pricing regulatornew delhi, noV 9:A closely guarded proposal to dismantle the NationalPharmaceutical Pricing Authority (NPPA) has trig-gered a sense of unease among public health campaign-ers, who plan to approach the Supreme Court seekingits intervention on the move.Over the past three weeks,government and Niti Ayog officials had two rounds ofconsultations. A report has been prepared on whyNPPA must be dismantled and how the drug price con-trol mechanism would work in the absence of theauthority that has been fixing the ceiling price of essen-tial medicines since 1997.“We would request theSupreme Court to seek clarifications from the govern-ment as the move is meant to appease only the indus-try,” said S Srinivasan of LOCOST, a non-governmentaloutfit that advocates affordable medicine.No documenton the plan to dismantle NPPA has been released in thepublic domain. The two consultations on October 19and November 7 were attended by officials from thedepartments of health, pharmaceuticals, industrial pro-motion, commerce and Niti Ayog. None of the NPPAmembers were invited for these meetings, sources told.The minutes of one of the meetings suggest officialswanted to delink the drug price control order from thenational list of essential medicine.“NPPA in its presentform may be wound up and deployed in the depart-ments of pharmaceuticals, and the right to regulateprices should be vested with the government,” a gov-ernment official said.While approving new drugs, thebureaucrats proposed that a drug might be considered‘new’ for a period of 10 years instead of the current fouryears. If implemented, this would restrict manufactur-ing of low-cost generic medicine.“The Supreme Courthas held that the government has a Constitutional obli-gation to ensure the affordability of essential medicines.What is astonishing is the manner in which the govern-ment is simply capitulating to industry demands with-out a thought for patients,” said Srinivasan.NPPA cur-rently fixes the prices of 376 molecules and more than500 formulations, accounting for just about 12% of theIndian pharmaceutical market. India’s domestic phar-maceutical market is estimated to be worth Rs 1 lakhcrore, besides an equally big export market.“Nearly80% of medical care costs have to be paid by thepatients out of their own pocket. Of this, 70% of theexpenditure is on medicines. Denial of essential life-saving medicines due to lack of affordability is a harshreality,” said Mira Shiva of the All India Drug ActionNetwork, which is the petitioner in an ongoing case onaffordable medicine before the apex court.

In the world of today, media has become

almost as necessary as food and cloth-

ing. It is true that media is playing an

outstanding role in strengthening the soci-

ety. Its duty is to inform, educate and enter-

tain the people. It helps us to know current

situation around the world. The media has a

strong social and cultural impact upon soci-

ety. Because of its inherent ability to reach

large number of public, it is widely used to

convey message to build public opinion and

awareness. The original idea behind the cre-

ation of various ‘media means’ was to enter-

tain masses. Radio, TV, cinemas and maga-

zines spend most of their resources targeting

on entertaining items and programs. One of

major duties of media today is to inform the

people about the latest happening around

them and the world. They cover all aspects

of our interest like weather, politics, war,

health, finance, science, fashion, music, etc.

The need for more and more news has

evolved into creation of dedicated TV & radio

channels and magazines. People can listen,

watch and read latest news whenever and

wherever they want. Media is the overseer of

the political system. If it plays its role hon-

estly, it will be a great force in building the

nation. It plays a great role in bringing com-

mon man close to their leaders. The media fo-

cuses in bringing details of all major politi-

cal situations, decisions and scenarios. Hence

people can better understand their rights and

make better decisions. Because of the power

of media is so extensive and huge, it can be

used to educate people with very little cost.

Imagine a classroom in every city with thou-

sands of students being taught by just one

teacher. But unfortunately, because of

money-making approach of media and lack

of interest by government, very less work is

done in spreading the education. Various au-

thorities and agencies utilize the power of

media to spread informative messages to

public. This may include warning against a

storm or epidemic, delay in arrival or depar-

ture of flights and trains, etc. In some cases, it

is legally binding to publish notices in news-

paper like tenders, change of property owner-

ship, etc.We will be left in a world of journal-

ism that is entirely populated by Arnab and

anchors like him, competing on the basis of

passion and anger, and by people who pull

out their phone and tweet a comment without

first-hand information. It will be a frightening

world. Almost all business concerns uses the

power of media to sell their products. They

advertise in media for the enhancement of

business purposes. Huge amounts of money

are invested in media for marketing of a

product. The more attractive the advertise-

ment, the more people will follow it. The me-

dia has the power of educating people, the

good and the bad. Since it affect the eyes, the

ears and the mind simultaneously nothing

can overcome the influence of the media. The

media in the advanced society should per-

form a noble mission of enlightening people

and discourage sectarian, communal and di-

visive trends.

any nation which professes to

be democratic is the preva-

lence of tolerance therein.

