o nearly $4 million in economic
development unds, STOPs
case seeking an overturn o the
disposable container ban, and
District One Councilman Richard
Zapatas action against the City or
the release o City Manager emails, two more
high-prole cases were led last week.
You may have already heard about the
one aimed at Scooter Store ounder DougHarrison, so well get to that one later. What
you likely havent heard about, unless you
ollow us on Facebook, is the suit led against
Mayor Gale Pospisil and New Braunels Police
Chie Tom Wibert or acting without legal
authority regarding the Citys action on the
new towing contract, which was to eliminate
the previous vendor rotation system in avor
o a single contractor model, but didnt.
Interim City Manager Robert Camareno andPurchasing Manager Mary Quinones are also
named as deendants.
The issue acing the court isnt the single
vendor system. Its that the bidding process
demanded certain criteria be met, and then,
at the last minute, ater the bids were in, the
City made wholesale changes to that criteria
- verbally and on the y - selecting multiple
companies or the work rather than one. And
those companies, the suit alleges, didnt meet
the terms o the initial bid. This is much like
checking everyones Lotto numbers and then
pulling selected numbers out o the ball beore
the drawing. Not exactly, but Im sure you get
the point. #gamerigged
Heres the problem with our companies
being selected rather than just one: Two o the
plaintis, the owners o JJs Towing and Pro Care
Wrecker Service, did not submit bids or thecontract, because they didnt think they could
reasonably handle 100% o the work. Had they
known the contract would be split our ways, they
would have certainly submitted a bid. The third
and nal plainti, the owner o Comal Towing,
did submit a bid, but structured it to conorm with
the terms o the original deal. Had he known
those terms were to change, he would have bid
dierently. As one might imagine.
Then there was this damning phrase,
right there in Section VIII, ELEMENTS OF
CONTRACT, paragraph 5, Agreement;
Exceptions (d) o the Citys RFP
(Request or Proposals): No oral
statement o any person shall
modiy or otherwise change
or aect the terms, conditions,
or specifcations stated in the
RFP or the resulting contract.
That means that Council couldnt
change stu with their mouths. Always
a good policy.
There was this item too, under section
1.8 SPECIALITY EQUIPMENT: Must have
wreckercapable o towing 12-yard tandemdump loaded (50,000 GVW) and all other
equipment needed to right an over turned big
rig or an 18 wheeler. And yes, that emphasis
on Must have wreckerwas in the RFP. They
meant business on this one.
Until they didnt.
The suit alleges that at the time the
contract was awarded, none o the our
companies that got it had that equipment.
Or, or that matter, the land required to storeat least 100 vehicles, as the RFP required.
Comal Towing did. JJs and Pro Care would
have arranged to comply had they known the
rules were up or grabs. But nobody could
have seen that coming. This, boys and girls,
is where lawsuits come rom.
We were at the meeting when the contract
was awarded we saw the verbal change
take place. Why the City Attorney doesnt stop
Council when its about to do something like
this is bafing. My lawyers stop me rom doing
stupid stu all the time. In act, thats the most
important part o their job.
As or the Doug Harrison lawsuit,
well, it looks like ormer Scooter Store
employees are turning on the man that was
once able to convince them to sacriice
or the greater good.
GOOD SOLID ADVICE: It should be notedthat when somebody with more than what
you have asks you to sacrice, they really
mean they want you to give something up
so they can either a) keep more of what they
have, or b) get more of what they want. The
correct response to someone who has more
than you, and who asks that you sacrice, is:
You rst. Then get back to me when we have
equal shares. Youll nd they never quite give
enough away to match you.

Doug Harrisons 8,400 square foot house,
7,000+ square feet of barns and stables, full
sized tennis court and pool clocks in at a value
$1,734,500, per the County Tax Assessor,
while the average home of the people he
asked to sacric does not.
At issue is the current value o The Scooter
Store Employee Stock Ownership Plan, orESOP, o which the nearly 3,000 plaintis
in the case have no idea. The ESOP was
the plan that compensated Store employees
with stock in the company, to make them
eel like employee-owners. In 2008, it was
worth $36.9 million. At the end o 2011, it
was worth $7.5 million. Ouch. Like we said,
nobody is saying what its worth now, but ater
an FBI raid and a bankruptcy ling, well, itsprobably not much.
Harrison responded to the suit on social
media with the ollowing quote. As weve said
beore, this guy is good. Very, very good. He
manages to say its not his ault, that he eels
bad or everybody, and, as a coup de grce,
puts the blame or the losses not on Store
executives, but places it rmly on the heads
o the people bringing the suit. Remember cult
rules dictate that i someone holds the leaderresponsible, that someone is actually hurting
you, and only because they are such a sad,
little person, whom we should all pity. Anyway,
heres what Doug had to say:

and me. While the people involved have
voiced numerous complaints, the primary

For the record, that is completely untrue.

