Introduction

One of the most useful tools, when new legislation is being con-templated in a given state, is a collection of similar legislation thathas been enacted by other states. 'Although the details may beinappropriate, the approach and many of the individual provisionsmay be well suited to the needs of a state on the verge of legislat-ing a new prograM.

In recent years states legislatures have enacted a number of newlaws in the area of career education and a number of others areconsidering such action, Existing laws contain a wide range ofapproaches, from fairly limited resolutions to fully developedcareer education legislation. In some states, career education hasalso been integrated into legislation that is concerned with educa-tional reform.

As an aid to individuals who are currently reviewing approaches todeveloping state career education legislation, existing legislationhas been compiled and is included in this volume, It is designed toserve as a companion report to ECS Report No. 118, Legislating forCareer Education: A flatuthook for State Policy Makers, The tworeports provide xth a guide to developing career education legisla-tion (Report No. 118) and the examples of legislation that havealready been.enacted in 21 states (included in this report),

These two reports have been developed with the guidance andassistance of a,nationalTask Force on Career Education chaired byGovernor George Busbee of Georgia, The twelve members of theTask Force are nationally recognized leaders in career educationfrom the business/industry and labor communities as well as repre-sentatives of education and government. It is the intention of thetask force, through the publication of these two reports, to assistinterested individuals in preparing career education legislationthat is appropriate to their needs and circumstances.

WHEREAS, over twenty states have already passed legislativeacts-to set guidelines for and to fund career education in theirstates; and

WHEREAS national organizations such as the American Per-sonnel and Gujdanco Associat4n and' the National Vocational=Guidance Association hav'made commitments across the nationfor increased omphasis in the area of career education andplaniiing; and

WHEREAS, data collected froM suriieys in Indiana and across!the nation has shown an ap,parentrtesd by both students andparents for infusion of 'career Oilcan-Val and planning into the

entire educational system, andWHEREAS, today's youth live in a highly complex society with

any decisions and many different variables, there is a need fora process to learn better implementation of self in the world ofwork: and

WHEREAS, young people in the state of Indiana need to bemade aware of the 35,000 job options available to them; andWHEREAS, parents need to be educated as to what they can doto`assist their children in choosing a meaningful-career,BEASSEMBLYREPRESENTATIVESSectionurgedtionDepartment

not responded to the ne a great number of the youths whopass through the school _ tem, andWhereas, teacher training in titutions generally have not placedsignificant emphasis on a veer awareness component inteacher preparation programs, a_Whereas, public school progriims, publicly supported vocationalschools and state colleges and universities have not been able tokeep pace in their educational programs with changing jobrequirements and labor market demands: Now, therefore,BE IT RESOLVED BY THE SENATE OF THE STATE OFKANSAS, THE HOUSE OF REPRESENTATIVES CONCUR-RING THEREIN: That in recognition by the Legislature of theState of Kansas of the urgent need for incorporation' into thepublic school system of the concepts of career education, includ-ing career' awareness and career preparation and exploration, ,

the state board of education is hereby directed to provide furtherleadership in the field of wog education so that state goals andobjectives can be implemented in the school districts of Kansasat the earliest practicable time. In recognition of the fact thatthe state board of education already has articulated statewidegoalfor career education and has cooperated in the operation ofseveral individual career education projects, including inservicetraining sessions, the state board'of education is furtherdirected,to prepare and submit to the 1975 legislature a proposed actionprogram containing a detailed funding proposal designed asexpeditiously as possible to make career education opportunitiesavailable to all students of Kansas school districts; encouragepost-seeondary institutions to incorporate into their teiichertraining programs effective career education preparation oppor-tunities: prepare guidelines to assist school districts in planningand organizing career education programs; provide inservice andother programs as may be necessary to reorient teachers servingin the field; prepare, publish and otherwise 'disseminate mate-rials for continuing education of school personnel: evaluate theffectiveness of school district career education prrgrims; anprovide such further state-level direction and leadership as willbring the full benefits of career education to the youth of thisstate. Be it further resolved: That the state board of regents ishereby directed to emphasize career awareness in teacher prep-aration programs in .the institutions under their management.Be it further resOlved: That the secretary of state is herebydirected to transmit a copy of this resolution to the chairman ofthe state board of regents, the chairman of the state board ofeducation and to the commissioner of education fo'r duplicationand transmittal to every school board member within the stateof Kansas.

