REGULATING MOTORCOACHES

• Commercial vehicles over 4.5t must have a USDOT Number
• Subject to federal safety regulations.
• Officers enforce the federal rules through roadside inspections.
• 3 million inspections are performed annually.
• Companies are assigned a public safety rating (CSA score)
• Drivers must log hours of service (HOS) to comply with safety regulations.
• 80% of drivers still use the paper logbooks.
• HOS paperwork volume is the 2nd largest after tax filings. (FMCSA, 2014)

• FMCSA established the HOS regulations to keep fatigued drivers off the public roadways
• These Regulations limits the time a driver can driver, drive after working and driving and establishes minimum time periods in which a driver must be provided an opportunity to obtain rest.

FMCSA reports that in as many as 16% of the large truck crashes driver fatigue was either a cause or
contributing factor to the crash. (We believe these numbers are substantially overstated)

LEGAL REQUIREMENTS
• The HOS rules apply to all motor carriers and drivers with some limited exceptions (395.1(b)-(r))
• Drivers are required to prepare, and carriers are required to keep daily Records of Duty Status (RODs or Logs) in accordance with 49 CFR 395.8(a)
• Motor Carriers and drivers are required to prepare true and accurate RODs 49 CFR 395.8(e)
• Drivers’ RODs must be maintained current to driver’s last change in duty status 49 CFR 395.8(f)(1)
• Drivers’ RODs must be completed in the Form and Manner required by the regulations. Each log must include the 11 Data Points Required by 49 CFR 395.8(d)
