choosing a lender

Things to consider when choosing a Lender:

The competence of the lender will dramatically effect the outcome of your

home buying experience.

Beware of certain internet lenders. These faceless sources of loans can often

times create unnecessary problems and delays.

The best results come when a local lender is chosen. Your REALTOR® can

be more of an advocate for you if there is a person we can go to to keep the

process moving along.

It is important to choose a lender who will meet contract deadlines. When

talking with potential lenders, ask what % of their loans close on time!

EARNEST MONEY

To communicate your interest in purchasing a home, we will present the listing agent with a written offer in the form of a Tennessee Associa-tion of REALTORS® (TAR) Purchase & Sale Agreement. The Purchase Agreement used is a standard document approved by our state and local real estate associations.

When the seller accepts an offer, it becomes a legal contract (called a Binding Agreement). The Purchase & Sale Agreement constitutes your offer to buy, and once accepted by the seller, becomes a legal contract.

After we present your offer to the listing agent, it will either be accepted, rejected or the seller will make a counter-offer. This is when we will negotiate terms of the contract, if necessary.

When you write an offer, be pre-pared to pay an earnest money deposit. We deliver a copy of your trust money check with any po-tential offer. This is to help guar-antee to the homeowner that your intention is to purchase the property. The check will be deposited into the escrow ac-count of the Listing Broker upon acceptance of the offer.

closing on your home

THE CLOSING TABLE1

A “closing” is where you and I meet with a representative from the lending institution and a representative from the title company or attorney to transfer the property title into your name. Most often in Tennessee, this will not include the Seller as we close at sepa-rate locations, often on the same day.

THE CONTRACT2

The Purchase Agreement you signed describes the property, states the purchase price and terms, sets forth the method of payment and sets the date when the “closing” or actual transfer of the property title and keys will occur and the loan is funded by your lender.

THE FINANCING3

If financing the property, your lender will require you to sign a promissory note as evidence that you are personally responsible for repaying the loan. You will also sign a Mortgage or Deed of Trust on the property as security to the lender for the loan. The Mortgage or Deed of Trust gives the lender the right to sell the property if you fail to make the payments.

THE TITLE INSURANCE4

Before you exchange these papers, the property may be surveyed, appraised, or in-spected, and the ownership of title will be checked in county and court records. Title Insurance, insurance against loss due to an unknown defect in a title or interest in real estate, is typically paid by the seller on resale properties. If new construction is in-volved, it is customarily charged to the buyer. However, it can be a negotiated expense.

THE CLOSING COSTS5

At closing you will be required to pay all fees and closing costs in the form of “guaran-teed funds” such as a Cashier’s Check or wire transfer. Your lender or escrow office will notify you of the exact amount.
