LONDON - EMI Recorded Music contin-ued its run as the most prolific majorlabel in offering legitimate digital music,after making available more than140,000 from 3,000 -plus acts for down-loading in Europe last week.

The April 23 initiative, which followsa similar move by EMI in the US lastNovember, enables more than 20 musicretail web sites in six European marketsto sell consumers music to download onPCs, burn to blank CDs, and transfer toportable devices such as MP3 players.

Following the allocation of a terrestrial FM frequency inStuttgart (see story, page 3), the German music industryis to have its very own laboratory in which to test new tal-ent-through Chart Radio, a project which brings togeth-er the country's official sales chart compiler Media Con-trol alongside Warner Music, Universal Music and BMG.

This is a logical step in an ongoing process. Recordcompanies have long complained that German radio pro-grammers play it too safe and are not willing to supportnew talent. Now, a radio station, albeit an experimentalone at this stage, has the opportunity to prove the radioestablishment wrong.

But the best of intentions can be deceptive. Ten yearsago the very same thinking was the reason most Germanrecord companies got together and launched music TVViva, only to discover a few years later that they had cre-ated a monster whose power totally outgrew them.

Broadcasters, especially those with a strong musiccontent, have a logic of their own. Their goal is to

attract an audience that either justifies the money gov-ernments pour into them-in the case of public broad-casters-or airtime that can be sold to advertisers, orsometimes both.

In any case, programming a radio station has to bedone via a fine balance between one's target audienceand its supposed tastes, and the musical repertoire avail-able. Simply force-feeding an audience unfamiliar newmusic is not the answer. Any programmer knows thatthere's a level of resistance to novelty and change, andthat to win an audience, packaging counts for a lot.

It is obvious that the radio industry in Germany will bemonitoring the situation in Stuttgart with much interest. Ifthe promoters of the project can prove that there's truly amarket for neW material, especiallyfrom domestic acts, this might create anew attitude within the radio commu-nity and consequently less resistanceto programming new talent.

But if they fail, this will merelyconfirm the "told -you -so" attitude andconservatism of many German radioprogrammers. This would be a realblow to the German music industryand to their artists.

LONDON - Satellite broadcaster BskyBhas launched three new music TV chan-nels to challenge MTV andEmap Performance's domi-nance of the UK music TVmarket with a pledge to sup-port new acts.

"We will support, and beseen to be supporting, newmusic," promises BskyB'shead of music TV LesterMordue (pictured).

Sky's three music chan-nels, which took to the air on April 17,are being defined by the lifestyles oftheir target demographic, rather thanby music genre. Scuzz, which airs mod-ern rock and nu -metal, has 16 -year -oldmales at the centre of its demographic,while 16 -year -old females are the coretarget of Flaunt, which blends crediblepop with dance and urban. The Amp,which has been working with Londonalternative rock station Xfm, is aimingat 20 -something males with a mix of

alternative and album -oriented rock.Mordue, a 12 -year MTV veteran, did,

a tour of the major record labels twoweeks prior to the channels' launch.

"Most of the labels said thesame thing as we did, thatmost of the [existing] chan-nels are playing the samesort of music at the moment,and there're very few areasthey can expand some oftheir acts. MTV are not verybig risk takers, althoughthey'll tell you they are. AndEmap is playing the same

songs across eight channels, and that'sreally killing music at the moment."

Record companies are initially posi-tive. "I've had few chances to see if it'sworking for us at this early stage, butthe range of channels and the addedchoice can only be a good thing," saysJacqui Quaife, director of TV promo-tions, BMG UK & Ireland. "You'realways going to have new acts thatcan't get played somewhere, and these[new channels] provide us with more

opportunities."Steve Morton, director of media at

Virgin Records UK, says: "What is clearis that with the proliferation of musicTV channels we as the record industryare going to have to look very carefullyet how we work with them. Perhapswe'll see a reduction in the timebetween delivering a video of a big actfrom six weeks to around three, so thevideo doesn't burn out well before thesong it's promoting is released."

With short lifestyle and music fea-tures sandwiched between each video,Sky's channels are occupying a spacebetween MTV's long -form program-ming and Emap's back-to-back videos."The channels are like magazines onair," says Mordue, who expresses sur-prise that Emap hasn't utilised itsprint magazine expertise to do some-thing similar. "Any old fool can launcha mainstream channel of back-to-backvideos-before I left MTV I put togeth-er TMF [UK] in two weeks. Although itwas well researched, it was so easy itwas almost painful."

Germany to finally incorporate Copyright Directiveby Olaf Furniss

HAMBURG - Germany will introducecopyright legislation in line with theEuropean Copyright Directive by thebeginning of July at the latest, afterthe ruling coalition and oppositionChristian Democrat party (CDU) inthe lower house (Bundestag), votedfor an amendment to the existingstatute. Subsequently it will be illegalto override copy -protection devices, aswill publishing or advertising code -breaking software.

Blighted by widescale CD burningactivity, the German record industryfeels many of the issues can now beresolved via the new laws. "The musicindustry welcomes the fact that thislong -overdue step has finally beentaken," says IFPI Germany president

Gerd Gebhardt. "As a result we will atleast have some of the changes recordcompanies so desperately need."

The amendment should pass theCDU-controlled upper house (Bun-desrat) as it enjoys the party's sup-port. Previously the Bundesrat hadsent the proposal back to the lowerhouse and the parliamentary legalcommittee, delaying any changes tothe existing law, which were supposedto be made by late December 2002 inaccordance with the European Copy-right Directive.

Yet Germany's record industryremains disappointed that otherloopholes remain open. It will still belegal, although not a "right", to makea "private" or personal copy of a CD,and it will not be illegal to own musicwhich has been illegally down-

loaded-so-called "data laundering."But burning when a copy -protectionsystem has been circumvented willbe against the law.