more questions than answers. I am
considering the possibility o hosting a
town hall meeting like we used to have
in the good ole days. I cannot ofcially
speak or the company, and I might not
have answers to all o your questions,

and I will pursue urther.
Last, but not least, while I believe
that this misguided lawsuit has a very
high probability o having a negative
impact on your receipt o proceeds
rom your ESOP account, please do
not hold this personally against the
people involved. I can only assume
that - like many o the rest o us - they
are hurt, scared, and simply looking
or answers. I will continue to reach
out to them and Ive already spoken to
their attorney to help answer many o
their incorrect assumptions.

on April 20! The event was part of the New Braunfels Hospitality and
Visitors Association (HAVA) membership drive which was a huge success.

who made recommendations on the sidewalks,and then the city spent thousands to get specicrecommendation on the sidewalks, then thecity will spend thousands on engineering thesidewalks. Then they have to come up with themoney to actually do the construction. Are youwith me so ar?
The thinking is that sidewalks in thedowntown bring in business (which they can)and increase oot trac thereby creatingstronger business environments and, get this,(its important), they generate more tax revenue.Its a sound thought process except or the partabout the city also destroying opportunitiesto create stronger business environmentsdowntown when they also vote down issuesbecause they dont want their riends having toworry about competition or because they dontcare or a particular person. This just sends astrong message to people trying to create adowntown business: Dont bother.
As or your sidewalks, well, how do youexpect to compete when you dont createrevenue or the city? I mean i the new sidewalkcame with a couple o new restaurants, a snow-cone stand and some bail bond companies, thenmaybe you could get a study requested. Or not.
To be air, the city has at times beggedthe state or eds to give them money to createsidewalks in neighborhoods, but theyve never
hired anyone to create a three inch thickbinder on the subject, so those dollars are ewand ar in between. In reality, in many placeslike here, the property owner is responsible ortheir portion o sidewalk on their property butin the public right o way. We dont deal withthis much or enorce it, but in the cold states, itis a crime to not shovel snow o the sidewalk inront o your home or to repair it i it is broken.
Perhaps i we just required people tohave and maintain the sidewalks on theirproperty, then these businesses who protrom the sidewalks would pay or their ownand keep them up instead o yet another caseo re-distribution o our money. Problem is, thatwould mean that riends o certain ocialswould have to pay some o their money orthat and we cant have that.

Dear Jose,I havent been on Facebook much lately
and at my age, I dont even remember how tochange the picture anyway. I have always beenopposed to discrimination o gays and lesbiansand I support their right to be treated the sameas anyone else. I was always ne with extendingbenets to lie partners much like heterosexualcouples who were common-law married. Theonly thing I can absolutely say on gay marriageis that it should be up to the states to decide theirown issues and not the ederal government.

it regularly. But today, I was struck
by something you said in a recent
column about how Mexicans can
make Americans like Mexicans. So I
quote: We called ourselves Spanish,