Legislatures have, in the past fewyearii, enacted a relatively largeamount A...legislation designed to strengthen and encourage localcareer education implementation efforts. These laws were toonumerous to include in this report, but some examples are in order.Those chcsen simply reflect the range of opportunities available tothe legislature in providing limited, but significant, support forcareer education implembntation_

7467. Legislative Intent. The legislature hereby finds ariddeclares that there exists in this state a serious need to increasethe effectiveness of career development programs. For this pur-pose, the legislature intends Heat the one pilot California careerguidance center, established pursuant to this chapter, shall

43 serve as a regional guidance resource center, amply equippedwith modern occupational' measurement and career guidancematerials and a professional resource sniff. Thd department ofeducation, in cooperation and consultation with the advisorycommittee estahlished,pursuant to Section 7467.4, shall providestate-level.guidance and supervision to the career guidance pilotproject.

7467.1 Application, pilot Application for establishmentof a career guiclince center may be made to the state board ofeducation by any county superintendent of schools or of thegoverning hoard of any school district, either separately orjointly, upon forms provided by the state department of educa-tion. The board of education shall select one applicant to bedesignated as a pilot California career guidance center.7467.2 Guidelines. Upon recommendation of the superinten-dent of public instruction, the state board of education shalladopt guidelines which shall include, but not be limited to,criteria for selection of an applicant pursuant to Section 7467.1,selection of project sites, fiscal accountability, and proceduresrelative to interagency contracting and overall project adminis.tration and evaluation.7467.3 Department of education: advise and consult. In theimplementation of this chapter, the department of educationshall, on a regular basis, advise and consult with representativesof the Department of Human Resources Development, the officeof the Chancellor of the California Community Colleges, theCalifornia Postsecondary Education Commission, The Univer-sity of California, the Chancellor of the California State Univer-sity and Colleges, the Commission for Teacher Preparation andLicensing, the Department of Industrial Relations, the Depart-ment of Consumer Affairs, the California Advisory Council onVocational Education and Technical Training, and the StatePersonnel Board.7467.4 Local advisory committee. The career guidance centershall appoint a local advisory committee composed of 11 mem- -bets, at least seven of whom shall be representatives of business,

I 11 This act shall be _known and may be cited as the "StudentServices Act."12) It is the intent of the legislature to articulate the functionserved by each of the components of a program of studentservices. It is further the intent of the legislature that eachschool district develop a plan for providing student services to allpublic school students in the district. This Wan shall be designedto insure effective use of available resources and avoid unneces-sary duplication.131 A "student services program" is defined as a coordinatedeffort which shall include, but not be limited to:

participating in career education, and persona representative ofthe'Various regions of the state including both rural and urbanresidents.

158.520. Curriculum Areas included.(1) Career education shall be conducted in the elerrien-tary, secondary, post-secondary, and adult education pro-grams administered by the department of education underauthority of the state board of education as a processincorporated into the total curriculum and in conjunctionwith courses in any appropriate area of study.(2) Career education shall include, but not be limited to,the areas of

la) Personal development, including the developmentof competencies necessary to acquire basic learningskills; communicate: compute using-the basic proces-ses; acquire knowledge and skills through continuedlearning; make informed decisions relating to careerand life development; apply acquired knowledge andskills to real-life situations; pursue personal interestsand enrichment; and obtain and apply knowledge ofphysical fitness, nutrition, and mental health to life-long personal health maintenance;(b) Career and occupational awareness, including in-formation, activities and guidance procedures of thecareer education concept designed to develop the un-derstanding and ability necessary to make careerchoices, to cope with the changing economic and occu7pational environment, and to develop occupational andeducational competencies necessary for employmentand continued education;c) Economic understanding, including knowledge of

economic systems, information on tax structures andobligations, understanding of personal and familymoney management, and the competencies requiredfor the application Of such knowledge and understand-ing to consumer practices;(d) Citizenship, including the rights and respon-sibilities of citizenship in the community_ , state, nation,and world social and political orders; .

