In accordance with the provisions of House Rule 321(b) you are hereby notified that the Fall Meeting of the House of Delegates will be held at the Sheraton Harrisburg Hershey (phone 717-564-5511) in Harrisburg, Pennsylvania on Friday, November 17, 2017. Reservations can be made on-line or by calling the Reservations Department at 1-800-325-3535. Individuals should identify themselves as attending the PA Bar Association House of Delegates meeting to receive the group rate of $137 single or double occupancy, plus tax. GUIDELINES OF THE COMMITTEE ON CREDENTIALS AND ADMISSIONS REGARDING EXCUSED ABSENCES IN ACCORDANCE WITH HOUSE RULE 324

The Committee on Credentials and Admissions being cognizant of the Bylaws of the Pennsylvania Bar Association and the Rules of the House of Delegates, felt it appropriate at this time to advise the members of the House of the guidelines which the Committee utilizes in determining which absences from meetings of the House shall be excused as permitted by Rule 324 (c).

Rule 324(c) follows:

(c) A Zone Delegate who fails to register in person for a meeting of the House may request an excuse for such absence by filing a written request therefore with the Committee on Credentials and Admissions at any time before or within 30 days after the date of the opening session of the meeting of the House involved. The Committee shall act on all requests and give written notice of its action to the Delegates affected within 50 days after that date. A Delegate may appeal to the House a rejection of his or her request by filing an appeal with the Chair of the House within 30 days after such notice.

In establishing these guidelines, the committee considered the fact that the House of Delegates is the governing body for the Association, the membership in which is a matter of some prestige to the members of the Association. It is also considered that membership in the House is sought by many, but is limited by the Bylaws. Further, the Committee considered the importance of having the maximum number of active members of the Association participate in the deliberations and actions of the governing body.

Nevertheless, the Committee recognizes that the members of the governing body have other obligations also. They are practicing attorneys first. As such, they owe a duty to their clients as set forth in the Code of Professional Conduct, and also owe a duty to the courts before which they practice, as officers of those courts. In most instances they have families, with the attendant obligations and responsibilities. In many instances, they are active members of community and governmental bodies or organizations, thereby having important civic responsibilities.

By and large, the House of Delegates meets two times annually at meetings scheduled well in advance, in accordance with the Bylaws of the Association. Generally, the Annual Meeting is scheduled no less than twelve (12) months in advance, and the Midyear Meeting is scheduled approximately six (6) months in advance. The Committee believes that most lawyers have the ability to control their individual schedules to a great degree, with some exception.

Consequently, the Committee has devised the following guidelines for excused absences, which it applies to requests of the members of the House of Delegates when an excused absence from a meeting of the House is sought in accordance with the rules.

1. If the lawyer controls the scheduling of the conflicting matter, there shall be no excuse. a. It will be presumed that the lawyer controls all scheduling if he/she is not

in court.b. Exceptions to the presumption may apply if:

i. The lawyer is an associate of a firm in which the partners assigned the particular activity; or

ii. The activity is demanded by a major client of the lawyer and there is no practical way to reschedule; or

iii. The activity is a compelling matter which cannot be practically rescheduled.

2. There shall be no excuse for vacations, even when substantial, forfeitable, prepayments have been made.

3. Personal illnesses are excused, but consideration should be given to resignation if the illness is of long duration.

4. Personal family matters will be considered for excused absence only if the nature of the conflict is a one-time, uncontrolled activity such as the graduation of a child from college, death or illness in the immediate family, or some such compelling reason.

5. The burden is on the member for demonstrating that exceptional circumstances exist for which an excuse should be given. Requests for excused absence shall be made by letter addressed to the Committee on Credentials and Admissions. Among the excuses deemed insufficient are the following:

• “out of town”• “press of business”• “prior commitment”• “preparing for court”• “family matter”• “scheduled for depositions”• “urgent matters”• “continuing negotiations in a legal matter”

VOLUNTEER OPPORTUNITY: ATTORNEYS AND NOTARIES NEEDED

TO HELP OUR FIRST RESPONDERS AND VETERANS!

