on my path between my mailbox and my desk.

10. Anything with “Corrected!” in it. If you have to correct, then whatmakes you think I have con�dence in your seminar on Metrics andAnalytics?

11. Reptilian Tactics or Rambo Tactics. Now, you have my attention!

12. Kyle Gideon’s invitation is waiting for your response. I certainly don’t want to snub Kyle Gideon.

13. Wanna win a getaway to a private island in Belize? Nope. I really,really don’t. I once sat next to a pool in Cabo all day watching people whoaccepted a trip there to take a tour of the condos. �ey looked like theywere about to publically eviscerate themselves.

�ere used to be a program on TV titled “Lifestyles of the Rich andFamous.” Sitting through one show was enough to make you want to bepoor and obscure, much like the attention grabbing email titles.
