    THE UTTAR PRADESH STAMP (VALUATION OF PROPERTY) RULES,1997

    In exercise of powers under Sections 27, 47-A and 75 of the Indian Stamp Act,1899 (Act no. II of 1899) the Governor is pleased to make the fol lowing rules:

    1. Short title and commencement. - (1) These rules may be called the UttarPradesh Stamp (Valuation of Property) Rules, 1997.

    (2) They shall come into force with effect from the date of their publication in the Gazette.

    2. Definitions. -In these rules, unless there is anything repugnant in thesubject or context-

    (a) Act means the Indian Stamp Act, 1899 (Act No. II of1899);

    (b) " authorised agent " means-

    (i) a person holding a power of attorney authorising him toact on behalf of and in the name of his principal, and(ii) a person empowered by written authority under thehand of his principal;

    (c) " countryside area " means an area other than urban area orsemi-urban area;

    (d) "Commercial building " means commercial establishmentor shop as defined respectively in clause (4) and clause (16) ofsection 2 of the Uttar Pradesh Dookan Aur VanijyikAdhishthan Adhiniyam, 1962;

    NOTES The original text of clauses ( 4 ) and (16) of section 2 of U ttarPradesh Dookan Aur Vanijyik Adhishthan Adhiniyam, 1962 aregiven below :

    "(4) " commercial establishment " means any premises, not

    being the premises of a factory, or a shop, wherein any trade, business, manufacture, or any work in connection with orincidental or ancillary thereto, is carried on or profit andincludes a premises wherein, journalistic or printing work,

    business of banking, insurance, stocks and shares, brokerageor produce exchange is carried on, or wh ich is used as theatre,cinema, for any other p ublic amusement or entertainment orwhere the clerical and other establishment of a factory, towhom the provisions of the Factories Act, 1948 (Act no. 63 of1948) do not apply, work:

    (16) ' shop ' means any premises where any wholesale or retailtrade or business is carried on, or where services are rendered tocustomers, and includes, all offic es, go-downs or warehouseswhether in the same premises or not, which are used inconnection with such trade or business .

    (e) 'Industrial development area means an area declared underclause (d) of section 2 of the Uttar Pradesh Industrial Area Development Act, 1976(U.P. Act. no. 6 of 1976)

    NOTES The original text of clause (d) of section 2 of Uttar Pradesh Industrial

    Area Development Act, 1976 (U.P. Act. no. 6 of 1976) is given below:(d) Industrial development area' means an area declared as such

    by the State Government by notification;

    (f) " Referring officer " means a court or any of the following;

    (i) Commissioner of Stamps, or (ii) Additional Commissioner of Stamps, or(iii) Deputy Commissioner or Stamps, or (iv) Assistant Commissioner ofStamps; or (v) any officer of the Board of Revenue authorized under section47-A to refer.

    NOTES The original text of the Section 47-A of Indian Stamp Act, 1899 is given below:

    47-A. Instruments of conveyance, etc., if under-valued, how tobe dealt with-

    (1) If the market value or any property, which is the subject of anyinstrument on which duty is chargeable on the market value of the

    property, as set forth in such instrument is less than even the minimumvalue determined in accordance with any rules made under this Act,

    the registering officer appointed under the Registration Act, 1908, shallrefer the same to the Collector for determination of the market value ofsuch property and tile proper duty payable thereon.

    (2) Without prejudice to the provisions of sub-section (1) if suchregistering officer while registering any instrument on which duty ischargeable on the market value of the property, has reason to believethat the market value of the property which is the subject of suchinstrument, has not been truly set forth in the instrument, he may, afterregistering such instrument, refer the same to the Collector fordetermination of the market value of such property and the proper duty

    payable thereon.(3) On receipt of a reference under sub-section (1) or sub-section (2)the Collector shall, after giving the parties a reasonable opportunity of

    being heard and holding an inquiry in such manner as may be prescribed by rules made under this Act, determine the market value ofthe property which is the subject of the instrument and the duty asaforesaid. The difference, if any, in the amount of duty shall be

