Trooper’s interview of juvenile at school, following search of juvenile by school principal during which illegal drugs were uncovered, was not a seizure based on the total-ity of the circumstances because juvenile was interviewed in the presence of his mother, was not physically restrained, and was released into the custody of his mother following the interview. Thus, trooper was not required to give Miranda warnings prior to interview and Motion to Suppress juvenile’s statements during interview was denied.

The juvenile, B.L., is charged with Possession With Intent to Deliver a Controlled Sub-stance,1 namely 25C-NDOMe.2 On January 4, 2016, a Motion to Suppress was filed contesting the search of the juvenile, as well as statements made by him to the Assistant Principal of Northwestern Lehigh High School, Donald Allen, and Trooper Geoffrey Godshalk of the Pennsylvania State Police. However, counsel for the juvenile at the suppression hearing held on January 7, 2016, withdrew all of the claims with the exception of the challenge to the statements provided to Trooper Godshalk. It is alleged that the juvenile was in custody when he spoke to Trooper Godshalk.

The charges arose as a result of an investigation conducted by Assistant Principal Allen. He had received a phone call from a parent that his child had purchased drugs at school. A subsequent investigation led to the juvenile, who was requested to come to the principal’s office. There, he was told by Assistant Principal Allen that he was suspected to be in possession of contraband. Assistant Principal Allen told him that pursuant to school policy, he in-tended to search him. He asked the juvenile if he was “agreeable” to the search, and the juvenile replied, “go ahead you’re not going to find anything.”

The juvenile was incorrect. Although Assistant Principal Allen failed to locate anything in the juvenile’s book bag, he located what the juvenile described as a “designer drug” in his wallet. The sub-stance was on blotter paper containing cartoon characters, with perforated tabs. The juvenile admitted he was selling the substance at $5.00 a tab.

Trooper Godshalk was asked to respond to the high school, and Assistant Principal Allen showed him the blotter paper with the substance. The juvenile’s mother had also been asked to come to the school, and Trooper Godshalk asked her for permission to interview the juvenile. She agreed and Trooper Godshalk inter-viewed the juvenile, but without providing him with Miranda warnings. Trooper Godshalk did, however, tell him that he did not have to speak to him. The sum and substance of the juvenile’s statement was that he was selling drugs for money. At the conclu-sion of the interview, the juvenile was released into the custody of his mother.

DISCUSSION

Miranda3 warnings are only required prior to a custodial in-terrogation. Commonwealth v. Housman, 604 Pa. 596, 625, 986 A.2d 822, 839 (2009). Juveniles, as well as adults, are entitled to be apprised of their constitutional rights pursuant to Miranda. In the Interest of R.H., 568 Pa. 1, 6, 791 A.2d 331, 333 (2002).

A custodial interrogation has been defined as “questioning initiated by law enforcement officers after a person has been

taken into custody or otherwise deprived of his [] freedom of action in any significant way.” Commonwealth v. Mannion, 725 A.2d 196, 200 (Pa. Super. 1999); see also, Commonwealth v. Gonzalez, 979 A.2d 879, 887-88 (Pa. Super. 2009) quoting Miranda v. Arizona, 384 U.S. 436, 444 (1996); Commonwealth v. Dupre, 866 A.2d 1089, 1106 (Pa. Super. 2005) quoting Commonwealth v. DiStefano, 782 A.2d 574, 578-80 (Pa. Super. 2001) (a person is in custody for the purposes of a custodial interrogation when he is physically deprived of his freedom in any significant way or is placed in a situation in which he reasonably believes that his freedom of action or move-ment is restricted by the interrogation). The United States Supreme Court has stated the “ultimate inquiry is ... whether there [was] a ‘formal arrest or restraint on freedom of movement’ of the degree associated with a formal arrest.” Commonwealth v. Boczkowski, 577 Pa. 421, 447, 846 A.2d 75, 90 (2004) quoting Stansbury v. California, 511 U.S. 318, 322 (1994).