Former BMG Europe presidentand existing head of the company'sGSA division, Thomas Stein, has beenamong the more vocal critics of theGerman government's failure toimplement the Copyright Directive ontime. He criticises "data laundering"and believes that the failure to legis-late against it sends out the wrongsignal to consumers. "The new copy-right law unfortunately does not suc-ceed in properly closing all aspects ofexisting loopholes," he says.

The IFPI's Gebhardt vows that assoon as the current law is amended,the local industry will begin fightingfor its remaining goals.

COLOGNE - Chart Radio, theInternet radio enterprisejointly owned by music datacompiler Media Control plusmajor record companiesBMG, Warner Music and Uni-versal Music, has won an FMfrequency in Stuttgart whichwill allow it to test out newformats, artists and musicstyles on behalf of the recordindustry.

The new frequency, whichwill have a coverage of abouta million listeners, wasadvertised by the local licens-ing authority LfK specificallyfor an experimental stationdesigned to test new radiocontent and new methods offinancing radio.

According to Chart Radio

CEO Ulrike Altig, musicresearch techniques devel- oped at Chart Radio will beutilised at the new station-for example, listeners will beencouraged to phone in to acall centre or respond on theInternet to the tracks beingplayed. Chart Radio alreadyhas a call centre with 60trained interviewers.

She says that the yet -to -be -named station will probablybe financed partly by chargeslevied on the record compa-nies involved in the projectwho want to test out newmusic or formats. Radio sta-tions around Germany wouldalso be able to test out newtitles on the station. "There'sso much music which isn'theard on radio, and whichyou can only get in the

Altig says that a decisionhad yet to be made over themain daytime format of thestation, but "it would berecognisable: you can't gofrom nought to 100 just likethat." BRUSSELS - Appointed man-aging director on March 1,Radio 3000's Stephan Falk isdetermined to bring the com-pany's loss -making AC sta-tion Das Hitradio back intothe black after five years ofinvestor patience.

Falk co -launched the sta-tion as marketing manager in1998, a position he held untilhis promotion, replacing Har-ald Gehrung, who has left thecompany to become a directorat Radio FFN in Hanover.

Das Hitradio was foundedin 1998 by Radio 3000, aunique public/private part-nership comprising Belgianholding company BRF Media(51%) and Germany's RadioSalti (49%), part of french

group Lagardere Active RadioInternational. The stationbroadcasts to the so-called"Euregio" triangle which cov-ers the Belgian, German andDutch borders, offering analternative to the output ofBelgian German -languagepublic broadcaster BRF andGermany's commercial andpublic stations in the Nor-drhein-Westfalen area.

Falk says he is determinedto break even by the end ofthis year. "In addition to ouradvertising blocks per hour[two for regional advertising,and one for national advertis-ing], I believe that specialcampaigns and promotionswill be our main way ofachieving the objective."

Today, around 90% of thestation's audience is across

the German border, althoughDas Hitradio still has a grow-ing potential audience in Hol-land and in German-speakingBelgium, where the station'sstudios and 20KW transmit-ters are located in Eupen.

Falk claims that therecently -published CIM rat-ings figures for Belgium arenot relevant for Das Hitradio,because the CIM survey inthat part of Belgium mostlycovers the French-speakingaudiences of Wallonia. How-ever, he says that in Ger-many, where Das Hitradio issold to advertisers as part ofthe WDR "Europremium"package, "we are the leadingcommercial station in Nor-drhein-Westfalen, accordingto the recent [official MA Ger-man ratings] figures."

ZURICH - Swiss collection society Suisa has called for anairplay quota to be introduced forcing radio to programmelocal repertoire. In an interview on April 17 the organisa-tion's head of communications, Roy Oppenheim, com-plained that local repertoire's airplay share was currentlybelow 10% and advocated the introduction of a quota tostimulate demand for domestic music. Like a similar callfor newcomer productions in neighbouring Germany, themodel favoured in Switzerland would be limited to pub-licly funded broadcasters and would not extend to com-mercial stations.

DVDs help churnmusical archives

Music DVD had been wide-ly touted as the next bigthing for the music andvideo businesses, thecombination of pictures

and high quality sound seeminglyirresistible to the consumer.

Noting that the proud possessorsof DVD players and 5.1 surroundsound systems were not always in thefirst flush of youth, an unlikely trini-ty made up of broadcasters, musiccompanies and video distributorsformed, intent on mining their com-bined archives.

The record companies and thebroadcasters recognised that eachhad what the other needed, and fromthis marriage hoary old rock showsand the hoary old acts that appearedon them were reinvented as brands tokick start the market.

Possibly the biggest of these todate is the BBC's DVD compilationfrom its vintage rock show The OldGrey Whistle Test (OGWT). Actsranging from Little Feat to the NewYork Dolls, Edgar Winter and TheJam appeared during the pro-gramme's 16 -year period on air.

The first DVD has sold around50,000 copies on the back not just ofnostalgia but, as critics never fail topoint out, also because of the BBC'srelentless ability to cross -promote. Anentire television programme was

overcame Beefheart frontman DonVan Vliet's initial objections, convinc-ing him that it "would be a terribleshame if nobody was allowed to seethis classic piece of TV and of musicthat hasn't been seen since the pro-gramme went out."

She expresses a forceful disap-pointment at Cooder's reaction,relayed by his manager, but adds thatshe respected the wishes of thoseartists who had misgivings about thequality of their performance.

As to its appeal, she says that inaddition to the obvious nostalgiaamong 35 -plus fans, she is convincedthat there is a younger elementintrigued to discover just what it isthat their parents have been bangingon about for years.

"More people under 25 buy LedZeppelin and Jimi Hendrix than over25. While that may be because thelatter have already got them I'm sure

broadcast at the time of release topoint out the musical heritage of theshow and former presenters such as"whispering" Bob Harris, who nowworks for BBC Radio 2, acted aspotent reminders of the musical past.

