BY THIS Notice the Transport Commission, acting pursuant to Section 16V of the Passenger Transport Act 1997 and Regulation 25A of the Passenger Transport Regulations 2000, hereby exempts effective from the date of this Notice and until 1 July 2012 operators of small passenger vehicles used for the provision of a community transport service from the need to be accredited under Part 2A of the Passenger Transport Act 1997.

For the purposes of this Notice a “community transport service” means a transport service provided by –

(a) an organisation–

(i) that is a not-for-profit organisation; and

(ii) that is funded entirely or partially by any of the following or a combination of any of the following:

(a) the Commonwealth;

(b) the State;

(c) a council; or

(b) an organisation that is, or is entitled to be, endorsed by the Australian Taxation Office as a charitable or benevolent institution; or

(c) a council; or

1. The management plan for the Tasmanian commercial dive fishery has been changed pursuant to section 48A(1) of the Act.

Rule 5 of the Fisheries (commercial Dive) Rules 2005 is changed by omitting “for 5 years” and substituting “until 21 March 2011”.

Explanatory note: This Order extends the management plan for the commercial dive fishery to provide continued operation of the management plan as implementation of new rules for the fishery is finalised.

(1) Proclamation under section 2 of the Local Government Amendment (Local Government Board) Act 2009

This proclamation, made under section 2 of the Local Government Amendment (Local Government Board) Act 2009, fixes 1 January 2011 as the day on which the provisions of that Act commence.

(2) Wildlife (General) Regulations 2010

These regulations, made under Part 4 of the Nature conservation Act 2002 –

(a) establish a licensing and permit system to regulate hunting, trading, taxidermy and related uses of wildlife and the products of wildlife; and

(b) classify wildlife as protected, partly protected, specially protected and restricted (special purpose) for the purposes of the Act and these regulations; and

(c) prescribe certain animals as restricted animals and domestic stock for the purposes of the Act; and

(d) are made consequentially on the repeal of the Wildlife Regulations 1999 under section 11 of the Subordinate Legislation Act 1992.

(3) Wildlife (Exhibited Animals) Regulations 2010

These regulations, made under Part 4 of the Nature conservation Act 2002 –

(a) establish a licensing and permit system to provide for the conservation and preservation of wildlife kept in wildlife parks, circuses and other public exhibitions; and

(b) are made consequentially on the repeal of the Wildlife Regulations 1999 under section 11 of the Subordinate Legislation Act 1992.

(4) Wildlife (Deer Farming) Regulations 2010

These regulations, made under Part 4 of the Nature conservation Act 2002 –

(a) regulate deer farming by requiring, amongst other things, the approval of deer farm fences to prevent the escape of farm deer into the wild; and

(b) are made consequentially on the repeal of the Wildlife Regulations 1999 under section 11 of the Subordinate Legislation Act 1992.

(5) Residential Tenancy Amendment Regulations 2010

These regulations amend the Residential Tenancy Regulations 2005 to provide that the Residential Tenancy Act 1997 does not apply to premises that are part of an educational institution except where the premises are the subject of an allocation under the National Rental Affordability Scheme Regulations 2008 of the Commonwealth, or an application for, or reservation of, such an allocation.

(6) Road Amendment Rules (No. 3) 2010

These rules amend the Road Rules 2009 by –

(a) amending the age, from 4 to 7 years old, at which a passenger is not required to use a child restraint; and

(b) requiring a passenger who is less than 7 years of age to wear a seatbelt in certain circumstances where the passenger is exempt from using a child restraint; and

(c) amending the approval requirements for certain child restraints; and

(d) making other miscellaneous amendments.

(7) Vehicle and Traffic (Vehicle Operations) Amendment Regulations (No. 2) 2010

These regulations amend the Vehicle and Traffic (Vehicle Operations) Regulations 2001 by –

(a) removing the requirement for a notice made under the regulations to be published in full in the Gazette; and

(b) requiring the making of such a notice to be notified in the Gazette.

(8) Vehicle and Traffic (Vehicle Operations) Notice 2010

This notice –

(a) provides for the exemption, subject to conditions, of certain vehicles and combinations from the operation of certain provisions of the Vehicle and Traffic (Vehicle Operations) Regulations 2001; and

(b) replaces the Vehicle and Traffic (Vehicle Operations) Notice 2009.

(9) Poisons (Declared Restricted Substances) Amendment Order 2010

This order amends the Poisons (Declared Restricted Substances) Order 1990 by adding zolpidem and zopiclone to the list of restricted substances to which section 36 of the Poisons Act 1971 applies.

(10) Poisons (Prohibited Substances) Amendment Order 2010

This order amends the Poisons (Prohibited Substances) Order 1990 by adding certain substances to the list of prohibited substances.
