The regular meeting of the Aurora Public Schools Board of Education will convene in the Dr. Edward and Mrs. Patricia Lord Boardroom of Educational Services Center 4. Individuals wishing to address the Board of Education on a specific agenda item are requested to sign up at the table on the south side of the boardroom prior to discussion of the item. Individuals wishing to address the Board of Education on a non-agenda item are requested to sign up and will be provided an opportunity, limited to three minutes, at the beginning of the meeting and, limited to three minutes, at the end of the meeting during Opportunity for Audience. Please contact the Aurora Public Schools at 303-344-8060, ext. 28988 if, because of a disability, you require special assistance (such as sign language or oral interpreting services) in order to participate in a meeting of the Board of Education. Shepherd called the August 4, 2015, workshop to order at 6:00 p.m.

Roll Call The following members were present:

Pledge of Allegiance Shepherd led the Board and audience in the pledge to the flag. She then welcomed visitors to the meeting.

Approval of Agenda

The August 4, 2015, agenda was amended to include one additional item under Informational Report, Food Services of America 2015-16 Contract Approval. Shepherd moved and Lewis seconded to amend the August 4 Board agenda to include one additional item under Informational Report, Food Services of America 2015-16 Contract Approval. Approval of Minutes The minutes of the regular meeting of the Board of Education held on June 16, 2015, were approved as written.

II. INFORMATIONAL REPORT

Leadership Team Report

Nome Park Lease Brandon Eyre, legal counsel; Joshua Hensley, planning coordinator; and Emily Patterson, The Trust for Public Land, provided the Board with an overview of the

Nome Park Lease. Patterson worked closely with the City of Aurora and Aurora Central High School on expansion plans for Nome Park, which is adjacent to Aurora Central and an important connection to the school. The plan would better serve the needs of Aurora Central students and the neighboring community by allotting space for a new plaza and a community garden through a partnership with Denver Urban Gardens. The plan would also include renovation and expansion of the existing playground and implementation of connective sidewalks. The Aurora Parks Board hosted three public meetings and approved the plan in December. Six stakeholder meetings were held throughout the community in which four were held at Aurora Central, including two with the student leadership class who elected to take on the community garden project as their legacy project. The Trust for Public Land received a National Endowment for the Arts Grant for the 2015-16 school year to place art in the park and is in the process of writing a call for artists to work with the City of Aurora’s art program and engage with Aurora Central students. Hensley explained that representatives from the City of Aurora and The Trust for Public Land approached district staff about two parcels of unutilized land adjacent to Nome Park. He noted that the City of Aurora agreed to rehabilitate both parcels, which will benefit students by providing programming and outdoor learning space, including a community garden and fitness zone for physical education classes. The lease between the district and the City of Aurora is termed for 30 years. Yamrick asked about the number of community stakeholders who attended community forums. Patterson estimates that approximately 200 community stakeholders attended forums. Nelson asked about safety and security plans. Patterson indicated that safety and security were topics of discussion at community forums and shared that law enforcement would be included in future discussions. She added that current plans include clear and visible sightlines throughout the park. Lewis asked about the Board’s role in the planning process. Hensley shared that City of Aurora staff asked if unutilized parcels of land could be utilized as part of an existing project related to the Highline Canal. He noted that a number of internal discussions occurred with central office staff, maintenance and operation staff, and Aurora Central staff and students. He added that the plan is still in the early development stage. Yamrick voiced concerns regarding parking spaces for community stakeholders who wish to take advantage of the community garden. Patterson expressed that neighborhood parks are generally accessed by walking. She shared that street parking would be available as well as a shed for the community to store garden tools. Hensley indicated that a shared-use agreement could be structured between the district and the City of Aurora for parking on district facilities. This item will be included on the August 18 consent agenda for action. Food Services of America 2015-16 Contract Approval The APS Nutrition Services Department collaborated with four metro school districts to create a cooperative entitled Central Colorado Co-op. The cooperative

is made up of APS, Mapleton Public School District, Adams 14 School District and Harrison School District Two. The purpose of the cooperative is to receive the best value for school meal programs within the four districts through a prime vendor. The approximate amount of this contract is $6,000,000. Using a prime vendor will effectively leverage what we spend, improve quality of products and services, reduce infrastructure costs, manage risk, and meet internal and external customer requirements. Fewer orders will be generated leading to fewer trucks delivering products to the district warehouse. This will reduce the number of invoices processed and workload for district employees. Five distributors/vendors submitted RFPs created by the co-op. Two were disqualified for not complying with bid requirements. The vendor selected met all requirements and received the best score on the evaluation score sheet. Price weighted the most points on the evaluation tool. Drevon asked if the cooperative model was new to other districts. Trautenberg replied that this was the first time the cooperative model had been utilized in APS and other districts. Wildman asked if other districts were asked to join the cooperative. Trautenberg believes that conversations occurred with the Cherry Creek School District. Board members requested additional information related to past vendor contracts, cost savings and benefits to the district, ramifications if a district elects to opt out of the cooperative, and total distribution costs among participating districts. Trautenberg will request that Mona Martinez-Brosh, director of Nutrition Services, attend the August 18 Board meeting. This item will be included on the consent agenda for action on August 18, 2015.