The Wills for Heroes Program seek Attorney Volunteers to participate in an event hosted by the Bar Association of Lehigh County to provide local First Responders and Veterans with Free Estate Planning Documents. WHERE: The Barristers Club, 1114 W Walnut Street, Allentown, PA 18102 WHEN: Saturday, November 4th, from 9AM-4PM WHAT: “Wills for Heroes” is a free service that provides wills, living wills, health care and financial powers of attorneys to first responders or veterans and their spouses, partners, and significant others. At the conclusion of the one-hour appointments with Lawyer Volunteers, first responders/veterans leave with a fully executed set of estate documents. WHY: First responders and Veterans selflessly devote their lives to serving our communities and country. Despite the inherently dangerous nature of their jobs, an overwhelmingly large number of these individuals – approximately 80-90% -- do not have wills. (This figure is based on experiential date from state and national first responder organizations). EVENT INFORMATION: We are seeking 12-15 lawyers, at least 4 notaries, and 8 witnesses (who do not need to be lawyers) for the event. Lawyer volunteers do not need to practice trust and estate law. We will conduct a one-hour refresher course the morning of the event to familiarize Lawyer Volunteers with what they need to know. In addition, we will conduct training on the computer-based program used to generate the estate documents. Lawyers who are well versed in estate planning will be available throughout the event to answer any questions that may arise. The event usually runs from 9AM -4PM with training from 9-11AM. Appointments begin at 11AM. If you previously participated in a Wills for Heroes Event and do not need the training, you should arrive at 10:30AM. Breakfast and lunch will be provided. About the Wills for Heroes Program Anthony Hayes, a South Carolina lawyer who wanted to do something meaningful to help the country after the September 11, 2001 terrorist attacks, founded the Wills for Heroes program. He met with South Carolina fire fighters and noted a glaring need for estate planning services. Daniel McKenna, a Philadelphia-based Ballard Spahr attorney and board member of the Wills for Heroes Foundation initiated the Wills for Heroes program in Pennsylvania. The Pennsylvania Bar Association Young Lawyers Division adopted the Wills for Heroes as one of its statewide service projects in spring 2009. In 2014, the Pennsylvania Bar Association expanded the program to include Veterans. Each first responder sits with a Lawyer Volunteer to review a questionnaire that the first responder has filled out in advance. The Lawyer Volunteer enters the information into a computer-based program and reviews the documents with the first responder to ensure accuracy. The documents are printed, signed, and notarized. Writ of Habeas Corpus—Prima Facie Case—Preliminary Hearing—Hearsay Evidence—Circumstantial Evidence.

The Commonwealth is not required to prove a defendant’s guilt beyond a reasonable doubt at the time of a preliminary hearing. The Commonwealth must present a prima facie case that a crime has been committed and that the defendant is the one who committed it. In doing so, the Commonwealth may rely upon hearsay and circumstantial evidence, and is entitled to all reasonable inferences which could support a prima facie case.

steinberg, J., September 7, 2017. The defendant, Robert Grey, along with a conspirator, Peter Baglio, is charged with the commission of eighteen (18) residential burglaries and related of-fenses in Lehigh, Northampton, Berks, Bucks and Luzerne Coun-ties.1 A preliminary hearing on those charges was held on May 17, 2017, before Magisterial District Judge daniel trexler, who at its conclusion determined that the Commonwealth had established a prima facie case, and the defendant was held for court.2

Counsel for the defendant filed an “Omnibus Pre-Trial Mo-tion” which included a “Writ of Habeas Corpus” on August 11, 2017. It is alleged that a prima facie case was not established at the preliminary hearing. On August 16, 2017, a hearing on that pre-

trial motion was held during which the Commonwealth introduced the transcript from the preliminary hearing, a DVD of a prison conversation intercepted on June 10, 2017, and brief testimony from the police prosecutor, Corporal Chris Yaworski.

The sole witness at the preliminary hearing was Corporal Ya-worski. He outlined the investigation, which was conducted with other police departments, and explained that these burglaries oc-curred “either late morning or early afternoon,”3 between December 5, 2016, and December 29, 2016. His investigation also concluded that the same methods were used to gain entry. He elaborated that jewelry and cash were the targeted items after entry was gained into the households.

The investigation eventually led to Mr. Baglio and his cell-phone, which was then downloaded. It was determined that at the time of the burglaries a phone number identified with the contact “Rob G” frequently communicated with the Baglio cellphone.4

Corporal Yaworski testified that at the time of the burglaries, “the phones were in the immediate area hitting off cell phone towers.”5 A court order was secured for the cell phone number associated with “Rob G” and it was registered to a “Mussaf Fuqua.”6 A Facebook account for Mussaf Fuqua depicted a black Cadillac CTS, which was observed at a local pawn shop where the defendant either sold jew-elry or was in the presence of Mr. Baglio when jewelry was sold.7

The DVD contains a conversation between the defendant and a woman which confirms that the defendant uses the name “Musa.” It does not, however, implicate the defendant in the burglaries. Instead, the defendant in that communication, alleges that he is a drug dealer, not a burglar.