(e) Family life, including information and activitiesdesigned to develop an understanding of the role of theindividual in family life, the rights and responsibilitiesincumbent upon each role participant, the respon-sibilities and duties of marriage and parenthood, andthe theories and practices of child rearing and earlychildhood development, and(f) Human relations, including knowledge of the rela-tionship of the individual to his social, cultural,n ral, and political environments, andirof the worth and dignity of other people, and theskills and understanding required in developing anability to work with and relate to other individualsand groups, and art appreciation of the historical andcultural heritage and values of his environment andthat of others.

(3) Career education shall be sequential in nature andsuited to meet the needs of the students at their respectivegrade levels.

158.525. Development of program Functions of department.The department shall develop a comprehensive statewide pro-fur= of career education by assuming the following functions:

11) Assist in the development and dissemination of modalciirricula in career education for the public schools, inconjunction with the programa of local boards of educationand the institutions of higher education responsible forteacher education;12) Identify and disseminate information relating to in-novative teaching methods for instruction in career edu-cation;(3) Assist local school districts in conducting teacher in-service education programs on career education based ona training program developed by the department;(4) Assist teacher education institutions in the develop-ment of a program designed to prepare teachers to utilizethe theories and methods required of a program of careereducation;(5) provide funding for teacher in-service education pro-grams when so requested by local school districts as pro-vided in KRS 158.545; and(6) Assist in the design and implementation of careereducation guidance programs and services deemed appro-priate by the department.

158.530 Policy of local school district. The governing board ofeach local school district shall adopt a policy regarding careereducation by resolution in accordance with the guidelines andregulations approved by the state board of education, and consis-tent with the proVisions of KRS 158.510 to 158.545, specifyingamong other things the curriculum or program to be utilized incareer education, provisions for teacher in-service education,assistance to teachers and guidance personnel in implementa-tion of such program, and the procedures by which parents,community members, and others may provide input to the pro-gram

158.535. Assistance from persons outside school system permit-ted. Nothing in KRS 158.510 to 158.545 shall be interpreted asprohibiting any local school district, superintendent, principal,teacher or counselor from inviting qualified persons in the areasof career education from outside the school system to assist theteacher or counselor in classroom programs or to prernt pro-grams to all or any part of the student body in lir mannerconsistent with policy and regulation of the local bo d of educa-tion, the state board of education, and the provisi s of KRS158.510 to 158.545.

158.540. Implementation of KRS 158.510 to 158.545. To as-sure effective implementatioilx-of KRS 158.510 to 158.545, thedepartment shall upon passage, institute planning, research,employment of appropriate personnel, and program implementa-tion, and shall develop and submit to the governor, the legisla-tive research commission, and the state board of education acomprehensive plan for achieving the priorities and programsset forth in KRS 158.510 and 158.520. Such plan shall include,but not be limited to, the curriculum areas involved in theprogram; the method by which the program is to be presented inthe public schools; procedures for development of model cur-ricula, assisting in providing teacher in-service education andguidance services, and cooperative arrangements established forsuch purposes with local school districts and institutions ofhigher education responsible for teacher education.

training shall melte application to the department forsuch funds. Each district application shall include, but notbe limiteCto, a description of the career education pro-gram to be implemented including an evaluation design,the number of students in the district who will be par-ticipating in the frograin, and the number of teacherswho will be participating in in-service training. The de-partment may provide that additional information, if re-quired in determining grants to local school districts, beincluded in such application.(2) Each local school district desiring to receive fundingunder the provisions of this section shall make applica-tion, as provided in subsection (i) of this section, to thedepartment no later than July 1 of the year in whichcareer education is to be implemented in the educationalprogram of the district.(3) Of the total funds appropriated to carry out the provi-sions of KRS 158.510 to 158.545, the state departrhens ofeducation shall retain no more than two and one half percent (nick ) for administration services.(4) Grants to local school districts shall be made inamounts proportionate to the number of teachers requir-ing in-service training and the number of students whowill participate in the program under guidelines estab-lished by the department.