because Im not black or red or Asian. I
understand what Im made o.
People rom Spain are Caucasian.
But in the U.S., educators dont teach you
anything about Spain. Tey downplay
Spains impact on this country. est
questions in school always emphasizedthat the Spanish came here or glory
and gold, not to settle this land. So I
took 15 trips to Spain over a period o
20 years to explore Spain. Ive written
and researched or years to learn who
the Spanish really are. And I am here to
tell you that I am proud to have a drop
o Spanish blood! Do you know where
to nd the towns o Laredo, Reynosa
and Durango? Not only in Mexico, but
in the Basque Region o Spain! Yes. Te
conquistadores named New Spain areas
ater towns in Spain! So even i we are
one-quarter Spanish, we are members
o the white race.
he Anglo-Americans have
succeeded in many ways o shaming
Mexicans about their heritage and
their ancestry. But I am very proudo being Mexican. I know who we are
and I know who I am. he blood in
my veins is Indian and Spanish; we
are Caucasian as well. I we cant call
ourselves white, why can others? Why
is it that my riends rom Iran, Egypt
and Albania check o white when
aced with a U.S. application or legal
orm? How do these groups end up
being white and Mexicans dont?
Why is it that even a mulatto calls
himsel white now? So please dont
be so eager to dismiss us as non-white!
Dear Brownie: You dont regularly read
my column? No manches! I have no problem
with Mexicans being proud o their Spanish
ancestry as long as they dont ignore their nopal
en la rente, just like I dont mind Mexicans to
be proud o their indigenous blood as long
as they dont try to pass themselves o as the
pure-blooded heir o Cuauhtmoc. But news
fash, chula: Mexicans no son white. Nor
are Spaniards. White is a construct, not
a race. And the only legitimate Caucasians
come rom the Caucasus, ancestral home o
the Boston Marathon bombers (quick asideor Mexicans: dont the Tsarnaev brothers
look like at least one o your cousins, just
like Saddam Hussein looks like everyones
to?). Finally, do better researchLaredo and
Reinosa are in Cantabria, which is about as
Basque as you are white.
Dear Mexican: As a student o
history, I believe that Mexicans shouldbe more attuned to speaking English.
Te Spanish did nothing but enslave
and subjugate everybody on this
continent. Speaking their language
only gives them credit they dont
deserve. For all the aults o the U.SA
(and there are many, as you know), at
least speaking and writing English can
open some doors or you here and give
you a chance in lie. Every immigrant
group that ever came over on a boat
or crossed the border has had it tough
in this country. Te ones who couldnt
speak uent English naturally had
it tougher. So, as a certied advice
columnist, whether or not youre
really an hombre or not, you should
be advising everyone to at least sign
up or the program here. I they dontlike whats happening, they can always
swear at their boss in Spanish and he
or she will never know the diference.
But ask or a big at raise in English.

Reeds Extra Ginger Brew
Im letting beer take a brie aside this week
so I can talk about my avorite non-alcoholic
beverage (note, non-alcoholic beverages
are those things kids and really religious
people drink). Im talking about ginger beer.
While it has a very misleading name, it can
be an extremely complex and delicious
drink. Well, provided you like ginger.
Theres really no getting around the
ginger in a ginger beer. Ive tried a TON o
ginger beers. Whenever I come in contact
with a new one, I try it out, much the
same I do with beer. This particular ginger
beer, Reeds Extra Ginger Brew, is ar and
away my avorite o them all. My main big
reason: the sweetener. Nothing throws me
o more than getting a chemical-y, corny,
breakast cereal tasting sweetness. The
main reason I dont drink most soda, in
act, is that lavor.
Some ginger beers will go or a cane
sugar, which is nice, or even an agave
nectar, which I really enjoy. Reeds
however takes the necessity o sweetening
and uses it as an excuse to add some
really interesting lavor. They do indeed
use cane sugar, but they also use honey,
pineapple juice, lemon, and lime. I really
appreciate the pineapple juice, it adds
a great tang and noticeable pineapple
notes. You get the honey notes as well, but
not really so much honey sweetness.
The ginger itsel is a great, earthy,
spicy variety. The regular and the Extra
Ginger are the same except in regards to
the ginger content, which is nearly double.
I cant say I am an expert at the dierent
varieties o ginger, but this is the classic
lavor. They inish o the brew with a blend
o secret spices. Ive seen some ginger beers
that used peppers, some that used vanilla
or lavender, but the Reeds is a secret.
What I can pick out is deinitely clove,
cherry, and maybe, MAYBE a little bit o
lemongrass or something. Im not sure, but
Id love to see the recipe. Theyve also got
a apple spice, a premium, a raspberr y, and
a cherry ginger brew. This is a seriously
good ginger beer, and although this one
doesnt have alcohol, its still a great drink.