    payable by the person liable to pay the duty."(4) The Collector may, suo motu or on a reference from any Court orfrom the Commissioner of Stamps or an Additional Commissioner ofStamps or a Deputy Commissioner of Stamps or an AssistantCommissioner of Stamps or any Officer authorised by the Board ofRevenue in that behalf within four year- from the date of registration ofany instrument on which duty is chargeable on the market value of the

    property not already referred to him under sub-section (1) or sub-section (2), call for and examine the instrument for the purpose ofsatisfying himself as to the correctness of the market value of the

    property which is the subject of such instrument and the duty thereon

    and if after such examination he has reason to believe that the marketvalue of such property has not been truly set forth in the instrument, hemay determine the market value of such property and the duty payablethereon in accordance with the procedure provided for in sub-section(3). The difference, if any, in the amount of duty, shall be payable bythe person liable to pay the duty.

    (g) 'Registering Officer' means the Registrar or Sub-Registrar appointedunder the Registration Act, 1908 (Act no. XVI of 1908)

    (h) Semi-urban area means an area-(i) other than urban area declared as development area under

    Section 3 of the Uttar Pradesh Urban Planning and DevelopmentAct, 1973;

    NOTESThe original text of Section 3 of Uttar Pradesh Urban Planning andDevelopment Act, 1973 is given below:

    3. Declaration of development areas . - If in the opinion of the StateGovernment any area within the State requires to be developed accordingto plan it may, by notification in the Gazette, declare the area to be adevelopment area.

    (ii) Other than the urban area to which Uttar Pradesh Avas EvamVikas Parishad Adhiniyam, 1965 is applicable.

    (iii) of two kilometers width of revenue villages peripheral to an urbanarea not covered by clause (i) or clause (ii);

    (iv) falling under a transitional area as defined under the U.P.Municipalities Act, 1916;

    NOTESThe above mentioned transitional area'which is defined under clause(23-A) by Section 2 of U.P. Municipalities Act, 1916 (UP Act no.2 of1916) is given below:(23-A) 'transitional area' means an area in transition from a rural area toan urban area notified as such under clause (2) of Article 243-Q of theConstitution,

    (i) " Section " means a section of the Act;

    (j) " sub-district " means a sub-district formed under sub-section 5 of theRegistration Act, 1908 (Act no. XVI of 1908);

    5. Districts and sub-districts . - (1) For the purpose of this Act the StateGovernment shall form districts and sub-districts, and prescribe, and may alter,the limits of such districts and sub-districts.

    (k) " Urban area " means an area--(i) comprised in a metropolitan area or a municipal area as defined in the UttarPradesh Municipal Corporation Act, 1959; or

    NOTESThe words 'urban area' which is defined in clause (45-A) by Section 2 ofUttar Pradesh Municipal Corporations Act, 1959 (Act no.2 of 1959) isgiven below:(45-A) Metropolitan area' means an area as defined in clause (c) ofArticle 243-P of the Construction.

    (ii) comprised in a smaller urban area as defined in the United ProvincesMunicipalities Act, 1916 or

    NOTESThe words 'smaller urban area' which is defined under clause (22-A) bysection 2 of the U.P. Municipalities Act, 1916 (Act no. 2 of 1959) isgiven below:

    "(22-A) 'Smaller urban area' means an area notified as such underclause (2) of Article 243-Q of the Constitution.

    (iii) comprised in a cantonment as defined under section 3 of theCantonments Act, 1924; or

    "3 . Definition of cantonment:- (1) The Central Government may by notification in the Official Gazette,declare any place or places in which any part the Forces is quartered orwhich, being in the vicinity of any such place or places, or are required for

    the service of such forces to be a cantonment for the purposes of is Actand of all other enactments for the time being in force, and may by a likenotification, declare that any cantonment shall cease to be a cantonment.

    (2) The Central Government may by a like notification, define the limits ofany cantonment for the aforesaid purposes.

    (3) When any place is declared a cantonment for the first time, the CentralGovernment may, until a Board is constituted in accordance with the

    provisions of is Act, by order make any provision which appearsnecessary to it either for the administration of the cantonment or for theconstitution of the Board.