DISCUSSION

The defendant contends that the Commonwealth’s evidence fails to establish a prima facie case with respect to the charges.

Commonwealth v. Hendricks, 927 A.2d 289, 290-91 (Pa. Super. 2007). At this stage of the proceedings, the Commonwealth is not required to establish the defendant’s guilt beyond a reasonable doubt. Commonwealth v. Saunders, 456 Pa. Superior Ct. 741, 691 A.2d 946 (1997). Instead, it is only required to present a prima facie case that a crime has been committed and that the accused is the one who committed it. Commonwealth v. Fountain, 811 A.2d 24, 25-26 (Pa. Super. 2002). It has been frequently explained:

The Commonwealth must show sufficient probable cause that the defendant committed the offense, and the evidence should be such that if presented at trial, and ac-cepted as true, the judge would be warranted in allowing the case to go to the jury. When deciding whether a prima facie case was established, [the evidence must be viewed] in the light most favorable to the Commonwealth, and ... all reason-able inferences based on that evidence which could support a guilty verdict [must be considered].

Commonwealth v. Barnes, 14 A.3d 128, 130 (Pa. Super. 2011) (quoting Commonwealth v. James, 863 A.2d 1179, 1182 (Pa. Super. 2004)) (en banc); see also, Commonwealth Cordoba, 902 A.2d 1280, 1285 (Pa. Super. 2006) (“In determining the presence or absence of a prima facie case, inferences reasonably drawn from the evidence of record that would support a verdict of guilty are to be given effect, but suspicion and conjecture are not evidence and are unacceptable as such.”); Commonwealth v. Weigle, 606 Pa. 234, 244, 997 A.2d 306, 311 (2010) (“A prima facie case exists ‘when the Commonwealth produces evidence of each of the mate-rial elements of the crime charged and establishes probable cause to warrant the belief that the accused committed the offense.’ ”); Commonwealth v. Marti, 779 A.2d 1177, 1180 (Pa. Super. 2001) (Prima facie standard requires evidence of the existence of each and every element of the crime charged.).

The Commonwealth, in meeting the prima facie threshold, may use hearsay evidence to establish any element of an offense at a preliminary hearing. Commonwealth v. Ricker, 120 A.3d 349 (Pa. Super. 2015), appeal granted, 635 Pa. 255, 135 A.3d 175 (2016); see also, Pa. R.Crim.P. 542(E). The use of hearsay does not run afoul of the constitutional right to confront witnesses either under

the Pennsylvania or United States Constitutions. However, the Commonwealth may not satisfy its burden by presenting the tes-timony “of a mouthpiece parroting multiple levels of rank hearsay.” Commonwealth v. McClelland, 165 A.3d 19, 32 (Pa. Super. 2017).

Here, the evidence presented by the Commonwealth at the preliminary hearing and the habeas corpus hearing truly tests the limits regarding the use of hearsay to establish a prima facie case. Although the courts have not applied “the law of evidence in its full rigor” at preliminary hearings, it is not a pro forma proceeding. “The principal function of a preliminary hearing is to protect an individual’s right against an unlawful arrest and detention.” Com-monwealth v. McBride, 528 Pa. 153, 157, 595 A.2d 589, 591 (1991).

A review of the testimony from the preliminary hearing shows a dearth of information. The testimony used to connect the defen-dant to the burglaries did not include any inculpatory statements made by him nor any statements implicating him by the cocon-spirator, Peter Baglio. No eyewitness testimony or scientific evi-dence, like fingerprints or DNA, was presented by the Common-wealth. Corporal Yaworski conceded that nothing presented at the preliminary hearing demonstrated that the defendant entered any of the properties.8

Moreover, the preliminary hearing left in doubt the charges the Commonwealth was pursuing. Throughout the preliminary hearing it was alleged that the defendant participated in seventeen (17) burglaries;9 however, when the Criminal Information was filed, the defendant was charged with eighteen (18) burglaries.

No testimony was presented at the preliminary hearing re-garding some of the burglaries, some addresses were incomplete, and some testimony was presented regarding burglaries not charged in the criminal information. For example, one burglary was alleged to have taken place at 8427 South Ridge Drive in Lower Macungie Township, but was only identified as “South Ridge Road in Lower Macungie Township.”10 Two burglaries are alleged in the criminal

information to have occurred on Hassadahl Road; namely, 5450 Hassadahl Road, and 7192 Hassadahl Road. The testimony at the preliminary hearing made reference to one burglary on Hassadahl Road without further clarification.11 Corporal Yaworski was also asked about burglaries in Berks County; namely, One Holly Lane in Mohnton, and Cocalico Road.12 However, the only burglary from Berks County listed in the criminal information occurred at 41 Pennwood Drive in Morgantown. No testimony regarding that burglary was presented at the preliminary hearing.

