Under the changes, BMG has replaced the European, Latin and Asia regional offices with four operational divi- sions-Office of the Chairman, Label Group, Territory Man- agement, and Corporate Center-all of which directly report to the Office of the Chairman, led by BMG chairman/CEO Rolf Schmidt -Holtz (pictured). A BMG spokesman in New York tells M&M: "The regional system worked dur- ing its time, but we want to take the next step. We are creating smaller regional groups, getting managers with A&R backgrounds and experience." The spokesman refused to discuss potential job losses but confirmed that the new -look BMG would reduce bureaucracy and "lighten overheads". The regional structure which has long -dominated BMG's way of thinking is the legacy of former president/CEO Strauss Zel- nick and chairman Michael Dornemann, both of whom left the company in 2000 " after clashing with then-Bertelsmann chair- man/CEO Thomas Middelhoff over BMG's strategic direction. In EMI's Robbie Williams the music industry has a newspokesman, although the jury is out as to whether it's agood or bad thing.

Williams, like many of us, went to the French Rivieralast week for Midem and delivered one of his trademarksnappy one-liners; he found piracy "great". There was"nothing no one can do about it".

That Europe's most popular artist says he finds piracycool should be no surprise-he is in sync with his fans,even if, luckily for him, many of them continue to buy hisrecords. He might find it less cool, argued a few people inCannes, when his royalty cheques start shrinking.

By adding that record companies "don't know what todo about [piracy]," Williams asked for a rebuke, whichduly came from several sources. IFPI chairman JayBerman, who delivered Midem's keynote speech the dayafter Robbie's outburst, easily played "the responsible"figure against Robbie "the irresponsible" (after all, that'swhat is expected from artists, right?). Berman appearedupset, but secretly could not have wished for a betterscenario.

Williams gave him a wonderful platform from which tooutline the dangers of physical piracy-linked to organ-ised crime-and online piracy, affecting everyone in thefood chain, save for telcos and ISPs.

Berman's point-also mentioned by RIAAchairman/CEO Hilary Rosen in her MidemNet keynotespeech-was that law enforcement and proper legislationis one thing, but it's by offering proper online alternativesthat the industry will win back consumers.

Such views would have carried more weight if indeedconsumers, especially in Europe, had seen a difference in2002, but aside from a few services such as OD2, Vita-minic or Wippit, there's still far more on offer for free. Andlittle can be expected in 2003 from Pressplay and Music-

Net, with both services focusing on the US market.What came across at Midem was the notion that to

woo consumers back, labels mustoffer something extra. This wasexemplified by the presentation ofMicrosoft's new Windows Media,which allows through DRM systemsto select-and limit-which applica-tions consumers can access from aCD. A way forward yes, but not theonly way, hopefully; after all, whoreally wants a Microsoft -dominatedmarket?

Italian radio lobbys against airplay quotasby Mark Worden

MILAN - Italy's commercial radiogroups have stated their outright oppo-sition to any plans by the Italian gov-ernment to introduce air-play quotas which wouldforce them to devote 50%of their musical output tolocal repertoire.

As the Italian parlia-ment's Culture Committeecontinues to examineassorted legislative pro-posals in connection withthe country's long-awaitedMusic Bill (M&M, Novem-ber 16), preliminary draftsof the Bill- designed to give help to thecountry's troubled music industry-include such measures as tax incentivesand establishing a French -style export

office, as well as the 50% airplay quotaproposal. The country's record industryis prepared to accept a 40% quota,according to Enzo Mazza (pictured),director general of local labels' organisa-

tion FIMI, but this mustbe for new, rather thanestablished, domesticartists. "Establishednames like Vasco Rossidon't need support, butyoung artists definitelyneed more airplay," saysMazza.

The three radio lobbygroups-RNA, represent-ing the national networks,and two organisations rep-

resenting local stations, FRT and Aer-anti-Corallo-made their cases in ajoint presentation to the parliamentaryCulture Committee on January 9.

In a document which the lobbygroups claim represents the views ofItaly's "1200 radio stations and 14national networks, which serve 36 mil-lion daily listeners and employ 15,000people" it was stated that 15% of Italy'sradio stations already play exclusivelyItalian music, while the national net-works play an average of 37.7% Italianmusic. The report says the average fig-ure for local stations is 44%.

The Culture Committee, under thepresidency of Ferdinando Adornato ofthe ruling Forza Italia party, has yet todraft the final Bill, although Adornatorecently assured FIMI representativesthat it would be presented "by March."The proposal for a 50% airplay quotaforms part of a proposal made byGuglielmo Rositani of the nationalistAlleanza Nazionale party, a partner inthe Berlusconi coalition government.

Critics create new %credible' Danish music awardby Charles Ferro

COPENHAGEN - Describing last year'sDanish Music Awards (DMAs), as "com-mercial, predictable and self-serving," agroup of 15 leading Danish music crit-ics collectively known as FDM havebonded together to create a new musicaward, Steppeulven, as an alternativeto the established accolades.

"We don't care if the artist has soldfive hundred or five million records,"notes Klaus Lynggaard, a music criticat broadsheet newspaper Information."We have decided to create an awardbased on credibility and originality."

Industry reaction to the rebelawards has been surprisingly positive."We welcome it with open arms asanother window of opportunity with itsown merits," says Ole Mortensen (pic-tured), international exploitation direc-tor at EMI Denmark.

Urban act Mmlk de Kojn (BMG)have received six nominations in the 10categories, followed by Outlandish(BMG), Saybia (EMI/Medley) andUnder Byen (Pladeselskabet).

