Police-public meet held STATE TIMES NEWS RAJOURI: A police public interaction meeting was held close to Line of Control in Tarkundi area of Manjakote Tehsil in Rajouri District on Monday. Meeting was held on the directions of SSP Rajouri and was chaired by SDPO Manjakote Imtiyaz Ahmed while SHO Manjakote Mohd Iqbal was also present. A large number of residents from villages located on LoC including Turkundi Gali, Peer Gali and Chor Gali took part. The main issue put forth by locals was in adequate arrangements for them at the time of LoC firing while other issues related to some other government depart- ments were also put forth by public. Addressing the meeting, SDPO Manjakote Imtiyaz Ahmed hailed the positivity shown by border residents and assured that all their grievances and demands will be shared with higher authorities in a proper man- ner so that the same can be resolved. STATE TIMES NEWS JAMMU: Jammu Municipal Corporation (JMC) on Monday continued with its special drive against illegal Rehris/Pharis and encroach- ers causing traffic congestion and obstructing free move- ment of pedestrians on foot- paths. The anti-encroach- ment drive was conducted under the instructions of JMC Commissioner, Ramesh Kumar. It was supervised by Joint Commissioner (A), JMC, Rajesh Sharma and Assistant Commissioner (Rev.), JMC, Vinakshi Koul. Chief Enforcement Officer, Rajesh Gupta, Enforcement Officer, Kamini Kesar, Revenue Officers, Parmod Kumar, Ashwani Sudan, Parveen Gupta and Sunil Gupta of JMC and other Enforcement staff carried out the drive. The drive was conducted in the areas including Ranbir Market, Indira Chowk, Shalamar Road, City Chowk, B.C. Road and Mahespura. During the drive, the enforce- ment team removed encroach- ments and cleared the foot- paths and pavements. The team seized about 10 illegal Rehris plying without licenses and seized one truck of mate- rial displayed by the shopkeep- ers/Phariwalas in front of their shops and footpaths causing traffic congestion and hindering free flow of pedes- trians. STATE TIMES NEWS JAMMU: All J&K OBC Mahasabha on Monday rued that discrimination with State OBCs has been going on unabated despite change in the Governments at state and the central levels. The issue was discussed at the Executive Body meeting of OBC Mahasabha held under the Chairmanship of Kasturi Lal Basotra, President All J&K Sain Samaj in the presence of Dr.Tara Chand, Chief Advisor of OBC Mahasabha, Mohan Lal Pawar, senior leader of Kashyap Samaj and Bansi Lal Choudhary Convener OBC Mahasabha. Kamal Kishore Bhardwaj, senior leader of OBCs alleged that despite OBCs whole- hearted support to BJP and PDP in forming the govern- ment in State and to BJP for getting into power in centre, the status of State OBCs has not changed and they still struggling for their rights especially with regard to reservation. He said that though the state Government constituted OBC Advisory and Development Board and appointed Rashpal Verma as its Vice-chairman but initia- tive drastically failed in addressing the issue of 27 per cent reservation in J&K state Govt. services as per Supreme Court verdict dated November 16, 1992 on Mandal Commission Report in the case Indira Sawhney verses Union of India. "The aforesaid Board also failed regarding the development of OBCs in other fields", he added. Vishal Choudhary, leader of youth wing highlighted the cumbersome process of get- ting OSC and OBC certifi- cates. Suggesting simple measures, he demanded that the aforesaid process should be simplified for the conven- ience of the Biradari mem- bers. 'BJP-PDP regime failed to address OBCs' issues' STATE TIMES NEWS JAMMU: A delegation of Sanskrit scholars led by Bawa Kailakh Dev Asthan Mahant Rohit Shastri on Monday called on Member Parliament Rajya Sabha Dr. Karan Singh here at Amar Mahal and put forward various issues and problems associated with Sanskrit in Jammu and Kashmir and demanded ample job opportu- nities for Sanskrit scholars. The delegation said that J&K has given birth to Sanskrit scholars like Kalhana and Bilhana, who spend their whole life for the Sanskrit language. Moreover Kalidass and other eminent poets found roots in here. Highlighting step-motherly treatment with Sanskrit, the delegation appealed to Rajya Sabha