MINUTES OF THE COMMISSION MEETING OF FEBRUARY 10, 2011

1. OPENING Chairman Beardsley called the meeting to order at 7:00pm.

2. REVIEW OF MINUTES

Chairman Beardsley asked for a review of the January 13, 2011 Regular Session meeting minutes.

ON MOTION OF COMMISSIONER BEAMAN AND COMMISSIONER BEARDSLEY THAT THE COMMISSION APPROVE THE MINUTES OF JANUARY 13TH, 2011 AS PRESENTED. MOTION CARRIED.

3. BUSINESS ARISING FROM THE MINUTES

Commissioner Beardsley asked Clerk if a letter had been sent to the Department of Transportation and Infrastructure Renewal regarding the status of the Commission’s request for road repair on many of the Village streets.

Clerk stated he would stop in to the New Minas DTIR office on route to the Association of Nova Scotia Villages meeting in Bible Hill on Friday, February 11.

4. COMMITTEE REPORTS

Wastewater, Public Works, and Recreation reports were received as presented. Clerk reported the SCADA system began that afternoon with a few glitches to work out

with regard to procedure and that after a month or two of data they should have more information. Clerk will create a login for Commissioners to view the system for a better understanding of the system.

Commissioner Beaman asked if staff had researched road salt alternatives. Clerk reported on a recent newspaper article for the Town of Berwick on sand/salt usage and

that the Village of Kingston was using 7% of the amount of salt they were using and was not aware of any issues in Berwick. Clerk reported there are other options but they are at least 6 times the cost of salt. Commission decided the present system was

efficient with regard to safety and economics. 5. POLICY AND FINANCE COMMITTEE

Commissioner Beaman reported there are specific projects/service initiatives approved by the Commission that have yet to be completed and recommended the costs

associated be transferred to reserves for completion in the next fiscal year.

ON MOTION OF COMMISSIONER BEAMAN AND COMMISSIONER BEARDSLEY THAT THE COMMISSION APPROVE TRANSFERS TO THE OPERATING RESERVES IN THE AMOUNT OF $12,500 FOR WORK TO BE COMPLETED IN 2011/12.

MOTION CARRIED. 6. FIRST READING – BY-LAW #1 – ELECTION BY-LAW

Clerk presented a summary of the process to pass a by-law and informed the Commission that advertising is optional for first reading. The enactment of this by-law

will coincide with changing the dates of the Annual General Meeting to the first Thursday of June in accordance with the Municipal Government Act of holding the AGM by June 30. This change would accommodate staff in the preparation of tax bills in

April and ensure that revenues and expenses be charged to their proper periods and make sure items would not be missed. The change would also allow rate payers an increased opportunity to vote should there be an election for a new Commissioner

either at the advance poll the Tuesday before the AGM or on Election Day, the Saturday after the AGM. Also, candidates would have an opportunity to speak at the Annual General Meeting but there would be no voting at the AGM. Clerk stated the Final

Reading will occur at the next Regular Session Meeting. ON MOTION OF COMMISSIONER BEAMAN AND COMMISSIONER BEARDSLEY

THAT THE COMMISSION GIVE FIRST READING TO BY-LAW #1 BEING THE ELECTION BY-LAW OF THE VILLAGE OF KINGSTON. MOTION CARRIED.

7. 2011/12 OPERATING AND CAPITAL BUDGET – SCHEDULE & INFORMATION

Clerk stated he will be advising the public of the upcoming 2011/12 Budget Meetings through various forms of advertising.

Report was received as presented. 8. UPDATE – STEER BBQ COMMITTEE

Commissioner Beardsley, Village representative for the Steer BBQ Committee, gave a brief update on the plans for the 2011 Steer BBQ. The Village will again be responsible

for the Friday evening activities including fireworks. There was discussion of the food services being available for a longer period Friday evening and later on Saturday as well. The Committee is also looking into providing a small carnival providing space is

available. Clerk stated that Elm St. could be closed off to provide adequate space. Clerk requested reports from the Steer BBQ Committee be made available to the Village staff.

9. DISCUSSION – WITHDRAWAL FROM APPLE BLOSSOM PRINCESS EVENT

Clerk stated staff is requesting direction from the Commission with regard to the Village’s involvement in the Apple Blossom Festival and sponsoring a Princess for the

event. The request is being made due to senior volunteer members of the Apple Blossom Committee stepping down. After a discussion the Commission decided to advertise for a solid commitment of about 10 volunteers through newsletters, a

newspaper article and the Village website. Staff will contact past princesses as well with the request.