The BBC is clearly intent on min-ing the OGWT archive further. Twomore DVDs are currently in produc-tion and, with thousands of hours offootage from the show available, theseries can run and run. It was, saysJill Sinclair, who produced the DVDfor the BBC, quite unlike any othermusic show.

"The programme is 30 years oldand most contracts from the '70s did-n't mention new or yet to be inventedformats, this was a time when therewas no VHS recorder, so we had to getin touch with all the artists to asktheir permission," she says.

That was quite a detective job, sheadds, especially where she had totrace relatives of now dead artists.Another major problem was "the factthat a lot of executives working forthe record companies nowadays don'tknow who these artists are".

Permission was also obtained

because of the "huge affection forOGWT from artists and their manage-ment. They all said they rememberedit as a fantastic show because it wasthe only place a lot of acts could beseen if they didn't have a Top 20 singleand could appear on Top of the Pops".

Recorded mostly on 2 -inch tape,Sinclair says that she has only seenone performance so far that shethought she could not use. "It wasPsycho Killer by Talking Heads and itwas so bad I thought it was unusablebut the guy in the editing suite justran it through his magic box [aDVSAC machine] and it was great."

OGWT was recorded as live and inmono. Sinclair says the BBC was nottempted to add a faux 5.1 surroundtrack. "We wanted to retain theintegrity of the programme," she says.

For those without the coordinatedpower of the BBC, things are a littlemore difficult, unless they have anequally powerful brand to market.EMI's upcoming Beatles Anthologyrelease (see review, p5) is that rarebeast in the music industry, a bandwith a global brand.

Expensively remastered at AbbeyRoad (where else?), the title has thepotential to act as a format breaker inthe way that Bond movies have in thefilm world.

Staying currentThat said, EMI's DVD executiveStefan Demetriou claims the compa-ny's emphasis is still mostly on cur-rent projects rather than delving intothe archive. "Obviously we have actsin the catalogue that we are lookingat," he says.

It should, however, be noted thatEMI Recorded Music chairman AlainLevy is rather more overtly keen onexploiting EMI's archive. He signedan archive footage deal last year withwebcaster Newsplayer to put EMI'smusic archive online.

French music DVD best-sell-ers include Garou's Live A Bercy, PinkFloyd's The Wall, Lara Fabian's Liveand hip hop collective Urban Peace,which all sold over 60,000 units.

In the UK, music DVD retail salesaccounted for 3.7% of the overall DVDmarket in 2002. Music video salesreached 4.7 million units, with 71%accounted for by DVDs, for a tradevalue of E 32.2 million (euros 46.3 m).

Universal Music, hesays, "definitely looks toinsert such material in ourDVDs, we used OGWTmaterial for The CompleteJam disc and The Policegreatest hits release (seereview, p5)."

Outside of the UK, headds that he is looking atmaterial from French showLes Enfants Du Rock,which is held by statearchive INA. Like many inthe video business, he con-cedes that using suchfootage often depends onovercoming some fairlyhairy ideas about what it isworth commercially."These archives often don'trealise that we are not sell-ing the kind of volumesthey think we are," hesays.

For most distributors,the use of archive musicfootage is more often thannot a documentary formatthan a musical one as canbe seen in the likes of EagleRock's Classic Albumseries, which benefitedfrom a strong run on TV.

side of broadcast wasunknown. The result is that themusic companies may own the songbut the broadcaster owns the footageand both sides have tended to positionthe elements at a massive premium totheir true worth.

One of the most difficult to dealwith is the BBC, according to indus-try insiders, who naturally did not

want to be named. "God,the BBC," says one. "Yougo to them wanting somefootage in perpetuityworldwide, they will onlygive you four to five yearsand at huge cost. Then ifyou agree, you get fiveyears down the line and aletter arrives from theirlawyers saying you nolonger have the rights.

"Then they have youby the balls, if you wantto carry on. You can try toedit their footage out butoften it's an integral partof the show or you justdelete the release, whichis often what you end updoing."

However, not every-body has found the BBCdifficult. Warner Visionhas had a major successwith 10 Years Of Later,its first trawl through thearchive performancesfrom former Squeeze key-board player JoolsHolland's late nightmusic show.

Warner Vision's SimonHeller says that the BBCwas a delight to dealwith, though he concedesthat the friendshipbetween Warner Visionpresident Ray Still andLater producer MarkCooper may havesmoothed the way.

Interestingly, WarnerVision is taking a differ-ent tack to the BBC in its

exploitation of the music show'sarchive. In many ways a successor toOGWT in giving more album -basedacts a presence on TV, Warner Visionhas decided to release themed productrather than a straight best of compila-tion like The Old Grey Whistle Test.

"We're going out with genre releas-es next," says Heller. "We've got Later

Louder (released May 5; see review,p4), Later Icons, Later Acoustic, andLater Hootenanney. I just think thatit presents a better deal to the con-sumer than a second attempt at a`Best Of'-that just smacks of 'notquite as good as the first of'."

Visual appealWhile Later is not as much of a brandas OGWT, Warner Vision has come upwith a rock brand to stand compari-son with The Beatles. The distributoris set to release a Led Zeppelin DVD(see review, p4) on May 26 with a run-ning time of some five hours and 20minutes that has taken around twoyears to put together. Stuffed withrarely seen archive footage, the dischas been put together in conjunctionwith the remaining members of theband and authored in 5.1 surround."We think this will set a benchmarkfor the music DVD and will open upthe whole genre," says Heller.

Universal also had a "brand" bandrelease on April 26 with the remas-tered 1990 film of Pink Floyd's TheWall Live in Berlin. Robert -Murphysays it too will be a groundbreakingDVD, having been remastered in 5.1surround sound by the show's originalsound engineer.