    (4) The Central Government may, by notification in the Official Gazette,direct at in any place declared a cantonment under sub-section (1) the

    provisions of any enactment relating to local self-government other thanthis Act shall have effect only to such extent or subject to suchmodifications, or that any authority constituted under any such enactmentshall exercise authority only to such extent, as may be specified in thenotification.

    (iv) demarcated for industrial, commercial and residential purposes by theconcerned Industrial Development Authority under clause (c) of sub-

    section (2) of the section 6 of the Uttar Pradesh Industrial AreaDevelopment Act, 1976.

    NOTESThe original text of clause (c) of sub-section (2) by Section 6 of the U.P.Industrial Development Act, 1976 is given below:

    6. Functions of the Authority- (1) The object of the Authority shall be tosecure the planned development of the industrial development areas.

    ***************(c) to demarcate and develop sites for industrial, commercial andresidential purposes according to the plan.

    3. Facts to be set forth in an instrument :- In case of an instrument relating toimmovable property chargeable with an ad valorem duty, the following particulars

    shall also be fully and truly stated in the instrument in additional to the marketvalue of the property-

    (1) in case of land -(a) included in the holding of a tenure holder, as defined in the law

    relating to land tenures :(i) the Khasra number and area of each plot forming part of the subject-matter of the instrument;

    (ii) whether irrigated or un-irrigated and if irrigated, the source ofirrigation;

    (iii) if under cultivation whether do fasali (two crops) or otherwise;(iv) land revenue or rent whether exempted or not and payable by suchtenure-holder;

    (v) classification of soil, supported in case of instruments exceedingtwenty thousand rupees in value, by the certified copies, or extractsfrom the relevant revenue records issued in accordance with law;

    (vi) location (whether lies in an urban area, semi-urban area, orcountryside); and

    (vii) minimum value fixed by the Collector of the district;

    (b) being non-agricultural land :(i) area of land in square metres;

    (ii) minimum value fixed by the Collector of the district;(iii) location (whether lies in urban area, semi-urban area, orcountryside).

    (2) in case of grove or garden -(a) the nature, size, number and age of trees;(b) annual recorded land revenue or where the grove is not assessed toany revenue or is exempt from it, the annual rent and/or premium if letout, otherwise the average annual income which has arisen from itduring the three years immediately set, preceding the date of theinstrument;

    (c) area covered by grove or garden;(d) location (whether lies in urban area, semi-urban area, or countryside).

    (3) in case of buildings -(a) total covered area and open land, if any, in square metres;(b) number of storeys, area and covered area of each storey in square

    metres;(c) whether pucca or katchha construction;(d) year of construction;(e) actual annual rent;

    (f) annual value assessed by any local body and the amount of house tax payable thereon, if any;

    (g) nature of building, whether non-0commercial or commercial; and(i) in case the building is non-commercial, is minimum value of

    construction as fixed by the Collector of the district; and(ii) in case the building is commercial, its minimum monthly rent per

    square metre of covered are fixed by the Collector of the district, and

    (h) location (whether lies in urban, semi-urban or country side).

    4- Fixation of minimum rate for valuation of land, construction value of non-commercial building and minimum rate of rent of commercial building.

    (1) The Collector of the district shall biennially, as for as possible, in themonth of August, fix the minimum value per acre/per square metre of land,the minimum value per square metre of construction of non-commercial

    building and the minimum monthly rent per square metre of commercial

    building situated in different parts of the district taking into consideration thefollowing facts;-

    (a) in case of land -(i) classification of soil,(ii) availability of irrigation facility,

    (iii) proximity to road, market, bus station, railway station factories,educational institutions, hospitals and government offices; and

    (iv) location with reference to its situation in urban area, semi-urban

    area or countryside;

    (b) in case of non-commercial building- (i) cost of material used in the construction of building;(ii) labour charges;(iii) type of construction, age and the depreciation of building;

    (c) in case of commercial building -

    (i) prevailing rent in locality; and(ii) nature of economic activity in the locality,

