Criminal Homicide—Robbery—Prima Facie Case— Pretrial Motions—Weight of Evidence.

The Court found that the Commonwealth presented direct and circumstantial evi-dence to establish a prima facie case of robbery, and therefore, denied the defendant’s pretrial Motion for Writ of Habeas Petition to Dismiss for Failure to Establish a Prima Facie Case of Robbery.

Steinberg, J., August 26, 2016. The defendant, Steven Dreis-bach, is charged with Criminal Homicide1 and Robbery.2 It is al-leged that he stabbed the victim, Cooper Wertman, to death. The victim suffered eighteen (18) stab wounds, including fifteen (15) wounds to the back region.3

On July 13, 2016, counsel for the defendant filed Omnibus Pretrial Motions, which included a “Motion for Writ of Habeas Petition to Dismiss for Failure to Establish a Prima Facie Case of Robbery.” A hearing on that motion was held on August 3, 2016, during which the Commonwealth introduced various exhibits, in-cluding the following: (1) the transcript from the preliminary hear-ing;4 (2) autopsy report;5 (3) photographs, including photographs of the crime scene, the victim, Cooper Wertman, the defendant, Steven Dreisbach, a knife, and clothing of the defendant with what appears to be blood;6 (4) Miranda Rights form;7 (5) log of text mes-sages between the defendant and Salvatore Tsounis.8

On February 9, 2016, Officer Bruce Bastian responded to 424 Chestnut Street, third floor, room 12, in the Borough of Em-maus, and observed the body of Cooper Wertman inside that room. upon his arrival, two people were performing CPR on Cooper Wertman. One of them directed Officer Bastian’s attention to a stab wound on the chest of Cooper Wertman.9 An autopsy later revealed eighteen (18) stab wounds, fifteen (15) of which were described in the autopsy report as “a group of 15 stab wounds about the posterior aspect of the lower chest and lumbar region.”10

The defendant, who was already in custody prior to Officer Bastian’s observations, was transported to the Emmaus Police Department, where a recorded interview was conducted. Prior to that interview, the defendant was advised of his Miranda rights and waived those rights.11 He admitted stabbing Cooper Wertman with a knife multiple times. He explained that he could not pay for the hashish that Cooper Wertman was providing, and decided to stab him instead of paying him. The defendant convinced Cooper Wertman to turn his back by deceiving him into believing that he was going to get money to pay for the hashish. Instead, he ap-proached Cooper Wertman from behind and repeatedly stabbed him.12

It was also learned that the defendant possessed an “iPhone,” and with the assistance of the Digital Forensic Lab, “learned [that] there was Facebook activity prior to the incident.”13 Some of the activity included “messages between Steven Dreisbach and Salva-tore Tsounis.”14 Mr. Tsounis testified that he interacted with the defendant through a “message service with Facebook ... called messenger.”15 On the date of the homicide, the defendant com-

municated with Mr. Tsounis in that manner, and proposed com-mitting a robbery “for $90 worth of hash.”16 A sample of the mes-sages, beginning at approximately 1:00 p.m., discloses the following:

Dreisbach to Tsounis (13:10 hours): ‘still want to help jump this kid for hear this a quarter pound of hash?’

D to T (19:50 hours): ‘if y’all do as planned there will be bigger amounts in the future I’ll bring y’all up to date with my organization.’

D to T (20:00:11 hours): ‘tonight is a quick 5 minute job.’

D to T (20:01:06 hours): ‘that’s why y’all should be here at 9 so o [sic] can show and tell y’all the positions and all.’

D to T (20:01:47 hours): ‘but y’all have the choice on how to get him on the ground I don’t give a fuck if y’all stab him lol.’

D to T (20:47:56 hours): ‘I’ll do it myself but if you hear about a dead Emmaus man just keep your mouth shut and delete the thread and tell him I’ll hook him up with what-ever he wants a bitch with no gag reflex.’

DISCuSSION

The defendant contends that the Commonwealth failed to establish a prima facie case of robbery. However, the evidence demonstrates that the defendant admitted he stabbed Cooper Wertman because he could not pay for the hashish he ordered. The search of his apartment uncovered no money to pay for the hashish. Finally, the messages between the defendant and Salvatore Tsounis convincingly demonstrate that he was planning the robbery prior to its execution.