How far the appetite for nostalgiawill take the record industry is open todebate. Robert -Murphy, like others,argues that the DVD format is notgoing to save the record industry, but itwill certainly alleviate the pain-espe-cially, he adds, if the likes of MarcoBorsato continue to sell 130,000 discsin territories such as Holland.

Outside of such strong brands asOGWT, The Beatles and LedZeppelin, Robin Wilson, veteranmusic video executive at BMG,argues that music DVDs have to havean extremely strong visual appealbeyond simple archive footage.

Says Wilson, "There has to be anarresting visual element to a musicDVD. Bowie, The Cure, etc, have anappeal that is not just about theirsound."

Archives could be goldmine for DVD producersFor DVD producers looking to find archive material,there is good news in that a flood of pop nostalgia pro-gramming in countries such as the UK has prompted arush back to the archives for many broadcasters.

Shows such as Chrysalis TV's "I Love the 70s" haveprovided wonderfully cheap programming through theuse of recycled music clips and have built up a base ofexpertise about pop's visual history.

UK -based archive researcher Steve Bergson, who hasworked on a variety music quizzes on TV, says: "Popvideos have become key pieces of intellectual property.TV channels are constructed around them and companieslike UK -based Mission TV are building webcast andinteractive programming with current archive. DVD isalso clearly a huge potential market for this material.

"It's the BBC Radio 2 demographic, which is a prettypowerful one, as they have discovered," he adds. "Radio 2is really the Classic FM of rock music with its histories ofbands and genres."

Apart from the vast and well -used catalogues of com-panies like LA -based Dick Clark Productions, there aregems lurking in some surprising places. The BBC haslost much of its 1960's pop material but, as can be seenfrom Old Grey Whistle Test and Later, there is an embar-rassment of riches from the 1970's onwards.

"With some lateral thinking about the likely tourschedules of bands like The Doors or the Beach Boys, itis also possible to find archives such as that of SwedishTelevision (SVT). Here you can find gems from the likesof The Beatles, Supremes and Aretha Franklin," saysBergson.

Syndication agreements and overseas representationmeans that a catalogue like SVT's-which comes up todate with acts like U2-is available through specialistcompanies such as California -based Reelin' in the Years.

DVD producers in search of archive material are bestadvised to employ a specialist footage researcher, whocan save valuable time and effort searching for that elu-sive clip. Their knowledge-of sources such as London'sFilmfinders and the newsreels that often had wonderfulcameos from sometimes less obvious acts-is crucial.

"The problem is that in terms of using them creative-ly, finding gems is just the beginning," adds Bergson."Unlike much cinema ephemera, which can safely be con-sidered in the public domain and under the control of itscurrent owner, music is nearly always subject to so manythird party rights-the publisher and the performer forstarters. The user needs very specialist advice to stay outof trouble."

Spin takes on Dublin's piratesWith a licence to play all forms of credible newmusic from Alternative Rock to Urban, Dublin's Spin103.8 is aiming to win back all those who havebecome disillusioned with the "safe" music choicesof other stations in Ireland. Ann Scott reports.

YOU ASKED FOR ITRecently celebrating its firstyear on the air following itsApril 19 launch last year,Spin 103.8 has alreadymanaged to secure a

decent -sized chunk of the Irish cab-ital's fiercely contested radio mar-ket in its first official JNLR ratingsfigures released this February.

Measured over six months, fig-ures for Spin-which targets 15-34-year-olds-show that after eightmonths on air, the station recordeda 5% reach in the Dublin market,with a 10% reach among 15 -to -34 -year -olds, and a 16% reach among15 -to -24 -year -olds.

A total of 10 local and nationalstations now operate in the Dublinmarket, making it the most compet-itive radio environment in theRepublic. While public news/talkerRTE Radio 1 is still the dominantplayer with a 36% reach in Dublin,the music sector is hotly contestedby FM104 (CHR) and 98FM (HotAC), which both have a 20% reach,and public CHR station RTE 2FMat 17%.

However, Spin's programme con-troller Liam Thompson-previouslyresponsible for developing new tal-ent and new schedule elements at2FM-believes that a lot of listen-ing has been going the way of unau-thorised pirate stations. "There's anenormous problem with pirate radiostations in Ireland," he says."There are about 15 pirate stationsin Dublin alone, all taking a smallpiece [of listening] which disap-pears from the surveys and statis-tics."

It is these listeners, believesThompson, who provide the windowof opportunity for Spin in a marketwhere there are already several

established contemporary musicstations. "Where we found ourgrowth was bringing people backinto the legal radio fold. I think a lotof young people were disillusionedwith radio, generally fed up withwhat was on offer, downloadingmusic from the Internet and turn-ing to the pirate radio stations.There's a lot of that invisible compe-tition here but we'll keep a close eyeon it, and will continue to keepgrowing, taking listeners back frompirate radio."

The first rule of Spin's music pol-icy is that it plays nothing olderthan 2000. "Every station plays hitsfrom the '70s, '80s and '90s. Wedon't, and that gives us the space tobreak new acts," explainsThompson.

Spin divides its music into fourmain styles-dance, alternativerock, pop and urban, with thisbreaking down as roughly 35%dance, 35% urban, 15% rock and

moment," he says. "Even JenniferLopez's last album points verystrongly in an R&B direction.House is also still strong, but harddance has had its day and technowas never really big here. I would-n't say dance is dead-it's just got abit funkier."

The station's multi -genre"youth" format allows it to alsoplace cutting -edge rock tracks byacts such as The Strokes alongsideurban and dance tunes.

"If it fits we'll play it," enthusesThompson. "We have specialistshows covering different genres, butin daytime playlisting we also mix

the styles quite a bit. The playlist isdriven by melody, so once we havethe right feel we can mix the stylesand fit tracks together reasonablywell, maybe separating some songswith sweepers or ads. It gives a lotof tempo to the station. We also lookat album tracks, dance remixes ofsongs, even demos. If it's newmusic, once it's out there, we'll playit and play it."

