CONDITIONS OF SALE FOR BUYERS

1.Thehighestbiddershallbethepurchaser,subjecttotheauctioneerhaving the right to refuse the bid of any person. Should any disputeariseastothebiddingsthelotindisputewillbeimmediatelyputupforsaleagainattheprecedingbidding,ortheauctioneermaydeclarethepurchaser,whichdeclarationshallbeconclusive.

2.Nopersonshalladvancelessatabidthanthesumnominatedbytheauctioneerandnobidmayberetracted.

3.Alllotsaresoldsubjecttotherightofthesellerorhisagenttobidorelsetoimposeareserve.

4.Thepurchasershallcompleteabiddingcardbeforethesalegivingnameandaddress. Immediatelyafter thesale thepurchasershallpay10%of thepurchaseprice inpartpaymentandshallpay thebalancewithintendaysofthedateofthesaleunlesspriorcreditarrangementshavebeenmade.

7.Webb’sactasagents.Theyhavefulldiscretiontoconductallaspectsof the sale and to withdraw any lot from the sale without giving anyreason.

8.Eachlotisattheriskofthepurchaserfromthefallofthehammerandis tobe taken away at thepurchaser’s expense immediately after thesale.IfthisisnotdoneWebb’swillnotberesponsibleifthelotislost,stolen,damagedordestroyed.

9.Nogoodsaretoberemovedwhilesellingisinprogress.Receiptedinvoicesmustbeproducedpriortodeliveryofanylot.Theauctioneersreservetheright torequest identification inthecaseofanypurchasernotknowntoWebb’swhopaysbycheque.

10.NopersonpurchasinganyitemwhichfallswithintheprovisionsoftheAntiquitiesAct1975ortheArmsAct1958shallbeentitledtotakepossessionof the itemunlessanduntilsuchpersonhasproduced toWebb’salicenseundertheappropriateAct.

11.IfapurchaserfailseithertopayforortakeawayanylotWebb’sshallwithout further notice to the purchaser, at its absolute discretion andwithoutprejudicetoanyotherrightsorremediesitmayhave,beentitledtoexerciseoneormoreofthefollowingrightsorremedies:(a)Toissueproceedingsagainstthepurchaserfordamagesforbreachofcontract(b)Torescindthesaleofthatoranyotherlotsoldtothepurchaseratthesameoranyotherauction.(c) To resell the lot bypublic or private sale.Anydeficiency resultingfrom such resale, after giving credit to the purchaser for any partpayment,togetherwithallcostsincurredinconnectionwiththelotshallbe paid to Webb’s by the purchaser. Any surplus over the proceedsof sale shall belong to the seller and in this condition the expression“proceedsofsale”shallhavethesamemeaninginrelationtoasalebyprivatetreatyasithasinrelationtoasalebyauction.(d)Tostore the lotwhetheratWebb’sownpremisesorelsewhereatthesoleexpenseofthepurchaserandtoreleasethelotonlyafterthepurchasepricehasbeenpaidinfullplustheaccruedcostofremoval,storage,insuranceandallothercostsconnectedtothelot.(e)TochargeinterestonthepurchasepriceataratetwopercentaboveWebb’sbankers’thencurrentrateforcommercialoverdraftfacilities,totheextentthatthepriceoranypartofitremainsunpaidformorethansevendaysfromthedateofthesale.(f) To retain possession of that or any other lot purchased by thepurchaseratthatoranyotherauctionandtoreleasethesameonlyafterpaymentofallmoneydue.(g)Toapply theproceedsofsaleofany lot thenorsubsequentlydueto the purchaser towards settlement of money due to Webb’s or its

vendor.Webb’sshallbeentitledtoapossessorylienonanypropertyofthepurchaser foranypurposewhileanymoneyremainsunpaidunderthiscontract.(h)ToapplyanypaymentmadebythepurchasertoWebb’stowardsanymoneyowingtoWebb’sinrespectofanythingwhatsoeverirrespectiveof any directive given in respect of, or restriction placed upon, suchpaymentbythepurchaserwhetherexpressedorimplied.

12. Bidders deemed principals. All bidders shall be held personallyandsolely liable forallobligationsarisingfromanybid, includingboth‘telephone’and‘absenteebids’.Anypersonwishingtobidasagentfora thirdpartymustobtainwrittenauthority tosodo fromWebb’spriortobidding.

ABSENTEE BIDSTheseareacceptedbyWebb’sandcarriedoutfreeofcharge.Lotswillbeboughtas favourablyas isallowedby thebidding in thesaleroomandany reserve imposed. “Buy” (unlimited)biddingdirectionswillnotbeaccepted.Webb’srequireconfirmationinwritingorbyfaxofbiddingdirectionspriortothesale.
