These inclusions have no effect unless their inclusion is so approved. The plan will be made available for inspection at Service Tasmania shops and through the LINC and can be downloaded from the DPIPWE web site at www.dpipwe.tas.gov.au to allow inspection of the plan pursuant to Section 28(6) of the Act.

I, Jeremy Rockliff, the Minister administering the Living Marine Resources Management Act 1995, pursuant to section 94 of that Act, hereby:

1. Set the Total Allowable Catch for the commercial banded morwong fishery for the quota period 1 March 2017 to 28 February 2018 inclusive, at 30,992 kilograms — equating to 26 kilograms per quota unit; and,

2. Determine that the part of the commercial banded morwong fishery from which the total allowable catch is to be taken is: the “TAC area” as defined in the Fisheries (Scalefish) Rules 2015.

Words and expressions used in this Public Notice have the same meaning as they have in the Living Marine Resources Management Act 1995 and the Fisheries (Scalefish) Rules 2015.

Pursuant to the powers under section 48A(2) of the Living Marine Resources Management Act 1995 ("the Act") that were delegated to the Director (Marine Resources) on 20 January 2016 by the Secretary acting pursuant to section 20(2) of the Act notice is hereby given that:

1. The management plan for the Tasmanian abalone fishery has been changed pursuant to section 48A(1) of the Act.

2. The change is as follows:Rule 51A of the Fisheries (Abalone) Rules 2009 is rescinded and the following rule is substituted:51A. Over-catch more than 30% (1) Notwithstanding any other provision of these

Rules, if the holder of a fishing licence (abalone dive) takes on a fishing trip an amount of abalone that exceeds his or her quota limit by more than 30%, the amount of abalone that exceeds his or her quota limit by not more than 30% may be dealt with in accordance with rule 51 as if the total amount of abalone taken on the fishing trip exceeded the licensee's quota limit by more than 20% but not by more than 30%.

(2) Nothing in sub-rule (1) is to be taken as preventing any proceedings or actions from being taken against the holder of a fishing licence (abalone dive) in respect of such amount of the over-catch referred to in sub-rule (1) as is not dealt with in accordance with rule 51.

Explanatory note: This order changes the management plan for the abalone fishery by clarifying that any proceeding or action relating to a quota limit excess greater than 30% is to exclude any amount less than 30% administrated under rule 51.