At this stage of the proceedings, the Commonwealth is not required to establish the defendant’s guilt beyond a reasonable doubt. Commonwealth v. karetny, 583 Pa. 514, 529, 880 A.2d 505, 513-14 (2005); see also, Commonwealth v. Marti, 779 A.2d 1177 (Pa. Super. 2001). Instead, it is only required to present a prima

facie case that a crime has been committed and that the accused is the one who committed it. karetny, supra at 511, 880 A.2d at 524. It has been frequently explained:

[T]he Commonwealth must show [significant] probable cause that the defendant committed the offense, and the evidence should be such that if presented at trial, and ac-cepted as true, the judge would be warranted in allowing the case to go to the jury.

When deciding whether a prima facie case was estab-lished, ... the evidence [must be viewed] in the light most favorable to the Commonwealth, and ... all reasonable infer-ences based on that evidence which could support a guilty verdict [must be considered].

Commonwealth v. Barnes, 14 A.3d 128, 130 (Pa. Super. 2011), quoting Commonwealth v. James, 863 A.2d 1179, 1182 (Pa. Super. 2004) (en banc). See also, Marti, supra.

“A person is guilty of robbery if he inflicts serious bodily in-jury on another in the course of committing a theft.” 18 Pa. C.S. §3701(a)(1)(i). See also, Commonwealth v. Shank, 883 A.2d 658, 665-66 (Pa. Super. 2005); Commonwealth v. Carter, 377 Pa. Su-perior Ct. 93, 111-12, 546 A.2d 1173, 1182 (1988). “[T]he time of [the] formulation of intent to commit theft is crucial when he has also inflicted serious bodily injury upon his victim.” Id. Here, the defendant alerted Salvatore Tsounis to his intentions, and then robbed Mr. Wertman of his hashish and life. The defendant’s formulation of his intent to commit his theft coincided with his decision to harm Mr. Wertman.

Robbery requires the specific intent to deprive another of his property. Commonwealth v. Stewart, 377 Pa. Superior Ct. 530, 534, 547 A.2d 1189, 1191 (1988). “[F]elonious intent is one of the important elements of the crime of robbery.” Commonwealth v. Mays, 450 Pa. Superior Ct. 188, 199, 675 A.2d 724, 730 (1996). Here, the motive for the actions of the defendant was to deprive Cooper Wertman of his hashish. The Commonwealth presented direct and circumstantial evidence to establish a prima facie case of robbery.

The defendant’s argument that a prima facie case is negated because some of the common characteristics of a robbery were missing, i.e., “outturned pockets,” or that the victim’s “drugs” were still in the defendant’s apartment, is unconvincing. The robbery statute does not require features found in a mystery novel or even a completed theft. See Commonwealth v. Robinson, 936 A.2d 107, 110 (Pa. Super. 2007) (“A conviction for robbery does not require proof of a completed theft, it requires only that the requisite force was used ‘in the course of committing a theft,’ which is statutorily defined as ‘an attempt to commit theft … or in flight after the at-tempt or commission.’ ”).

The defendant is essentially making a weight of the evidence argument. The weight of the evidence is not a factor at this stage of the proceedings. Commonwealth v. Landis, 48 A.3d 432, 444 (Pa. Super. 2012).

For all the foregoing reasons, a prima facie case of Robbery was established and the defendant’s requested relief must be de-nied.

ORDER

AND NOW, this 26th day of August, 2016, upon consideration of the defendant’s “Motion for Writ of Habeas Corpus ... to Dismiss for Failure to Establish a Prima Facie Case of Robbery” filed on July 13, 2016, and after hearing held on August 3, 2016;

IT IS HEREBY ORDERED that said Motion is DENIED.

LEHIGH COUNTY LAWYER’S CHARITABLE FUND GRANT

The Bar Association of Lehigh County (“BALC”) has established a fund with the Lehigh Valley Community Foundation known as the Lehigh County Lawyer’s Charitable Fund. The Fund is made possible by the generosity of our members. On an annual basis, BALC awards grants of up to $5,000.00 each to selected Lehigh Valley 501(c)(3) organizations. Interested Lehigh Valley 501(c)(3) organizations are invited to submit a grant Application to BALC in accordance with the below Application Guidelines. 2016-2017 Theme is “School Programs in Need”. The committee will make a concerted effort to review applications from area nonprofits that benefit school programs especially those affected by recent budget cuts. This could be educational, arts, sports or extra curriculum programs. Please keep this in mind when preparing your application. Application Guidelines To apply for a Lehigh County Lawyer’s Charitable Fund Grant, Applicants must comply with each of the following:

1. Each Applicant must be a 501(c)(3) corporation in good standing, which maintains an active presence in the Lehigh Valley, and provides a product or service which benefits Lehigh Valley communities and/or residents.

