During the rest of the voyageOne and pleasant weather was enjoyed.Tbo Alameda mado the voyage In thegood time of five days, eighteen hoursand fourteen minutes.

The following vessels are reportedsighted by the Alameda on the voyage:April 23, 6:M p. m Ut. 37.14 N Long.124.36 W., met S. S. Nevudan bound luand a three-maste- d schooner standingto the north. AprilSi, 2:30 a. m., l.ut. 25.18 N Long.151.39 W met stmr China, bound N. E.

The Alameda brought' a fair-- list ofpassengers. Among these Is Mrs, Gard-ner K. Wilder, tho widow of tho latoG. K. Wilder, the Honolulu attorneywho died In San Francisco a short timeago, who accompanies tbe remains ofMr. Wilder which were brpught here bytlia steamer.

With Mrs. O. K. Wilder are C. C.Dams and Miss E. L. Barns, ber broth-er and sister, who accompany her onher sad voyago.

H. Pollltz, the well known sugarmagnate, came to tho Islands to lookafter tbo great sugar Interests whichho hus here.

K, M. Walsh, an Oakland attorneywho formerly was a resident of Hono-lulu and who still possesses variousInterests hero, comes on a buslneeltrip. Ho Is accompanied by Mrs.Wolsb.

Walter Clark comes hero to accept nposition with the Kamebamoha Schools,He Is accompanied by his wlfo.

there Is any danger of this, but I sliaKsatisfy tho Governor of the certainlythat the bandsmen will not lack fortransportation Jiomo In caso tho tripshould be a failure. Mr. Carter hasbeen perfectly fair In this propositionand Is doing no more than right inprotecting the members of the band.Tho bandsmen havo unanimouslyagreed to go and I will satisfy themas well as the Governor on tho safetyof tho trip from a financial point ofview. I am aa anxious to havo theband come back as anyone and I wouldnot think of taking the band awaywithout full guarantee of safe return.

"Tho Chamber of Commerce, trus-tees at their meeting yesterday gavetheir approval of the trip on generalprinciples but said It was outside theirprovince' to endorse a private enter-prise."

of tho different plantations are highlynattering and but for tho general de-

pression which has ruled In plantationslocks, would bo suftlclent to causemarked activity In tho market. Theexcellent showing made In theso re-

pot ts, together with the advanco In theprice of raw sugar, which I bcllevo willbo permanent, will, In my opinion, soon overcome tho backwardness of in-

vestors. These Improved conditionswill soon cause tho past to bo forgottenand better times for Hawaii will result.

"I consider the advance In raw sugarwill be steady because tbo consump-tion of sugar is constantly on the lu- -

crftneo and the supply-l- on tho decline. The latest reports slato ti deellnoln the.production of sugar of 533,000 tons. This decreasing supply with the In-

creasing demand Is bound to have Itseffort on Investors sooner or later,

as yet the public Is unrespons-ive, because, tbo full effect Is not felt.Everybody In San Frnnclsco Is pleasedwith tbo showing mado by Hawaiianplantations, especially with those plan-tations well known on the Const. Tbls, with tho activity in tbo marl.et forraws, will In n short time restoro

as the people will como to theconclusion that Hawaii has not soldthem a gold brick."

Mr. Pollltz said that the leap hopperreports had had a decidedly bear effecton Hock on tho mainland but that haconsidered the worst past on this score.Ho referred to the appearance of thehopper seven or eight years ago and Itsquick disappearance and does not an-ticipate that this pest will cut any fig-

ure in the cane fields after this year.

Proprietor E.' S. Cunha of tho UnionArt Gallery must uo without the bitvlccsW minor mixologists. So Baysthe litanlmous decision of tho Territo-rial Supreme Court, handed down thisforenoon, In the matter of Territory vs.K, sJjCunha, appealed directly fromtho District Court of Honolulu.

Chief Justlco Krear writes the opln- -

'on- - -In part, the decision la as follows.A section of a statute may be Invalid

In nart nnd valid as to the remainderBtatutc which forbids any keeper

op proprietor of any place where Intox- -

llratlng or spirituous liquors arc sold, ,,crn,u nny mnor t0 Vtt or remain)n u room whcre ga(1 ,qlIor8 are golu

,.cpl for 8a)(J ,g not limll(1 as ben(.In excess of tho police power or contrary to tho Fourteenth Amendment.

This Is an appeal on points of lawfrom a Judgment of tho District Magistrate of Honolulu finding the defendantguilty of violating Section 2 of Act 4

of tho Laws of 1901 and sentencinghim to pay a fine of $25 and costs. Two points aro raised: (1) thnt tholaw is unconstitutional, (2) that thoevidence was Insufficient.

Tho law, omitting the enactingclauc nnd Section 4, which provideswhen It shall take effect, reads as fol-

lows:'An Act to Prevent the Employment

'

'

I

uors are sold or dispensed, nny minor.Sec. 2. It shall be unlawful for

I

nny keeper or proprietor of any placowhere Intoxicating or Bplrltuous liq-

aro sold or dispensed, to permitany minor to visit or remain in thoroom where said liquors are sold, keptfor Ra0 r dispensed.

..Suc- - 3 Any ,,crson wn0 shall vlo- -

lslons of this Act shall of amisdemeanor, and upon convictionshall bo fined not less than twenty-flv- o

dollars nor more than ono hundred dol- -

lars, and on his second offense the li-

cense ot said person bhall bo forfeitedand revoked."

The contention Is thnt this section ufthe statute goes too far lu that, al-

though Intended, ac argued, to piohlbIt the employment or loitering of mi-

nors In saloons, It Is not confined to'"iv"--..'- or loltciing but extends

mcrc remaining, perhaps on lawfulbusiness.

In our opinion the Legislature didnot exceed Its powers In enactlug thisstatute. If tho statute Is thought tugo to unneccssiry lengths, tho Legis-

lature Is the body to which applicationshould lie made for relief.

The second point Is that the cvl- -

denco was Insufficient In that. It falls(o 8,low knmv,cdB0 or lltent or reg ,bmiy. on tll0 parl of tno dcf(,ml,ant ag , )ho mlnor.g prcsenc0 ln Ul0gaioon

Now that the Solumon Meheula case
