AN ORDINANCE SETTING THE WEST POINT CITY COUNCIL MEETING
SCHEDULE FOR CALENDAR YEAR 2017
WHEREAS, West Point City, a Municipal Corporation, hereafter referred to as the “City,” is
a public body of the State of Utah; and WHEREAS, the City is governed by a Mayor and City Council duly elected according
to law; and
WHEREAS, the City Council has traditionally met to consider and deliberate matters of City business on the first and third Tuesdays of every month; and
WHEREAS, the City is required by State Law (U.C.A. 10-3-502) to set by ordinance the
meeting schedule and venue of the City Council;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF WEST POINT CITY, UTAH as follows:
The Mayor and City Council of West Point City, Davis County, State of Utah, hereby set the
City Council Meeting Schedule for the Calendar Year 2017, as put forth in Exhibit A, attached hereto.
This Ordinance shall become effective immediately upon passage.

A RESOLUTION APPROVING A BETTERMENT AGREEMENT BETWEEN WEST POINT CITY AND THE UTAH DEPARTMENT OF TRANSPORTATION FOR THE
INSTALLATION OF WATER AND SEWER IMPROVEMENTS
WHEREAS, West Point City plans to upgrade water and sewer lines on 2000 West; and
WHEREAS, The Utah Department of Transportation is willing to install said improvements on
behalf of West Point City; and
WHEREAS, a betterment agreement has been prepared, which outlines the responsibilities of
each party and a methodology for sharing the costs of said improvements.
NOW, THEREFORE, BE IT RESOLVED, FOUND AND ORDERED, by the City Council
of West Point City as follows:
1. The Betterment Agreement, which is attached hereto and incorporated by this reference, is hereby
approved.
2. The Mayor is hereby authorized to sign and execute said agreement.

THIS AGREEMENT, made and entered into the date shown above, by and between the UTAH DEPARTMENT OF TRANSPORTATION, (“UDOT”), and West Point City, a political subdivision of the State of Utah, (“Local Agency”). WHEREAS, UDOT is engaged in preparing plans, specifications and estimates of costs toward constructing a roadway widening project, known as SR-108; SR-127 to SR-107, in Davis County, Utah (“Project”). Subject to the attached provisions, UDOT will include betterment work items requested by the Local Agency into the Project and will oversee construction of said betterment work. Upon signing this agreement, the Local Agency agrees that the costs shown below are estimates and that the Local Agency will be responsible for paying the actual cost associated with these betterment work items. Description of Betterment and Eliminated Project Utility Work: Local Agency betterments include water and sanitary sewer infrastructure within the Project limits. Local Agency betterment work is identified in the attached plans shown as Exhibit “A”, and are incorporated by reference. A listing of betterment items, quantities and cost estimates for such items are shown in Exhibit “B”, and incorporated by reference. UDOT has identified locations of Project utility impacts that will be eliminated with the installation of the Local Agency betterment work, resulting in project savings. UDOT and the Local Agency have agreed that said savings will be credited to the Local Agency as a Lump Sum towards betterment costs. Exhibit “C” summarizes the amount of this Lump Sum.

The total lump sum cost of the betterment work shall be deposited with UDOT within 90-days of Betterment Agreement execution. The Local Agency shall deposit the lump sum amount with UDOT’s Comptroller’s Office located at UDOT/Comptroller, 4501 South 2700 West, Box 141500, Salt Lake City 84119-1500.

