Regarding the selection of the weekday afternoon peak hour, Commission Transportation staff suggests that, unless extraordinary circumstances dictate, weekday afternoon peak hour analysis should always occur within the 4:00PM-6:00PM window. This document has been prepared to respond to comments raised in a letter from the Cape Cod Commission dated July 30, 2013 regarding the transportation comments received in the Bayside Engineering comment letter for the proposed Lowe’s in Dennis, Massachusetts. The Bayside Engineering letter was submitted to the Commission on July 6, 2013. The following text summarizes our responses to the Commission staff’s responses to Bayside Engineering’s comments. Response: In order to analyze the peak hour of data for an entire network, the intersections were split into clusters made up of closely spaced intersections. The average peak hour for each of these groups of intersections was used as the peak hour for all of the intersections within the cluster. With the exception of the intersections of Route 134 at Upper County Road and Main Street at Highbank Road, the peak hour for all of the study area intersection clusters was 4:00 – 5:00 PM. This is common practice and the most accurate way to evaluate intersections located in close proximity. In analyzing the Route 134 ATR data, it is not practical to determine different peak hours for the northbound and southbound directions. As traffic volumes do fluctuate depending on the directional distribution, it is more practical to look at the combined northbound and southbound volumes on Route 134. When the two directions on Route 134 are summed, the peak hour results are 4:00 – 5:00 PM on Thursday, 3:45 – 4:45 PM on Friday and 4:00 – 5:00 PM on Monday. These ATR volume peak hours are equivalent to the 4:00 – 5:00 PM peak hour was the used for the weekday evening peak hour analysis. As the majority of the study area intersections are on Route 134, it is natural that the peak hour along Route 134 would dictate the peak hour for all of the study area intersection clusters. Comment No. 5 & 6

Bayside Comment: “At the intersection of Route 134, Upper County Road and Duck Pond Road it appears that the counted traffic volumes for both peak hours (weekday day evening and Saturday midday) were decreased with no explanation provided.” “At the intersection of Main Street, upper County Road and Highbank Road, it appears that the counted traffic volumes for the Saturday midday . . . do not match the volumes shown in Figure 5 of the May 10, 2013 TIAS.”

CCC Response: “In order to determine compliance with the RPP, the Applicant should review the traffic volumes at the following intersections and revised level of service analyses as necessary to reflect correct traffic volumes:

o Route 134, Upper County Road and Duck Pond Road

o Main Street, Upper County Road, and Highbank Road”

Response: As described above under Comment No. 3, the peak hours used within the analysis were overall network peak hours for a cluster of closely spaced intersections. In both of these instances, the overall network peak hour used for the analysis was slightly different from the intersection’s individual peak hour. In each of these cases the difference in traffic volumes between the network peak hour and individual intersection peak hour was 39 vehicles or less overall for the entire intersection, which would not have a significant influence on the overall intersection operations. Comment No. 7

Bayside Comment: “As the manual turning movement counts were conducted in 2012, and it does not appear that any growth has been applied, the networks are inaccurate in describing themselves as 2013 Existing Conditions and 2018 No-Build Conditions.”

CCC Response: “In order to determine compliance with the RPP, the Applicant should demonstrate that use of 2012 data in a 2013 analysis is justifiable giving the traffic patterns in the area or reevaluate their analysis assumptions.” Response: As part of the preparation of the TIAS, VHB conducted research to determine the historic growth rate for traffic in this area as well. Based on information contained in the Cape Cod 2012 Traffic Counting Report, traffic has decreased at a rate of -0.74 percent per year Cape-wide over the last ten years (2002 –

2012). Within the Mid Cape region, which the Town of Dennis is considered to be a part of, traffic decreased at a rate of -1.06 percent per year between 2002 and 2012. To provide a conservative analysis, the count data from 2012 was not decreased to reflect 2013 conditions. A growth rate of 0.5 percent per year for five years was applied to the existing conditions volumes to project them to No Build and Build conditions, resulting in a conservative increase of 2.5 percent.

Comment No. 9, 66 & 76

Bayside Comment: “The Applicant has stated that as part of the project, the Applicant will work with the [Cape Cod Regional Transit Authority] CCRTA to provide transit service to the site. As this is a key component in affecting the Applicant's traffic generation, the status of discussions with the CCRTA should be provided.” “A location for the transit stop on the site should be identified.”