Umbrella labour organisation LO ishelping fund the event, and will give a

grant of euros 6,666 to thewinner of the Hopeful ofthe Year award. The acttaking that prize will alsobe guaranteed a slot atthis year's Roskilde Festi-val.

"It's positive there'seven more focus on music,and I like-just as it is inthe world of cinema-theidea that there's an alter-native to the majorawards," says IFPI Den-

mark marketing director AnnetteTingstrup, who oversees the DMAs."One element of the critics awards Ireally like is the prize for 'best idea' inmusic. It can pertain to radio, manage-ment, the web, a label or anything to dowith music. It's an idea that wouldn'tfit into the DMA format."

YLE defends new -look stationsby Jonathan Mander

HELSINKI - Finnish publicbroadcaster YLE has beenresponding to criticism thatits new bouquet of nationalstations, which debuted onJanuary 13, are too similar toservices already provided byits commercial radio rivals.

Pointing out YLE's obliga-tion as a state -funded broad-caster to provide an alterna-tive to commercial radio for-mats, the commercial stations have been accusing newHot AC station YLE Q (whichhas replaced Radio Aino) andCHR station YLE X (whichhas replaced Radiomafia) ofbeing direct competitors tocommercial stations such asAC outlet Radio Nova andCHR stations Kiss FM andNRJ Finland.

YLE dismisses the accu-sations made by the com-mercial sector, and is urgingcritics to listen to its newstations properly for longerperiods of time. "Anyone

who takes time to properlylisten to our programmingwill notice that our stationsare not clones of Kiss orNRJ," says YLE's director ofprogramming Heikki Pelto-nen (pictured). "Of course[YLE X and YLE Q] playsome of the same music asthe commercial stations,but the biggest difference isin how all the other thingsare done."

Perhaps bearing out Pelto-nen's theory, Kiss FM's initialviews on the new YLE X have

softened after a week ofintensive listening to the sta-tion, according to program-ming director Pasi Piipponen."I expected them to movemore clearly onto our turf,but YLE X is playing morerock and is primarily target-ed both at male and moreteen -oriented audiences."

Petri Paarnio, pro-gramme director of commer-cial domestic repertoire sta-tion Radio Suomipop, adds:"In commercial radio we'reamazed that YLE can affordto just throw away a strongbrand like Radiomafia."

YLE has received anabundance of feedback dur-ing the first week of its newservices, much of it from lis-teners who are missing theirfavourite programmes. "Theamount of feedback we'vereceived is positive in that itreveals people really careabout what we do," says Pel-tonen. "Unfortunately spon-taneous reactions are oftenmore likely to be negative."

The Gala World Event: as a pre -cursor to a major "planetary" charity concert in Paristhis September, the Midem trade fair in Cannes hosted an evening featuring some ofthe 20 internationally renowned artists who feature on the up -coming Gala album,the brainchild of French musician/composer Alan Simon released on March 21 in aidof financing environmental education around the world. BRUSSELS - The musicindustry was given amuch -needed boost in itsfight against piracy lastweek (January 20) whennew rules to tackle theincreasing waves of coun-terfeit goods entering theEuropean Union wereunveiled.

Under the proposals,customs officials will begiven more power to stopthe flow of counterfeitgoods, the range of goodsthat can be seized will beextended, and officials willbe given the authority toconduct more extensivesearches of travellers' bags.

Procedures will be

streamlined to make it eas-ier and cheaper for compa-nies to ask customs to seizeand destroy counterfeitproducts, without havingto await the outcome ofsubstantive legal proceed-ings that could take years.

The proposal suggestsgranting customs officialsthe right to open investiga-tions and to improve data -sharing between industryand governments about thetrade in fake products thatmanufacturers. It alsoimproves the quality ofinformation provided tocustoms by right holdersapplying for action. Theperiod of validity and theform of applications foraction would also be har-

monised, and applicantsencouraged to lodge themby computer.

Robert Verrue, the EC'sdirector general for tax andcustoms matters, admitsthat counterfeiting haschanged much in recentyears, both in scale andscope. "Piracy as a phenom-enon has been underesti-mated for years, andenforcement mechanismshave been underdevel-oped," he says. The trade inpirated CDs alone is esti-mated at between four andfive billion a year, he adds.

The new rules are likelyto come into force nextyear, once approved by theEuropean Parliament andnational governments.

According to expected market figures for thefinal quarter of 2002, local IFPI affiliate AFP reportedthat sales of Portuguese music had increased, thanks toseveral quality albums launched in 2002 being wellreceived by the public. Growth again for French market in 2002by Emmanuel Legrand

CANNES - France againbucked the trend in mostmajor markets in 2002 byposting a 4.4% rise in thevalue of music shipments to1.3 billion euros, according tofigures unveiled at last week'sMidem trade fair in Cannesby local trade body SNEP.Unit shipments rose 3.3%from 2001 to 171 million.

"The recovery we enjoyedin 2001 was confirmed in2002," says SNEP head ofeconomic affairs AntonieCartier. Results for the firstnine months of 2002 showeda 10% growth, although thefourth quarter revealed adecline in sales.

A total of 39.3 million sin-gles (against 38m in 2001),125.7m albums (against

122.8 m) and 3.8m videomusic carriers (against 3.0m)were sold in 2002.

According to SNEP,France is expected to replaceGermany in 2002 as theworld's fourth largest musicmarket. SNEP director gen-eral Herve Rony cites thestrength of local repertoire,which accounted for 58% ofsales last year, as one of themain reasons for the continu-ing success of the Frenchmarket.

Seven of the best-sellingsingles in 2002 were fran-cophone, nine of the 10 best-selling were francophone.

