    Classification

    The Living Wage

    Enables the male earner to provide forhimself and his family not merely thebare essentials of food, clothing andshelter but measure of frugal comfort

    including education for children,protection against ill-health andmisfortunes including old age.

    The Fair Wage

    Must be sufficiently high toprovide a standard family withfood, shelter, clothing, medicalcare and education of childrenappropriate to the workmanbut not at a rate exceeding hiswage earning capacity in theclass of establishment to whichhe belongs

    The Minimum Wage

    The lowest hourly rate ofcompensation that employersmay legally pay to workers. Itsa wage which would besufficient to cover the barephysical needs of worker andhis family.

    Who is Responsible to

    Payment of Wages

    According to section 121 of Labour act, every employer

    shall be responsible for the payment to persons employedby him of all wages required to be paid.

    The responsibility of the payment of wages is transferred toothers In following-

    In case of persons employed otherwise than by a contractor, the chiefexecutive of the establishment or the manager shall be responsible for suchpayment.

    In case of person employed by a contractor, then the wages shall be paid byemployer and he will adjust the payment against the contractor. 9

    Salary And Wages

    In general, Salaryis used for paymentof services of higherclass and Wage is

    confined to theearning of laborers

    and artisans.

    The High Court ofMadras states, If the

    remuneration that ispaid daily or weekly

    can be calledWages; but wherethere is monthly

    payment and isfairly high is to be

    called Salary.

    Back Wages

    According to Blacks law dictionary,

    Money paid by an employer to a dismissed employee isBack Wages.

    Such a payment is often made in exchange for a release of any

    claims that the employee might have against the employer.

    Deduction from Wages

    Section 125 ofThe Bangladesh Labour Act 2006 authorizes to

    the employee for the deduction from the Wages only in

    accordance with the provisions of this Act. Namely:

    Fines

    Section 25 of the Act allows the employer can deduct from the

    wages of the employed persons.

    Deduction for Unauthorized Absence from theDutyAccording to Section 126 of the Act, deduction may be made only on

    account of the absence of an employed person from the place or

    places where by the term of his employment he is required to work.12

    Deduction from Wages(contd.)

    Deduction forDamageor Loss

    Deduction may be made on account for damage or loss of goods

    where these are expressly entrusted to the employed person for

    custody, or for loss of money for which he is required to account,

    where such damage or loss is directly attributable to his/her neglector default.

    Section 127(1) lays the rules for such deduction.

    Deduction for House-Accommodation

    According to section 128 of the act, A deduction shall not be made

    from the wages of an employed person unless the house

    accommodation has been accepted by him.

    Deduction for Recoveryof Advances

    Section 129(1) States,

    Advances made before the employment shall be recovered from

    the beginning of the first complete wage payment period.

    No recovery shall be made of such advances given for traveling

    expenses.

    Deduction for Overpayment of wages

    According to sec.129(2) of the Act deductions shall be subject tothe recovery of advances of wages not already earned shall be

    subject to any rules made by the Government regulating the extent

    to which such advances may be given and the installments by which

    they may be recovered. 14

    Unpaid wages of a Dead

    Worker

    Wages in this cases shall bepaid to the nominee madein this behalf by the workeras per rules

    In the absences of nomineethe Labour Court will beconsidered.

    Accordingto section131(1) of

    the Act

    Delay in Payment of Wages

    Section 132 of the Act says that for delay in payment an employedperson can apply to the Labour Court.

    Every such application shall be under the jurisdiction of the Labour

    Court where the worker used to work or where the wages was paidand be presented within twelve months from the date on which the

    payment of the wages was due to be made, as case may be.

    Appeal against Direction of

    Labour Act

    An Appeal against the directionmade may be preferred, within

    thirty days of the date onwhich the direction was made,

    before the tribunal.

    A sum of moneygiven by the

    According to sec.

    2(10) Gratuity

    means paymentequivalent to 30days basic pay forevery complete