Provisions (Note: the language in these provisions shall not be changed without prior approval from the Utah AG’s office)
UDOT has prepared plans, specifications and estimates of costs for the construction of the project, hereinafter referred to as the “Project.” The Local Agency desires to include the betterment work items described herein in the Project contract work. UDOT is agreeable to include the Local Agency’s requested betterment work in the Project contract providing that the Local Agency pay the actual additional costs incurred. The Local Agency agrees that UDOT’s Project will not be delayed as a result of adding these betterments, and that no betterments will be added to the bid package until this agreement has been signed by both parties. The Local Agency, at no cost to the Project, shall provide on-call support from Local Agency’s Design Engineer or appropriate representative to correct or clarify issues during construction and to perform the necessary inspection for the Local Agency work installed by the contractor. The Local Agency engineer and/or inspector shall work with and through UDOT’s Project Manager or Resident Engineer and shall give no orders directly to UDOT’s Contractor unless authorized in writing to do so. It is agreed that UDOT’s Contractor will accomplish the work covered herein on Local Agency’s facilities in accordance with the plans and specifications provided by the Local Agency, including changes or additions to said plans and specifications which are approved by the parties hereto. The Local Agency, through their inspection of said work, will provide UDOT’s Project Manager or Resident Engineer with information covering any problems or concerns the Local Agency may have with acceptance of said facilities upon completion of construction. Any periodic plan and specification review or construction inspection performed by UDOT arising out of the performance of the project does not relieve the Local Agency of its duty in the
performance of this project or to ensure compliance with acceptable standards. Except in cases of emergency It is understood that access for maintenance and servicing of the Local Agency facilities located on State right of way will be by permit issued by UDOT to the Local Agency, and that the Local Agency will obtain said permit and abide by the conditions thereof for policing and other controls in the conformance with Utah Administrative Rules.
I. Indemnification: UDOT and the Local Agency are both governmental entities subject to the Governmental Immunity Act. Each party agrees to indemnify, defend, and save harmless the other from and against all claims, suits and costs, including attorneys' fees for injury or damage of any kind, arising out of its negligent acts, errors or omissions of its officers, agents, contractors or employees in the performance of this agreement, and from and against all claims, suits, and costs, including attorneys' fees for injury or damage of any kind. Nothing in this paragraph is intended to create additional rights to third parties or to waive any of the provisions of the Governmental Immunity Act. The obligation to indemnify is limited to the dollar amounts set forth in the Governmental Immunity Act, provided said Act applies to the action or omission giving rise to the protections in this paragraph. The indemnification in this paragraph shall survive the expiration or termination of this Agreement.
II. Termination:
This agreement may be terminated as follows:
a. By mutual agreement of the parties, in writing
b. By either UDOT or the Local Agency for failure of the other party to fulfill their obligations as set forth in the provisions of this agreement. Reasonable allowances will be made for circumstances beyond the control of the parties. Written notice of intent to terminate is required and shall specify the reasons for termination.

c. By UDOT for the convenience of the State upon written notice to the Local Agency.
d. Upon satisfactory completion of the
provisions of this agreement.
III. Maintenance: The Local Agency agrees that, upon completion and final inspection of the Project construction, to accept, own and maintain the betterment work covered herein at no further cost to UDOT. IV. Payment and Reimbursement to UDOT: The Local Agency shall be responsible for all actual costs associated with these betterment items. The Local Agency agrees that if it modifies or cancels this betterment agreement at any time after it has been signed, the Local Agency agrees to pay any cancellation penalties or costs incurred by UDOT as a result of the betterment work scope being modified or cancelled. In the event the Local Agency fails to reimburse UDOT for the costs included in this betterment
agreement, funding for other Local Agency projects or B&C road funds may be withheld until the entire payment is made.
V. Change in Scope and Schedule: The Local Agency recognizes that if their project scope or schedule changes from the original intent of this agreement, the UDOT Project Manager or Resident Engineer will be notified prior to changes being made. Any costs incurred by UDOT as a result of these scope or schedule changes will be the responsibility of the Local Agency. In the event there are changes in the scope of the work, extra work, or changes in the planned work covered by this agreement, a modification to this agreement approved in writing by the parties hereto is required prior to the start of work on said changes or additions. VI. Content Review:

Minutes for the West Point City Council Administrative Session held at West Point City Hall, 3200 West 300 North, West Point City, Utah 84015 on December 20th, 2016 at 6:00 pm with Mayor Craythorne presiding. MAYOR AND COUNCIL MEMBERS PRESENT: Mayor Erik Craythorne, Council Member Andy Dawson, Council Member Kent Henderson, and Council Member Jeff Turner EXCUSED: Council Member Jerry Chatterton and Council Member Gary Petersen CITY EMPLOYEES PRESENT: Kyle Laws, City Manager; Boyd Davis, Assistant City Manager; Ryan Harvey, Administrative Services Director; Paul Rochell, Public Works Director; Megan Mills, City Treasurer; and Casey Arnold, City Recorder VISITORS: Rob Ortega, Heather Christopherson, and Julie Bashford 1. Discussion Regarding the Christmas Box Angel Statue for the West Point City Cemetery – Mr. Kyle Laws
Mr. Laws explained that Micah and Keeley Worley had approached the Council, via email, about constructing a Christmas Box Angel in the West Point Cemetery, and Staff would like to hear Council’s thoughts on their proposal and discuss the various options. Mr. Laws explained that the Christmas Box Angel Statue was created by Richard Paul Evans, author of The Christmas Box, and is an angel statue dedicated to children that have passed away, and stands as a gathering place for mourning families to grieve and heal. The statues are placed in various locations throughout the world, however, the organization does not allow statues in every cemetery; they would like the statues to be placed some distance apart, so that there is only one statue in a regional area. The Worley’s lost their son earlier this year, and they would like an Angel Statue to be placed in the West Point Cemetery. They have already set up a non‐profit organization, KindWorks Foundation, Inc., and have been granted 501c3 status to do fundraising for various projects to help struggling children. The Worley’s, with the help of the Cemetery Administrator, Casey Arnold, also held a vigil at the Cemetery on December 6th, 2016 for all those who have children in the Cemetery that have passed away. Mrs. Worley stated that even though the vigil was held on short notice and not well advertised, 15‐20 different families (about 60 people) attended and commented on how healing it was to participate in such a neat gathering. Mrs. Arnold stated that there are 157 children under the age of 21 in our Cemetery, which is a fairly substantial number for a cemetery of our size. Mr. Laws presented pictures of various Angel Statues that have been dedicated. The Angel Statue is the same, but the base can be customized as long as it contains wording that the monument is The Christmas Box Angel and that December 6th marks the annual gathering for people who have lost a child. Mr. Laws explained that the idea is that on December 6th of each year at 7:00 PM, a vigil is held at the statue to remember the children that have passed, and the families can place a white flower at its base. Mrs. Worley commented that Bountiful City has recently submitted an application for a statue, but the organization told her that there was not a currently an application for any cities surrounding West Point. Mr. Laws stated that if the City did move forward with the Statue, it would be unique to the