"The figures are good,"says Rony, "and Franceremains an untypical mar-ket. However, we do seepotential clouds coming ourway. There's a tough interna-

tional environment, CD -burning is also affecting usand the online piracy cloudhas not stopped at theFrench border."

Another source of satisfac-tion for the industry in the2002 figures was the ongoingsuccess of French acts out-side France. Statistics for2001 show that internationalsales of French and French -signed acts topped close to 40million units, an increase of1.6% over 2000. EricMorand, founder of electroni-ca label F Communicationsand president of the Frenchexport office, said that"despite a bad internationalclimate, sales by Frenchartists are still on the rise,which is a tribute to thequality of the artists and theteams working with them."

CHINA READY TO OPEN DOORS TO MUSIC SPECIALISTS

A delegation of Chinese music executives visitingMidem for the first time told delegates that a massivemarket is open and ready for business. Gary Chen,chairman of Pulay Talent Agency, said: "The musicindustry is a numbers game and the one thing Chinahas is huge numbers," although he acknowledged themarket was missing two vital ingredients: specialistretailers and music publishers. "There are tremen-dous opportunities for foreign partners in these sec-tors," he added. Daxin Zhao, GM of the state-ownedChina Record Corp., said China's joining the WorldTrade Organisation has led to it strengthening copy-right legislation which would make it a more attrac-tive business environment.

FRENCH MUSIC RETAILER CALLS FOR VAT CUT

Leading French music retail chain Fnac ran a five-daycampaign in its store in Cannes last week to highlightdemands for a cut in VAT on sales of pre-recordedmusic from the current 19.5% to 5.6%. Speaking at aMidem summit in which industry representativescalled for a VAT reduction on recorded music,Christophe Cuvillier, director-general of Fnac, calledon the industry and retailers to sign up to apledge that it would pass on any savings to theconsumer. Arlene McCarthy, a member of theEuropean Parliament, said Europe's politi-cians recognised that the music industry"needed a break, [and as] legislators we wantto support a VAT reduction campaign, but it's notgoing to be easy". Despite calls for VAT to be reducedin areas such as music sold online or video, FrancoisLeotard, the French "envoy" to the EU on the issue ofVAT, said his remit was limited to physical CDs andother pre-recorded products. Leotard, who wasresponsible for lowering VAT in 1987 in France, toldattendees that he hopes to convinced all 14 EU mem-ber states to the urgency of such measure.

MILAN - Despite the currentdownturn in the dance music sector,one of the biggest gainers in Italy'sAudiradio ratings for the fourthquarter of 2002 was dance stationRadio Italia Network, which saw itsaverage daily audience increase by6.6%, returning it to the two millionmark.

"We've maintained our positionwhen many others have lost listen-ers, which has to be seen as a satis-factory result," says Italia Networkmanaging director Giorgio Bacco. "Ithink we've achieved results byfine-tuning, rather than changing,our programming, bringing in newDJs like Camilla from MTV andshifting other shows and DJs tomore suitable times of the day."

Audiradio's fourth quarter fig-ures, based on telephone interviews

conducted between November 2 andDecember 20, estimated the coun-try's average daily radio audience at35.26 million. Of the leading 10national networks, five saw gainsand five suffered losses. In additionto Italia Network, the winnersincluded the public stations RAI 1and RAI 2, CHR outlet Radio 105and domestic repertoire Radio ItaliaSMI. Small losses were suffered bythe two biggest CHR networks,Radio Deejay and Radio DimensioneSuono, and the two AC -leaningmusic networks, Radio Montecarloand RTL 102.5 Hit Radio.

Italia Network's Bacco says ofthe latest figures: "If there is a gen-eral trend, then it's the [audience]flight from generalised networkseither to local stations or to morespecialised, formatted networkslike ours and one or two others,such as Radio Italia SMI."

STOCKHOLM - For the first timeever in Sweden, a commercial sta-tion has more listeners to its break-fast show than that of the breakfastshow, on national public CHR sta-tion P3.

Morronzoo ("Morning Zoo") onMTG Radio's Hot AC network RixFM now has a daily reachof 462,500 according tothe latest quarterly rat-ings from RUAB, cover-ing the period September30 to December 8, 2002.That's a couple of thou-sand more than P3'sMorgonpasset, althoughstill substantially less than publicnews/talk station's P1 morningnews programme, which reachesmore than 600,000 listeners.

"I believe we've made a connec-tion with our listeners," says MTGRadio's group programme directorChrister Modig. "The chemistrybetween three strong personalities[pictured above] is also important,plus the fact that the show is aboutquite everyday things close to theeveryday life of the listeners."

Rix FM increased its overalldaily reach in the RUAB ratings to10.3%, up from 9.7% a year ago and10.0% in the previous survey. Maincompetitor Mix Megapol is still at6.9%, while NRJ is up 0.2 to 6.8%.

Among the public stations, SR'slocal network P4 has gained 1.3 toachieve a 36% daily reach, althoughthis is 1.4 below its rating a yearago. Although its breakfast showhas been overtaken, P3's recentdecline seems to have been halted,with the station increasing its reachby 0.1 to 10.5%, though that's still2.0 lower than a year ago.

In Stockholm, localpublic full -service stationP5 Radio Stockholm con-tinues to lose listeners,falling to a 13.5% dailyreach. Sister channel P4Radio Stockholm, whichtargets an older targetgroup, is now almost as

big with a reach of 13%.MTG Radio's Lugna Favoriter

104.7 (soft AC) and Power Hit Radio(CHR/dance) are still the numberone and two commercial stations inStockholm at, respectively, 9.2%and 7.4%.