CCC Response: “As noted in the June 27, 2013 Memorandum from Mr. Randall Hart to Ms. Andrea Adams, the Applicant’s transportation engineer “VHB has already contacted the CCRTA and discussed the desire to locate a transit stop for the H2O Line on the proposed site. VHB will continue to coordinate with CCRTA and will relay progress updates to CCC staff.” An update was provided in the July 29, 2013 Memorandum from Mr. Randall Hart to Ms. Andrea Adams including a letter from CCRTA Administrator Mr. Thomas Cahir noting that pending the Applicant’s “ability to obtain all state and local approvals for the proposed project, and assuming that Lowe’s moves forward with construction of the project, CCRTA will extend existing bus routes to include a bus stop on the Lowes site as it would be in public’s interest to have one there.” If a transit stop is to be located on the site selection of the location should be done in consultation with CCRTA.”

Response: As indicated by the Commission, the Proponent has requested and received a letter from the CCRTA stating intent to create a bus stop onsite and reroute existing buses already in this area through the site, provided the project is approved and constructed. The Proponent will continue existing coordination with the CCRTA as the project progresses, including discussion of a location for the CCRTA bus stop.

Comment No. 23 & 57

Bayside Comment: “The TIAS states that the 85th percentile speed on Theophilus F. Smith Road is 26 mph for eastbound vehicles and 24 mph for westbound vehicles. This data is based on an ATR conducted in February 2012. The February 2012 ATR data should be provided.”

CCC Response: “In order to determine compliance with the RPP, the Applicant should provide the data from the February 2012 speed measurements that justify the observed 85th percentile speeds used in the site distance calculations.”

Response: As requested, the February ATR count data, including speeds, has been provided in the Appendix.

Comment No. 26, 56, 67 & 68

Bayside Comment: “Relating to the proposed signalization of Theophilus F. Smith Road, the westerly site drive, and Enterprise Road, the letter states that “sidewalks and appropriate crosswalks should be provided on Enterprise Drive as it connects to Patriot Square.”

CCC Response: “As presented on the Site Plans dated 5/3/13, sidewalks are proposed on Enterprise Road as part of the signal installation. Based on further review of the project, in order to ensure compliance with the RPP, Commission Transportation staff suggests the Applicant should include a crosswalk across Enterprise Road, with proper sidewalk connections, to allow a safe connection to businesses in Patriot Square.”

Response: The proposed improvement plan provides safe and efficient pedestrian connections between the Lowe’s site and Patriot Square via an actuated traffic signal and crosswalk system. As proposed, there will be sidewalk provided along the entire site frontage, pedestrian crosswalk across TFS Road and a sidewalk along the west side of Enterprise Road allowing pedestrians to enter Patriot Square through a controlled condition. The realignment of Enterprise Road (to the east) has impacted the layout and parking area within the existing center and further widening in this area is not practical or necessary. There is no sidewalk on the north side of TFS Road today or on the east side of Enterprise Road, nor is any proposed as it would be redundant. Therefore, implementing a crosswalk as part of this project is not practical.

Comment No. 31

Bayside Comment: “Regarding the proposed configuration changes at the intersection of Route 134 and Theophilus F. Smith Road, the letter states that “further, the proposed design should be assessed to determine if there is adequate width on the Route 134 southbound departure leg to receive two lanes of turning traffic safely.””

CCC Response: “As detailed in the July 9, 2013 Staff Report, Commission Transportation staff have concerns relating to the proposed lane configuration and other elements of the proposed mitigation at the intersection of Theophilus F. Smith Road at Route 134. The Applicant presented additional information on proposed mitigation at this intersection in the July 29, 2013 Memorandum from VHB. This document is currently under review by Commission staff.”

Response: As indicated, additional information has been provided to the Commission related to the proposed mitigation at the intersection of Route 134 and Theophilus F. Smith Road. The Proponent will continue to work on the proposed design at this location based upon comments from the Commission and in coordination with the Commission and the Town of Dennis.

Comment No. 39, 40, 60 & 98

Bayside Comment: “Relating to the proposed signalization of Theophilus F. Smith Road, the westerly site drive, and Enterprise Road, the letter states that the proposed improvement is “essentially the 'front door' for the project” and should “not be included in the overall costs associated with the mitigation of the projects traffic impacts.” The letter additionally states that “the Applicant should show that they have the rights to re-align Enterprise Road.””