    (2) The Collector of the district may, suo motu or on an application made to himin this behalf, on being satisfied about the incorrectness of the minimum value ofland or of the construction of non-commercial building or the minimum rent of acommercial building fixed by him under sub-rule (1), for reasons recorded inwriting, revise the same within a period of two years from the dated of fixation ofminimum value or rent as the case may be.(3) The Collector of the district shall after fixing the minimum value peracre/per square mete of land, and of the construction of non-commercial buildingand the minimum rent per square metre of commercial building under sub-rule (1)

    send a statement shall contain the division of each sub district of the district underhis jurisdiction into urban area, semi-urban area and the countryside, the second part shall specify the minimum value of land situated in different parts of the sub-district and the third part shall contain, in the case of non-commercial building, theminimum value of construction and in the cast of commercial building theminimum rent fixed under sub-rule (1).

    (4) The Registrar shall supply copies of statement mentioned in sub-rule (3) to thesub-Registrars under his control and shall also forward a copy of the same to theInspector General of Registration, Uttar Pradesh.

    (5) Every Registering Officer shall cause a copy of the above statement to beaffixed on the notice board outside the registration office.

    5. Calculation of minimum value of land, grove, garden and building.-For the purposes of payment of stamp duty, the minimum value of immovable

    property forming the subject of an instrument shall be deemed to be such as may be arrived at as follows:(a) In case of land Minimum value

    Twenty times the annual rent plus the premium,if any, plus the value determined in accordance

    with sub-clause (i);

    (iii) if not assessed torevenue or is exemptedfrom it and profit hasarisen during three yearsimmediately precedingthe date of the instrument

    Twenty times the average annual profit plus thevalue of the trees standing thereon determinedin accordance with sub-clause (i);

    (iv) if not assessed to

    revenue or is exemptedfrom it and no profit hasarisen during three yearsimmediately precedingthe date of instrument

    Twenty times the average annual profit plus the

    value of the trees standing thereon determinedin accordance with sub-clause (i);

    (c) In case of buildings-

    (i) Non-commercial building

    Minimum value of land whether covered by the construction or not, which is subject-

    matter of the instrument worked out underclause (a) plus three hundred times theminimum rent of the building arrived at bymultiplying the constructed area of each floorof the building by the minimum value fixed bythe collector of the district under rule 4.

    (ii) Commercial building Minimum value of land whether covered bythe construction or not, which is subject-matter of the instrument, as worked out under

    clause (a) plus three hundred times theminimum monthly rent of the buildingarrived at by multiplying the constructed areaof each floor of the build ing with theminimum rent fixed by the Collector of thedistrict under rule 4.

    6. Statement of market value to be furnished to the Registering Officer-(1) The party presenting an instrument relating to immovable property

    chargeable with an ad valorem duty shall submit along with the instrument astatement in duplicate in the Form appended to these rules.

    (2) The registering officer may call for any additional information from theconcerned parties or call for and examine any record maintained by a public officer

    or authority.(3) The registering officer shall forward one copy of the Form received by himunder sub-rule (1) to the concerned Deputy Commissioner of Stamps or AssistantCommissioner of Stamps as the case may be.

    Explanation. -(1) If an instrument relates to different kinds of properties the marketvalue of each such property shall be specified separately.

    (2) If an instrument covers more than one immovable property situated at different places, market value of each such property shall be specified separately.

    7. Procedure on receipt of a reference or when suo motu action is proposedunder Section 47-A. (1) On receipt of a reference or where action is proposed to

    be taken suo motu under Section 47-A, the Collector shall issue notice to parties tothe instrument to show cause within thirty days of the receipt of such notice as towhy the market value of the property set forth in the instrument and the duty

    payable thereon be not determined by him.

    (2) The Collector may admit oral or documentary evidence, if any, produced by the parties to the instrument and call for and examine the original instrument to satisfy

    himself as to the correctness of the market value of the subject matter of theinstrument and for determining the duty payable thereon.

    (3) The Collector may-(a) call for any information or record from any public office, officer or

    authority under the Government or a local authority;(b) examine and record the statement of any public officer or authority

    under the Government or the local authority; and(c) inspect the property after due notice to parties to the instrument.