In Skane, commercial radio sta-tions broadcasting on low -poweredfrequencies originally intended forcommunity radio continue to score.Lugna Melodier, run by BonnierRadio with a Soft AC format, hassurpassed both Rix FM and RadioCity (Hot AC) less than a year afterits launch with a daily reach of8.8%. This follows the recent suc-cess of Bonnier Radio's two Gold -for-matted Vinyl stations in the area.

PARIS - France's radio market hasreached an almost perfect 50-50equilibrium between national musicnetworks and full -service andnews/talk stations.

The combined audience of RTL,France Info, France Inter, Europe 1,RMC Info, BFM and a few othersmatches that of NRJ (confirmed for asecond successive sweep as the lead-ing station in France in terms ofreach), Nostalgie, Skyrock (achievingits highest ever audience), Fun Radio(which has gained 200,000 listenersin two months), Europe 2, CherieFM, RFM, Rire & Chansons, RTL2and MFM.

Overall, however, the speech -lednetworks have gained two points inaudience share at the expense of themusic outlets, which could be

explained by important events suchas the situation in Iraq and floods inthe south of France.

The latest Mediametrie surveycovers the period November -December 2002, and is the second setof ratings results sinceMediametrie's change in methodolo-gy, which has seen the inclusion ofthe 13-15 year -old audience for thefirst time.

The major highlight of the figureswas the overall increase in reach byalmost all stations compared to theprevious (September -October 2002)survey. As a whole, radio's totalweekly audience jumped from 84.1%in September -October 2002 to 86.5 %in November -December 2002.

Other highlights include thestrong performance of Radio France'sRadio Bleu (a network of MOR/talklocal stations), up to 7.4%.

Dopp sets trend by bucking itn 1986 Warner employees were pre-sented with a new act from the UKnotorious for playing 20 minute sets,causing riots at their gigs and mak-ing feedback an integral part of their

songs. The band was the Jesus andMary Chain, and when the assembledproduct managers were asked whowanted to take on the project, only onehand was raised. The hand belonged toBernd Dopp, who went on to break theyoung Scots in Germany.

Sixteen years later, Seeed, an 11 -piece reggae band from Berlin singingin both German and English, collect-ed two Echo awards and stole theshow with a blinding performance atthe gala. The act are signed to Warnerimprint Downbeat, which waslaunched in 1997 when Dopp offeredthe owner of one of Germany's leadingreggae record shops a label deal.

Both examples highlight some ofDopp's outstanding qualities: a love ofmusic, a determination to break actsand a desire to do the best job withthe minimum of fuss.

Despite operating in a declining market, Warner MusicGermany reported a 3% increase in turnover for 2002compared to the previous year. Olaf Furniss profiles thecompany's president Bernd Dopp, a man well-known forbucking the trend In Germany.and most recently the girl trioWonderwall. It took three singles tobreak the latter act, but the persistencehas been rewarded with a gold album.

A&R focusAt the same time, Warner MusicGermany has been moulded into aeven more music orientated companysince Dopp took the helm, with astrong focus on the core areas of A&R,marketing and promotion.

"We have people who fit into thecompany culture and are dedicated tomusic, able to think for themselves,introduce new ideas and have anaffinity with the artists," he says.

This is backed up by Wegener. "Itis worth looking at who Bernd has put

Dopp's former mentor, GerdGebhardt, who until last year waspresident of Warner Northern/Central Europe, agrees.

Music lover"He can get on with the most difficultartists," he says. "There are manypeople who claim to be music lovers,but with Bernd it is actually true."

This becomes evident when talkingto Dopp in his office. On the wallshang giant posters of acts he hasworked with such as Lou Reed, whileeven the briefest conversation will seethe Warner president namecheck atleast half a dozen artists he is cur-rently excited about.

Significantly, he is also one of thefew German executives who insists onplaying forthcoming releases and newsignings to visitors. Moreover, asksome of his competitors what they aremost proud of in their careers andthey are likely to start boasting aboutmarket share or some particularlypersonal achievement. This is not thecase with Dopp.

"I wouldn't consider myself a proudperson," he says. "I would describemyself as low key. I'm proud of ourartists and proud of my team."

While the global record companyculture is increasingly orientatedtowards immediate success, Dopp fur-ther distinguishes himself by stickingby his signings-a policy which haspaid dividends with acts such as Seeed,

into senior positions within the com-pany-there are a lot of people with astrong connection to artists," he says."It's a classic record company struc-ture, but while others are still talkingabout it, Bernd has already done it."

And it is clear that in a short spaceof time he has succeeded in establish-ing Warner as the first port of call formany managers seeking deals forunsigned acts.

"What Bernd has done is great, Iwould approach Warner with anyartist I am working with," says JensGeisemeier, who manages severalsongwriters and represents labels forlicensing deals.

It is testimony to Dopp's restruc-turing that his reputation as a musicman loyal to his team still remainsintact. Few noticed the roster beingreduced by some 40 acts and that bymoving East West and WEA into a

new building, 20% of the staff weremade redundant.

Media mix-upYet while he is admired within theindustry and also among retailers, hehas sometimes been less successful atcommunicating his strengths in theGerman media. In the past editorshave complained about strong-armtactics being used following poorreviews of Warner acts, with threatsto withdraw advertising and publica-tions being struck off mailing lists notunheard of.

"He's one of the few executives whoI wouldn't address in informal [du]register, I've never got to the pointwhere we have sat down and had acouple of beers," says one veteranmusic industry journalist, who askedto remain nameless.

"There was a time when we got a

complaint about every three monthsthat we were not writing aboutenough WEA acts."