Tolerance is not merely a

goody-goody virtue. It is vital

because it promotes the receiv-

ing or acknowledging of new

ideas and this helps to break

the status quo mentality.

Tolerance is particularly need-

ed in large and complex soci-

eties comprising people with

varied beliefs, as in India. This

is because readiness to tolerate

views other than one’s own

facilitates harmonious coexis-

tence.

A liberal democracy accepts

the fact that in a free country,

one can have different opin-

ions and should have equal

rights in voicing them. This is

pluralism, and tolerance is its

ultimate rationale.

Tolerance accords high respect

for human rights, especially

freedom of conscience and

freedom of thought.

Disagreement with the belief

and ideology of others is no

reason for their suppression,

because there can be more than

one path for the attainment of

truth and salvation. Even if

there is only one truth, it may

have a hundred facets.

Intolerance stems from an

invincible assumption of the

infallibility and truth of one’s

beliefs, the dogmatic convic-

tion about the rightness of

one’s tenets and their superior-

ity over others, and with the

passage of time, this leads to

forcible imposition of one’s

ideology on others, often

resulting in violence. At pres-

ent, the virus of intolerance has

acquired global dimensions.

Religious and political perse-

cution has become rampant

and curiously that too some-

times in the name of God

Almighty or some Divine

Power.

An intolerant society does not

brook dissent. Suppression of

dissent by censorship is an

indispensable instrument for

an intolerant authoritarian

regime. Censorship, indeed, is

its natural ally.

The necessity for tolerance has

been internationally recog-

nised. It is noteworthy that the

Preamble to the Charter of the

United Nations proclaims that

to achieve the goals of the

Charter we need to “practice

tolerance and live together in

peace with one another as

good neighbours”. Another

significant UN instrument is

the Declaration of November

25, 1981 on the Elimination of

All Forms of Intolerance and of

Discrimination Based on

Religion or Belief which

emphasises that it is essential

to promote tolerance and

requires states to adopt all nec-

essary measures for the speedy

elimination of intolerance in all

its forms and manifestations. It

is evident that there is an essen-

tial linkage between tolerance,

human rights, democracy and

peace.

Intolerance does not always

emanate from official or state

action but also from certain

groups or sections in society. A

not too recent instance was the

determined effort to ban the

exhibition of the film Ore Oru

Gramathiley by a group of per-

sons who regarded its theme

and presentation as hostile to

the policy of reservation of jobs

in public employment and

seats in educational institu-

tions in favour of Scheduled

Castes and backward classes.

There were threats of attacking

cinema houses where the film

would be shown.

The Madras High Court in an

incredible judgment revoked

the certificate granted by the

Board of Censors to the film

and restrained its exhibition.

The Supreme Court promptly

reversed the judgment in a

landmark decision, S.

laid down an extremely

important principle: “Freedom

of expression protects not

merely ideas that are accepted

but those that offend, shock or

disturb the state or any sector

pluralism, tolerance and

broadmindedness without

which there is no democratic

society”.

Intolerance has a chilling,

inhibiting effect on freedom of

thought and discussion.

Remember how Galileo suf-

fered for his theory that the sun

was the centre of the solar sys-

tem and not the earth. Darwin

was a victim of intolerance and

was lampooned and consid-

ered an enemy of religion for

his seminal work, The Origin

of Species. Nearer home we

have the example of Raja Ram

Mohan Roy, whose efforts for

reform, especially for the aboli-

tion of Sati, evoked fierce

opposition because of intoler-

ance. We must not revert to

those dark days because when

that happens democracy is

under siege.

We must combat intolerance

and its manifestations result-

ing in human rights violations

by appropriate legal remedies.

However, the crucial point is

that tolerance cannot be legis-

lated. No law can compel a

person to be tolerant.

Therefore, we must develop

the capacity for tolerance by

fostering an environment of

tolerance, a culture of toler-

ance. Stereotypes and preju-

dices about certain classes and

communities must be

eschewed. Educational institu-

tions have a vital role to play in

this connection. The immense

value of tolerance must be

ingrained in the hearts and

minds of the students.