Like most stations, Spin usesmusic scheduling software to pro-gramme the music, but, saysThompson, "you have to be carefulto go through it hour by hour tomake sure the fit is right and thefeel is right."

Spin adds between eight or 10new songs to its playlist each week.Typically, a song on the A list willair 44 times per week. This fairly

Spin's presenter line-up includesdance luminary Johnny Moy, MartyMiller (formerly of AC/talk TodayFM) and ex-FM104 jock Steve K.Also popular are Ray Foley,Clionadh O'Leary and Nikki Hayes.

While its distinctive music policyhas so far been Spin 103.8's biggestasset, this has been supported by a

Goldfrapp roll on with Train

Although something of a slow burner, thanks toa plethora of memorable tunes set to lusharrangements, Goldfrapp's first album FeltMountain (Mute) went on to shift more than500,000 copies and established them as a classicMute crossover act-fiercely individual musi-cians with undeniably great songs.

Where Felt Mountain was musically sophisti-cated, the new album Black Cherry-releasedon Mute on April 28-goes straight for the jugu-lar, with several tracks sporting a raunchy glamrock feel.

"I've always been drawn to the theatricalityand the fantasy singerAlison Goldfrapp (pictured) says. "And we[Alison Goldfrapp and song-writing/productionpartner Will Gregory] did want the new albumto be different. There have been a few corn-

ments about changing a winning formula butthe way we look at it is 'we make the rules so wecan break the rules'."

Doubters aside, reactions to this newGoldfrapp sound have been extremely positive.The lead single Train was serviced to radio andTV in early March. In Germany the single is onvarious playlists including the WDR LIVESounds of Tomorrow rotation (sevenplays/week) and Radio Eins. MTV Germany hasthe track on Active rotation (eight plays perweek).

"In France, Train has been serviced to allradio stations," says Donna Vergier, Mute inter-national director. "We are targetting specialistFM stations and AM stations such as(News/Talk) Europe1-they like the track," shesays. Vergier adds that that list also includesFrance Inter, RTL, Radio Nova, Oui Fm, LeMouv', Radio FG and Lastar radio network.

The video meanwhile has been made an MTVEurope priority with MTV Online running aGoldfrapp feature across 10 countries. Thisincludes an online exclusive Ewan Pearson Dubremix stream of the single, a stream of theTrain video plus artwork and a link to theband's official site. MTV France has alsoplaylisted the video for Train, airing it at leastten times a week.

The promo campaign started in January inthe US before moving on to cover key citiesacross Europe. Further trips are planned toZurich, Milan, Madrid and Portugal "withPhase One of the promotion running right in toPhase Two (TV/radio) around the single releaseon April 14," according to Vergier.

The European tour starts on May 5 inBruxelles with dates in France, Germany,Luxembourg and the UK to be followed by toursof the USA, Australia and Japan alongsideEuropean festivals this summer.

Mull Historical Society deliver moreby Steve Adams

Colin Maclntyre, aka Mull Historical Society, isclearly addicted to songwriting. At the last counthe'd written over 400 tunes.

The Scottish act's second long player Us-another platter of gently skewed pop in the samevein as its predecessor Loss-is a case in point.Released throughout Europe on a staggered basisthroughout March by Blanco Y Negro/WarnerMusic, it contains 13 songs from over 40 thatMaclntyre had worked up.

"I ended up recording between 30 and 35 ofthem, because I like to give them all a chance,"says the Scot, who hails from the island of his out-fit's moniker.

The album contains four bonus tracks that canonly be accessed via computer, and Maclntyreexpects another 10-15 to turn up as B-sides.

"It's good to have [extra tracks] for punters, andfor me it means getting more songs out there," headds. "All I want is for people to hear them."Listeners to Scottish CHR station Tay FM certain-ly got to hear the album's first single The FinalArrears. The station A -listed it from day one.

"The single was one of those that on first hearingit you just knew was a brilliant radio song-it wentstraight on to the A list," says Graeme Waggott,head of music at the Dundee -based station.

"I feel it's important that as a Scottish radio sta-tion we promote, where possible, Scottish talent.Although [the single] didn't perform as well as theymight have liked in the charts, it's still a greatradio tune and judging by the reaction we got from

the presenters and listeners,single might just do it."

Although The Final Arrears only caused minorripples in the rest of Europe, the follow up Am IWrong is released on May 26, and Maclntyre andhis four -piece backing band will be hoping to stokeup interest via a heavy touring schedule.

Having already breezed through the UK inMarch, the band embarked on a two-week US tour.They then went to Ireland where they performedin Dublin. While there, Cohn performed a live ses-sion for Today FM Radio. There will be more showsin May in the UK. European shows likely to follow,with the territories which are still to release thealbum, particularly Germany, basing their releaseplans around the those live appearances.

Cerys Matthewsretreats to country

Cerys Matthews' debut solo album Cookahoop(Blanco Y Negro/Warner Music) is as radical a rein-vention as we have heard from a high profile in a longtime. Gone is the chart -friendly Brit -pop of Welsh actCatatonia, the band she fronted for more than adecade. In its place comes a collection of folk andcountry -tinged songs in predominantly acoustic vein.

Released on May 21, it's an album that is set toestablish her as a mature artist with an across-the-board appeal. "We're distancing the record fromCatatonia," says Warner Music UK's marketingmanager at WEA/London, Danny Watson. "SomeCatatonia fans will get it, for sure. But it's a recordthat has to happen by itself. To market it with allguns blazing like a Catatonia release would bedetrimental."

Although Matthews says she simply wanted tomake "proper music in the old way", Warner has aspecific target alt -country audience in mind. "It willappeal to the same kind of people who bought RyanAdams' Heartbreaker," Watson says. "It's not aboutshipping a huge quantify at the start. Its about20,000 people getting into it and then it growingover the next six months by word of mouth."