Like most everyone else, I imagine, I have
been caught up in the coverage o the Boston
Marathon bombing. Under no circumstances isthis an event over which to make political hay,
but the coverage o the bombing brought into
ocus two issues that I eel are worth talking
about. In both cases, the issues are something
we will have to come to grips with since our
country will continue to ace attacks like this.
The rst issue is that we dont seem to
have a xed understanding o the denition
o terrorism. Classically, terrorism is denedas the use o terror as a means to promote a
political agenda. But thats not how we have
come to understand it in recent history. I it
was, then we would have to agree that almost
all military action is terrorism. Ater all, are not
most military operations designed to terriy
someone? And, isnt war just a particularly
aggressive means o accomplishing what are
usually political goals?
Most o us, instead, accept a slightlydierent denition o terrorism. It is a denition
that is unsaid, but understood. Terrorism is the
use o terror targeting innocent civilians as
a means to promote a political agenda. The
dierence is minor, but i you examine current
aairs, youll see that its an important one.
For example, I have recently seen
libertarian activists make the argument that
since our drone strikes oten result in the deathso innocent civilians, then they should also be
considered terrorism. The idea behind this is
to create a moral equivalency between our
actions in the Middle East and elsewhere and
the attacks we ourselves have experienced.
Accepting this should erode support or our
military actions abroad, something that many
libertarians would like to see stop.
Regardless o how much I would like our
government to stop kicking a hornets nest,
though, I cant accept the equivalency because
it ignores an important aspect o the denition:
intent. Our drone strikes are not intended to
result in civilian casualties. The civilian casualties
are an unortunate result o some o our attacks.
I the death o innocent civilians was all
that was required to make something terrorism,
then almost all war would all into this
category. This twisted logic is used repeatedlyin arguments we see, rom the insistence that
Ruby Ridge and Waco could be considered
governmental terrorism, to the argument that
Israeli reprisals or terrorist attacks are terrorism
themselves. In both cases, one could make alegitimate argument that these actions were
poorly planned or even oensively callous, but
it would simply be inaccurate to say that they
targeted innocent civilians.
Similarly, other groups twist the denition o
terrorism to t their own ends. Both the Aurora,
Colorado, and Sandy Hook, Connecticut,
shootings have been called terrorism by some.
In these cases, innocent civilians are targeted,but there is no discernible political motive to
be ound. Being crazy doesnt prevent you
rom having political motivations (Charles
Manson or example), but being insane is
hardly a political perspective. Alternatively,
there are cases where clear political motives
are ignored to avoid labeling the action as
terrorism - the most blatant example being the
Fort Hood workplace violence.
The denition o terror is importantbecause we ace a secondary issue in our
continued War on Terror; how exactly are
we going to respond to terrorism as a nation?
During the Bush years, we decided to
react militarily to terrorism. We used the
military to hunt down terrorists, and we were
willing to topple governments that appeared
to be harboring or hiding them. This seemed
pretty clear-cut in the response to 9/11. But,ater Aghanistan, things got uzzier. Was our
involvement in Iraq really necessary? Why
did we not treat Iran and Pakistan in the same
way? There was certainly credible evidence
that both nations harbored terrorists.
Since Bush, we have moved away rom
this. President Obamas administration kept
many o the tactics the Bush administration
used; they just avoided openly deending them.
When orced to look at terrorism, our current
administration is most likely to approach things
rom a criminal justice point o view.
There are several problems with this
attitude. It does little to address how we handle
terrorism militarily, and we are still engaged
in combat in several countries. It also makes
gathering intelligence somewhat troublesome.
As we have seen in the atermath o the Boston
Marathon bombing, allowing a terrorist hisconstitutional rights to an attorney can really
slow things down.
At the same time, I am concerned that we
might go too ar. In the Boston terror bombing,
we have a suspect who is an American citizen,and like it or not, he has rights. We cant allow
the government too much leeway, or well nd
ourselves with no rights at all. I now believe I
made a mistake in supporting the passage o the
Patriot Act. Like many others, I was convinced
that it was needed. In many cases it was, but
it has certainly been abused since its passage,
and it hasnt solved our terrorism problem.
I still support the idea o ghting terrorists
and those who support them vigorously.
Outside o our borders or when dealing with
non-citizens, terrorism should be a oreign
policy or even a military issue. That means that
terrorists we catch should be treated as enemy
combatants. They cant expect to receive the
same legal treatment as American citizens.
And when we are dealing with nations that
support terrorists or sponsor terrorism, it should
be clear to them that the consequences will besevere. Such acts are tantamount to war.
Terrorists that have citizenship, however,
need to be aorded their rights, with one
glaring exception. Our government should
withhold contact with any legal representation
until such time that its convinced that any useul
intelligence has been collected. As a trade-o,
no evidence collected in such a manner should
be available to prosecute the suspect, and the
government should be held civilly liable incase where suspects are later ound innocent.
This would hopeully deter abuses.
Interrogation will not be a means by which the
government can avoid air legal proceedings
since any inormation gained will be
inadmissible in court. It should also make the
government wary about scooping up suspects
with dubious evidence since alse imprisonment
charges would be almost certain to ollow.
I oer these ideas only as my own. As a
nation we are going to have to begin creating a
template or dealing with terrorism. The rst step
has to be a clear and careully worded denition.
The second should be a careul consideration o
how we will treat terrorists. I think its time that
we recognize that this is something we will need
to deal with or some time to come.