10. DISCUSSION – SPEED LIMITS WITHIN VILLAGE BOUNDARIES Clerk stated a second request had been made by a resident for the Commission to

contact the Department of Transportation and Infrastructure Renewal regarding the speed limit in east Kingston. The request is to have the speed limit changed along Hwy #1 at the Village boundary to 50km/hr rather than the present speed limit of 80km and

then 60km. Clerk stated that staff send a letter to DTIR and will also contact the Traffic Authority Officer and invite him to the next Regular Session Meeting.

ON MOTION OF COMMISSIONER BEAMAN AND COMMISSIONER BEARDSLEY THAT THE VILLAGE SEND A LETTER TO THE DEPARTMENT OF TRANSPORTATION AND INFRASTRUCTURE RENEWAL REQUESTING A

REDUCTION OF SPEED WITHIN THE VILLAGE BOUNDARIES. MOTION CARRIED.

11. HOTEL FEASIBILITY STUDY IN WESTERN KINGS REGION Chairman Beardsley welcomed Warden Diana Brothers to provide background

information on a study being conducted by Kings Regional Development Authority. Kings RDA has requested funding from the County to hire a consultant to conduct a study on the feasibility of a hotel for the Kingston/Greenwood area. Warden Brothers

stated a previous study was conducted but was not very extensive. A meeting with the

consultant team will be held at the Kings RDA office in Kentville on Monday, February 14th, 2011 and they are requesting representatives from the Villages of Kingston and

Greenwood, as well as the County. After a discussion Commissioner Reid will represent the Village at the meeting.

12. QUESTIONS FOR WARDEN BROTHERS Clerk asked the Warden if there were any challenges facing the County regarding the

upcoming budget such as Provincial rollbacks. Warden Brothers stated they are usually given notice of one year on Provincial commitments to the County.

Chairman Beardsley also wanted to inform Warden Brothers that the Commission had submitted a list of roads that needed resurfacing within the Village twice over the last few years to the Department of Transportation and Infrastructure Renewal. He stated

the Commission would like to have some assistance from the County in their efforts to get the Province to repair existing roads within the Village. Commissioner Reid stated the Department of Transportation and Infrastructure Renewal is not accountable to the

Villages. Warden Brothers stated she would write a letter to Fred Whynot – DTIR Area Manager for Kings County and carbon copy to the MLA for Kings West, Leo Glavine, as well as the Minister of Transportation.

Warden Brothers also commended the Village on the great job of snow removal this

year and to the New Years Eve Committee on a successful event again this year. Chairman Beardsley thanked Warden Brothers for the updates.

13. UPDATE – TRAFFIC CHANGES WITHIN VILLAGE Clerk will contact Fred Whynot, DTIR Area Manager for Kings County to follow up on the

Village’s requests for traffic changes on Markland Road and Magee Drive. 14. FINANCE REPORT

Clerk presented finance report for period ending January 31, 2011 and confirmed some expected year-end variances.

ON MOTION OF COMMISSIONER BEAMAN AND COMMISSIONER BEARDSLEY THAT THE PROJECTED VARIANCE OF $17,800 BE USED TO REDUCE THE

INTERNAL BORROWINGS ON VILLAGE EQUIPMENT AND THAT THE FINANCE REPORT BE RECEIVED FOR INFORMATION. MOTION CARRIED.

15. CORRESPONDENCE – LETTER FROM KINGS AREA SCOUTS The Village received a letter from Kings Area Scouts requesting use of the ball field and

arena for a fun day of activities on April 30th. Staff will send confirmation. 16. CORRESPONDENCE – LETTER OF THANKS FOR NS POWER

The Village received a letter of thanks from NS Power for participating in this year’s LED Holiday light exchange program at the Santa Comes to Kingston event.

17. MISCELLANEOUS

Commissioner Beardsley/Volunteer Fireman inquired about the status of the Village’s water committee and/or the possibility of an emergency water supply for the Village. Clerk stated staff will contact Kings County for a meeting to revisit the feasibility and

cost of a central water system. 18. ADJOURNMENT

Re: Environmental Services Report

RECOMMENDATION THAT THIS REPORT BE RECEIVED FOR INFORMATION.

REVIEW

SCADA system installation is complete along with training on the system which includes navigating the web site, setting up the call out list, how to edit system and make

unique changes, and understanding the digital read outs of the electronic modules installed on existing lift station panels. We are now receiving quality information and trending, such as pump run times and pump cycles. With additional inputs in the

modules and proper pump volume information added, the actual amount of volume station is pumping can be determined. This will be quality information from an engineering standpoint for expansion of the sanitary sewer collection system. Alarm

notification system is working really well as we have had some station issues and alarm notices were received from promptly from Omni-site.