When asked about past tiffs withthe media, Dopp is keen to point outthat his approach was based on fight-ing his artists' corner. "We expect thesame professionalism from others aswe demonstrate in our work," he says."Having said that, you do get olderand wiser!"

His media -savvy counterpart atUniversal Germany, Tim Renner,acknowledges that his Warner peer issometimes misunderstood but isquick to point out examples of Dopp'smore conciliatory side.

"Bernd is an innovative wolf, whocomes across as a conservativesheep," he says. "He's an extremedemocrat who can switch off his egofor the greater good."

Radio quotasThis was evident in Dopp seeking tobuild bridges with commercial radiostations during his time as head ofthe German industry's chart and mar-keting committee. Nevertheless, hebacks the principal of quotas for new-comer acts being playlisted at publicstations, and his reasons are clear.

"We are on the verge of provingthere is a very good music scene inGermany, but we need more plat-forms for local acts," he says. "Thereis no A&R crisis in Germany. There islots of talent, but there are very fewplatforms and radio is the biggestproblem. That is why we are pushingfor public stations to play more new-comers and new releases."

And while he does not profess tohave any long-term aspirations to riseup the international corporate ladder,Dopp remains ambitious for Germanartists.

"It is still very difficult for Germanacts internationally. Apart from one-off dance singles, novelty records andRammstein, we've not managed toestablish real stars abroad...moreneeds to be done!"

If he can repeat his recent trend -bucking achievements at home fur-ther afield, then the next Germanband to break internationally couldwell be a Warner signing.

Career starts and thrives by taking chancesBernd Dopp's career at Warner began in 1984 following alunch with Gerd Gebhardt, now president of the GermanIFPI and industry body the BPW. Gebhardt was market-ing manager at WEA at the time and eventually rose tobecome Warner's president of Northern/Central Europe.At the time Dopp was head .buyer for the record depart-ment of German retail chain Schauland.

Within a few weeks of the lunch Dopp was working asa junior product manager at the label and hit the groundrunning. Posts as marketing manager, marketing direc-tor and deputy managing director followed until in 1997he was promoted to managing director of WEA. DuringDopp's tenure the label broke a diverse range of actsincluding German hip hoppers Deichkind, Berlin reggaeact Seeed and pop crooner Sascha.

Moreover, he personally signed A -ha, re -launching theNorwegian trio as a platinum selling act after they had

spent seven years in the wilderness.Dopp also headed the BPW's chart and marketing

committee from 1999 until last summer, overseeing sev-eral key reforms of the sales charts, the introduction ofthe official dance chart and initiating a close dialoguewith radio.

In July 2001 he became president of Warner Germanyand deftly brought together East West and WEA, build-ing one of the most promising teams in the local industryin time for the labels moving into new headquarters inHamburg in June.

"When I appointed him, the job offered less moneythan he was earning in Schauland, but he took the posi-tion anyway, because he saw it as a chance to do what hehad always wanted to do," says Gebhardt. "When I askedhim about whether he minded, he replied: 'Don't worry,I'll make it up in the future', And he did!"

Malin executes fine art of reinventionby Steve Adams

"I'd always been listening to stuffthat was about lyrics and emo-tions and I wanted to be able totell stories instead of just hittingmyself with the microphone."

Making the leap from manicpunk rocker to singer -songwriterwas no easy task for New YorkerJesse Malin. But, for the formerlead singer of hardcore outfit DGeneration, it's one he says wasinevitable.

"We did seven years and I wasalways listening to the sort ofmusic I am now-whether it wasThe Clash or Bob Dylan it wasalways about songs," he says. "Butpeople always looked at [our] hair and make-upand it was really distracting-the 'read the coverand not the book' syndrome."

The decision made, Malin left the band andbegan writing for himself, trading lyrics and riffswith Ryan Adams, with whom he'd become friend-ly after the latter moved to New York following thebreak-up of Whiskeytown.

"I gave him a demo of some stuff and he reallydug it, and he offered to produce [my solo] record,"says Malin.

The album-The Fine Art Of Self -Destruction(One Little Indian)-was recorded in a six -daywhirlwind six days at the start of 2002, withAdams in overdrive and Malin worrying whetherwhat they were getting was good enough.

"We were doing everything live with me playingguitar and singing at the same time, it was likeJohnny Cash's Sun sessions," he laughs. "I figuredit'd be better if I took a few more stabs at the vocals,but Ryan was like 'Yeah that's it, that's a take'. I'mreally proud of the record now. I think he did awonderful job-but at the time there was tension!"

Not surprisingly the album is a stripped -backaffair, with Malin's introspective tales of love andloss perfectly augmented by Adams' laid-backatmosphere. It's bound to appeal to lovers of alter-native country, but there's more to it than that,according to Nick Stewart, who presents UK rockstation Virgin Radio's Sunday night Americanashow under the moniker Captain America(Stewart's day -job is as VP, international, A&R for

BMG UK)."Jesse Malin stands out from the

current pack of alt. country singersongwriters because of his urbanroots," explains Stewart, whorecently aired a session by the NewYorker. "His lyrics are incisive, tothe point and relevant, backed up bygreat tunes."

Colin Martin, executive producer(music) at UK public AC/MOR sta-tion BBC Radio 2, agrees. "It's analbum straight out of the RyanAdams academy of Americana, withadditional vocal coaching from theschool of Bruce Springsteen," hesays. "There's a lot to commend itwith a couple of interesting radio -friendly tracks, but is there room

commercially for someone so close to Ryan[Adams]? Time will tell but I think he'll be muchappreciated among album buyers."

