TN-URBAN WATER SUPPLY

Safeguard Policy Issues / Land Acquisition Plan

Prior to appraisal, the Borrower contracted a qualified consultant to prepare an EnvironmentalAssessment of the Project including a review of potential environmental impacts and development ofappropriate mitigation measures. The Environmental Assessment Report is available in theSONEDE's Project files and the Bank's Infoshop.

EnvironmentThe project is expected to bring significant environmental, socio economic and public health benefitsthrough better quality and availability of treated water, and improvements in the sustainability of rawwater sources through reductions in losses and wastage.

Only limited and temporally negative impacts are expected during construction phase while someadverse impacts may result from the operation of water treatment facilities and potable water wells ifthey are failures in their design, implementation and operation. Potential impacts during constructionand operation phases involve:

(a) Impacts were surveyed on air and water quality and noise, resulting from excavation work,machinery operation, and traffic as a result of construction and rehabilitation of transmission anddistribution networks, construction of storage reservoirs in urban area and the water treatment plant.These impacts will be localized, temporary and minimal, due to the EMP mitigation measures.(b) Unsustainable use of the groundwater resources: Creation of wells for potable water is among thesubprojects requiring environmental screening. For each drinking water well, the Bank will requiredocumentation (from DGRE) that demonstrates the water requirement of the project in relation to thecurrent exploitation and renewable resource status of the aquifer involved.(c) ST4, the planned water treatment plant will remove sediments, iron and minerals, and precipitatesfrom intake waters and might produce sludge contaminated with chemical/hazardous pollutants. Thecontractor in charge of the design and construction of ST4 will be requested to prepare an EAincluding the development and implementation of a sludge management plan for the whole watertreatment pole in Ghdir-el-Golla. ToRs for this specific EA will be included in ST4 biding documents.(d) The potential water quality and health risks of additional water supply causing overloading ofsewerage, treatment and disposal systems were reviewed. It is expected to be minimal since most ofthe planned subprojects will have limited implications for increased wastewater production.Nevertheless, the EMP includes provisions for a rapid EA screening/appraisal for some urban centresin order to identify appropriate mitigation measures.

In general, the project, through the implementation of the developed EMP below, is not expected tohave significant negative environmental impacts and will not generate any health damage.

Land Acquisition PlanUnder the Environmental Assessment, special attention was made for OP 4.12 on involuntaryresettlement. It was confirmed that only a small amount of land will be needed for storage tanks andpipelines construction/operation with none involving relocation. SONEDE land acquisitionprocedures have been reviewed and deemed satisfactory. Detailed surveys for all known landacquisition have been completed and are summarized in the table below. The main land requirementanticipated will be for the construction of << ST4 >> treatment plant and a storage tank in Ghdir El

SONEDE's tested land acquisition procedures have applied to previous bank financed projects, andprovided in the appendix below.

Cultural Property

The EA report indicates that project activities would not affect any above ground artifacts witharcheological, paleontological, historical, religious, or unique natural values as defined under OPN11.03. However, most of the construction activities will involve excavation work and thus all

contracts will include standard clauses which follow Tunisian law (Law n° 35 of May 9, 1986) andregulations regarding chance finds during construction.

Environmental Mana2ement Plan (EMP)

The objectives of the EMP are to identify feasible, cost effective measures that may be used tomitigate any adverse environmental impacts that might occur during the construction and operation ofthe project. The proposed EMP will consist of three kinds of activities: (i) implementation ofmitigation measures; (ii) monitoring and evaluation of mitigation measures; and (iii) strengthening thecapacities of SONEDE.

Mitigation Measures

Mitigation measures have been identified to ensure that the defined objectives of the project areachieved whilst preventing and reducing any adverse environmental impacts. The mitigation measuresare to be executed by the Construction Contractors with supervision by the SONEDE and involvedgovernmental institutions.