February 14 - Called to Kalley Lane in Oakhurst subdivision from resident with sewer backing up in basement. Manholes were checked in the street and blockage was obvious in main line under street. Auger machine and sewer rods were retrieved and

line was cleared. This was the second blockage on one year in same section of pipe. In spring, line will be high pressured flushed to remove sand build-up in line , most likely got in pipe when line was installed for new subdivision.

February 28 - Called out to residence on Victoria Dr. Plumbers had been there most of

the day cleaning out sewer line and felt blockage was under shoulder of road were main line is. Retrieved sewer rods with auger and helped plumbers run rods out to main sewer line. Line was clear but could still see water in pipe. After some discussion it was

determined that sewer line had dip in pipe and was the likely reason there was so much grease build-up.

As stated above, alarm notification system was notifying staff about pumps tripping overload switches. Pumps were pulled at RCMP station and East Main St and rags were

removed from impellers. Pumps in these stations were part of our preventative maintenance program in the fall but aging pumps with older style impellers tend to jam up with rags and will be replaced with newer style Flygt N Pumps. Two pumps were

ordered through capital budget and should receive pumps the end of March. Due to increased wear and maintenance required for pumps, staff are looking into some practical training on tearing Flight pumps down to replace bearings and seals. Pump

also had to be pulled in Forrest Brook subdivision and a rag had to be removed. It should be noted that at no time did the stations with pumps tripped out, stop working. All pumping stations have 2 pumps in each wet well and that other pump in station was

doing its job. No emergencies.

REVIEW

Arrangements were made with DTIR to wing back snow that has accumulated between sidewalk and curb. Snow was pushed onto the sidewalk and then blown off sidewalk

with MT Trackless. Areas focused on were Pine Ridge and Maple St. Parts of Pine Ridge and Westwood St. curb side snow build-up was removed by Public Works staff using Kubota tractor and MT trackless.

With all the extra snow removal, MT Trackless snow blower has had significant wear and tear on blower drive train. Another sprocket had to be ordered and installed along

with new chain ordered earlier in the month. Drive chain that turns augers is practically all new. Broken (asphalt) curbing that is winged back by highway ploughs is a major contributor to parts wearing out on blower.

Two hundred hour service was carried out on the MT Trackless. Staff changed out 42 litres of hydraulic oil and changed filter. motor oil and filter, along with fuel filter was

also changed as part of the 200 hour service. Tandem load of sand/salt mix was ordered to replenish supplies due to excessive use

with this year’s winter conditions. Sand was loaded into truck bay and should be enough to finish winter season. Salt is still being added as salt already mixed in with

sand is of a small percentage to keep sand from freezing. Steel Frame man door was installed at village public works barn completing major

building renovation. Met with electrical contractor for price on new fixtures, new panel, and general tidying up of loose wires. Portable stairs were also purchased and installed in barn. Stairs are on wheels and can be moved around from loft to loft, freeing up

more space, instead of having 2 sets of permanent stairs.

Kubota tractor used for sanding and salting sidewalks had to have right front axle bearing and seal replaced in front end.

RECOMMENDATION THAT THIS REPORT BE RECEIVED FOR INFORMATION.

BACKGROUND

KINGSTON ADULT PROGRAMMING Adult morning Skate program at the Kingston Rink from 10:30 – 11:30am each

Tuesday & Thursday. This program has been very successful with an average of over 20 participants coming out each week. Last session will be Thursday March 10th.

LOCAL SCHOOLS – DAILY PHYSICAL ACTIVITY Afterschool programs at Kingston School:

Basketball - Wednesdays 3:15 to 4:30pm – Currently we have between 38 to 50

children participating each week. Snow Play – Outdoor sledding & snowshoeing at Kingston School for grades 4-5. Volleyball for grades 4-5 beginning after March Break.

PineRidge Middle School: Intro to Golf – Mondays afterschool with Gerry & Chad McMillan. Jazz/Hip Hop Dance on the stage at Pineridge afterschool Thursdays with

Rebecka Hendrickson from DansXpress. PINERIDGE MIDDLE SCHOOL – FRIDAY SKATING

Friday Skating with PineRidge School is finishing up this Friday. This is a great initiative which ran very smoothly and was a terrific option to maintain physical

activity for the kids. SUMMER STUDENT FUNDING

Federal Summer Student Funding program applications are in and we are currently waiting for a reply.