They'll get the chance to do just that all overEurope, as the album has now been releasedthroughout the region-on One Little Indian in theUK, and through deals with MNW for Scandinaviaand Fargo in Italy, France, Spain and Benelux.Zomba is handling distribution in Austria,Switzerland and Germany.

Having opened for Ryan Adams on a series ofUK dates at the end of last year, Malin began hisown tour in Birmingham on January 14. "I'mgonna jump back and forth between here and theStates like some crazy little mouse," he says. "We'llsee how [the album] sells and just go with it."

Jaimeson puveys new urban sound

UK urban music is evolving, and oneof the artists at the cutting edge ofthe new sound is 27 -year -old produc-er, DJ, singer and MC, JamieWilliams, aka Jaimeson.

His single True, released onJanuary 13 through UK indie V2, isthe centre of a unique marketing andre-release effort, as the single wasoriginally mixed over a year and ahalf ago and has already been a mas-sive club hit. Yet radio has provedthat time has not dulled the track'sinfectious chorus and sweet soulfulhouse stylings. The single is current-ly being played by all the major UKradio groups, is A -listed at Londondance station Kiss 100, and is also onthe A list on the BBC's national CHRstation, Radio 1.

"Jaimeson is part of the newwave," says Mark Jackson, productmanager at V2 UK. "Like Big Brovazthis is new UK urban music. It's notjust garage-it's dance, R&B, pop, all

mixed into one. So Solid and MoreFire Crew are fantastic artists butthey are part of the more traditionalUK garage sound."

Backing up True's bubbly basslineand the sassy vocals of Angel Blue wasa marketing strategy which saw V2team up with Shazam Entertainment,the UK mobile marketing company.Through Shazam's technology, mobileusers ring a number, direct theirphone at a sound source-a radio orspeakers in a bar or club, for exam-ple-and get a text back telling themwhat the track is. Following its cluband radio play, True reached the top ofShazam's "tagging" chart, where itstayed for four straight weeks inNovember/December last year.

"People were tagging the trackthrough the amount of Kiss 100 playwe were receiving at the start of thecampaign," says Jackson. "So weknew that working with Shazamwould be a very effective way toreach this target audience."

Vijay Solanki, UK marketingdirector at Shazam, picks up thestory. "On the day of True's release,we sent SMS messages to anyShazam user who has tagged thetrack telling them of its availabilityin store," he says.

There will be more singles fromJaimeson this year, and an albumwhich will feature urban pop mixedin with underground garage cuts.Internationally, V2 plans to releaseTrue where it has a presence,although the label says no releasedates have yet been set.

BITTER SWEETThe D -Influence remake of theGladys Knight classic Taste OfBitter Love (Dome/UK), featuringRomina Johnson (who appeared on,and co -wrote, the Artful Dodger'sMovin' Too Fast) stays close, butnot too close, to the original. A full-blooded horn section provides thepunctuation on a production thatalso features strings, chuggingwha-wha guitar and a stirling vocalperformance by Johnson. The radioedit lopes along at a classic R&Bpace while the Messy Boys Mix isan altogether more uptempo affair,clocking in at 135 bpm. This pro-vides a radically different take onthe track that, style -wise, liessomewhere between classic houseand two-step.

GLOBAL CHICANERYChicane's Saltwater(XtravaganzalUK), featuring thehighly -individual voice ofClannad's Maire Brennan, hasalready been used as the backingon the global TV campaign forTourism Ireland and is conse-quently enjoying a greater reachthan it ever could via radio. Thecombination of Chicane's hit of thissummer and Brennan's vocalmakes for a trance -influenced tunethat should also have enoughmelodic content to appeal to a

broader audience. Despite thename, the dancefloor-boundThrillseekers House Mix, bangsalong at a trance-ish 145 bpm withenough references to the radio editfor mainstream clubs.

FINNISH QUALITYAcross the growing range of musiccoming out of Finnish labelExogenic Records, whether it bebanging techno, minimalist elec-tro, dub reggae or funky jazz, thehigh quality of the artists is unde-niable. Happily, this has nevermore evident than on the latestlabel compilation Complications-Exogenic Breaks Volume 1, whichfeatures an eclectic and inspiredselection of tracks from artists whorichly deserve to be better known.Naeae Eletrok by Brothom Statesis tuff, bleepy and uncompromisingwhile Purnaus by Centro 53 pro-vides a soundtrack that wouldwork well in Bladerunner. Meikkuby Uusi Fantasia features a com-pletely different approach, aspacey mix of dub reggae with asublime horn motif and occasionalvocals. Yet more quality Finnishreggae comes from Velours Perfecton Different Passages, while Ladaby DJPP is funky, jazzy and sound-track -worthy. The top track of thealbum is, however, the brilliantlyoff -kilter Parasite Of Power by DJVahamieli. Altogether, an album ofreal class.

As well as the good looks, Edyta hasthe voice, as is apparent here, as she sings soulful-ly over an electronic dance beat. Tomcraft's Loneliness (Kosmo) is sitting prettyon top of the European Dance Traxx chart for asecond straight week. The single enjoys both anincrease in club play and dance retail sales acrossEurope and has benefited from debuts onPoland's regional top 30 dance chart, as well ason Spain's monthly chart.

Madonna, meanwhile, stays at number twowith Die Another Day (Maverick). The track reg-isters a decline both in terms of club play and atspecialist dance retail-those factors make itunlikely it will return to number one.

Jennifer Lopez's Jenny From The Block (Epic)holds its position at number three on the chartfor the third week. Although the track is a nonmover, it is enjoying increased support.