    (4) After considering the representation of the parties, if any, and examining therecords and other evidence, the Collector shall determine the market value of thesubject-matter of the instrument and the duty payable thereon.

    (5) If, as a result of such inquiry, the market value is found to be fully and truly setforth and the instrument duly stamped according to such value, it shall be returnedto the person who made the reference with a certificate to that effect. A copy ofsuch certificate shall also be sent to the Registering Officer concerned.

    (6) If, as a result of inquiry, the instrument is found to be under-valued and not dulystamped, necessary action shall be taken in respect of it according to relevant

    provisions of the Act.

    8. Appearance through advocate or authorised agent -In any inquiry under theserules, any of the parties to the instrument may appear in person or through anadvocate or an authorised agent.

    9. Service of notices, etc . - (a) (1) All notices, orders and other documents requiredto be served upon any person shall be deemed to be duly served-

    (2) Where the person to be served is a company, if it is addressed to thesecretary of the company at its registered office or at its principal office or place of

    business and is either -(i) sent by registered post, or(ii) delivered at the registered office or at the principal office or place of

    business of the company;

    (b) where the person to be served is a firm, if it is addressed to the firm at its principal place of business, identifying it by the name or style under which its business is carried on and is either-

    (i) sent by registered post, or(ii) delivered at the said place of business;

    (c) where the person to be served is a public body or a corporation or society orother body, if it is addressed to the secretary, treasurer or other chief officer of that

    body, corporation or society or other body at its principal office, and is either-(i) sent by registered post, or(ii) delivered at that office;

    (d) in any other case, if it is addressed to the person to be served and(i) is given or tendered to him or his authorised agent, or(ii) is sent by registered post to that person, or(iii) if such person cannot be found and notice or order or the document sent to

    him through registered post is received back undelivered, is affixed onsome conspicuous part of his last known place of residence or business, oris given or tendered to some adult member of his family.

    10. Fine for breach of rule. A breach of any of these rules by any party to aninstrument shall be punishable with fine not exceeding rupees five hundred.

    11. Repeal and saving. Rules 340, 340-A, 341, 342, 343, 344, 345, 346, 347,348, 349, 350, 351 and 352 of Chapter XV of the U.P. Stamp Rules, 1942 arehereby repealed :

    Provided that the repeal shall not affect the previous operation of the rules sorepealed or anything duly done or suffered thereunder:

    Provided further that anything done or any action taken or orders made ornotification or directions issued shall be deemed to have been taken, made orissued or done under the corresponding provisions of these rules.

    In exercise of the powers under sections 27, 47-A and 75 of the Indian StampAct. 1899 (Act no. 2 of 1899) read with section 21 of the General Clauses Act,1897 (Act no. 10 of 1897) the Governor is pleased to make, the following ruleswith a view to amending the Uttar Pradesh Stamp (Valuation of Property) Rules,1997.

    UTTAR PRADESH STAMP (VALUATION OF PROPERTY)(FIRST AMENDMENT) RULES. 2005

    Notification

    1. (1) These Rules may be called the Uttar Pradesh Stamp (Valuation ofProperty) (First Amendment) Rules, 2005.(2) They shall come into force witheffect from the date of their publication in the Gazette.

    2. In rule 5 of the Uttar Pradesh Stamp (Valuation of Property) Rules. 1997 forsub-clause (ii) of clause (c) set out in column-I below, the sub-clause as set out incolumn-II shall be substituted, namely:-

    COLUMN-1 COLUMN-2Existing sub-clause Sub-clause as hereby substituted

    Commercial ( ii) Minimum value or land whether covered Commercial ( ii) Three hundred t imes theminimum

    building by the construct ion or not, which is the building monthly rent of the building, whichis

    subject matter of the instrument, as the subject matter of theinstrument,

    worked out under clause (a) plus three calculated by multiplying the conhundred times the minimum monthly rent structed area or each floor of the

    buildof the building arrived at by multiplying ing with the minimum rent fixed bythe constructed area of each floor of the the Collector of the district under

    building with the minimum rent fixed by rule 4.the Collector of the district under rule 4.