MP to intervene and ask the ministry of HRD to work for the development and preser- vation of Sanskrit language and to open the 16th Sanskrit University in Kashmir. Besides, delegation also appealed to set-up a separate ministry for Sanskrit lan- guage, making Sanskrit lan- guage compulsory from 6th standard in JKBOSE syl- labus, separate scholarship and reservation quota in uni- versity. STATE TIMES NEWS JAMMU: A Division Bench (DB) of High Court of Jammu and Kashmir at Jammu head- ed by Justice Tashi Rabstan on Monday dismissed a contempt petition filed in much publi- cised Gair Mumkin Khad case relating to Kaluchak Nallah Khad land. The contempt petition was filed by one Balbir Singh, son of Late Sardar Singh, resident of Village Mangowali, Tehsil R.S Pura Jammu against var- ious officers of J&K Government including H.C Jeerath Chief Engineer, Irrigation and Flood Control Department, Dewan Chand XEn Flood Control, Rajinder Khajuria Assistant Executive Engineer, Flood Control, J.R Mailk, Junior Engineer, Flood Control, Shabir Ahmad, Tehsildar, Bahu Jammu, Mohammad Bashir, Naib Tehsildar Bahu Jammu, Uttam Chand SSP Jammu, Rahul Malik, Superintendent of Police J&K South Jammu, and Ajay Jamwal SHO Police Station, Gangyal, Jammu. The Bench in a detailed Judgment held that there is willful and intentional disobedi- ent of the orders of High Court and therefore the contempt petition lacks in merit and is accordingly dismissed. The DB passed this order after hearing K.S Johal senior Advocate with J.I Balwan, Advocate for petitioner, Aseem Sawhney Advocate for Vijay Kumar Duggal and Varinder Duggal (Interveners ) and R.S Jamwal Deputy AG. The DB observed that the contempt proceedings had been initiated against respon- dent for disobeying the Khad land case vide order dated July 10, 2014. The DB had stayed further construction in the area of water body and sale of river bed and Khad. K.S Johal alleged that there was construction going on near the Kaluchak Nallah by the official respondent and there- fore the petitioner alleged that it was in violation of the afore- said court order. This PIL in the Khad land case was officially disposed on February 12, 2016 but the Division Bench directed the respondent / State to frame the water policy and plan/ scheme in term of the Act. The Court had directed that till water policy is frame by the state government status quo with regard to State Khad lands shall remain enforce. In reply, the official respon- dent submitted before the Division Bench that there was no question of disobeying the interim order of the court as the officers were only laying crates as abutment on both sides of the Kaluchak Nallah and in fact it is the petitioner who had constructed his house in the middle of the Nallah. Aseem Sawhney submitted that he had filed intervention as the petitioner has leveled allegation against his clients. He submitted that the case is fallacious and full of errors as the case basically pertained to Water Resources Act but the Commissioners had given a finding that it pertains to Big Landed Estates Abolition Act. This Act is not attracted in the present case as the proper- ty was situated at Kaluchak and that was not a rival area where the Act was applicable, he submitted. Advocate Aseem Sawhney further submitted that his clients also moved the con- tempt petition against the offi- cial respondent where in the respondent officers were found guilty and were directed to pay compensation of Rs One lakh to his client as they had illegal- ly acted upon the wrong report of the Commissioner and therefore in contempt of the order dated February 12, 2016 as the building of his clients viz. Duggal brothers was demol- ished/ damaged. Upon this, the DB held that in contempt petition the rights of the parties as mentioned in the Commissioner's reports cannot be adjudicated and merely for technical breach the court cannot punish respon- dent for contempt. The Court further held that in the contempt proceedings, the Division Bench cannot go beyond the proceedings avail- able under contempt and open another branch and proceed- ings. The contempt petition lacks in merit and is, accord- ingly, dismissed along with con- nected MP(s), the court observed. Contempt plea in Kaluchak Khad case dismissed