The connection with Ryan Adams is in fact atangible one Cockahoop was produced by BuckyBaxter, who played guitar in Adams' band for twoyears. The first single, Only A Fool, will be releasedin June, to coincide with European tour dateswhich will be announced shortly. Warner also plansto enter the record for the Mercury Music Prize, theUK's major album award. The 12 -strong Mercuryshortlist will be announced in July.

For Matthews, the record represents a remark-able turn around. After a spell in a rehabilitationclinic two summers ago, she emerged to announcethat she was quitting Catatonia. Almost a yearlater in June 2002, she arrived in Nashville. "I'dalways wanted to come ever since I heard DollyParton when I was a kid," she says.

Matthews' original intention was an album oftraditional songs. But living in a cabin without run-ning water or electricity, she passed the time whileBaxter finished the studio he was building by writ-ing songs. In the end, seven of them feature onCockahoop, alongside a couple of traditional bal-lads and a cover of Weightless Again by alt -countrycult favourites, the Handsome Family.

Warner reports an overwhelmingly favourablereception at radio and among reviewers. "We haven'thad a single negative reaction," Watson says.

Matthews, who has now bought a house inTennessee, will play a showcase in Nashville onApril 29 for European radio and television. She isalso due to appear on BBC2 television's Later WithJools Holland on May 3.

Lyrically the track continues in thesame vein, while musically it is an intriguingmixture of electronica, R&B and pop, with amemorable, poppy hook. It is on the A -list atYLEX, the Helsinki -based national CHR sta-tion of Finnish public broadcaster YLE. "Thesong is a clever fusion of groovy, hip hop beatsand teenage pop attitude," says Heikki Hila-maa, head of music at YLEX, where the trackis getting around 25 spins a week. Italian Benny Benassi ascends to number oneon the post -Easter European Dance Traxxchart, as his Satisfaction (Energy) moves upto the top spot from number three last week.As with many Italian tracks, Satisfaction is ahigh-flier in France and, as well as beingnumber one in Hungary, is currently thebiggest -selling dance record in Germany andis making inroads in the Netherlands.

Taking up the space behind Benassi, afterjumping from number four to number two, isRoom 5's Make Luv (Noise Traxx), which isbased on Oliver Cheatham's '80's disconugget Get Down Saturday Night (MCA) andfeatures the veteran soul singer's vocals. Thetrack comes only four months after DJ Abdelfeat. Rohff & Oliver Cheatham's Get DownSamedi Soir (U.L.M.) peaked at number 152on the chart.

Three tracks enter the top ten this week.Master Blaster's How Old R U (Clubland)rockets from number 18 to number five, onlytwo months after the act's debut trackHypnotic Tango (Clubland) peaked at num-ber eight. The latter track is at number 26this issue, while the former is this week'sbiggest gainer. Meanwhile, signed jointly byDr Dre and Eminem, US rapper 50 Centjumps from 12 to number six on the chartwith In Da Club (Interscope). Sleeper InMetropolis 3000 (Gang Go) by Anne Clarkalso climbs the chart, from number 11 to ninethis week, after charting in GSA, Beneluxand Hungary.

There are eight new entries to the top 100this issue. The highest of them, at number 47,is Dana's Excuse Me (Q Dance/ID&T), basedsoley on chart entries in the Netherlands.Riding on the back of the current bhangracraze, five places below Dana we find Husanby Bhangra Knights Vs. Husan (Positiva).And at number 55 is another chart debut-DJ Bobo's Chihuahua (BMG).

Although outside the top 40, look out forBelgian Jessy's Look @ Me Now (Oceanic),which is the biggest gainer this week in termsof sales and stands at number 99 this week.

Robbie Williams is still number one on theEuropean Radio Top 50 chart with Come Undone(Chrysalis), while Avril Lavigne also retains herplace at number two with I'm With You (Arista).Meanwhile, Madonna swaps places withChristina Aguilera this week, with the MaterialGirl moving up one place to number two withher new single American Life (Maverick) andAguilera taking up the number four spot withBeautiful (RCA).

107.8 Arrow FM is a Hot AC station based inHastings on the English south coast. AndyKnight is head of music for both Arrow and sis-ter station 107.5 Sovereign Radio in Eastbourne.He says that Europe's current top four are all bigtracks on his stations too. "It took a couple of lis-tens but I think American Life is a great song-I really got into it-and we've been playingBeautiful for about three months now," he says.

While Simply Red's Sunrise (simplyred.com)swaps places with Coldplay's Clocks(Parlophone) (five and six respectively), the restof the top 20 is pretty stable with Celine Dion,Shania Twain, Jennifer Lopez, Counting Crowsand Sugababes all holding the same positions aslast week.

Further down, Justin Timberlake makes animpressive move up the chart, from number 41to 20 with Rock Your Body (Jive). Arrow has justadded the song, and it is the station's Hit ToHappen this week. Andy Knight is particularlyenthusiastic. "It's a fantastic song-I think itwill be Justin's first UK number one," he pre-dicts.

Make Luu (Positiva) by Room 5 featuringOliver Cheatham is another favourite at Arrowand has just made it on to the A list. Othertracks on the A list include Richard X vs LibertyX's Being Nobody (Virgin)-this week's number15, up one place on last week-and JuniorSenior's Move Your Body (Universal), down twoplaces to 33 on this week's chart.

Tracks which the station hasn't gone withinclude Shania Twain's new single Ka -Ching

(Universal), currentlyat number eight on thechart. It received somespot plays but nevermade it on to theplaylist. And the RedHot Chili Peppers's(pictured) new singleCan't Stop (Warner)also failed to make iton to the playlist.Although the stationdid play the act's last

single The Zephyr Song, the new track wasdeemed to edgy for Arrow's 25-54 demographic.

