01UNDERSTAND THE CONCEPT OF TRUSTS

Most people are aware of trusts and have heard that is an eff ective estate planning tool if structured and administered correctly. However, very few people really understand what a trust is and how it should be used, as well as the rights and duties of trustees and trust benefi ciaries.

02CLASSIFICATION & DESCRIPTION OF TRUSTS

In this module is a brief description of the diff erent types of trusts recognised in terms of South African law. Depending on specifi c grounds, it is possible for a trust to fall into several categories, such as, for example, a testamentary discretionary trust. The module will also explore the Trust Instrument. The trust instrument vests the ownership of the trust assets in the trustees in their offi cial capacity.

03APPOINTMENT OF A TRUSTEE

There are no specifi c or prescribed qualifi cations or requirements to be met to act as a trustee. For example, a minor can act as trustee with the consent of his / her guardian. There are, however, persons who are disqualifi ed from acting as trustee.

04OFFICE OF TRUSTEE

A trustee’s duties are determined by three sources, namely the trust instrument, the Act and the common law. The duties imposed on trustees by the trust instrument will diff er from one instrument to another, depending on the specifi c intention and objectives associated with the relevant trust. The duties imposed by the Act and the common, however, are similar for all trusts and have to be complied with by each and every trustee.