CCC Response: “Commission Transportation staff agrees that proposed signalization of the Westerly Site Drive / Enterprise Road on Theophilus F. Smith Road should not be considered as part of the mitigation package as the installation primarily serves the Applicant’s access needs. Regarding the right to re-align Enterprise Road, the Applicant has proposed this improvement and it is their responsibility to ensure it is feasible. If such an improvement were infeasible they would be unable to meet the requirements of the potential decision and therefore be unable to move the development project forward.” Response: While the Westerly Site Driveway / Enterprise Road at Theophilus F. Smith Road serves as the primary access to the site, the design also fulfills the Town’s desires to maximize the spacing between Route 134 and Enterprise Road and improve the interaction of traffic at the driveways to Cumberland Farms/ Cranberry Square and the proposed Westerly Site Driveway. The layout of this intersection was the subject of extensive discussions with the Town of Dennis prior to the submission of the DRI application and numerous alternatives were evaluated at the Town’s request. It should also be noted that there is some common ownership between the Lowe’s site and the land required to realign Enterprise Road. As such, the owners are well aware of the property impacts of the proposed realignment and are supportive of the plan.

Comment No. 44 & 87

Bayside Comment: “The Applicant should re-visit the potential of this mitigation measure. Based on the data in the Appendix, the total cost for this measure is approximately $51,000 and there are no right-of-way impacts. As this will improve the intersection per MPS TR3.4, this mitigation measure should be fully funded.”

CCC Response: “As detailed in the July 9, 2013 Staff Report, Commission Transportation staff suggests that the mitigation proposed at the intersection of Theophilus F. Smith Road at Route 134 is currently insufficient. Commission Transportation staff suggests the Applicant revise their approach to mitigating safety and congestion impacts at this intersection to ensure compliance with the RPP.

The Applicant presented additional information on proposed mitigation at this intersection in the July 29, 2013 Memorandum from VHB. This document is currently under review by Commission staff.”

Response: As indicated, additional information has been provided to the Commission related to the proposed mitigation at the intersection of Route 134 and Theophilus F. Smith Road. The Proponent will continue to work on the proposed design at this location based upon comments from the Commission and in coordination with the Commission and the Town of Dennis.

Comment No. 90

Bayside Comment: “The Applicant states 'The off-site mitigation measures proposed as part of this project will maintain or improve upon the existing level of pedestrian and bicycle accommodations ' To respond appropriately, these measures should be identified here.”

CCC Response: “Commission Transportation staff suggests that the off-site mitigation measures currently proposed will maintain or improve upon existing level of pedestrian and bicycle accommodations. However, as previously discussed, in order to ensure compliance with the RPP, Commission Transportation staff suggests that additional accommodations should be provided at the proposed new signal at the intersection of Theophilus F. Smith Road, the westerly site drive, and Enterprise Road.”

Response: Please refer to the response to Comments No. 26, 56, 67 & 68.

Comment No. 94 & 95

Bayside Comment: “The Applicant states 'While the construction of a traffic signal is proposed as part of this project, the traffic signal will serve the project needs and improve on existing operations along this corridor. Therefore the improvement is a benefit and demonstrates access management along this corridor.' The proposed traffic signal is designed to primarily provide access to the proposed project. As such, the maintenance and operating costs should be borne by the Applicant.” “Count station equipment should be included in the proposed traffic signal and costs for maintenance should be paid for by the Applicant.”

CCC Response: “As presented in the July 9, 2013 Staff Report, Commission Transportation staff noted that, if deemed appropriate by the Commission, the Applicant should revise their mitigation approach to address MPS TR3.13 (Operation and Maintenance Costs) and MPS TR3.14 (Traffic-Monitoring Devices).

Additional comments from the public brought to light concerns which Commission Transportation staff would like to address:

1. The Applicant should provide design details on the proposed improvements at the Route 6 Eastbound Off-Ramp that are referenced in Figure 11 of the May 2013 TIAS but not included in the Appendix.

2. Public concern was voiced over letting the Applicant “buy their way” out of traffic impacts. To avoid any confusion, Commission Transportation staff notes that the RPP allows only physical improvements to address safety impacts and not payments.”

Response: The Proponent will agree to provide the operations and maintenance costs and traffic monitoring equipment when it is deemed necessary by the Commission. The Proponent will coordinate with CCC Transportation staff on the details of those commitments. (1) As requested, the 40-Scale version of the Route 6 Eastbound Off-Ramp improvements figure from the May 2013 TIAS has been provided again in the Appendix.