2. Complete the attached Application and required narrative.

3. E-mail the completed Application and the narrative as a single file to the BALC Executive Director, Ray Bridgeman at: [email protected]. In the Subject Line reference: Application for Lehigh County Lawyer’s Charitable Fund Grant. Questions regarding the grant process should be directed to Mr. Bridgeman at (610) 433-6204, ext. 15.

4. Applications must be received by 5 p.m., October 31st. Applications not received by the deadline will not be considered.

Please note that: $5,000 USD is the maximum award (unless special

approval is received by the BALC Board of Directors). Smaller grant requests are encouraged.

The proposed use of Lehigh County Lawyer’s Charitable Funds must provide some clear benefit to the Lehigh Valley as a whole, its communities, and residents in the form of providing needed services, new knowledge, developing or sharing of resources, or good practice in learning, teaching, or assessment, or providing disaster relief.

Applicants not selected for grants are encouraged to submit an Application the following year.

Successful Applicants agree to provide to BALC, no later than July 1st of the year in which the grant is awarded, a brief written summary detailing how the Grant was utilized or will be utilized by the end of the calendar year, and authorizing BALC to post the summary on the BALC website.

Funds from the LCLC Fund Grant may not be used for: o Registration for, travel to, or accommodation at

conferences; o Internal staff training and development (although

this maybe a secondary outcome); and o Fundraising.

Process for Making Awards The BALC Community Services Committee will evaluate the Applications and make recommendations to the BALC Board of Directors on grant recipients. Final Approval will be decided by the BALC Board of Directors. All applications will be considered confidential. Grants will be awarded in the first quarter of the year following the Application deadline.

“Natural Law Part Two: The Last 350 Years” Presented by: John P. Servis, Esq.

In Part One we looked at thinkers from the 5th century B.C.E. through the 16th century who articulated and developed theories of natural law. In essence, we saw the argument that there are eternal, unchanging laws of human conduct that are of divine origin. Individuals and societies ought to feel compelled to follow these laws. Ignoring these laws would result in some type of eternal punishment.

In this seminar (Part 2) we will consider how natural law theory evolved in the early modern and modern eras. First, we will discuss how John Locke expanded previous notions of natural law into a natural rights theory. We will then look at the works of Sir William Blackstone, the preeminent commentator on English common law. His writings, ironically, influenced the American colonists in their rebellion against the Crown. In addition, we will examine the natural law arguments made by Gustav Radbruch, Mohandas K. Gandhi, Martin Luther King, Jr., John Finnis, Robert George and Jacqueline Laing. We will also examine the ideas of John Rawls and Ronald Dworkin, who identify circumstances under which civil disobedience of an unjust law is justified. Finally, we will try to identify natural law theories and arguments in the Supreme Court’s 2015 decision, Obergefell vs. Hodges, which held that the fourteenth Amendment requires states to license marriages of same sex couples and recognize same sex marriages from other states.

Attorney John Servis is Chairman of the BALC Continuing Legal Education Committee. He has practiced law in Pennsylvania since 1988. John has a B.A. in classical language from Cornell University, a J.D. from American University, an LLM (Taxation) from Villanova University, and an M.A. in history from Lehigh University. He has practiced in both the private and public sectors, and served as solicitor to the Lehigh County Register of Wills for eight years. John recently began his 14th year of service on the Board of Trustees of the Lehigh County Historical Society. Having presented more than thirty seminars at the Bar Association of Lehigh County since 1999, John enjoys legal history, discovering origins of ideas and principles we now take for granted, and examining change over time in areas of procedural and substantive law.

“Recent Family Law Topics” Presented by: Mr. Joseph Egler, CFA Thursday, September 29 2016

Join frequent guest speaker, Mr. Joe Egler, for a faced paced seminar on three topics geared toward the family law practitioner.

First, Joe will lead the discussion of the ‘Double Dip’ in alimony. The double dip - referring to the inclusion of business profits in the calculation of alimony. An evolving topic which is still controversial since case law in Pennsylvanian is minimal.

Second, Joe will then address personal good will in medical and dental practices. Personal goodwill reflects the impact of a renowned practitioner who draws patients based on personal reputation. The appraisal process assumes that the seller leaves the practice after the sale. There are several methodologies to correct for this impact of the practice that Joe will share with you.

And last but not least, Joe will talk about discounts related to minority and marketability of a business interest. Marketability and minority discounts are always important. This part of the discussion will address the factors that an appraiser uses to determine a reasonable discount. Since these discounts can be substantial, it is important that an attorney review the factors that affect these discounts.

