ESTABLISHMENT OF THR GREArER ST. LUCIA WETLAND PARK ANDAUTHORITY
I, Mohammed Valli Moosa, Minister of Environmental Affairs and Tourism, hereby under-

The definition of “World Heritage Site” in section 1 of the World Hczti age

Convention Act, 1999 (Act No 49 of 1999) (hereinafter referred to as ‘theAct”), read with sections 2, 4(2) and 13(2) of the Act, proclaim the Greate St.Lucia Wetland Park as depicted on the proclamation diagram in Annexu e 1;for the avoidance of doubt, the Greater St. Lucia Wetland Park include allmarine areas depicted in Annexure 1.
Section 9 of the Act read with the definition of “establishment date” in section1 of the Act, establish an Authority for the Greater St. Lucia Wetland Parkwith effect fi-om the date of publication of this notice in the GoverndzentGazette.
Section 10 of the Act, determine that the Authority shall exercise its po~ersand pefiorm its duties through a Board and Executive Staff Component ~ setout in the Act and the Regulations.
Section 11 of the Act, determine the name of the Authority to be the “Gr aterSt. Lucia Wetland Park Authority”.

liaise with relevant nah.m conservation, cultural and similarauthorities, organisations :md institutions on a local, provincial,national and international level;
conserve, manage. promote, facilitate and monitor natural and culturalheritage;
manage natural and cultural heritage in accordance with the Act,Regulations and all other applicable national and provincial legislation,policies and management plans;
negotiate land claims over-
(aa) State land with claimants, in consultation with the Departmentof Land Affairs in terms of the Restitution of Land Rights Act,1994 (Act No. 22 of 1944), and settle any such claims, with theapproval of the Minister for Agriculture and Land Affairs or hisor her delegate; or
(bb) private land forming part of or affecting the GSLWP with theowner, and settle any such claims;
acquire land or rights in land by contract, donation or otherwise;
charge fees, r~nt or consideration for-
(aa) any fi.mction it fidfils; or
@b) any right it grants;
use for gain or reward any movable and immovable asset under itscontrol, subject to all applicable law, where such asset is not requiredby the Authority for the fulfillment of its functions, but such movableand immovable property that is required for the fi.-ilfilment of thefunctions of the Authority may not be alienated, leased or encumberedwithout the prior written approval of the Minister;
undertake, or cause to be undertaken, research or investigationsrelevant to the GSLWP;
co-ordinate with-
(aa) the relevant tribunals under the Development Facilitation Act,1995 (act No. 67 of 1995), if applicable; or
@b) similar bodies or relevant planning authorities, on a national,provincial and local level,

in order to expedite sustainable development in the GSLWP and t 2ensure that development takes place in accordance with all applicabk.law and procedures;
(x) initiate, assist, comment on and facilitate any application under theDevelopment Facilitation Act, 1995, or other applicable development ,planning or management law relating to or affecting the GSLWP; 1
(xi) perform any fimction, on contractually agreed terms that are fair inrelation to the obligations imposed on an Authority, at the request of-
(aa)

a national government department;
an institution or statutory body;
another country or any international organisation;
a province;
a regional council;
a local government; or
any other entity or person approved by the Minister;
(xii) employ persons or entities on a permanent or temporary basis;
(xiii) make rules regarding all matters reasonably necessary-
to fulfil the duties of the Authority; I
(bb) for the proper day-to-day management and functioning of th~GSLWP; ~
(cc) establish committees and subcommittees and otherwise arrangeits internal affairs in a manner it deems necessary;
(xiv) enter into contracts in an open and transparent reamer regarding natur1conservation or cultural development with a competent national
provincial or local government or private nature conservation entitywith the necessary administrative capacity and resources;
(xv) to rati@ and/or adopt as its own the actions, rights and obligations ofany predecessor entity or person.
(xvi) do all things incidental or reasonably necessary for the propefulfillment of the foregoing. i
(f) Section 19(2) of the Act, unless otherwise provided in the Act or th

Regulations, give all powers of the Authority to the Executive StatComponent, but any action which will result or has a reasonable likelihood t

resuit in an obligation for the Authority in excess of R500,000 (annuallyadjusted for inflation, using 2000 as basis year) shall also be refimed by theChief Executive Officer to the Board for approval; Provided that in the case ofan emergency or if other compelling reasons exist this requirement can bepostponed and ratification can be sought afterwards fi-om the .Board at the firstavailable opportunity.
(g) Section 32 of the ,Act, declare that Chapter VI of the Act shall apply to theAuthority subject to the Public Finance Management Act, 1999 (Act No. 1 of1999).