Ends Conversation

Open Dialogue Standing Committee Report Yamrick shared that the Hinkley community garden is thriving. She invited Board members to the Hinkley community garden potluck on Monday, August 10, at 6:00 p.m. Lewis reported that feedback received from the strategic plan follow up presentation with the Key Community Response Team, which she and Munn facilitated in July, was extremely positive. She discussed the importance of increasing opportunities to go out into the community to highlight the work of the district and accomplishments of students. Jorgensen mentioned that Chief Accountability Officer Lisa Escárcega received an award for policy advocacy work from the Colorado Association of School Executives. Yamrick and Wildman attended the Not One More Child in Arapahoe County meeting. Yamrick is excited about what is occurring in Arapahoe County in terms of reduced child fatalities, better collaboration with community agencies, and establishment of a statewide number to report cases of child abuse. Wildman added that a representative from the Excelsior Youth Center would like to partner with APS to increase supports for their kids. Wildman recognized Vista PEAK Preparatory Principal Garret Rosa and staff for community engagement work and efforts with parents. Shepherd requested that Jay Grimms, new director of the APS Education Foundation, and Mary Spillane, chair of the APS Education Foundation, provide the Board with an overview of the foundation on August 18.

Future Business Munn noted that new principals and directors will be introduced to the Board on August 18. Chief Academic Officer John Youngquist will provide the Board with a presentation related to high school graduation requirements on August 18. The Board will also be provided with information and recommendations regarding enrollment to capacity challenges over the next couple of months. Yamrick questioned if the workshop would be an appropriate time to discuss opt out options related to state graduation requirements. Munn replied yes. CUBE Summer Issues Seminar Shepherd estimated that more than 200 people attended the recent CUBE Summer Issues Seminar. She highlighted presentations and distributed information that focused on recruitment and retention of superintendents in challenging urban school districts, third grade literacy, and reauthorization and lobbying efforts related to the Elementary and Secondary Education Act. She also highlighted discussions that focused on the increased number of charter schools in urban school districts. Yamrick will represent the Board at the Annual CUBE Conference in Phoenix. She noted major ramifications nationwide if legislation passes and is in favor of having early discussions on potential impacts. Shepherd concurred and indicated that NSBA would most likely provide guidance to assist local boards of education. Did the Board receive information at tonight’s meeting that requires additional information or monitoring? Additional information will be provided to the Board. Board Self-Monitoring Shepherd expressed that tonight’s meeting went very well.

Briefing

After evaluation of bids received, Andrews Foodservice has been selected to provide fresh produce for the purpose of providing school meals to students and staff. Nutrition Services estimates annual expenditures with Andrews Foodservice to be $1,500,000. Nutrition Services entered into a Request for Proposal (RFP) process to solicit bids for fresh produce for the 2015-16 school year. The RFP was advertised on the Rocky Mountain E-Purchasing website. Five vendors responded to the RFP, including Andrews Foodservice, American Produce, Fresh Pack, Fresh Point, and Colo-Pac. The responses were evaluated on key factors such as quality of services offered, ability to provide desired number of deliveries, ability to conform to food safety guidelines,

experience of the firm, management’s experience, product cost and financial capability of the firm. Based on these factors, the award was made to Andrews Foodservice.

3. Meadow Gold Dairy 2015-16 8:00 - 8:05 Purchase Agreement

Briefing

Meadow Gold Dairy has been selected to provide milk and dairy products for the purpose of providing school meals to students and staff. Nutrition Services estimates annual expenditures with Meadow Gold Dairy to be $2,000,000. Nutrition Services entered into a Request for Proposal (RFP) process to solicit bids for milk and dairy products for the 2015-16 school year. The RFP was advertised on the Rocky Mountain E-Purchasing website. Nineteen vendors on the E-Purchasing website were eligible to respond to the RFP. Meadow Gold Dairy was the only vendor to respond to our RFP. Factors considered in the evaluation of this RFP were the ability of the vendor to conform to food safety guidelines, price, and product quality. Based on these factors, the award was made to Meadow Gold Dairy.

A. 1. Food Service of America Staff Responsible – Trautenberg Staff Responsible – Smith 2015- 16 Contract 8:59 - 9:14 (Attachment V-A-1)

After evaluation of bids received, Food Services of America (FSA) has been selected to provide frozen and dry food for the purpose of providing school meals to students and staff. Nutrition Services estimates annual expenditures with Food Services of America to be $6,000,000. Nutrition Services, through the Central Colorado Co-op, entered into a Request for Proposal (RFP) process to solicit bids for frozen and dry food for the 2015-16 school year. The RFP was advertised on the Rocky Mountain E-Purchasing website. Five vendors responded, including FSA, Sysco, Andrews, Front Range, and Hi Liner. Factors considered in the evaluation of the RFP were price, service capability, technology, and overall proposal content. Based on these factors, the award was made to FSA. RECOMMENDATION: The Board of Education approve the agreement with Food

Services of America for the 2015-16 school year.

additions and/or mobile classrooms

In 2014-15, approximately $7 million was spent on food and about $571,000 was spent on supplies to provide school meals to our students and staff. We expect to spend similar amounts in 2015-16.