158.550. Title KRS 158.505 to 158.545 shall be known as TheCareer Education Act of 1976."

Section 1. The headiing of Chapter 9 of Title 17 of the LouisianaRevised Statutes of 1950 is hereby changed to "Career Educationand Rehabilitation."

Part 1. Career Education1991. Definitions, As used in this part, unless otherwise clearlyindicated, the following terms have the meanings ascribed be-low:

111 "Board" means the state board of education or itssuccessor;(2) -Department" means the state department of educa-tion or its successor;(3) :Superintendent of Education" means the statesuperintendent of education or his successor.

1992. Duties of the board and department to establish andimplement career education. The board and the departmentshall plan, develop and provide a coordinated, comprehensiveprogram of career education to encourage and to promote theacquisition of skills for earning a living together with basicacademic skills and to develop the potentials of students intoabilities that will enable them to be as self-sufficient as theirtalents permit, to function effectively in society and to live

meaningful, enjoyable lives; provided, however, that every stu-dent enrolled in elementary or .eeendary school *hall be re-quired to pursue the basic academic curricula that shall beprovided in all such schools as a condition precedent to theawarding_ of a diploma and the ,graduating from such schools.Nothing herein contained shall prevent the offering of a com-prehensive program of electives.

1993. Implementation of career education by board and de-partment. To accomplish the goals set forth in Section 1992, theboard in cooperation with other educational institutions and thedepartment shall implement' career education by planning,executing and administering plans for, but not limited to, thefollowing:

(1) The development of professional skills in career edu-cation by preservice training of teachers and counselorsand by inservice training of teachers, counselors, adminis-trators and supportive service personnel for which theboard may utilize personnel and facilities of the institu-tions of higher learning that are under its jurisdiction,and may participate in cooperative programs for the samepurpose with other institutions of higher learning.(2) Allocation of vocational-technical teachers throughoutthe various levels and throughout the system of careereducation.(3) Writing or revising the handbook for school adminis-tration.(5) Printing of curricula and printing of guidelines there-for.(6) Higher levels of training for career students at theinstitutions of higher learning, including one and two-year certificate and associate degree programs in techni-cal and paraprofessional fields of study.

1994. Regional coordination and planning of postsecondaryvocational-technical education. Regions are hereby created forpurposes of administration, coordination and planning of pro-grams and functions of postsecondary vocational-technical edu-cation schools, consisting of the following parishes. IA listing ofeight regions is included in the legislation.)

1995. Regional administration. All postsecondary vocational-technical schools shall be under the control of the board, whichshall adopt policies governing the schools. The board's policiesshall be executed and administered by the department.

Under the direction of the state superintendent of public educa-tion, the bureau of vocational education of the state departmentof education shall provide leadership and supervision of thepostsecondary vocational-technical schools.A. For each region, the board shall create and employ a directorfor a regional center which shall be the administrative unit forthe postsecondary vocational-technical schools in the region andshall coordinate the functions of these schools as they relate tocareer education. The director may employ such staff for theregional center as may be necessary. Subject to the control of theboard, the regional center shall administer the following:

(1) Regional fiscal matters(2) Personnel matters, including the selection of a direc-tor of each of the schools of the region13) Buildings and maintenance14) Reporting and data collection15) Coordination of instruction16) Such other duties as may be prescribed by theor department.

B. After consultation with the advisory councils and consulta-tion with directors of schools in the region, each regional cantershall submit to the board an annual budget for all of the schoolsunder the administration of the regional center.C. The director of the regional center shall be responsible forthe general 'effectiveness of the regional, area and branchschools of the region.

1996. Racial segregation prohibited; personnel.A. The department shall operate the vocational-technicalfacilities on a racially nonsegregated policy; making full utiliza-tion and employment of professionals presently employed attheir present level of employment and with all rights andprivileges thereto appertaining.B. The board shall establish nonracial objective criteria for theemployment, promotion, dismissals and/or demotions of all per-ionnel.

1997. Open door policy; state-wide service. The vocational-technical schools shall be operated under an open door policyand shall serve persons on an equal priority basis, including butnot limited to, adults, veterans, high school students, personswho have dropped out of high school and minority ethnic groups.Persons meeting board requirements witkrespect to age shall befree to enroll in any school in the state and there shall not beany geographic barriers to enrollment.