50 Cent's In Da Club (Interscope) movesinexorably up the playlists of many Europeanradio stations and is to be found at number 30this week, up four places. Also moving up fourplaces is Craig David featuring Sting with Rise& Fall (Telstar). Arrow is playing both the newsingle and David's last one Hidden Agenda,which drops two places this week (23 to 25).

Further down, Danni Minogue makes aneight -place leap from 49 to 41 with I Begin ToWonder on London Records.

Finally, look out for Gareth Gates enteringthe top 50 next week. He is currently hoveringjust outside the chart with his current singleAnyone Of Us (Stupid Mistake) (5).

To discourage their subscribers fromdownloading illegally, the retailers willuse online marketing to highlight newreleases the moment they're availablein digital format.

EMI's latest move means it hassigned more than 60 licence agreementswith third parties, including US sub-

scription -based ser-vices such as Music -Net, which it partlyowns, and Pressplay.

De Buretel believesthis European push isbigger and more var-ied than the similarmove EMI made withnine US retailers lastyear. "Initially, therewere technical prob-

lems [for digitisation] because Europewasn't as ready as the US," he says."But we implemented parallel newskills and people in each [EMI] countryvery fast, and we've all our territoriespushing as many titles as possible. It'sthe only way to compete with [online]piracy."

Fergal Gara, EMI ContinentalEurope's VP of digital media, says thecompany intends to keep up themomentum. "We're not stopping here.It's one thing to achieve the launch,it's another to make sure the processcontinues."

The participating retailers are usingthe digital platform supplied by UK dig-ital service provider OD2, which digitis-es the songs licensed by the labels andoperates the back technology for itsretail clients selling the music via theirbranded Web sites.

"As a proportion, EMI easily has thelargest share of the (digitised) songs wecurrently have, while the remainder isequally shared among Universal, BMGand Warner," says Paul Smith, OD2'sUK managing director. He expects SonyMusic Entertainment Europe to comeon board soon.

Online music analyst 'Mark Mulli-gan welcomes EMI's latest initiativebut argues that OD2 has been instru-mental in enabling the major labels togrow Europe's legitimate digital -musicsector. "OD2 has ended up as the onlysignificant player by default and I thinkit'll remain the only player for a longtime, for the market is still not matureenough for the labels to have done thison their own," he says.

UK's Jazz FM's not -so -smooth moveby Jon Heasman

LONDON - UK regulator the RadioAuthority says it is in "ongoing talks"with Jazz FM followingcomplaints from listen-ers concerning thebrand's musical direc-tion under its new own-ers GMG Radio.

Under GMG's man-agement, Jazz FM-which has regional FMstations in Greater Lon-don and Manchester(covering north-westEngland) and is alsoavailable nationally viathe Freeview TV plat-form-has increased theamount of traditionaljazz airing during off-peak hours (M&M, December 28,2002).

But more recently it has alsomoved the station's core daytimemusic format away from its previousUS -inspired "smooth jazz" policy infavour of a music mix that includesmore soul, pop jazz and jazz stan-dards. Songs being aired by the sta-tion in recent days include SimplyRed's Sunrise, Craig David feat.Sting's Rise And Fall and Nelly Fur-tado's I'm Like A Bird.

"The more time we've spent work-ing [at Jazz FM] and done ourresearch there, it appears the smoothjazz thing has had its day," explainsGMG's group programme directorJohn Simons (pictured). "It peaked acouple of years ago and has since spi-ralled down into oblivion. Even theUS is leaning away from it now."

Simons describes the currentchanges, which are backed by an

extensive marketing campaign fea-turing images of Stevie Wonder, Sadeand Ella Fitzgerald, as "trying to playmore music that people are familiar

with, so they recognisewhat they hear whenthey tune in, ratherthan hearing a blandinstrumental."

New shows intro-duced to the Jazz FMschedule recently in-clude a late night week-day soul show withTony Blackburn, and anew Saturday morningjazz chart show withPaul Gambaccini.

Given that "to a lot ofjazz people smooth jazzisn't jazz," Simonsclaims that GMG has

actually increased the amount of jazzmusic being aired on Jazz FM. "We'renot playing very much more soul thanwas being played [under] the previousmanagement," he says. "What we'vedone is swap a lot of the [smooth jazz]instrumentals for jazz standards likeNina Simone, Ella Fitzgerald, FrankSinatra and Tony Bennett."

The Radio Authority (RA)'s headof programming and advertising,Martin Campbell, reports: `We'vecertainly had a lot of people queryingthe current direction of the station.We are talking to the station [aboutthese concerns], and they are ongoingtalks." He points out, however, thatthis is not an unusual scenario forthe RA. "Whenever there's atakeover, particularly with a special-ist station, it's prudent we think totalk to the new people there aboutwhat sort of direction they see thestation taking."

Campbell emphasises that "the[Jazz FM] format has alwaysdemanded as much soul as jazz-even the original Jazz FM [licence]application didn't propose wall-to-wall jazz, it's just that a lot of peoplethink that's what it ought to be.Putting an emphasis on soul duringthe day and jazz at night is not neces-sarily something that breaches theformat."

Jazz FM's existing written formatagreement with the RA requires that"at least half the music during day-time must sit well with the label`jazz'." It says the rest of the station'smusic output can be drawn from thegenres of soul, blues and R&B. Thereis also an obligation to run a certainnumber of specialist shows.

Says Simons: "We've bought inmore pure jazz, but it's all open inter-pretation, and that's part of the diffi-culty of programming this format-it's so difficult to keep the more vocalparts of that audience happy. Butwe're programming it to the formatthe Radio Authority has laid down."

Indeed, the artist is doing promoafter the release of the album, giving"people a chance to appreciate themusic before she comes over", saysMcGhie.

The album American Life wasreleased on April 22 and was pre-ceded by the single of the samename, which was made availablefor download on the same day itwent to radio. The single, a slice ofpop electronica featuring a rap byMadonna, was released commercial-ly on April 14.