area. In his previous meeting with the Worley’s, Mr. Laws explained to them that the Cemetery will be expanded in the near future, and may delay placement of the statue, if it is approved. The Worley’s are ok with that potential issue, and are also ready and willing to handle all of the fundraising efforts. The Statue itself is $14,500, plus the cost of the base, which will vary depending on design, but is estimated to be between $3,000 to $6,000. Council Member Dawson commented that Nationwide Monument constructed the West Point Military Memorial, and they have been great to work with and would be a good option for this project. Mrs. Worley also suggested a cement base, for which she thought labor and supplies might be donated, and then a monument company could engrave it. Mayor Craythorne commented that a cement base with a rock veneer and an engraved plaque would look really nice, to which the Council agreed. Mrs. Worley stated that she hoped she could raise the funds within a few years, hopefully even less, for this project if the Council agreed. Mrs. Arnold commented there is a cluster of large trees and a small garden near the infant section of the Cemetery that could be left intact in the expansion design, and then be a great place for the Statue to be placed in as soon as the funding was available, instead of having to wait for the cemetery to be expanded. The Council liked this area, and wanted the Worley’s to move ahead with the project.
2. Discussion Regarding Employee Death Benefits – Mr. Kyle Laws
Mr. Laws stated that in the previous City Council Meeting, there had been a discussion about what the City might be able and willing to do for its employees who pass away while still actively employed by the City. This subject has come to light because of a West Point employee who is terminally ill, and whose health is rapidly failing. It was proposed to create a benefit that provides a burial plot and a no‐fee interment or perpetual care for a City employee who passes while still employed. Staff proposes the following language in accordance with that discussion:
(4) Death Benefit – This benefit is provided for the purpose helping our employees’ families during the difficult and
often tragic time surrounding an employee’s death. The City will provide the following to all active employees
who pass away while still employed by the City:
a. One burial plot at the West Point City Cemetery; and,
b. No interment, perpetual care, or weekend burial fees.
The benefit will only be provided to the employee, not his or her spouse or children. The Council was in agreement with this language, and would make a final vote in the General Session.
3. Audit Presentation – Mr. Ryan Harvey
Mr. Harvey stated that this audit was both his and Megan Mills, the City Treasurer’s, first audit, and he thanked Heather Christopherson with Ulrich and Associates, PC. for her work in actually doing the audit, Julie Bashford with McEwan and Company, the City’s accounting firm, Staff and Department Managers, and especially Mrs. Mills for her extensive work and preparation for this audit. Mr. Harvey stated that the auditors issued no findings in this Fiscal Year 2016 Audit, which is a great thing. They did offer some recommendations, however. The first recommendation was that they simply pointed out that there is an operational deficit in the CDRA fund, and their recommendation was that we have a plan for dealing with future deficits. Tax increment will be a future revenue source for the CDRA, and the fund will continue to be monitored. The second recommendation was that because now that West Point City is now a 4th Class City, the City should be preparing monthly financial reporting for the Council to review. Staff already prepares monthly financial statements, and so those will now be forwarded to the Council each month, but presentations will continue to only be done quarterly. This will fulfill the reporting requirements.

As an overview, Mr. Harvey highlighted the following for Fiscal Year 2016:
The City's total net position of $35,955,307 is made up of $25,877,309 in capital assets and other net position of
$10,077,998. Of this amount, $7,311,273 may be used to meet the ongoing obligations of the City, while
$2,766,725 is restricted for specific purposes.
The City’s net position increased by $4,644,445, or 14.83% ($31,310,862 to $35,955,307).
The City's governmental funds reported a combined ending fund balance of $4,282,147, an increase of $474,473
from the prior year. The increase is primarily the result of the year‐end transfer from the General Fund into the
Capital Projects Fund for the purpose of future capital expenditures. Of the total fund balance, $568,042
(unassigned fund balance) is available to spend at the government's discretion.
In the proprietary funds (waste, water, storm water, etc.), the total net position increased by $873,405 during the
fiscal year.
The net change in Fund Balance for the General Fund increased by $1,112. Mrs. Bashford commented that to be able to transfer an excess of $535,000 out of the General Fund and into the Capital Projects Fund, while adding $2.5 million in improvements is “pretty fabulous.” The Council expressed their sincere appreciation for all the work Staff did on the audit, and wanted them to know they were greatly appreciated.
4. Discussion Regarding Budget Amendments – Mr. Ryan Harvey
Mr. Harvey stated that Staff would like to propose some changes to the FY2017 Budget. As discussed in the previous Council Meeting, due to increased levels of participation in the Recreation Department, it is necessary to hire a full‐time Recreation Program Coordinator. The increase for this position will increase the annual budget to $59,738. Since 52% of the fiscal year remains, the impact to the FY2017 Budget will be an increase of $22,746 for salary and benefits, provided by fund balance in the General Fund. The completion of the 520 North Loop Project has also necessitated the need for another crossing guard to be hired for the intersection at 300 N and 3650 W. Staff also recommends increasing the hourly pay from $9.41 to $10.00 to be more competitive with surrounding cities. The City currently has $37,475 budgeted for eight crossing guards, including salary and benefits. Adding a crossing guard and increasing the pay for each increases the annual budget by $4,426, and so affects the remaining FY2017 Budget year by $3,551. This increase will also be funded by Fund Balance in the General Fund. The City has also received a new estimate for the 2000 W Water Line and Sewer Line from 800 N to 300 N Project for $557,557. The original estimated cost when added to the CIP Matrix several years ago was $264,000; $258,200 of that was from the Beginning Fund Balance in the Waste Fund and the remaining $5,800 from the Sewer Impact Fee Balance. There is now also the need for a new manhole on 2000 W at Center Street, which has an estimated cost of $32,914, all of which can be budgeted from Sewer Impact Fees. The increased estimated cost for the water and sewer lines project, and the manhole, will increase the Waste Fund by $272,594 and the Sewer Impact Fee Fund by $53,877. This is a total increase of $326,471 to the Capital Projects Fund. There had also been a discussion about needing to increase the budget to also fund installing three School Crossing Lights at the round‐a‐bout at 3000 W and 800 N, which would cost approximately $10,000. However, Mr. Harvey explained that the 3000 West Widening Project has a balance of $20,304, and those lights should be part of that project and therefore funded by such. No budget amendment is needed.
5. Discussion Regarding the Newly Created Planned Variety and Flexibility (PVFD) Zone – Mr. Boyd Davis Mr. Davis explained that a steering committee was put in place to review and propose any changes to the current zoning codes in the City. This committee has proposed the “Planned Variety and Flexibility Development” or PVFD, which was presented at the last Planning Commission meeting, and a public hearing was held on the proposal. No

