I, NASHIRA MCCOY, declare:

1. I am employed as a Senior Project Manager by Gilardi & Co. LLC (“Gilardi”),

located at 3301 Kerner Blvd., San Rafael, California. Pursuant to its July 24, 2017 Order

Preliminarily Approving Settlement and Providing for Notice (Dkt. No. 164) (the “Notice Order”),

the Court appointed Gilardi to supervise and administer the notice procedure in connection with the

proposed settlement of the above-captioned action (the “Action”).

2. I submit this declaration in order to provide the Court and the parties to the Action

with updated information regarding the mailing of the Court-approved Notice of Pendency and

Proposed Settlement of Class Action (the “Notice”) and the Proof of Claim and Release (the “Proof

of Claim”) (collectively, the “Notice Package”) and the receipt of requests for exclusion.

3. I am over 21 years of age and am not a party to this Action. I have personal

knowledge of the facts set forth herein and, if called as a witness, could and would testify

competently thereto.

4. On October 25, 2017, the Declaration of Carole K. Sylvester was filed with the Court

(Dkt. No. 170) (“Initial Mailing Declaration”), detailing, among other things, the initial mailing of

the Notice Package and receipt of requests for exclusion as of October 23, 2017.

UPDATE ON DISSEMINATION OF THE NOTICE PACKAGE

5. As more fully stated in the Initial Mailing Declaration, as of October 23, 2017,

Gilardi mailed a total of 78,119 Notice Packages to potential Class Members and nominees. Initial

Mailing Declaration, ¶11.

6. During the time period from October 24, 2017 through the date of this declaration,

Gilardi has caused an additional 29,035 Notice Packages to be mailed in response to correspondence

received from potential Class Members and nominees.


7. Therefore, as of the date of this declaration, Gilardi has mailed a total of 107,154

Notice Packages to potential Class Members and nominees.

WEBSITE

8. Gilardi established and maintains a website dedicated to the settlement

(www.jcpenneysecuritieslitigation.com). On August 7, 2017, visitors to the website could download

the Notice Package, Settlement Agreement, and Notice Order. On October 27, 2017, all papers filed

in support of the settlement were added to the website.

9. Additionally, on November 14, 2017, the Settlement Hearing set for November 29,

2017was re-scheduled for December 5, 2017. The website was updated with the re-scheduled

Settlement Hearing date the same day.

REQUESTS FOR EXCLUSION RECEIVED TO DATE

10. As stated in the Initial Mailing Declaration, the Notice informed potential Class

Members that requests for exclusion from the Class are to be sent to Gilardi, such that the request is

postmarked no later than November 8, 2017. As reported in the Initial Mailing Declaration, as of

October 23, 2017, Gilardi had received six requests for exclusion.

11. Since the Initial Mailing Declaration was executed, Gilardi has received two

additional requests for exclusion.

12. Therefore, to date, Gilardi has received a total of eight requests for exclusion,

attached hereto as Exhibit A.
