Following is a summary of the April 19, 2018, AALA

Representative Assembly meeting, the fourth and final meeting of

the 2017-2018 school year. Complete agendas and minutes are

AALA President’s Report

1. AALA membership numbers: Nonschool, 791;

School-based, 1,759; Classified, 332; Total, 2,882.

2. AALA Certificated Negotiations: Negotiations on

salary, hours, and working conditions are ongoing.

Recently, AALA countered the District’s offer of a

2% raise with a proposal for a 6% raise (4% raise

retroactive to July 1, 2017, plus 2% effective July 1,

2018). The District countered with a 2% raise

retroactive to July 1, 2017, and a 2% one-time lump

sum. AALA rejects the District’s offer; negotiations continue.

3. Search for Superintendent 2018: President Juan A. Flecha sent a letter to Board of Education

members supporting Vivian Ekchian for Superintendent.

4. Emergency motion addressing AALA Bylaws: Section 5, Vacancies, Office of the President will

be revisited at the next Representative Assembly meeting (October 4, 2018).

5. An update was given on the Supreme Court case, Janus v. AFSCME (American Federation of State,

County, and Municipal Employees) and its potential impact on AALA.

PAC Council Report

Juan Flecha introduced the PAC Steering Committee members, reviewed AALA’s Core Values, and

described PAC procedures. Mary Jane Lira London and Tracie Bryant reviewed the PAC Steering

Committee recommendations for State Superintendent of Public Instruction and Governor. They made the

following motions:

1. PAC Motion: It was moved and seconded that the PAC Council endorse Tony Thurmond for

State Superintendent of Public Instruction and provide the maximum donation of $7,300.

MOTION PASSED UNANIMOUSLY 2. PAC Motion: It was moved and seconded that the PAC Council endorse Lily Ploski for State

Superintendent of Public Instruction and provide the maximum donation of $7,300. 2 ayes; 17 nays;

1 abstention.

for October 4, 2018.

BREAKING NEWS: Board of Education disregards recommendations of labor

partners and selects Austin Beutner as next Superintendent; offers him a three-year

contract with $350,000 annual salary, effective May 14, 2018 – June 30, 2021.

Evaluation criteria include fiscal sustainability, student attendance, graduation rates,

student achievement, parent and community engagement, transparency and

accountability, the opportunity gap, and school safety.

WHAT IS PERSONAL NECESSITY ABSENCE OR FLEX TIME

AND WHEN CAN IT BE USED?

Periodically, employees are faced with situations that necessitate their absence from work, but these

occurrences do not fall under the guidelines for illness, bereavement, or other specific types of absences.

Many times, employees are tempted to classify these absences as personal necessity even though they do

not meet the criteria for such. AALA members are reminded to only use or approve personal necessity

when appropriate according to the language in the Certificated Contract Article XI, Section 5.0, and Unit J

Contract Article XI, Section 13.0; also, note that only six days of such time can be used per school year.

Following is a listing of the situations that may allow the use of personal necessity time:

1. Death of a close friend or relative not included in the definition of immediate family

2. Time needed for the death of an immediate family member that is in excess of the contractually

provided amount

3. Serious illness of an immediate family member

4. Accident involving the employee or his/her property or that of an immediate family member

5. Birth or adoption of a child

6. Religious holiday

7. Imminent danger to the employee’s home due to a disaster, such as, flood, fire, or earthquake

8. Appearance of the employee in court as a litigant or witness under subpoena

9. Approved conference or convention attendance

10. Attendance at the employee’s child’s or ward’s school because of suspension

11. Attendance at the employee’s child’s, ward’s, or grandchild’s school for activities, with at least five

days’ notice

In addition, further negotiations with the District added:

… an employee shall be granted a paid personal necessity absence when … [any] other significant event

of a compelling nature to the employee, the gravity of which is comparable to the above, which demands

the personal attention of the employee during assigned hours and which the employee cannot reasonably

be expected to disregard, limited to one (1) occasion in any school year. This addition will allow AALA

members to attend weddings, graduations, and other significant events without having to misrepresent the

reason for their absence.

AALA members are also reminded of the availability of flex time that may be used when time is needed

that does not meet the guidelines for personal necessity.

UNIT J: Article IX, Section 2.2—When the work demands involve significant extended hours of work

within a given pay period, flexible reduced hours in the same or following pay period may be taken with

the prior approval of the immediate supervisor, so long as such absence does not interfere with the

continued operational obligations of the employee, work unit, or District. If such time can be

accommodated, it will be scheduled by the supervisor in consultation with the employee.

CERTIFICATED: Article X, Section 1.3—When the schedule of the administrator involves extended work

hours on a given day, flexible work hours on a subsequent day may be taken with the prior approval of the

immediate supervisor. Upon request of the administrator (go to Sample Log for Administrator), the

immediate supervisor must provide the administrator with a time within which to schedule the flexible work

hour. Such time shall fall within fifteen (15) working days of the date of the administrator’s request. Any

failure by the immediate supervisor to provide such time within the 15 days shall be grievable by the

administrator.

HEALTH BENEFITS FAQ—

OUT-OF-POCKET LIMITS AND DEDUCTIBLES

What is meant by out-of-pocket maximum/limit?

This dollar limit is the maximum members pay during a calendar year before their plans start to pay 100%

of covered health services. To see how close you are to your annual limit, add up any coinsurance payments

(Anthem EPO active members and pre-Medicare retirees), HMO copays, and any other qualified medical

expenses, such as the cost of visiting the emergency room, outpatient surgery, etc. This limit does not

include amounts paid for nonnetwork providers, other out-of-network cost-sharing, or spending for

nonessential healthcare services.