comments were received and the Commission approved the proposed amendments. The PVFD Zone has been discussed in depth at previous City Council meetings, and the Staff was asked to address what would happen if the required maintenance plan (which plan might include the creation of an HOA or something similar) fails. The City Attorney, Felshaw King, suggested adding language to the Code stating that if an HOA (or something similar) is created within a subdivision as part of the maintenance plan, and they fail to maintain landscaped areas, the City has the right to step in and maintain the area, and then bill the HOA to recoup its costs. If the bill is not paid, the City can place a lien on the property for the unpaid amount. The Council agreed to this language being added to the proposed language. Mr. Davis also asked the Council for clarification on the language for “bonus rooms” in regards to what areas are not calculated into the minimum square footage requirements. The proposed code reads that the “minimum square footage shall mean the finished floor area above grade typically containing a kitchen, living room, bedrooms, and bathroom. Such space is not to include an attached garage, bonus room above the garage, basement, covered patios, or any type of detached structure”. Mr. Davis’ understanding of a bonus room is an area that extends above the topline of the truss space. Mr. Davis noted that the committee specifically specified a bonus room as being above the garage. Mayor Craythorne stated that a space above the garage could be 200 sq. ft., but have no HVAC, and so it should not necessarily be considered part of a livable area. However, there are some homes that use those areas as regular, usable areas of the home, with their own HVAC, electricity, windows, etc. The Mayor suggested including “conditioned areas” into the minimum square footage calculation. The Council ultimately decided to change the language regarding bonus rooms to “bonus rooms that are considered non‐livable space.” This language gives some control to the City in determining what could be considered a livable space to meet the intent of the code when it receives an application.
6. Discussion of 650 North Project – Mr. Boyd Davis (This Item was discussed after Item 8) The budget for this project is currently $923,000, and Mr. Davis explained that the estimated cost of the full project is $1,407,618 which is almost $.5 million difference. In previous discussions, Council gave Staff instruction to bid the project out with different options so that the project could be scaled back to meet the budget. Staff has determined that the following three options would be the best way to bid the project (with their estimated costs):
Mr. Laws stated that Council Member Petersen, who could not attend this meeting but lives on 650 N, commented that he is not at all in favor of narrowing the road to 30’, and if no sidewalks were installed at this time, he would like residents in the area to be aware that there will be sidewalks in the future; they will just not be part of this present project. Mr. Davis stated that the road is currently is 28’ with a large gravel shoulder. Curb and gutter would eliminate any shoulder area. Another option would be to do spot repairs to the road, and then lay a 1 ½” asphalt overlay and create a 36’ road. The road would be functional, Mr. Davis explained, but would eventually crack through and need to be redone again in a few years. This option would cost $829,752, but would include curb and gutter. The Mayor suggested another option of a new 36’ road, but without installing curb and gutter. Mr. Davis stated that would necessitate adding road side swales and require a different design of the storm drain, and some additional time to rebid the project. Staff and Council would take some time to consider the options, and if this project is even worth spending this amount of money on at this time.