2. What guidelines are followed for the procurement of Nutrition Services food and supplies? District policy DJB, Purchasing Guidelines, and District regulations DJB-1-R and DJB-2-R, revised December 2013, provide guidance on the District’s current purchasing and solicitation procedures. Quoting from the policy, “All purchases, financial commitments and contracts for services, except insurance premiums and approved capital projects, of $750,000 or more shall be approved by the Board of Education.” Quoting from regulation DJB-1-R, “Cooperative purchasing with other school districts or governmental agencies is encouraged.” Other guidelines for nutritional content of prepared food are dictated by the Healthy Hunger Free Schools Act.

3. What procurement guidelines have been used previously?

Past practices were based on previous policy and regulation. Policy DJB, revised September 2012, states, “Contracts for services or equipment purchases with a unit value of $750,000 or more shall be approved by the Board of Education.” Historically, none of the previous Nutrition Services’ purchases exceeded the unit value rule. Previous guidance also encouraged the use of cooperative purchasing agreements.

4. Why is the agreement with Food Service of America (FSA) different from previous agreements?

The agreement with FSA is the first time that Nutrition Services has entered into an agreement with a “prime vendor.” A prime vendor contract is defined as a pricing mechanism that distributors offer to operators for items operators frequently buy. The prime vendor contract provides a degree of assurance that the vendor has a market for the company’s products and the operator (Nutrition Services) has a reliable supply of goods at a reasonable cost. In 2014-15, Nutrition Services used a variety of vendors and purchased food from 15 vendors. These vendors were Andrews Foodservice, Atlas Distributing, Churchfield, Dawn Foods, Front Range Wholesale, Stafford Flour, Stillman

Meats, Sysco Denver, Advance Beef, Cargill Food Solutions, Jennie-O Turkey, JTM Foods, Land-O-Lakes, Michael Food, and Tyson Chicken. In 2015-16, Nutrition Services will consolidate food buying purchases to a single prime vendor, FSA. In addition, this is the first time that Nutrition Services entered into a cooperative buying agreement with three other school districts. APS currently participates in other buying cooperatives. Examples are: US Communities, Western States Contracting Alliance, BOCES and the Cooperative Educational Purchasing Council. These coops provide classroom furniture, technology items, LED signage, audio/visual equipment, appliances, marker boards and more.

5. What was the procedure followed for the FSA award? The Request for Proposal (RFP) was posted on the Rocky Mountain E-Purchasing website. APS routinely uses this website to advertise its RFPs. Five vendors responded to the RFP: FSA, Sysco, Andrews, Front Range, and Hi Liner. Representatives (senior management) from the four districts in the cooperative reviewed the responses and rated them for price, service capability, technology, and overall proposal content. FSA received the highest score and received the award.

6. How is the District financially obligated to the four-district cooperative?

Any other obligations to the cooperative?

APS’s only financial obligation is limited to paying for the items that we purchase. Listed below is the RFP language that explains how the coop or part of the coop may cancel or terminate services with the prime vendor. Termination – The Contracting Officer, by written notice, may terminate this contract, in whole or in part, when it is in the Government’s interest. If this contract is terminated, the Government shall be liable only for payment of this contract for services rendered or goods provided before the effective date of termination.

7. What are the advantages of participating in the four-district cooperative?

The purchasing cooperative is formed and operated to meet the needs of its members. The cooperative leverages the collective expertise of its professionals. The cooperative also streamlines the administration and procurement practices. Cooperatives leverage the buying power of four school districts to purchase products or services. Historically, APS food prices have increased about eight percent each year. An analysis of high volume items, based on co-op prices, indicates an average cost decrease of about six percent. Please see the price comparison and projected cost analysis on the last page of this FAQ. Based on market conditions, some food prices could increase while others decrease. The

collective buying power of the coop is expected to protect us from large variances in prices. One example of the power of collective buying power is the expected price decrease in breakfast cereal. Our Breakfast after the Bell program will benefit from those reduced costs.

8. What other contracts or awards does Nutrition Services expect to award that exceed the $750,000 Board approval threshold? The Board will receive information about two additional awards that are expected to exceed the $750,000 threshold: 1) Meadow Gold Dairy for daily milk deliveries and 2) Andrews Foodservice for fresh produce.

9. How does the Nutrition Services staff assure that the food and supplies are of the best price and quality?

Prices for standard inventory items are bid out at least once a year. Cafeteria managers, coordinators and the Director of Nutrition Services perform quality checks on prepared food. Nutrition Services warehouse employees and the Nutrition Services buyer check for price compliance to the bid or award.