There are no new entries into the chart's top10 this week, but Blank & Jones' The HardestHeart (Gang Go) returns at number nine (from12). The resurgence is based on a number 19entry on the Swedish dance chart.

Meanwhile, UK Asian act Panjabi MC'sMundian To Bach Ke (Superstar) climbs fromnumber nine to four and has recorded thebiggest gain in support on the entire chart. Thethunderous bhangra tune debuts on regionalcharts in Italy, Denmark, Belgium, Poland andHungary.

Set to enter the top 10 is Russian female actT.A.T.U. with their controversial All The ThingsShe Said (Universal), which is all about a les-bian love affair. The track climbs from 14 tonumber 11 this week, and debuted on theSwedish dance chart. The same applies toTogether's So Much Love To Give from France'sRoule label, the company that brought us theStardust classic Music Sounds Better With You.The single credits Thomas Bangalter (the manbehind Stardust) and DJ Falcon, and jumpsfrom 40 to 16, as well as being number one onthe dance retail chart.

After last week's low number of entries, thereare 14 newcomers and two re-entries to the top100 this week. They are led by veteran UKtrance act Chicane with Love On The Run on thenew WEA London -marketed imprint M Records,which goes in at number 37 this week.

Robbie Williams is still the darling of Europeanprogrammers, as his Feel (Chrysalis) stays at thetop of the European Radio Top 50 chart for a sec-ond week. Another radio favourite, JenniferLopez, is steady at number two with Jenny FromThe Block (Epic), while Blue and Elton John creepup from five to number three with their new ver-sion of John's classic Sorry Seems To Be TheHardest Word (Innocent/Virgin).

Of the other tracks jock-eying for position in the top10, Stronger (Island) bySugababes continues itssteady climb up the chartfrom 11 to number eight,while T.A.T.U. drop downone place to nine with AllThe Things She Said(Universal). But theRussian girls need not

worry, as this week sees their new single NotGonna Get Us enter the chart at number 50.

Just below T.A.T.U. at 10 is Craig David withhis Hidden Agenda (Wildstar/Warner), whichmoves up eight places compared to last week.

A constant problem for radio programmers ishow far ahead of release date to playlist a track.Wolfgang Biechele, head of music at AntenneBayern in Bavaria, says the station has exactlythat problem with David's track. "The release isfour weeks ahead," he says, "and we always haveto be careful. If I play it thirty times a week itmight get burned out by the time we have therelease date. Often they [the record company]delay the release date and I go crazy, because Istarted with the company and then they delay thedate and I often have to pull things off the playlistwhen they need my help."

Mundian To Bach Ke (Superstar) by PanjabiMC moves up an impressive 15 places to number33 this week. Biechele is playing the track, butonly on specialist shows. "It's a bit too spicy fordaytime," he says.

Other songs thatmeet more with hisfavour include the newsingle by the CountingCrows featuringVanessa Carlton-acover of Joni Mitchell'sclassic Big Yellow Taxi(Geffen/Polydor).Biechele also likes thecurrent Pink track,Family Portrait(Arista), which movesup four places to num-

ber 28 this week. "It's a great flavour-a new stylefor her," says Biechele.

Further down the chart, at number 44, are UKhip hop/R&B boy -girl group Big Brovaz with theirNu Flow (Epic). Just below Big Brovaz are anoth-er UK outfit, the young rock trio Busted, whoseYear 3000 (Universal) sits at number 47.

Tracks that are picking up major airplay andmay break into the top 50 next week includeBeenie Man's Streetlife (Virgin) and Mel C's HereIt Comes Again (Virgin). Biechele says he likes thenew Matchbox 20 track Disease (Atlantic)"because it's good rock song and not sequencedrubbish." He also likes the new single by TheBangles. "It's good to see them back again. Againwe have to take care because the release date is sofar ahead," he notes.

In Europe, former BMG Europepresident Thomas Stein now heads theGerman-speaking territories as presi-dent of BMG GSA, while London -basedBMG Europe COO Tim Bowen will be incharge of BMG's operations in the UK,Australia, and South Africa.

Schmidt -Holtz said in a statementthat although the regional offices hadfunctioned well over the past years, thechanges in market conditions forced there -jig of the operations with a focus oncreative challenges and repertoire, whilstfinding a way to reduce overhead costs.

Schmidt -Holtz added that Stein hadsuccessfully restructured the Europeanregion and his experience will help turnaround the fate of the GSA company.Stein refused to comment on thechanges as M&M went to press.

The management in the Office of theChairman division includes Schmidt -Holtz as chairman, Michael Smellie asCOO, and the newly -appointed execu-tive VP marketing, Tim Prescott-for-merly senior VP of BMG's Asia -Pacificregion, who will relocate to New York.

Prescott's new role is tooversee global marketingcampaigns for BMG artists.Also reporting to the Officeof the Chairman are humanresources, strategy and newtechnology and corporatecommunications.

The Label Group con-sists of US -based records

labels including Arista Records, RCAMusic Group, Jive/Zomba, and RLG-Nashville, as well as BMG Music Pub-lishing.

Territory Management will consist ofStein and Bowen's operations as well asJapan. A number of other territorieswill report to former senior VP, corpo-rate development-and BMG Neder-lands MD-Maarten Steinkamp (pic-tured) who is appointed to the new posi-tion of president, international. BrunoGerentes (BMG France MD) and AdrianBerwick (BMG Italy MD) will report toSteinkamp, as will senior VP Latinregion, Rodolfo Lopez-Negrete.

Nicholas Firth, chairman of BMGMusic Publishing, adds to his responsi-bility that of Corporate Center, a divi-sion that includes legal and businessaffairs, information systems and tech-nology, finance, and coordination formanufacturing and distribution.

