1 Scenario Information This scenario is designed to show you how to prepare an application to register a strata titles scheme. Throughout this scenario, the resources available on the Landgate website are referenced to guide you through the completion of forms under the Strata Titles Act 1985. The approved strata forms referenced in this scenario are available on the Strata Forms page on the Landgate website. The Strata Titles Act 1985 (the Act) (currency start 1 May 2020) and Strata Titles (General) Regulations 2019 (Regulations) are available on the WA Government Legislation website. Landgate recommends reviewing the Act and Regulations. We advise you to exercise care when preparing any documents using this guide as varying circumstances require additional forms and evidence.

1.3 Basic considerations before lodgement The below scenario covers requirements for preparation and lodgement only. This scenario does not cover the legal considerations that may apply by a conveyancer, settlement agent or lawyer.

1.3.1 What do I need to apply? Use the Forms Reference Table and the Land Titles Registration Policy and Procedure Guides as a guide to assist on what strata forms may need lodging for dealings involving a strata titles scheme. This scenario requires:

1. Forms – Application to register strata titles scheme (AS) and Scheme Notice (SN) 2. Title Search (recommend for the completion of forms) 3. Search of the scheme plan 4. Evidence - Statement to Deal with Land and the written consent of the designated interested

holder 5. Registration fee payable to Landgate.

1.3.2 Title search – a copy of the original Certificate of Title An optional title search is highly recommended, as the search provides you with a complete up-to-date copy of the title (as at the date and time the title search is conducted). For a fee, you can conduct a title search online using an address and get a copy of the Certificate of Title.

1.3.3 Forms To register a new strata scheme after the scheme plan is placed In Order for Dealings (IOFD), lodge the approved Application to register strata titles scheme (AS) form in conjunction with a Scheme Notice (SN).

NOTE: In some circumstances a survey may be placed IOFD subject to other requirements. In these circumstances, the extra requirements are listed in the IOFD panel of the scheme plan and are required before or in conjunction with the Application to register strata titles scheme (AS) and Scheme Notice (SN). Form requirements differ depending on the circumstances of the new scheme. The Forms Reference Table provides additional forms and evidence that may be required. Please note forms lodged for registration must contain the original signature and be printed on white A4 size paper, in colour or black and white and in duplex (printed upon both sides).

1.3.4 Evidence Evidence requirements differ depending on the circumstances of the new scheme. The Forms Reference Table in conjunction with STR-02 Lodgement and Registration of new Strata Titles Schemes can help identify evidence requirements. In this scenario, a written consent is required from the mortgagee. A Statement to Deal with Land is also required for every Application for New Scheme where there are current limitations, interests, encumbrances and notifications registered or recorded against the land on the Parent Certificate of Title e.g. Mortgage, Caveat, Easement, Mineral Rights, etc.

1.3.5 Registration fees View the current Registration and Search Fees payable by cash, credit card, EFTPOS, or by cheque/money order made payable to Landgate. Fees must be paid when lodging the document in person or included if posting the documents to Landgate.
