It's not clear why Daniels wasn't placed in handcuffs or wheth-er he had been searched when arrested. Police also haven't said whether they believe Daniels used his own gun or one belonging to the department. University officials did not respond Tuesday to messages seeking additional details. They scheduled a news conference for later Tuesday.

Daniels, who is from the San Antonio suburb of Seguin, is charged with capital murder of a peace officer and is being held in the Lubbock County jail on a $5 million bond. Online jail records don't indicate whether he has an attorney who can speak on his behalf.

He's had prior run-ins with the law. Daniels was charged two years ago in Guadalupe County, which includes Seguin, with possession of drug paraphernalia, but the case was dismissed. Court records obtained by the Lubbock Avalanche-Journal show he was charged last year in Lubbock County with drug possession.

Daniels is the son of H. A. "Dan" Daniels, a well-known figure in Seguin. The elder Daniels was a city councilman from 1998 to 2002 and again from 2006 to 2010, when term limits prevented him from running for re-election. He didn't immediately reply to phone messages seeking comment that were left at a family business and calls to the family's home got a busy signal.

The school's president, Lawrence Schovanec, said East's fam-ily is in the thoughts and prayers of the Texas Tech community. East, 48, joined the department as a dispatcher in 2015 and became an officer in May. It was his first job in law enforcement, according to the Texas Commission on Law Enforcement.

Supreme Court ordered the 5th Circuit to review the case of 36-year-old Obie Weathers, who was convicted in a robbery-slaying in San Antonio in 2000.

The 5th Circuit last year rejected arguments that Weathers is mentally impaired and shouldn't be put to death. That decision, however, preceded a similar case earlier this year in which the high court decided that the Texas Court of Criminal Appeals ignored current medical standards and required use of outdated criteria when ruling on the mental disabilities of capital murder convicts.

Weathers was 19 in February 2000 when he shot 63-year-old Ted Church twice in the head and once in the abdomen as Church tried to break up the robbery at the bar on San Antonio's east side. Church was a customer. Weathers fled with about $200.

Victims, some as young as 15, were also killed if they didn't turn in enough money.

The sentence is partly symbolic because Mexico generally limits prison time to 60 years.