WESTERN KINGS ARENA Application for the RBC Play Hockey Grants has been submitted with support from GMH

and WKRA. The monthly meeting at the Arena will be held on Monday March 14th at 7pm.

MARCH BREAK DAY CAMP Glen is working on the finishing touches for our annual March Break Day Camp which will take place from March 14th – 18th (next week). We have hired a WKHS student to

RECOMMENDATION BE IT RESOLVED THAT THE COMMISSION GIVE FINAL READING TO BY-LAW #1

BEING THE ELECTION BY-LAW OF THE VILLAGE OF KINGSTON.

DISCUSSION During a review of the by-law after the first reading, staff noticed that the definition of

“Nomination Day” means the second Wednesday preceding Election Day. Based on this schedule, that would mean that Nomination Day would be six days before the advance polling day, which is the following Tuesday. If the by-law were to be approved as per

the version presented at first reading, this would not allow sufficient time to properly advertise election information to residents.

The proposed change to the by-law is as follows: 2. (f) “Nomination Day” means the second third Wednesday preceding Election Day.

As this is a minor or housekeeping change, staff feels the by-law does not have to go back for first reading.

VILLAGE OF KINGSTON

BY-LAW #1

ELECTION BY-LAW

Title 1. This By-Law shall be entitled the “Election By-Law.”

Definitions 2. In this By-Law:

a) “Act” means the Municipal Government Act, 1998.

b) “Advance Polling Day” means the Tuesday immediately proceeding Election

Day.

c) “Candidate” means a person who, at the close of nominations, has been

nominated for election to the office of commissioner.

d) “Clerk” means the Clerk and Treasurer appointed by the commissioners,

pursuant to the Act.

e) “Election Day” means the day commissioners are elected to office, being the

first Saturday after the annual meeting of each year, and/or any such other

day as may be required by the commissioners, pursuant to Section 411(1)(a)

of the Act.

f) "Elector" means a person resident within the village entitled to vote at a

municipal election, and who will have resided in the village for at least six

months immediately prior to the village election.

g) “Nomination Day” means the third Wednesday preceding Election Day.

h) “Nomination Period” means the period from and including the two (2) weeks

preceding Nomination Day.

i) “Returning Officer” means a person appointed by the Commission of the

Village of Kingston to conduct all regular and special elections required under

these by-laws.

j) "Special Election" means an election held pursuant to subsection 4.03 to fill a

vacancy on the commission.

k) “Village” means the Village of Kingston, Kings County, Nova Scotia.

Nominations 3.1 No person shall be eligible for election to the office of commissioner of the Village

unless that person has been nominated as a candidate, in accordance with this by-

law, by not less than five persons who, on Nomination Day, were qualified electors

within the meaning of the Municipal Government Act, section 403.

3.2 All nominations shall be in writing in Form “A” attached and shall be filed with the

Clerk at the village office on a business day during the Nomination Period between

the hours of eight (8:00) o’clock in the forenoon and four (4:00) o’clock in the

afternoon.

3.3 The Returning Officer shall advertise in a newspaper circulating in the village, a

notice of the time, date and place for the nomination of candidates at least two (2)

weeks prior to the Nomination Day.

3.4 No nomination shall be valid or accepted by the Clerk unless it has been completed

and signed by the candidate. Only the names of those persons duly nominated shall

appear on the ballots as candidates for election.

3.5 Before four o’clock in the afternoon of the day after Nomination Day, a candidate

may appear in person or by his official agent before the Clerk and file with him a

declaration signed by either of them that he withdraws as a candidate, whereupon he

shall be deemed not to have been nominated.

3.6 If a candidate dies before the close of nominations on Nomination Day, he shall be

deemed not to have been officially nominated.

3.7 If, upon the Annual General Meeting, no nomination papers have been filed with the

Village Office, the chair of the village may call for nominations from the floor at the

Annual General Meeting, or proceed to call a special meeting, pursuant to Section

411(1)(a) of the Act, for the purpose of filling the vacancy.

Vacancy 4.1 Subject to subsection 4.5, within 30 days after a vacancy occurs in the office of

commissioner because an insufficient number of candidates are nominated to fill the

vacancies at a regular or special election; or a commissioner dies, resigns, becomes

disqualified or forfeits office, a special election shall be held on a date set by the

Returning Officer.

4.2 The day fixed for the special election shall be a Saturday not more than 30 days after

the vacancy occurs.