7. Discussion Regarding an Interlocal Agreement with the North Davis Sewer District for the Combined Sewer Line on 300 North – Mr. Boyd Davis Mr. Davis stated that the budget amendments for the costs of this project were previously reviewed by Mr. Harvey, and the project itself has also been discussed with the Council in previous sessions. In regards to the manhole, in previous discussions it was thought that there would have to be payback agreements for the City to recoup the costs of the manhole, which are estimated to be roughly $32,000. However, if impact fees are used to fund the project, no payback agreements will be needed. The Council agreed with using impact fees rather than having to implement payback agreements.
8. Discussion of KenneVic Subdivision – Mr. Boyd Davis Mr. Davis explained that the owner of this project has requested to add one additional lot to this five‐lot subdivision that was approved in September 2016. The plat has not yet been recorded, and so the lot can still be added by simply amending the final approval. The Planning Commission granted approval of the amendment at their last meeting, and Staff recommends approval as well. The amendment will be up for final approval at the next City Council meeting.

Kathy Musselman‐Facer – 123 N 1750 W – Mrs. Facer stated that she became aware that there was a sign at the
cemetery stating that no visitors were allowed at the cemetery after sundown, and that the City Code itself stated
that visitors could only be at the cemetery at designated hours, unless they had written permission from the City.
Mrs. Facer continued to say that there is an individual on social media that told her she was trespassing because
this was against City Code, and that he would report her if he saw here there. To avoid any issues, Mrs. Facer

received written permission from Casey Arnold, Cemetery Administrator, to be at the cemetery after sundown,
because she frequently visits her husband’s headstone during those hours. Mrs. Facer would like the Council to
consider changing the Code to have no designated visiting hours, as the cemetery is a source of comfort to many
people, and their visiting hours should not be restricted. Mrs. Facer also thanked Mrs. Arnold for gaining
permission from City management for removal of the sign, but would still like the Code to be addressed.
8. Consideration of Approval of Minutes from the December 6, 2016 City Council Meeting

Consideration of Approval of FY2016 Audit – Mr. Ryan Harvey
Mr. Harvey stated that the FY2016 audit is now complete, and expressed his appreciation to Staff, especially the
City Treasurer, Megan Mills, for their work in preparing for the audit, as well as Julie Bashford of McEwan and
Company, Inc., the City’s accounting firm. Mr. Harvey also thanked Heather Christopherson and her team from
Ulrich and Associates, PC., for completing the audit. As discussed in the open administrative session, there were no
findings issued by the auditors. Two recommendations were made, and Staff will take those into consideration
and make the necessary adjustments.

9. Recognition of Commissioner John Petroff – Mayor Erik Craythorne
Mayor Craythorne stated that in his years of experience in working with Davis County Commissioner Petroff, he
came to greatly admire and highly respect him on both a personal and professional level. As a Councilmember
during the time Commissioner Petroff was West Point City Mayor (2002 to 2008), Mayor Craythorne sincerely
appreciated his leadership and ability to get things done. Even in his role as County Commissioner, Mr. Petroff
continued to serve the needs of West Point City; he was heavily involved in the approval of the extension of SR193,
the 2000 W widening project, and extension of the trail. The Mayor stated that all of Davis County was enriched by
Commissioner Petroff’s service and leadership.
In honor of his service, Mayor Craythorne issued a proclamation commending Commissioner Petroff for his
outstanding efforts, and the City’s sincere appreciation for his leadership in all areas of community improvement,
and for his desire to make West Point City a better place. Commissioner Petroff thanked the Mayor, Council, and
Staff for all of the work that they do, and also praised them for their efforts and ability to work so well together.
Commissioner stated that this cohesiveness is something to be proud of, as many cities in the County are not
nearly as harmonious.
10. Consideration of Resolution No. 12‐20‐2016A, the Adoption of the FY2017 Amended Budget for West Point City
and All Related Agencies – Mr. Ryan Harvey
Mr. Harvey explained that Staff would like to propose amendments to the FY2017 Budget. The amendments
include an increase of $22,746 to hire a full‐time Recreation Program Coordinator. This position is currently a part‐
time position, with no health benefits, but the increased levels of participation in the Recreation Programs have
necessitated the need for a full‐time position. Staff is also proposing hiring another crossing guard for the
intersection at 300 N and 3650 W, as well as increasing the hourly pay to $10.00. The City has had difficulty filling
current positions, and this increase in pay from $9.41 to $10.00 may help fill positions and retain crossing guards.