paths. The anti-encroach-ment drive was conductedunder the instructions of JMCCommissioner, RameshKumar. It was supervised byJoint Commissioner (A),JMC, Rajesh Sharma andAssistant Commissioner(Rev.), JMC, Vinakshi Koul.

STATE TIMES NEWSJAMMU: A Division Bench(DB) of High Court of Jammuand Kashmir at Jammu head-ed by Justice Tashi Rabstan onMonday dismissed a contemptpetition filed in much publi-cised Gair Mumkin Khad caserelating to Kaluchak NallahKhad land.

The contempt petition wasfiled by one Balbir Singh, sonof Late Sardar Singh, residentof Village Mangowali, TehsilR.S Pura Jammu against var-ious officers of J&KGovernment including H.CJeerath Chief Engineer,Irrigation and Flood ControlDepartment, Dewan ChandXEn Flood Control, RajinderKhajuria Assistant ExecutiveEngineer, Flood Control, J.RMailk, Junior Engineer, FloodControl, Shabir Ahmad,Tehsildar, Bahu Jammu,Mohammad Bashir, NaibTehsildar Bahu Jammu,Uttam Chand SSP Jammu,Rahul Malik, Superintendentof Police J&K South Jammu,and Ajay Jamwal SHO PoliceStation, Gangyal, Jammu.

The Bench in a detailedJudgment held that there is

willful and intentional disobedi-ent of the orders of High Courtand therefore the contemptpetition lacks in merit and isaccordingly dismissed.

The DB passed this orderafter hearing K.S Johal seniorAdvocate with J.I Balwan,Advocate for petitioner, AseemSawhney Advocate for VijayKumar Duggal and VarinderDuggal (Interveners ) and R.SJamwal Deputy AG.

The DB observed that thecontempt proceedings hadbeen initiated against respon-dent for disobeying the Khadland case vide order dated July10, 2014.

The DB had stayed furtherconstruction in the area ofwater body and sale of river bedand Khad.

K.S Johal alleged that therewas construction going on nearthe Kaluchak Nallah by theofficial respondent and there-fore the petitioner alleged thatit was in violation of the afore-said court order.

This PIL in the Khad landcase was officially disposed onFebruary 12, 2016 but theDivision Bench directed therespondent / State to frame the

water policy and plan/ schemein term of the Act.

The Court had directed thattill water policy is frame by thestate government status quowith regard to State Khadlands shall remain enforce.

In reply, the official respon-dent submitted before theDivision Bench that there wasno question of disobeying theinterim order of the court asthe officers were only layingcrates as abutment on bothsides of the Kaluchak Nallahand in fact it is the petitionerwho had constructed his housein the middle of the Nallah.

Aseem Sawhney submittedthat he had filed interventionas the petitioner has leveledallegation against his clients.

He submitted that the case isfallacious and full of errors asthe case basically pertained toWater Resources Act but theCommissioners had given afinding that it pertains to BigLanded Estates Abolition Act.

This Act is not attracted inthe present case as the proper-ty was situated at Kaluchakand that was not a rival areawhere the Act was applicable,he submitted.

Advocate Aseem Sawhneyfurther submitted that hisclients also moved the con-tempt petition against the offi-cial respondent where in therespondent officers were foundguilty and were directed to paycompensation of Rs One lakhto his client as they had illegal-ly acted upon the wrong reportof the Commissioner andtherefore in contempt of theorder dated February 12, 2016as the building of his clients viz.Duggal brothers was demol-ished/ damaged.

Upon this, the DB held thatin contempt petition the rightsof the parties as mentioned inthe Commissioner's reportscannot be adjudicated andmerely for technical breach thecourt cannot punish respon-dent for contempt.

The Court further held thatin the contempt proceedings,the Division Bench cannot gobeyond the proceedings avail-able under contempt and openanother branch and proceed-ings. The contempt petitionlacks in merit and is, accord-ingly, dismissed along with con-nected MP(s), the courtobserved.