998 Advisory councils. The board, union recommendations byregional directors and directors of postsecondary vocational-technical schools may appoint advisory councils on career educa-tion who -shall serve without pay, Such councils shall be repre-sentative of employee, employer, educational and public inter-ests and ethnic minorities. Each council shall be limited tofifteen members.

Note: The remainder of the legislation is concerned with theestabliahrnent of facilities, such as, for example, area schooland services (transportalen, etc.), and is not generally applicabto other states.

and intermediate school districts, in geographic proximityto each other and organized to increase cooperation andarikuistion between load educational agencies as theyplan to implement a career education program.let "Local educational agency" means local school dis-tricts and intermediate school districts and their boards.

Section 3 The Career education advisory commission, hereaftercalled the commission, is created in the department of education.The commission consists of '20 members of which not more thanone-halt shall represent the education profusion. The membersshall be appointed by the state hoard of education for terms oftwo years, except. that of the members first appointed, tenmembers shall be appointed for one year and ten for two years.The state superintendent of public instruction or his designatedagent shall be a nonvoting, ex officio member and shall serve asichairman. The commission membership shall include represent-atives of labor, business or industry, a noneducational stategovernmental agency, local and intermediate school board mem-bers and 4idnimigtrators, a community college district, a four-year college or university. a neighborhood education authority,the state advisory council Mr vocational education, parents,teachers, counselors, and students.

The hoard in consultation with the commission andteacher training inst itutiens shall develop a plan for pro-fe,ssional personnel development to assure saccessful im-plmentation of career education in all local educationalagencies. The professional personnel development planshall provide for the systematic development of all profes-sional personnel at both the preservice and inservicelevels and the criteria for assessing the performance ofthese professional personnel.

Section it The stiite shall be divided by the state board ofeducation into career education planning districts. A planningdistrict shall he structured to increase communication, coopera-tion, and planning among its-member educational agencies andto coordinate and promote career education programs in thedistrict. The number and boundaries of career education plan-ning districts shall initially be as established on January 1,1974, and be reviewed annually by the'State board of educationbased upon criteria to include the following:

Membership shall not exceed 20, of which notmore than one half shall represent the education profes-sion, and Mall nada& ropraaanlativea of local and inter.mediate board members and administrators, the arts,business or industry, a labor organization or manpoweragency, parents, teachers, counselors, and students. Allother local educational agencies shall be represented asnonvoting, ex officio members on the council serving theirarea of the state. A career education planning districtcouncil shall develop annually, beginning September 1,1975, a comprehensive, cohesive, and well-coordinatedcareer education plan, utilizing the guidelines recent.mended by the state board of education.

Section 7. Beginning with the 1975 -1978 school year each localeducational agency shall hale a comprehensive career educationplan and shall establish performance objectives. Each local edu-cational agency shall annually thereafter evaluate and Makerecommendations for its comprehensive career education pro-gram utilizing guidelines and goals recommended by the stateboard of education, the planning district's plan, and the localeducational agency's performance objectives and plan.Section 8. The department of education, in cooperation withother agencies, shall periodically compile and make available tocareer education panning districts and local educational agen-cies information pertaining to current and future job oppor-tunities.

Section 9. h e department of education shall provide to thelegislature and the governor by February 1, 1975, an estimate ofthe cost of implementing a comprehensive career education planfor the state.

Education' Reform Legislation

In Indiana, the legislature enacted a concurrent resolution dur-ing the 1978 session "memorializing the Indiana department ofpublic instruction to establish a method for implementation ofcareer education and planning programs in the schools."

Ch. 280 of the Iowa Code, "Uniform School Requirements,"includes in its provisions the requirement that "the board ofdirectors of each local public school district and the authoritiesin charge of each nonpublic school shall incorporate into theeducational program the total concept of career education toenable students to become familiar with the values of a work-oriented society,:: The law clearly differentiates between a voca-tional educational offering and the implementation of the con-cept of career education (Sec. 280 -9).