“The standard for determining whether an encounter with the police is deemed ‘custodial’ ... is an objective one based on a totality of the circumstances with due consideration given to the reasonable impression conveyed to the person interrogated.” Com-monwealth v. Johnson, 615 Pa. 354, 374, 42 A.3d 1017, 1028 (2012); Commonwealth v. Busch, 713 A.2d 97, 99 (Pa. Super. 1998). It was explained in further detail in Stansbury “that the initial deter-mination of custody depends on the objective circumstances of the interrogation, not on the subjective views harbored by either the interrogating officers or the person being questioned.” Stansbury v. California, 511 U.S. 318, 322-23 (1994). In Commonwealth v. Baker, 24 A.3d 1006, 1019-20 (Pa. Super. 2011) citing Common-wealth v. Mannion, 725 A.2d 196, 200 (Pa. Super. 1999), the fol-lowing factors were identified to determine under the totality of the circumstances whether a detention has become so coercive to constitute the functional equivalent of an arrest:

[T]he basis for the detention; its length; its location; whether the suspect was transported against his or her will, how far, and why; whether restraints were used; whether the law enforcement officer showed, threatened or used force;

and the investigative methods employed to confirm or dispel suspicions.

Id.; see also, Commonwealth v. Williams, 941 A.2d 14, 31 (Pa. Super. 2008); see also, Commonwealth v. Watkins, 750 A.2d 308, 313 (Pa. Super. 2000).

Additionally, in Howes v. Fields, 132 S. Ct. 1181, 1189 (2012) it was similarly explained:

As used in our Miranda case law, ‘custody’ is a term of art that specifies circumstances that are thought generally to present a serious danger of coercion. In determining wheth-er a person is in custody in this sense, the initial step is to ascertain whether, in light of the objective circumstances of the interrogation a reasonable person [would] have felt he or she was not at liberty to terminate the interrogation and leave. And in order to determine how a suspect would have gauge[d] his freedom of movement, courts must examine all of the circumstances surrounding the interrogation. Relevant factors include the location of the questioning, its duration, state-ments made during the interview, the presence or absence of physical restraints during the questioning, and the release of the interviewee at the end of the questioning.

Id. (internal quotations and citations omitted).

Here, the juvenile was interviewed at the high school in the presence of his mother. He was not handcuffed or physically re-strained, and at the end of the interview, he was not transported to the state police barracks, but released into the custody of his mother. Trooper Godshalk did not treat the interview as a custo-dial interrogation because he did not provide the juvenile with the full panoply of Miranda warnings. It appears that his method of investigation was aimed at merely confirming what the juvenile had already admitted to Assistant Principal Allen.

None of the aforementioned factors support the conclusion that a custodial interrogation was conducted. One of the significant factors to be considered is the location of the interview. See Dupre, supra (interview conducted in a bedroom of an apartment was not a custodial interrogation); In the Interest of V.H., 788 A.2d 976,

981 (Pa. Super. 2001) (interview conducted in juvenile’s home preceded by the invitation and permission of parents was not cus-todial in nature). The interview with this juvenile was conducted in a high school setting, which is far less restrictive or intimidating than a police station. Any restriction on his freedom of movement was due to the actions of the school, not Trooper Godshalk. See K.A. ex rel. v. Abington Heights School District, 28 F. Supp. 3d 356, 366 (M.D. Pa. 2014) (school officials questioning of student regarding synthetic marijuana was for disciplinary reasons, rather than law enforcement purposes, and thus student was not entitled to Miranda warnings although school officials contacted police); State v. Schloegel, 769 N.W.2d 130 (Wis. Ct. App. 2009) (high school student, if in custody at all, was in custody of the school and not being detained by the police during drug investigation).

Any apprehension on the part of the juvenile due to being in the principal’s office was probably enhanced by his knowledge that his “designer” drugs were uncovered, and that his mother and a state trooper were on their way to the school. However, the ap-prehension associated with a state trooper’s presence would be assuaged by the arrival of his mother. Furthermore, it also gave the juvenile greater freedom to discontinue any interview, and depart the high school.

The totality of the circumstances demonstrate that the juve-nile was not subjected to a custodial interrogation by Trooper Godshalk. The juvenile’s apprehension concerning any disciplinary action by the school, familial punishment, or legal ramifications did not translate into a setting requiring Miranda warnings. “At a minimum, there must be some restriction on liberty beyond that inherent in the school setting, and of a nature likely to affect sub-stantially the student’s will to resist and compel him to speak where he otherwise would not do so, to trigger a finding of custody for Miranda purposes.” Id. (CAstille, J., dissenting) (emphasis added). “[I]t is the special nature of the school setting, and the necessity for the personnel therein to maintain good order and provide for the safety of all the students therein, and not the specific [identity] of the party conducting the search or the interrogation, which has powered this Court’s precedents in this area. Indeed, if it were the

identity of the interrogators that mattered, it would be difficult to explain the results in [prior cases] where the actual searches were conducted, not by school police, but by local police at the behest of school administrators.” Id. at 344.