Out-of-pocket limits vary by medical plan. The chart below shows the per member and family out-of-

pocket limits for each District plan:

How do out-of-pocket limits work for Medicare retirees?

Even though out-of-pocket limits are indicated, the District’s Medicare Advantage HMO plans—Kaiser

Senior Advantage, Health Net Seniority Plus, and UnitedHealthcare®—the $5 copays per visit will likely

never add up to the annual amount. The same holds true for Anthem Blue Cross EPO retirees where

Medicare is the primary insurer for Medicare-covered visits and Anthem Blue Cross EPO is the secondary

payer. For EPO, Medicare pays 80% and Anthem pays 20% after the annual $300 deductible is met.

Medicare retirees in Anthem EPO who use in-network physicians and facilities and/or hospitals would most

likely have only the annual deductible to pay. Amounts paid to out-of-network providers are not counted

as out-of-pocket in any of the District’s medical plans.

How do deductibles work?

A deductible is the amount owed for healthcare services covered by the health plan before it begins to pay.

For example, if your deductible is $300, your plan will not pay anything until you have met your deductible

for the year. There are no deductibles for the District’s HMO plans—Kaiser, Health Net, Anthem Blue

Cross Select, or UnitedHealthCare® Group Medicare Advantage HMO.

Anthem Blue Cross EPO is the only plan with deductibles.

Active employees have an annual deductible calculated at 0.5% times the gross annual earnings,

rounded down to the next $50. The lowest minimum deductible is $100; the maximum is $800 per

member. For a member with dependents, the family maximum is 3 times the member’s deductible.

Retirees have an annual deductible of $300. The maximum deductible for family members in the

EPO is three separate deductibles.

Van Nuys High School (Yolanda Gardea, Principal) has two teams (see picture below) that will be

competing in the Army JROTC Leadership and Academic Bowl (JLAB) championship June 22 – 26 on the

campus of The Catholic University in Washington, D.C. JLAB brings together hundreds of JROTC

students to participate in challenging leadership activities and the largest academic bowl in the country.

Out of the almost 1,400 Army JROTC academic teams that competed from around the world, the Van Nuys

teams scored in the top two percent. The program’s cadets also won recognition for outstanding

performance in the annual All-City Drill Competition in January, placing in the top five in all categories.

Congratulations to the students, their instructors, Ret. Col. Andrew Flynn and Ret. Sgt. 1st Class Jorge

Martinez, and the entire school community.

2017 – 2018 MASTER PROGRAM INSTITUTE GRADUATES

Sixty-eight participants in Cohort 17, Series I and II, of the LAUSD/AALA Master Program Institute

Collaborative (MPI) successfully participated in the 80-hour intensive training program and received a

Final Reminder: EDST/EDSNCT Final Evaluation Report Due May 8, 2018

This is a final reminder that the deadline to issue the Educator Development and Support: Teachers (EDST)

and Non-Classroom Teachers (EDSNCT) final evaluation reports is May 8, 2018. For staff in Early

Education Centers, the deadline is May 30, 2018. To support the completion of the EDST/EDSNCT reports,

an administrator handbook and video tutorials (for administrators and teachers) are available in the

Resources tab in the My Professional Growth System (MyPGS).

ALUMNI SPRING LUNCHEON

An enthusiastic crowd of over 80 alumni members gathered at Maggiano’s at The Grove last week to

reconnect with their friends, catch up on all of the latest news, and win fabulous prizes. The program began

with Juan A. Flecha, AALA President, welcoming everyone, introducing generous AALA donors, Gloria

Rogers, California Credit Union, and Mario Dalangpan, Schools Federal Credit Union, and giving a brief

update on AALA happenings. Special guests were Board Members Dr. George McKenna, who was also

the guest speaker, and Scott Schmerelson; former Board Member Vickie Castro; and former

superintendents Gay Havard, Dr. Angie Stockwell, Sid Thompson, and Carol Truscott.

Dr. McKenna gave a candid assessment of the educational scene in Los Angeles today and how he and

Scott Schmerelson were trying to impress upon their Board colleagues the importance of an educator as

leader of the District. He stressed that the teacher is key to a strong educational program and an effective

principal is key to a successful school. Despite all the problems facing the District, he still is the passionate

educator we all know, and the students continue to be his priority.

Following a tribute by Mr. Schmerelson to members who had passed away during the last year, the luncheon

concluded with the much-anticipated opportunity drawing, in which fifteen lucky guests went home with

valuable gifts, including a 32" Toshiba flat screen TV; afternoon tea at the Biltmore Hotel; Ray-Ban

sunglasses; Patron tequila and shot glasses; and an espresso machine, among others. All of the proceeds

from the drawing will go to Friends of AALA to fund scholarships for LAUSD students.

IN MEMORIAM

JOSEPHINE MILES─Former director and adviser in Local District I, adviser in School Utilization Task

Force, principal of Manchester Avenue, 68th Street, and 20th Street elementary schools, and assistant

principal at 20th Street, Miramonte, and Parmelee elementary schools. Ms. Miles retired on January 3, 2005,

and passed away on April 27, 2018. Services will be held on May 4 and 5, 2018, in Louisiana.

Contributions in her memory can be made to Southern University at Shreveport Foundation for the

Josephine Miles Scholarship, P.O. Box 1124, Shreveport, LA 71163. Condolences may be sent to the