Our Supreme Court’s judg-

ment in Bijoe Emmanuel vs.

State of Kerala is significant.

Students belonging to the faith,

Jehovah’s Witnesses, stood up

when the national anthem was

sung to show their respect but

declined to sing along. The stu-

dents were expelled by the

school authorities. Their expul-

sion was upheld by the high

court.

The Supreme Court reversed

the high court judgment.

Justice Chinnappa Reddy,

who headed the bench, in the

course of the judgment,

observed that the students did

not hold their beliefs idly or

out of any unpatriotic senti-

ment but because they truly

and conscientiously believed

that their religion forbade

singing the national anthem of

any country. After a careful

consideration of the issues, the

Supreme Court concluded:

“Our tradition teaches toler-

ance; our philosophy preaches

tolerance; our Constitution

practices tolerance. Let none

dilute it”.

This is a classic judicial affirma-

tion of tolerance. Let us resolve

to promote tolerance in our

multi-religious, multi-cultural

nation and thereby strengthen

and enrich our pluralist

democracy which is the pride

of our nation.

Truly, the one-wordruling is convenient andcomfortable to the presid-ing judge who saves timeand energy of studyingthe entire case in detail todiscover the reasons/logicfor dismissal. On top ofthis, if you dare to pray tothe presiding judge torecord reasons for dis-missal, you only touch alive electric wire.Can it not be mademandatory and compul-sory to provide reasonsbehind every judgement?The problem of hugenumber of pending casescan very easily be solvedinstantly by giving a kindof bonus to the judging-group party for every de-cided case. That will en-sure even very latenight-sittings to completemore cases and earn more

legally, and get apprecia-tion. Thiswill enable the eliminationof all the various ills of se-lections by humans orthrough interviews, wheredifferent candidates areasked different questionsbased on the whims orgood/bad intentions of theinterview-board members.The right choice, manifest-ing the fullest of trans-parency, will then auto-matically be made.

In thecase of horticultural crops, farmers’premium burden will be 5% of thesum assured or 50% of the total pre-mium. Manhas stressed upon thefarmers to take maximum benefitfrom the schemes launched by gov-ernment and urged the field depart-ment to prepare a roadmap to covermaximum farmers under theseschemes.MLA Kathua Rajiv Jasrotia high-lighted the importance of govern-ment schemes for the benefit of thefarming community. He furtheradvised farmers to take benefit of allthese schemes to the fullest so thatthe risks involved in farming may bereduced.Vice Chancellor SKUAST-JammuProf P K Sharma urged the farmersto be in regular touch with theUniversity and Krishi VigyanKendras of the district. our CorrespondentJammu, noV 09:Minister for Food, Civil Suppliesand Consumer Affairs (FCS&CA),Chowdhary Zulfkar Ali today saidthat the Government was keenlyworking to expedite the relocationof oil depots from city area to lesspopulated area.Speaking at a meeting convened toreview the process of shifting of oildepots that are presently locatednear Railway Station in Jammu, theMinister Zulfkar Ali said that thepresent location of the depots is amatter of concern for the presentdispensation. He said the depots aresurrounded by residential areas thepopulation of which has increasedmanifold over the years.Concerned Minister said that ifsomething wrong happens there, itcould lead to a big disaster, causingloses of human lives as well as prop-erty. The Minister said that keeping safe-ty of people in mind, the shifting ofthe depots becomes imperative andgovernment is working on a plan toaccomplish this task. Suggesting the concerned officers toidentify land away from populatedarea, the Minister said that initially

the Government was mulling toidentify land in district Samba forestablishing new depots. However,he said that the idea was droppeddue to certain reasons. While directing the concerned agen-cies to expedite the process for landidentification for relocation of thedepots, the Minister said that theprocess should be completed in atime bound manner. He said that itwould be better if everything, fromidentification, procurement andother legalities are completed byJune next year. The Minster asked the concerned

functionaries to ensure that the siteidentified for the relocation ofdepots was both people as well aseco-friendly step. He said that pre-

fer should be given to barren orwaste land, and if private land isacquired the owners are duly com-pensated. The Minister also stressed upon therepresentatives of oil companies toensure that they prefer local popu-lace for jobs at the new depots.