4.3 A special election shall be conducted as nearly as may be in accordance with the

provisions governing regular elections.

4.4 A commissioner elected at a special election shall hold office from the time when he

takes his oath of office until his successor is sworn into office or, if there is no

successor, until the meeting at which the successor would have been sworn into

office if there was a successor.

4.5 Notwithstanding subsection 4.1, a vacancy need not be filled until the next annual

meeting or the election held in accordance with the election by-laws of the village

immediately following the next annual meeting if it occurs within six months of the

next annual meeting unless the Minister or the village commission determines

otherwise.

Elections 5.1 Elections for the office of commissioner shall take place on Election Day between the

hours of nine o’clock (9:00) in the forenoon and seven o’clock (7:00) in the

afternoon and on the advance polling day between the hours of eleven o’clock

(11:00) in the forenoon and seven o’clock (7:00) in the afternoon.

5.2 The Returning Officer for the advance poll and the election may appoint such persons

as deputy returning officers, who shall act as scrutineers or otherwise to assist in the

conduct of the election and to be present at the poll(s) during the balloting.

5.3 Voting for the offices of commissioner shall be held at such place(s), to be called

poll(s), as may be designated by the Returning Officer. The Returning Officer shall

advertise, in a newspaper circulating in the village, at least two (2) weeks prior to

the advance polling day, a notice of:

a) The date of election day and of advance polling day, and the hours of polling

at each; and,

b) The location of the various polls.

5.4 Any elector who expects to be unable to vote on election day may vote on the

advance polling day at an advertised poll.

5.5 A single ballot shall be held and a single ballot paper shall be used at an election

even if there is more than one vacancy in the office of commissioner. All candidates’

names shall appear on the ballot papers. An elector may vote only once for each

office to be filled and may vote only once for any candidate and these conditions

shall appear on the ballot papers.

Procedure at Completion of Vote 6.1 Upon the completion of the voting, the Clerk, and each of the two scrutineers, shall

open the ballot box and examine the ballot papers and proceed to count the votes.

6.2 The candidate obtaining the greatest number of votes at an election shall be deemed

to have been elected to the vacant office of commissioner having the longest term,

and the candidate having the second greatest number of votes shall be deemed to

have been elected to the vacant office of commissioner having the second longest

term, and so on.

6.3 After the votes are counted the Clerk and Treasurer shall make up a written

statement containing the following particulars:

a) the number of votes polled;

b) the names of the persons receiving votes and the number of votes received

by each person.

6.4 The statement shall be signed by the Clerk and filed with the minutes of the

meeting.

6.5 When there is a tie at an election of a village commissioner, the Clerk and Treasurer

shall determine the successful candidate by lot as prescribed by the Municipal

Elections Act.

Vote Recount 7.1 If, within three days after the election, any elector requests a recount of the votes

cast at the election, the Clerk shall appoint a time within three days to recount the

votes at the village office and shall, at the time and place appointed, in the presence

of the chair of the village and the elector, proceed to recount the votes.

7.2 The Clerk, as soon as the result of the poll is ascertained, shall declare to be elected

the candidate or candidates having the highest number of votes and in the event of a

tie determine the successful candidate by lot as prescribed by the Municipal Elections

Act.

Repeal 8.1 The Nomination Day/Election Process By-Law is repealed.

Re: Summer Usage of Western Kings Arena

RECOMMENDATION THAT THE COMMISSION APPROVE THE USAGE OF THE WESTERN KINGS ARENA

DURING SUMMER 2011 AND TO INCLUDE IN THE 2011/12 OPERATING BUDGET.

DISCUSSION

Last year, the village partnered with the Western Kings Arena (WKA), operating the arena during the summer months when the arena is vacant. While the village did not have a particularly successful season in terms of bookings or events, it was generally

felt that the venture was positive for residents, the village and WKA. This report is to receive concurrence to proceed for this summer and allow staff to

prepare staffing, start arena bookings and include in the 2011/12 operating budget as a base budget item. The Memorandum of Understanding signed last year is open-ended and does not provide an end date to cease the partnership, but staff felt it appropriate

to consult the Commission prior to undertaking any activities. At its February meeting, the WKA board approved continuing the partnership for

another year.

FINANCIAL IMPACT

Funds for this venture were included in last year’s budget to the amount of $4,300 ($6,500 for revenues and $10,800 for expenses). Staff are currently working on the budget, but expect the net budgeted amount to be around the same. If approved, there

will be minimal or no impact on 2011/12 operating budget.
