Rule 12 of the Fisheries (CommerCial Dive) rules 2011

Pursuant to the powers under the Fisheries (Commercial Dive) Rules 2011("the Rules") that were delegated to the Director (Marine Resources) on 19 August 2015 by the Minister, acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), I determine that the dates of closing of State waters of the commercial dive fishery to the take of periwinkles (Genus Turbo) in State waters in the south- eastern zone to the activities of the take of periwinkles (Genus Turbo) are as follows:

From 18 July 2016 to 31 August 2016 inclusive;where the “south-eastern zone” is defined to mean that area of State waters off the south east coast and south coast of Tasmania west of the line of longitude 148° 00’ 00” E and east of the line of longitude 146° 52’ 15” E (ie from the southern tip of Tasman Island to Whale Head including Maingon Bay, Storm Bay and Frederick Henry/Norfolk Bay).

Any expression used in this public notice having a particular meaning under the Act or the Rules has the same meaning in this public notice as it has in the Act or the Rules.

This public notice has the effect of closing the commercial dive fishery to the take of periwinkles in the south-eastern zone (from the southern tip of Tasman Island west to Whale Head. This includes Maingon and Norfolk Bays) from 18 July 2016 to 31 August 2016 inclusive as part of arrangements to control the total amount of periwinkles harvested in that area in the interest of resource sustainability.

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Firearms Amendment Regulations 2016These regulations amend the Firearms Regulations 2006 by providing that captive bolt devices operated by the use of blank ammunition are not classified as firearms.

(2) Proclamation under section 7 of the Roads and Jetties Act 1935 and section 3 of the Highways Act 1951

This proclamation –(a) notifies the dedication of land as a highway and the boundaries of that land for the purposes of section 3 of the

Highways Act 1951; and

(b) for the purposes of section 7 of the Roads and Jetties Act 1935 –

(i) declares a portion of Colebrook Main Road to be a subsidiary road that is classified as a main road; and

(ii) declares a certain portion of a road as ceasing to be a subsidiary road; and

(iii) amends an earlier proclamation (S.R. 1970, No. 67) to substitute a new definition for Colebrook Main Road; and

(iv) revokes an earlier proclamation (S.R 1992, No. 139) insofar as it relates to Colebrook Main Road.(3) Proclamation under section 52A of the Roads and Jetties Act 1935

This proclamation –(a) amends parts of an earlier proclamation; and

(b) declares that the Buckland and Cranbrook deviations on the Tasman Highway cease to be limited access roads, and the places of access to those limited access roads cease to be places of access, for the purposes of the Roads and Jetties Act 1935.

(4) Proclamation under section 52A of the Roads and Jetties Act 1935This proclamation, for the purposes of the Roads and Jetties Act 1935, declares –

(a) that a specified part of the Bass Highway near Penguin ceases to be a limited access road and that the access points for that part of the Highway cease to be places of access under that Act; and

(b) that the Bass Highway from Westbury to Penguin is a limited access road and specifies, for the purposes of that Act, the places of access for that part of the Highway.