According to the company, thechanges were originally laid out lastspring when Schmidt -Holtz and Smelliedid the rounds of BMG's worldwideoperations. In a statement, the newstructure is described as a way to"focusing on creating global musicsuperstars that reach across geographi-cal boundaries". "This is the latest stepin our strategy to make BMG the indus-try's leading home to world -class artistsand top creative executives," saidSchmidt -Holtz in a statement. "Weplace a premium on our relationshipwith our artists. And so this structureallows our creative executives to be clos-er to artists while allowing us to bettersupport our creative executives."

German Cartel office approvesRTL's AVE radio acquisitionsby Michael Lawton

Cologne - Germany's Federal Car-tel Office has approved virtually allof RTL's acquisition ofa portfolio of radioshareholdings ownedby AVE, a subsidiary ofthe Holtzbrinck pub-lishing group.

However, RTL hashad to withdraw-atleast temporarily-frompart of the AVE deal, in order to winthe Cartel Office's speedy approval forthe rest of its purchase plans.

As a result of the acquisition,RTL becomes the largest radio oper-ator in Germany, with shares in 19stations across the country.

In most markets, the AVE sta-tions were found not to compete withthose already owned by RTL,although the Cartel Office had mis-givings in two markets, which hasled RTL to withdraw its stakes inthe three stations affected.

In Baden-Wurttemburg, RTL hadacquired as part of the AVE deal28% of AC Radio Regenbogen, whichitself owns half of CHR station BigFM. RTL already owned 25% of thethree -station AC/Rock network inthe state, Hit Radio RTL. Hot ACcompetitor, Hit Radio Antenne 1,objected to the deal, so. RTL has

decided to drop that part of the dealfor now and present it to the regula-tor later, in a separate application.

In Berlin/Brandenburg, RTLacquired 40% of regionalmarket leader BB Radioto add to its 100% holdingin 104.6 RTL and its 30%holding in Berliner Rund-funk 91!4 (all AC). The

Rundfunk, which have now been dis-tributed among the other owners,and it approved the remainingshareholdings. But the regionallicencing authority, MABB, is stillnot happy with the situation.

The MABB's legal officer, Inge-borg Zahrnt, tells M&M that BBRadio was set up as a station for thestate of Brandenburg, which sur-rounds Berlin. The original licencerequired that none of the ownersshould be involved in the Berlinradio market. The MABB has toldthe current shareholders to find away of conforming to the licence byFebruary, or face their frequencybeing thrown open to other bidders.The situation has not made easier bystatements made against RTL'sinvolvement by Helmut Markwort,CEO of the BB Radio's other 40%shareholder, Burda Media.

Berman alarmfinely -balanced piece of legislation,"said Berman. "I am alarmed thatattempts are now underway atnational level to retreat from thishard-fought compromise."

He continued: "The music sectorneeds this Directive to be imple-mented rapidly and accuratelyacross Europe. We must resist allattempts to re -negotiate thisurgently needed Directive atnational level."

Berman pointed the finger atFrance, a country he described as "astrong defender of European cul-ture", where the implementation ofthe new copyright legislation "isproving problematic". He believesthat the draft French proposal toimplement the Directive "does notestablish a satisfactory judicialframework for the development ofsuch technological measures".

The IFPI, alongside representa-tives at the French industry, is con-cerned by the level of exceptions theFrench text will introduce. TheFrench proposal goes as far as sug-gesting that technical measures suchas encryption or copy protection usedto prevent copying could be removed."It would be a shame if the Frenchgovernment allows serious loopholesto appear in its forthcoming copy-right law," said Berman.

Aillagon tells M&M that "thereare conflicting views on this ques-tion and it is difficult to find a con-sensus". Aillagon adds that heexpected to present a new draft toparliament in March.

One of Aillagon's major problemsis that France's copyright law of1984 established a "right to homecopying" that is now strongly embed-ded in the mentality of users, whosee it as a limitation of their rights ifhome -copying is restricted throughtechnical devices. "Everything mustbe done to fight against piracy," saysAillagon, "but at the same time, weneed to maintain the possibility ofhome copying."

Pringle confirms that, since thenew year, the Capital FM Net-work's playlist-although remainingfirmly contemporary-has started toencompass a broader range of musicgenres, including some crossoverrock, and less manufactured pop."We haven't changed the shape ofwhat we're playing-it's more a genrebalance thing than a wholesalechange of direction," he explains. "Alot of music today is done to a formu-la, and people are starting to rebel abit against that-consumers thesedays are very savvy, and they don'twant to be fed stuff off a productionline. I think the need in hit radio in2003 is for a little bit of variety. Thatdoesn't necessarily mean that thewhole thing is going to go off at atangent, but that is what we're goingto concentrate on."

He adds: "When you get a numberof different genres that appeal to dif-ferent age groups, it's important toremember that if you just play theones that appeal to a singles -buying

Pringle and his team are lookingat the possibility of introducing aweekly rock show to CapitalFM/London-the station alreadyairs specialist urban and danceshows, and also recently introduceda Saturday morning album chartcountdown. "With a heritage station[like Capital FM] people have cometo expect it to provide for all theirmusic needs-so perhaps it is sensi-ble to provide a bit of variety at theedges," suggests Pringle.

The Capital programmer says healso wants the London outlet toreturn to its roots as a station knownfor promoting new music. "When wecan break songs that the other sta-tions in the market aren't so interest-ed in, that's great. I think Capital'salways had a reputation for leadingthe music scene, and I think thatshould continue."
