ContexteLa Commission des services financiers et des services auxconsommateurs (Commission) a approuvé, le 29 septembre2014, la publication aux fins de commentaires du projet deRègle INS-001 Droits exigibles. Le projet de Règle INS-001 aété publié aux fins de commentaires le 25 février 2015. La pé-riode de consultation devait prendre fin le 27 avril 2015, mais aété prolongée jusqu’au 1er mai 2015 à la demande d’un interve-nant.

BackgroundOn 29 September 2014, the Financial and Consumer ServicesCommission (Commission) approved the publication in order toobtain comments on the proposed Rule INS-001 Fees. On Feb-ruary 25, 2015, the Financial and Consumer Services Commis-sion published for comment proposed Rule INS-001 Fees. Thecomment period was scheduled to close on April 27, 2015, butwas extended to May 1, 2015 at the request of a stakeholder.

Amendments to proposed Rule INS-001When proposed Rule INS-001 was initially drafted, it wasthought that the Commission had the authority to move certainprovisions which appeared accessory to fees out of the regula-tions under the Insurance Act and into the proposed RuleINS-001. This included the length of duration of a licence, therenewal of licences, and the application process for a licence.Upon further consideration, the Commission has decided that itdoes not have the authority to move these provisions into itsproposed Rule INS-001. As a result, following the initial com-ment period, the Commission made alterations to proposedRule INS-001 to remove these provisions. The alterations areindicated in red and pink text in proposed Rule INS-001.

Request for CommentsThe altered proposed Rule INS-001 Fees is being re-publishedfor a 30-day comment period from 26 August 2015 to 25 Sep-tember 2015. EnColombie-Britannique, les émetteurs déposent le formulaire45-106F6, intitulée British Columbia Report of Exempt Distri-bution. Les modifications proposées remplaceront les déclarations ac-tuelles par les déclarations proposées et :

• faciliteront la conformité pour les émetteurs et les pre-neurs fermes en ayant un rapport harmonisé;

IntroductionOn 27 July 2015, the Financial and Consumer Services Com-mission (Commission) approved publication in order to obtaincomments on the proposed amendments.

Substance and Purpose of Proposed AmendmentsThe proposed amendments are intended to introduce a harmo-nized report of exempt distribution. Issuers who rely on certainprospectus exemptions to distribute securities are required tofile a report of exempt distribution, but that form is not currentlyharmonized. In all CSA jurisdictions except British Columbia,the form of report is Form 45-106F1 Report of Exempt Distri-bution, while in British Columbia issuers file Form 45-106F6British Columbia Report of Exempt Distribution.

The proposed amendments will replace the current reports withthe proposed report, while

• Reducing the compliance burden for issuers and under-writers by having a harmonized report; and

• Providing the Commission with necessary information tofacilitate more effective regulatory oversight of the ex-empt market and improve policy development.

1 Section 2 of New Brunswick Regulation 83-42 un-der the Motor Vehicle Act is amended by repealing thedefinition “municipality” and substituting the follow-ing:
