2)Tax Benefits Available to Senior Citizens:

A person becomes senior citizen under Income Tax Act in any year after attaining the age of 60 even for one day ( ?? ).  Once he attains 60 years, his status as senior citizen in that financial year, gives himsome relief .There are not many income tax exemptions available for senior citizens. These are listed below:1. Higher Exemption LimitFrom F.Y. 2011-12  Qualifying age for Senior Citizens has been reduced from 65 years to 60 years and from A.Y. 2015-16 exemption limit for Senior Citizens has been enhanced from Rs. 2,50,000 to Rs. 3,00,000.  A new category of Very Senior Citizens, 80 years and above, has been created who will be eligible for a higher exemption limit of Rs. 5,00,000. Senior citizen above the age of 80 years are entitled to higher exemption Limit of Rs. 5,00,000 from A.Y. 2012-13.

2. Reverse mortgage for senior citizensReverse mortgage’ – a concept introduced by Finance 2007 -provides that a senior citizen will be able to avail of monthly income streams by mortgaging a house owned by him.  For more details read the following article :- Reverse mortgage created under a scheme made and notified by the Central Government shall not be regarded as a transfer U/s. 2(47)

3. Tax benefits on medical insurance hikedA senior citizen can avail of higher of higher deduction of Rs 20,000 u/s Section 80D and the same limit is been further increased to Rs. 30,000/- from A.Y. 2016-17.

4.  Tax benefit in respect of Expense on medical expenditure in respect of a very senior citizen

With effect from A.Y. 2016-17 Any payment made on account of medical expenditure in respect of a very senior citizen, if no payment has been made to keep in force an insurance on the health of such person, as does not exceed thirty thousand rupees shall be allowed as deduction under section 80D. Section 80D- Hike in Deduction Limit for Mediclaim

5. Higher Deduction u/s 80DDB for Senior Citizens and Super Senior Citizens.Section 80DDB provides deduction to an assessee in case of expense on medical treatment of specified ailments. Generally this deduction is available upto Rs 40,000 . However , if the patient is a senior citizen, then deduction of Rs 60,000 is allowable.From A.Y. 2016-17 higher limit of deduction of upto eighty thousand rupees is allowable, for the expenditure incurred in respect of the medical treatment of a “very senior citizen”. A “very senior citizen” is proposed to be defined as an individual resident in India who is of the age of eighty years or more at any time during the relevant previous year.   Section 80DDB– Limit raised & waived condition of certificate

6. No Routine Income Tax Scrutiny of Senior Citizens-Appreciating the concern of these taxpayers and with a view to mitigate their hardships, Central Board of Direct Taxes has reviewed its scrutiny selection procedure. In order to redress the grievance, it has been decided that during the financial year 2011-12, cases of senior citizens and small taxpayers, filing income-tax returns in ITR-1 and ITR-2 will be subjected to scrutiny only where the Income Tax department is in possession of credible information. Senior citizens for this purpose would be individual taxpayers who are 60 years of age or more.

7. Senior Citizens not having Business Income Exempt From Advance tax payment :-  From Financial year 2012-13  resident senior citizen, not having any income chargeable under the head “Profits and gains of business or profession”, shall not be liable to pay advance tax and such senior citizen shall be allowed to discharge his tax liability (other than TDS) by payment of self assessment tax.

8.  Senior citizens receive a higher interest (up to 50 bps) on a 5-year fixed deposit, which is eligible for deduction from the total income under Section 80C.

9.  Senior citizens can claim exemption on the tax deducted at source (TDS) on interest income earned on deposits. It can be done by submitting Form 15H under Section 197 of the IT Act.

RETIRED LIC CLASS I OFFICERS' ASSOCIATIONCHENNAIAnnual General Body Meeting on 02. 05. 2015.

About 80 members were present -mostly pre August 1997.Sri.G.N.Sridharan President was the main speaker. Sri. M.Arunachalam(Vice President),Sri. D.Krishnan (Vice President) and 3 members spoke appreciating the efforts Sri.G.N.Sridharan has been taking(in spite of his old age )to improve the lot of pensioners and endorsed his approach.

My presence in the meeting was referred to on 4/5 occasions. Therefore, some of the members suggested my participation in the discussions .So, I did .I wanted 20 minutes. Allowed.(My thanks to Sri. Krishnan). I spoke for 20+5 minutes questioning/correcting many of the statements made.Some members expected me to continue. One member wanted me to stop - his hunger for food was more than his hunger for facts.

I am giving below a gist of some of the topics touched .I have used green colour for my submissions. The two cases filed by Sri. Asthana are not different .They are different. First in1998 (DA neutralisation) and second in 2007(pension up gradation).Sri. Asthana filed one case in 1998 and on Court's suggestion separated this into two.No hearing took place between 1998 and 2007.Where is the question of Court intervention?Also,there is no reference about this in affidavits submitted by LIC of India.Board Resolution recommends DA neutralisation only and not up gradation of Pension.Rationale behind Board Resolution, reference to +11.52%,LIC's letters to Ministry of Finance (obtained under RTI)etc. leave no doubt that up gradation of pension was also favourably considered.Justice Bhandari's Judgement is only for implementing Board Resolution.Justice Bhandari has clearly allowed both writ petitions. Judgement of Chandigarh High Court supports this interpretation.DA neutralisation can be achieved and not up gradation (Sri.G.N.Sridharan will however be 'the happiest' if up gradation is achieved).When all pensioners associations - LIC and others -are fighting for pension up gradation and Supreme Court Judgements have been supporting pension up gradation his stand shows his unique approach.Cases filed by Sri.G.N.Sridharan are for DA neutralisation only - what is achievable (leaving aside what is only desirable)Appears to be a 'self goal'-see 8 below.LIC is inclined to settle' DA neutralisation'. If so what prevents LIC from settling at least one issue . LIC can make necessary payments to 'eligible' pensioners (few thousands only out of about 40000 pensioners) . However, LIC/UOI affidavits have appealed against this part of the Judgement also.AS he is very old he wishes to get 'DA neutralisation' and resign from the posts he is holding now.If  and when he resigns -what  happens to pension up gradation? Are we to forget this forever?

 Firstly, we have to congratulate you that you have exposed the comparative analysisof Shri G N SRIDHARAN AND ASTHANA  in clear cut terms. Most of the pensionersor majority of pensioners are aware of the things from the first Judgement is deliveredby Shri JUSTICE M N BHANDARI on 12 01 2010. Even on today a section of the people are not aware of the Judgement on Justice M N BHANDARI  in 654/2007. Secondly, you have explained vividly before a larger section of people very well maturedand can convince Shri G N SRIDHARAN to amend his affidavit if necessary. You have replied every question coolly in a dignified manner and explained every pointin a descent manner the theme of AIRIEF. I hope and trust that all the pensioners could have properly understood the wisdom ofAIIRIEF for its success at Jaipur endorsed by Chandigarh High Court and also endorsedby Delhi Bench. So, the Jaipur Judgement given by Justice M N BHANDARI helps our case in the SupremeCourt. I wish many audience will  support our Leader Shri K M L Aasthana. You deserve many more CONGRATULATIONS for your valuable message in the GeneralBody held on 02 05 2015. With Greetings,----------L S R KRISHNA RAO

3)Primary requirement is needed,as ALL travellers find it difficult to LOCATE which way to go, right or left,to be in place just near the. compartmentallotted.We are helpless many times, Station ticket collector is not seen, we have to ask Coolies who are so helpful.But Railways must d o their job assigned & makeTravel super right from start

4) Another regular occurrence is Pasting of Reservation Chart belatedlyFurther when law abiding citizens,Sr citizens come before time,wait for long,even after the Train has arrived, the Compartment doors are not opened a little before,leading to problems in movement inside with such small spacewHY not attach a Bolt at Entrance,Exit for speedy movement with luggage for ALL. This Simple solution, Railways themselves should have done in all Bogies,in all trains

5)The greatest problem is so. minimum Space in Lavatory,sliding up down flooring causing disruption ,no smart fixing of rods& shelves fairly liberally,with protrusions, as when train moves,things fall in Flushout.So sad.Further,the MOST ACUTE issue is,i it should be a MUST,Every side must have. Both Indian & Western as Elders & many these days ,even at home,prefer. Western only for comfort? I have seen sometimes people report no proper positioning of Rods for lifting,standing with support & sometimes sharp protrusions so dangerous for all

Again a Simple problem,Why not Railway Engineers instal the easiest,open/close Taps & similarly for Flushout operation.Strange whensometrains,some compartments are decent with proper fitments ,how come deterioration happens,we notice decline in quality later.Supervision&constant vigilance!sound training for all-vis a vis passengers concerns &welfare is a must

6)Cansomething be done to improve the quality of breakfast,lunch&dinner.It is not bad,but combinations can be changed,a slightly larger plate provided,why not a small bottle of water in lieu of water bags so hard to break except bite.It is a tragedy that the dustbin overflows,none bothers,caterer is least worried,Some large carybinbags better be under somebody's control earmarked.Cleanliness & Hygiene has to be upgraded as a PRIORITY

7)How come Railways are immune to Cockroaches invading & in some trains we have seen rodents like rats a nuisance.? Constant antiflushing out with modern methods will make them extinct before it is too late.

8)We also find that sometimes we call for coffee or tea but SAME drink is brought for a long time.

9)We lack self control& self-discipline.What can RAilways do to control Noise,loud chatting,Mobile long talks,loud as a loudspeaker oblivious of social responsibilities & noise pollution,detestable.Insert some Dos & Donts,can you try what PM does ,at intervals of time,Alerts for Conduct for Happy tranquil journey thro Speaker can halt to some extent.

10)Last,it happens ,we witness,corridor sleep by conductor/waiter is so natural he NEVER cares to ALERT Passengers to wake up, be ready as his Station is nearingIn this context,it is pertinent to point out that sometimes when the Train is late,few are aware, there is no mechanism to inform passengers,none bothers.HERE too,an Announcement is desirable & just as few years before Night lamp indicators of Berths were provided to facilitate easy locating of berths at night.CAN Railways modernise the technology to Assist passengers in a big way in the months &years to come to earn goodwill,reputation,unsullied image &above all, as the largest network in world,to make big breakthroughs in safety,comfort,quality food & drinks,alerts timely,hygiene,punctuality to bring cherry & smile on everyone

I have been waiting for the copy of the order of the Hon’ble SC which was passed on 7/5/2015 in our case.  But since I have not seen the copy of the order, I am writing this note of the proceedings in short to apprise you of the said proceedings.  I have been giving detailed informations these two days on the mobile and phone.

When the case was taken up the SC felt that looking to two other part-heard cases it will not be possible to take up and complete the hearing of our cases therefore, it was proposed to be shifted in the last week of September.  Then our Sr. Advocate Shri Nidhesh Gupta and Shri R.K. Singh protested the same that for the last year it is being adjourned for one reason or the other and many have passed already and with every due to dejectment some go away.  The youngest of the pensioners is aged about 78 years on average.  We have already won our cases more than five times from three High Court and twice from the SC still the litigation is going unwontedly.  In case the Court still fells to adjourn the same interim relief be granted more particularly when there is no stay on the judgment dated 8/8/2013 by the Court itself. 

On this the Court suggested to give 20% out of the arrears. LIC’s Advocate said that they have already deposited the arrears in the Courts, then the Court making it easy said that then 20% be immediately paid to the pensioners.  I immediately stated that this is wrong statement of LIC counsel. The said deposit was not acceptable to us otherwise we would have drawn the same then and there, that is not AT ALL acceptable, the deposit has not properly been made and is based deliberately on incorrect calculations that too for DA/DR only in violation of the directions of the SC while our main case is of upgradation of pension with every wage revision and further that amount is not for pensioners and not even of all the petitioners. 7 have been left out, whether they are not entitled to get the benefit of the same judgment when our writ petitioners were allowed without exception.

Then the Court enquired and expressed its displeasure on the wrong statement of LIC Advocate and after our Advocates gave out a short summary of our case, the Court corrected the order and asked for making

20% of the arrears to the pensioners as per the judgment of Jaipur High Court. The payment has been directed to be made within six weeks.

There was no one from the side of Chandigarh HC to say whether those petitioners are agreeable or not to lift the amount deposited there. It was only on our objection that the order was corrected.