It currently stands at number twoon the Eurochart Hot 100 Singlesand at number two on the EuropeanRadio Top 50 chart.

"She is still Madonna and she hasthe knack of being popular underwhatever guise she takes on," saysDavid Harber, MD and programmecontroller at local UK south coastDance station Juice 107.2Brighton."It's going to maybe take a little bitlonger with this because she is going

a little bit leftfield. It may take a lit-tle more time for it to break throughand for everyone to accept it."

MTV Online premiered the albumin the US days before the officialrelease date, with Europe using var-ious online partners, with the UK,Germany and France using AOLMusic.

Madonna will be in Europe fromApril 28 for around 20 days for a mix-ture of high -profile TV appearancesand special events, although "it's stillto be 100% confirmed where she isgoing and in what order," saysMcGhie. No live performances areplanned. Promotion has been furthercomplicated by the fact that the "con-troversial" video for American Lifewas pulled by Madonna after beingshown for just one day (March 30)."The styling was military chic, cam-ouflaged clothes, etc. In the light ofthe subsequent war in Iraq, it wasdeemed inappropriate," says McGhie.

This absence made the running ofTV ads for the album more of a chal-lenge. Yet because the artwork forthe single and album is very similar"you can just run spots that just sayMadonna American Life," saysMcGhie.

The single is fairly representa-tive of the whole album, with its mixof stripped -down production andelectronic sound. All the songs onthe album were written by Madon-na-with three co -written with Mir-wais Ahmadzai, the French -Afghanwriter/producer with whom sheworked on her last album, Music.The new album was produced byMadonna and Mirwais.

"She tends not to use people whoother people are working with," saysMcGhie. "She wouldn't work withTimberland or The Neptunes. So itnever sounds like anything elsethat's around. You can't say it's an`electronic Britney' or it's like a`rockier Christina Aguilera'. You areforced to have an opinion just on themusic."

The uptempo, poppy Hollywood isas commercial as American Life anduses the combination of acoustic gui-tar and electronica featured else-where on the album. A bleepy,upbeat number Nobody Knows Me iscloser to the French electronicasound than any other cut on the set.There are also slower, more reflec-tive tracks on the album, such as X -Static Process and Intervention.

Nina Simone (1933-2003)PARIS - Jazz singer Nina Simone-known as one of the great femalevocalists of the 20th century-diedat her home in the south of Franceat the age of 70 last week (April 21).

Born Eunice Wymon in NorthCarolina in 1933 and one of eightchildren, she studied piano at Juil-liard School of Music in New York.

Her first album, 1959's My BabyJust Cares For Me (Bethlehem) yield-ed, apart from the title track, heremotional recording of George Gersh-win's I Loves You Porgy, a US Bill-board top 20 pop chart hit that year. She recordedand released Don't Let Me Be Misunderstood in1961 and in 1963 signed to Philips, producingseven classic albums for the label, before movingon to RCA.

In the '60s, her music expressed her feelings as a

black woman fighting for civil rights.After the death of four children in abombing of a black church in Alabamain 1963, Simone recorded her bitteranti -racist song Mississippi Goddam.Other politically -motivated songs of thatera she recorded included Kurt Weill'sPirate Jenny and Old Jim Crow.

In true jazz tradition, Simone craft-ed her own versions of other people'ssongs-such as Screamin' Jay Haw-kins' I Put A Spell On You and the BeeGees' To Love Somebody.

In 1987 My Baby Just Cares ForMe became a hit all over again after. the trackwas featured in a TV commercial for Chanel.

Simone had a reputation for being a tempera-mental artist and would often miss concerts orfight with audiences, yet she was consistentlyrevered and imitated by other singers.

Italy's radio trade association, the RadioNazionali Associate (RNA), which representsmost of the country's national radio networks, isreeling following a decision by four of its 13 mem-bers to quit the body. The four in question are allbased in Milan and are CHR network Radio 105and its AC sister, Radio Montecarlo-bothowned by the Hazan family's Finelco group-Lorenzo Suraci's RTL 102.5 Hit Radio and Radio101. Although refusing to comment as M&M wentto press, the disagreement is believed to be overthe future direction of digital radio in Italy. The"rebels" are expected to form a new organisation,which will be open to some of the networks whichstayed out of the RNA. RNA president, EduardoMontefusco, is the owner of the Rome -based CHRnetwork, Radio Dimensione Suono.

As another European country-Germany-signs up to the European Copyright Directive(see story, page 3) in an effort to stifle its musicpiracy problem, across the Atlantic US labels bodythe RIAA was slapping billion -dollar lawsuits onthree students at the University of Marylandwho'd set up a file -sharing network on the campus.As another Maryland student-who took down hisown file -sharing site rather than face the wrath ofthe US music industry-wailed to the New YorkTimes: "Who wants to face a $98 billion debt forthe rest of their lives?" The RIAA's "no quarter"approach appears to be working...

Further to BMG Entertainment's global mar-keting announcement (see story, front page),expect to see the UK company revitalise the hith-erto dormant Indolent imprint. Hotline under-stands that it'll be a frontline label with a wide-ranging A&R policy, operated in a joint venturewith BMG's publishing arm in the UK.

You just can't keep a good man down, can you?Konrad Hilbers, Napster CEO, has re-emergedas the new CEO of Germany's Home ShoppingEurope TV channels.

EMI Recorded Music chairman and CEOMain Levy was in Paris on April 23 to meet min-ister of culture Jean -Jacques Aillagon, as partof a series of meetings he's had in various coun-tries with government officials to talk about indus-try issues. Hotline hears that the ministerexpressed his satisfaction of seeing a Frenchmanat the helm of a major-albeit a UK one-with areal European focus, unlike Universal which,despite being French -owned, is considered by Ail-lagon to be managed by the US.