Mr. Joseph Egler, is a Senior Financial Analyst at Value Management Inc. He is responsible for financial analysis, economic analysis, industry analysis and valuation of privately held companies. He has prepared appraisals of businesses for stockholder dissolution, estate tax, ESOP’s and marital dissolution. Mr. Egler specializes in the valuation of Executive Stock Options.

Mr. Egler is a Chartered Financial Analyst and has a Masters degree in Business Administration from La Salle University with a concentration in Finance. He also received a Bachelor of Arts degree in Biology from Temple University. Mr. Egler has completed Business Valuation Course I – III of the American Society of Appraisers. Member of the CFA and is a member of the Financial Analysts of Philadelphia. Mr. Egler has testified in numerous counties in Pennsylvania including Lehigh, Carbon, Monroe, Wayne and Pike Counties. In addition, he has written several articles on Business Valuation topics.

An Introduction to Wildlife Law and Policy” Presented by: Ms. Marissa Altmann

Wildlife law and policy encompasses a variety of state, federal, and international regulations related to animals in the wild and the trade and sale of their parts. With nearly 8,000 species worldwide threatened by extinction, many of these policies are being expanded and certain laws are becoming stricter. Examples include the recent federal limitations on the sale of ivory, and the listing of the Northern Long-eared Bat (found in Pennsylvania) under the Endangered Species Act. As we saw with the killing of Cecil the lion, issues relating to these wildlife laws can be emotional and confusing for those involved.

Learn how we know that a species is threatened, and what that means for state, federal, and international laws. Items covered will be the Endangered Species Act, the Lacey Act, and the Convention on International Trade in Endangered Species (CITES). You will learn how species are added or removed from these lists, what the penalties are for violating these regulations, and get some clear examples of recent violations of these laws. Ms. Altmann will also discuss why wildlife law matters for communities, businesses, and human health.

Marissa attended College of the Atlantic in scenic Bar Harbor, Maine. While earning a B.A. in Human Ecology, Marissa focused her studies in the realms of the environmental and zoological sciences, wildlife management, environmental law and policy, and interdisciplinary methods.

Following college, Marissa worked as a seasonal bat technician with the Biodiversity Research Institute before taking a position as an Urban Parks Conservation Corps Fellow with the New York City Department of Parks and Recreation. Marissa served as an Environmental Education Volunteer in the U.S. Peace Corps in Mexico

In 2015, Marissa worked as a Research Assistant for Johannah Bernstein, International Environmental Lawyer, in Switzerland. She helped Johanna to complete an evaluation of the UNEP Major Groups and Stakeholders program, and assisted on a variety of other initiatives.

“Under All is the Land” is the first sentence of the Realtor® Preamble to the Code of Ethics and Standards of Practice of the National Association of Realtors. Ray Geiger will present a discussion of the challenges and solutions to appraising land. Valuing land is the most ubiquitous heart of any appraisal – even for improved properties – where it is often overlooked.

Ray Geiger has been a real estate appraiser since 1978, specializing in the Lehigh Valley, and extending throughout eastern Pennsylvania for selective assignments. Since 1989, his practice has been devoted primarily to non-lending institution appraisal assignments that have covered the gamut of property types and legal issues and needs. He is a former President of the Allentown-Lehigh County Association of Realtors and Chairman of the Lehigh Valley Planning Commission. He continues to serve as a member of the Lehigh County Board of View since 1995.

Join Ray as he shares his trials and tribulations in the art and science of valuing the seemingly “simple” parcel of vacant land. Using local examples, he will discuss the impacts of so few comparative sales; ever changing market conditions; and the diversity among the terms of sale, rights conveyed, and motivations of the buyers and sellers. Discuss too, the relevance of land and site value in an improved property appraisal.

Learn, how understanding the importance of land and site value offers clues to the credibility of any appraisal report, and how those clues may assist you in judging its reliability.

Since 2004, ALERRT has trained over 85,000 law enforcement professionals nationwide in rapid response to terrorist acts, mass shootings, and other dangerous, active threat situations. For individuals who find themselves involved in such incidents, we’ve learned from sad experience that hiding and hoping isn’t a very effective strategy. The CRASE program was developed to give civilians a simple plan of action – Avoid, Deny, Defend -- designed to maximize their chances of surviving an active shooter event. The program will be taught by Emanuel Kapelsohn, Esq. (“Manny”), who is an attorney with Lesavoy Butz & Seitz LLC, and is a nationally-prominent law enforcement trainer and use of force consultant.