During Construction PhaseConstruction mitigation measures will be required to minimize inconveniences to the public. Suchmitigation measures are standard and widely used in construction practices properly supervised forachievement of international standards of quality. Tables A, B, C et D (construction phase) in the EAreport summarize the major adverse environmental impacts during construction and their mitigationmeasures as well as involved institutions.

Other adverse construction activities will be mitigated through the adoption of Good EnvironmentalPractices given in Annex of the EA report. For instance noisy construction activities can be limited tonormal working hours and providing muffler to minimize noise nuisance. Dust emissions can beavoided by using dust suppression measures such as periodically sprinkling water in certain areas,providing appropriate covers and removal of excess material from the site. Dangerous activities inpublic areas will be controlled to reduce risk to the public, traffic and warning signs will be placed atconstruction sites, trenches will be provided by fences, or railings. The contract with contractors willincorporate all requirements to minimize disturbance from construction activities and will bemonitored by SONEDE (assisted by a Safeguards/Environmentalist Consultant) to ensure compliancewith the contract.

The cost of the mitigation measures during construction will be incorporated in the contract cost ofthe contractor. Moreover, the Bank will review all civil works contracts to ensure that the requiredmitigation measures have been incorporated in the tender documents.

During Operation PhaseThe operation of the water networks and treatment facilities and exploitation of groundwater (wells)can create adverse impacts, which need to be avoided through the implementation of mitigationmeasures. Tables A, B, C and D (operational phase) in the EA report summarizes the potentialimpacts and the proposed mitigation measures. Specific EA will be carried for identified subprojects(see list in the EA report) and will identify more specific safeguards measures.


Monitoring PlanMonitoring of construction activities will have to ensure that mitigation measures of constructionimpacts are being implemented properly, while monitoring of operation activities is to ensure that nounforeseen negative impacts are arising. During construction, the monitoring program will includedust and noise. Monitoring of the water supply will include biological, physical and chemicalparameters as well as heavy metals and pesticides residues. Table under Section 7.3 of the EA reportgives the proposed monitoring requirements during the construction and operational phases.

Institutional StrengtheningThe institutional arrangement and capacities of the organizations in-charge with the implementationand management of the proposed project were reviewed with the intention of providing technicalassistance and reinforcement. Environmental expertise will be strengthened through:

(i) the provision of an environmental expert to (i) assist the SONEDE in supervising theimplementation of the EMP; (ii) the elaboration of ToRs and review of EIE reports for subprojectsrequiring EA during the project implementation; (iii) the elaboration of EMP monitoring reports.

(ii) the provision of training programs that will be designed and implemented with the assistance of alocal or international expert and will cover the following main topics:

* Environmental Assessment* Effective implementation of mitigation measures* Project supervision, monitoring and evaluation

Implementing safeguard requirements

The borrower will hire a partial time safeguards/environmental consultant to assist the ProjectManagement in overseeing and managing the following environmental activities:

* Overall supervision and monitoring the EMP* Preparation of EIA ToRs for ST4 and supervision of relevant consultants works* Preparation of EIA ToRs of pipeline GEG -Ras Tabia and supervision relevant consultants

works* Preparation of ToRs for rapid EA screening/appraisal and reviewing relevant consultants'

reports

The EMP implementation planning includes contracting out the preparation of EIA and DS studies,implementation of environmental training activities, and EMP supervision and reporting. The projectbudget includes funds for the implementation of all safeguards requirements, including the following:

* Hiring a Safeguards/environmental Consultant* Preparing and implementing Specific EIAs and rapid EA screening/appraisal* Preparing and implementing EMPs* Preparing and implementing an awareness workshop on key environmental issues related to

water supply projects


* Training SONEDE staff and other involved institutions in fulfilling their responsibilities formanagement of safeguards issues.

Implementation of EMPs will be monitored by SONEDE regional engineers and/or Safeguardsconsultant as appropriate. The Tunisian EPA will also undertake periodic inspections.