For all the foregoing reasons, the motion to suppress the statements to Trooper Godshalk is denied.

Judge Richard E. Fehling was appointed as United States Bankruptcy Judge for the Eastern District of Pennsylvania on Valentine’s Day, February 14, 2006. Prior to his appointment, Judge Fehling had been an associate, shareholder, director, and General Counsel at Stevens & Lee, based in its Reading, Pennsylvania, office, for nearly 25 years. He had been Co-Chair of the Stevens & Lee Bankruptcy Group for 17 of those years. He has served as the Chair of the Pennsylvania Bar Association Bankruptcy Committee (1992-95), of the Berks County Bar Association Bankruptcy Committee (1993), and of the Eastern District of Pennsylvania Bankruptcy Conference (1996-97). Judge Fehling is a member of the ABI and is a life member of the American Bar Foundation. He received his B.A. from Yale University and his J.D., magna cum laude, from Dickinson School of Law, where he received the Walter Harrison Hitchler award for graduating first in his class. Judge Fehling has been a frequent lecturer in bankruptcy, financial distress, litigation, and ethics programs. He is a member of the Editorial Board and the Ethics Committee of the Pennsylvania Bar Association.

Has Your Client’s Trust Become Unworkable?: Trusts can go bad for many reasons. Some are problematic from the outset, such as trusts prepared by a trust-mill with no attention paid to the particular needs of the trust’s beneficiaries. Others may become defective over time, their stated purpose no longer matching the beneficiaries’ changing needs. Trust assets may have dwindled to the point that cost of maintaining the trust exceed its benefits. The trustee could be unsuitable, whether due to the trustee’s failure to respond to the legitimate need of the beneficiaries, investing the assets inappropriately, or becoming unable to handle the duties of trust administration.

Find Solutions for Trust-Related Problems: How can the PA Uniform Trust Act help fix these and other trust-related problems that estate and elder law attorneys frequently encounter? Learn about the judicial and non-judicial modification or termination of revocable and irrevocable trusts, the division of trusts, equitable deviation, identifying necessary parties and the representation of parties, decanting, the removal of trustees, and related income, gift, estate, and GST tax implications of using these techniques. “Natural Law Part One: The First Two Thousand Years”

We take it for granted that our laws can be criticized on moral grounds, i.e., that there are standards against which legal norms can be compared and sometimes found deficient. These standards have sometimes been described as, “a (the) higher law”. This higher law has also been called “natural law” from the time of the Ancient Greek and Roman writers through the present day. Natural law competes side by side with legal positivism (laws made by human beings) in our considerations of which laws are good and which ones are bad. What exactly does “natural” mean in the term “natural law”? 1. Derived from human nature? 2. Accessible by our natural faculties, i.e., reason? 3. Derived from the natural world in which we live? In this seminar we will see that natural law theorists often combine all three of these elements.

We will, in an admittedly cursory way, touch on the works of Sophocles, Plato, Aristotle, Cicero, Justinian, St. Augustine, St. Thomas Aquinas, Moses Maimonides, Francisco Suarez, Thomas Hobbes, Samuel von Pufendorf, John Locke and Sir William Blackstone. Our primary aim in this seminar will be to trace the development of natural law theory through the mid-18th century. In a later seminar (Part Two) which is scheduled for Wednesday, June 1, 2016, we will consider the works of natural law theorists of the past 250 years, and apply their theories to modern jurisprudence and legal issues.

Attorney John P. Servis is Chairman of the BALC Continuing Legal Education Committee. He has practiced law in Pennsylvania since 1988. John has a B.A. in classical language from Cornell University, a J.D. from American University, an LLM (Taxation) from Villanova University, and an M.A. in history from Lehigh University. He has practiced in both the private and public sectors, and served as solicitor to the Lehigh County Register of Wills for eight years. John recently began his 14th year of service on the Board of Trustees of the Lehigh County Historical Society. Having presented more than twenty-five seminars at the Bar Association of Lehigh County since 1999, John enjoys legal history, discovering origins of ideas and principles we now take for granted.