Then the UOI Advocate rose up and said that they have also filed SLP on which our Sr. Advocate said that it is delayed by more than four years and the delay should not be condoned since UOI had always been a party in all the Courts. The Court after hearing directed for issue of notice within four weeks of the application for condonation of delay on me and the Petitioners of Jaipur HC writ.  After service we have to file our objections within six weeks and the UOI has to file its reply within two weeks thereafter, if so desired.

As per the deliberations of 7th the 20% of the arrears of difference of Basic Pension (including DR, of course) has to be made to all the pensioners within six weeks since the Court has already expressed more than once that whatever be the order it will apply to all and the judgment of Rajasthan High Court is for all, Chandigarh followed 100% copying and Delhi HC based on Jaipur judgment also directed to be in rem.

Besides this I may also inform that wrong notions are being spread for oblique motives by some over-intelligent persons that interest has been awarded by P&H HC on the arrears.  The judgment of that HC after reproducing the judgments of Jaipur judgments has said that whatever relief has been given by Jaipur HC the same will be applicable to that judgment and Jaipur HC has not granted any interest.

I have tried to give some informations of 7th which I could hear and also participate since I was standing with the arguing Advocates. Except Our Advocates no other Advocate had any occasion to speak. This payment will give us some respite in these hard days.

As per the little knowledge I feel that we should not hurry up for accepting the money when it comes to be paid unless calculations are given since as in the past there is every chance of LIC playing unfairly with us and if there be any lacuna the same may be informed to Shri S.S. Saxena, All India President AIRIEF and me.

10) Supreme Court has ordered inter alia,

"If any amount, that has been deposited before the High Court pursuant to the order passed by this Court, 20% of the same shall be released in favour of the Life Insurance Corporation of India, so that CA 8959-62/13 3 it can pay to the concerned employees. "

My  view:

Our counsel  must have pointed out to the court immediately how the  relief provided is not only inadequate but also  erroneous-even for the respondent- pensioners  for the following reasons:

1) LIC  has not acted as per the directions of the Jaipur Single Judge Bench  allowing  writ petition no 6676/1998 as per which the anomaly in DR arising out of disparity in DR formula between pensioners and in-service employees prior to 1/8/1997  was to be removed and payment of difference in pension was required to be made from 1/11/1993 or the date of retirement whichever was later; 2)LIC has  restricted the revision of pension   only from 1/8/1997 without adopting the same principle of merger of Basic Pension and DR on 1/8/2002 & 1/8/2007 and paying difference thereof on further revisions of pension;

and

3)LIC had completely overlooked the fact that the Jaipur SJB order had allowed the W P No 654/2007,whereby pension of all retirees was to be upgraded  based on revised scales of pay on all future wage revision dates after 1/8/1997 also.LIC had not deposited any amount in Jaipur HC Registry in respect of some post- July 1997 retiree-petitioners

I hope the case managers will consider ways and means of bringing it to the notice of the Apex Court before 15/5/2015.

For the above reasons, my view is that the respondent- pensioners should refuse to accept the interim payment  when made by LIC  so as not to weaken our case for final verdict of the SC.

                            Time has come to ponder over this subject by the entire community of pensioners of all the Public Sector Units & Undrtakings ( Including RBI, Nationalized & Private Banks, LIC, GIC and other Financial Institutions ) and find ways and means to fight for our rightful demands UNITEDLY. Your opinion that " Pensioners federations must exchange developments in full and ensure similarity of responses for similar situations...."is wholly correct and timely.

In fact a time has come when AIRIEF has to take initiative, convene a meeting of Pensioners' organisations in Banking Sector , LIC & GIC and try to formulate a common programme to confront the unwilling hardened UOI to accept the principle of updation of pension in financial sector.

Coming to SBI Package I learn that the amounts are given out of huge accumulations of Imperial Bank Pension Fund. A payment was made earlier ( 2 or 3 years before) ranging from 5000 subject to production ofa certificate of medical expenses.  I learn the Bank promised to review the matter once again but was prevented by the then FM Shri PC. Now this package is announced.

As you rightly said this measure which looks benevolent has the potential of diverting the attention of pensioners from the important demand of Updation. No need to sing Hallelujahs to it.

But how is the SBIPF proceeding to achieve updation? As far as I know SBI Pensioners are following and appreciate our " Kurukshetra." In the SC Order of 7th May 2015 they see a silver line among the clouds.