In the 1974 session, the Kansas legislature adopted ConcurrentResolution No 82, "directing the state board of education toencourage, support and promote career education programs inKansas school districts and directing the state hoard of iegentsto emphasize career awareness in teacher preparation pro-grams."

In addition, also during the 1974 session, the legislature enacted"Interlocal Agreements" legislation enabling school districts toestablish cooperative arrangements in order to provide specialeducation, vocational education and/or career education pro-grams.

Kentucky has enacted The Career Education Act of 1976, amajor career education law. It is major in that it was backedwith a $2 million appropriation flit its first year of implementa-tnm I977-781 and in that it provides that career education"shall be conducted in the elementary, secondary, post-secondaryand adult education programs administered by the departmentof education under authority of the state hoard of education as aprocess incorporated into the total curriculum and in conjunctionwith courses in any appropriate area of study." Districts thatwish to receive funds under the law must develop career ciduca-

tion policies that are consistent with its provisions, specify thecurriculum or program to be used, provisions for teacher inner-vice education, assistance to teachers and guidance personneland the procedure by which parents, community members andothers may participate in the program.

Louisiana Sections 17:1991-2006 of the Louisiana Revised Statutes providethat the state board of education and the state department ofeducation are to "plan, develop and provide a coordinated, com-prehensive program of career education to encourage and topromote the acquisition of skillS for earning a living togetherwith basic academic The powers and duties of the statehoard and the department of education are specified in the law.

Michigan In 1974, the Michigan legislature enacted the Career EducationAct, PA 97. The law divides the state into career educationplanning districts and provides that by 1975-76 each localeducation agency is to -have a comprehensive career educationplan. Unlike most career education statutes, the Michigan lawmandates career education (rather than providing funds to dis-tricts that wish to establish career education programs). The lawalso establishes the Michigan Career Education Advisory Com-mission composed of 20 members at least half of which must benon-educators.

Mississippi chi 394 of the Mississippi code -authorizes and empowers"school diStricts to adopt plans for the implementation of acareer education program as the same best suits the needsthereof and thereby to orient its system to the field of work." Thelaw also provides for the establishment of an office of careereducation wiVith the state department of education.

Ch. 230 of the laws of 1970 provides for the implementation ofcareer development procedures. According to the 1978 NewJersey State Career Education Plan, the purpose of the legisla-tion is to emphasize the combination of technical activities andacademic curriculum that will help students, kindergartenthrough twelfth grade, develop self-awareness and an apprecia-tion of work.New Jersey's "Achool Education Act of 1975," Ch. 212, has led tofurther development of career education, through the law's pro-visions related to school improvement land as developed in theNew Jersey Administrative Code, Title 6, Subtitle B, Chapter 81.

The Ohio legislature provides funding for career educationthrough the state plan for vocational education.

Subsection 8 of Section 53=7=21 of the Utah Code provides fundsfor career education. Item tc1 of Subction 8 states that "fundsspent for career education shall be used to infuse career educa-tion into the school program and to encourage Joint endeavorsbetween school districts and the Utah career-oriented society."

Sec. 2 of Ch. 528, which defines standards of quality for publicschools, is concerned with career preparation. The law requiresthat by 1980, each school division shall have a program ofalternate career education (that is, career education is viewed asan alternate program of education rather than an integral partof the general educational program.)

Washington Ch..359 of the Washington Education Code, the Basic EducationAct of 1977, provides that schools must provide students withthe opportunity to achieve skills that are necessary to futurelearning. In particular, a minimum percentage of total programhour offerings must be devoted to the development of workskills. The minimum percentage increases gradually, from fivepercent in grades 4-6, to over 20 percent in grades 9-12. "Workskills" are broadly defined to include industrial arts, home andfamily life education, business and office education, distributiveeducation, agricultural education, vocational education, tradeand industrial education, technical education and career educa-tion, and career orientation.

The Education Commission of the States is a nonprofitorganization formed by interstate compost in 1968. Forty-sixstates, American Samoa, Puerto Rico and the Virgin Islandsare now members. Its goal is to further a working relationshipamong governors, state legislators and educators for theImprovement of education.