This additional position and pay increase will be a total increase of $3,551. Both of these amendments will be
funded by Fund Balance in the General Fund.
The 2000 West Sewer Line Projects are also included in the proposed amendments, and as discussed in depth in
the open administrative session, will be an increase of $326,471, funded by Fund Balances in the Waste Fund and
Sewer Impact Fee Fund.

11. Consideration of Ordinance No. 12‐20‐2016A, an Ordinance Amending West Point City Code Sections 17.25.080,
15.15.130(A0, Modifying Land Use Regulation and Establishing Section 17‐115, Creating the PVFD Overlay Zone –
Mr. Boyd Davis
Mr. Davis stated that this Ordinance will create the Planned Variety and Flexibility Development Overlay Zone,
which increases the minimum lot sizes for the entire City, but allows for the opportunity for smaller lot sizes and
increased density if certain conditions are met. The conditions would be outlined in a developer’s agreement and
would include elements of an architectural them or enhanced features, a master landscape plan, and a
maintenance plan. The developer’s agreement will be determined and customized to each development. Should
the maintenance plan for common space landscaping fail, the Ordinance also contains language that gives the City
the right to properly maintain the space and invoice the maintenance organization for its costs. A developer does
not have to enter into a developer’s agreement and can develop lots at the larger minimum lot size. This proposed
Ordinance will also adjust the minimum square footage requirements from 1,200 sq. ft. to 1,400 sq. ft. in the
residential building standards.
The proposed Ordinance also repeals Ordinance No. 08‐02‐2016A, therefore ending the moratorium on residential
development applications.

12. Consideration of Resolution No. 12‐20‐2016B, Approval of the Interlocal Agreement with the North Davis Sewer
District for the Combined Sewer Line on 300 North – Mr. Boyd Davis
Mr. Davis explained that the sewer line on 2000 W from 300 N to 470 N has been in the masterplan for many years
to be replaced and upsized, and can now be completed with the houses on the west side of the road being removed
for the 2000 West Widening. The North Davis Sewer District is willing to combine the City’s sewer line with their
new line, instead of installing double lines. The total cost for the City will be $557,557. The NDSD’s current line runs
diagonal from the intersection at 300 N and 2000 W to the intersection at 470 N and 2150 W, and runs through
vacant property that could be developed commercially in the future. Re‐routing the District’s line along 2000 West
opens up that property for development, and also gives us the opportunity to combine lines. Staff recommends
approval of the Agreement.

13. Consideration of Resolution No. 12‐20‐2016C, Approval of Changes to the Personnel Policies and Procedures
Manual, Relating to Employee Death Benefits – Mr. Kyle Laws
Mr. Laws stated that Staff had approached Council in the previous City Council meeting to see if there was anything the Council would be willing and able to do in the event of an active West Point employee passing away, which will be a situation occurring in the near future with a current employee. The benefits the Council discussed at that meeting are included in the proposed changes to the Personnel Policies and Procedures Manual, and are stated as follows:
Death Benefit – This benefit is provided for the purpose helping our employees’ families during the difficult and often tragic time surrounding an employee’s death. The City will provide the following to all active employees who pass away while still employed by the City:
a. One burial plot at the West Point City Cemetery; and,
b. No charge for interment, perpetual care, or weekend burial fees.