Although Pa. R.Crim.P. 542(E) does not require proof of ownership, the Commonwealth needs to at least identify the prop-erty and owner. Furthermore, Corporal Yaworski conceded that he did not have “firsthand communication” with all the victims, but “reviewed reports.”13

The testimony implicating the defendant in these burglaries can be characterized as follows: (1) the defendant’s presence with Peter Baglio on two (2) occasions when jewelry was sold at local pawn shops; (2) cellphone data from Peter Baglio’s cellphone in-dicating frequent communication with a “Rob G;” (3) “ping” in-formation demonstrating that a cell phone registered to “Mussaf Fuqua,” a name partially connected to the defendant, was in the vicinity of the burglaries and Peter Baglio’s cellphone; (4) a black Cadillac CTS, registered to an individual in Tunkhannock, Penn-sylvania, which may have been observed in the vicinity of some of the burglaries, and which was observed at a pawn shop where the defendant was selling jewelry. This vehicle was also observed at the defendant’s residence and seen on Facebook.

The initial gap in that evidence is that nothing was presented that the defendant knowingly participated in the sale of stolen jewelry from any of the burglaries. The Commonwealth contends that if the defendant was observed at the pawn shop with Peter Baglio, he must have been selling jewelry stolen in the burglaries. This is more suspicion or conjecture than a reasonable inference.

The cellphone data and “ping” information is also missing essential details. The testimony may authenticate the defendant’s ownership of the cellphone, but not his possession of the cellphone on the date of the burglaries. No testimony was presented placing any cellphone in the defendant’s hand on the date of any burglary. The evidence used to attempt to connect the defendant to the Cadillac is also flawed. No license plate information, “no registra-tion or state or tag,” and no description of the driver was secured by any witness.

The pieces of evidence in isolation fail to establish a prima facie case on any of the charges. However, evidence is not examined in isolation, but in conjunction with all the evidence presented at the preliminary hearing. Commonwealth v. Mitchell, 135 A.3d 1097, 1101 (Pa. Super. 2016) (citing Commonwealth v. Watley, 81 A.3d 108, 113 (Pa. Super. 2013)) (en banc) (The entirety of the evidence is reviewed in evaluating sufficiency challenges.). The evidence must also be viewed in the light most favorable to the Commonwealth, and they are entitled to all reasonable inferences which could support a prima facie case. Commonwealth v. Landis, 48 A.3d 432, 444 (Pa. Super. 2012). Moreover, the Commonwealth may sustain its burden by circumstantial evidence. Commonwealth v. Golphin, 161 A.3d 1009, 1018 (Pa. Super. 2017); Commonwealth v. Watley, 81 A.3d 108, 113 (Pa. Super 2013); Commonwealth v. Pedota, 64 A.3d 634, 635-36 (Pa. Super. 2013); Commonwealth v. Santiago, 980 A.2d 659, 662 (Pa. Super. 2009); Commonwealth v. Whitacre, 878 A.2d 96, 99-100 (Pa. Super. 2005).

The prima facie threshold is a low bar which the Common-wealth, with respect to some offenses, failed to clear and barely cleared with all the other offenses. The combination of “ping” information placing the defendant’s cellphone and that of his co-defendant’s in the vicinity of the burglaries, the observation of a car similar to one known to be operated by the defendant in prox-imity to some of the burgled residences, and his appearance with the co-defendant at pawn shops allows this case, in part, to proceed to trial.

On the other hand, the absence of evidence or lack of speci-ficity pertaining to certain residences burglarized also requires

dismissal of some of the charges. As a result, the following burglary charges must be dismissed:

(a) Count 6: 41 Pennwood Drive, Morgantown, Berks County;

(b) Counts 8 and 9: 7192 Hassadahl Road, South White-hall, Lehigh County, and 5450 Hassadahl Road, South White-hall, Lehigh County;

(c) Count 14: 461 Fourth Street, Plymouth Township, Lu-zerne County;

(d) Count 16: 3734 Christian Springs Road, Bethlehem Township, Northampton County;

The Commonwealth also failed to establish any of the Receiv-ing Stolen Property charges, Counts 19-33.

For all the foregoing reasons, the habeas motion is granted in part and denied in part.
