    When the County Clerks Wont Do Their Job

    The county clerk (lower c is your common law county Recorder) is supposed to take any andall affidavits given to her/him to record. If the clerk gives you any hassle, you will have to beprepared. Always be as nice as possible when speaking to these officials, never have a bad orcocky attitude as it will do more harm than good. First, understand that if s/he says that her/his

    county attorney told her/him not to record any documents like yours, then tell her/him that s/he isthe one who is refusing your affidavit, that you dont accept any third party interveners and thatyou will hold her/him personally responsible for any damages. Even though s/he is using her/hiscounty attorney as a scapegoat, s/he is the one making a legal determination about your affidavit.You can ask her/him if s/he has a license for practicing law and then inform her/him that if s/hewants to rebut anything in your affidavit, that s/he more than welcome to. Short of that s/heneeds to fulfill her/his oath, perform her/his sworn duty and record your affidavit.

    If s/he doesnt get the picture, then you need to play a little hard ball. Tell the clerk very nicelythat her/his failure to record the documents once deposited with her/him, is a crime againstjustice under Revised Statutes of the United States First Section 43 Congress and that sections

    5403, 5407 and 5408 total up to $9,000 in fines and up to 12 years in prison per affidavit s/hefails to record. You can prepare the notice below and have the county clerks name on it andhand it to her/him if it gets to this point. You can also try having someone else record yourdocument, as this sometimes seems to diffuse their rejections. It may also work if you send inaffidavits via Registered Mail, return receipt requested with instructions for the clerk to recordyour affidavit. Remember there is a difference between record and file. I believe thedifference is that when a document is recorded it becomes registered, but when it is filed itis merely a reference in a proper place. The registered document is a vessel operating in foreigncommerce. The documents is now a matter of public record and the document/vessel cannow go into international commerce should the need arise.

    If the county clerk still fails to perform her/his duty, then tell her/him that you have no choice butto place an affidavit of criminal complaint against her/him for breaching her/his oath, destructionof records, conspiracy to defeat enforcement of the laws, and throw in anything else you canthink of such as Title 18: 214, 242. Then you have to be prepared to carry through with this. SeeAffidavit of Criminal Complaint.

    $9,000.00 in fines and up to 12 years in prison per affidavit you fail to record. And 18 USCSection 2071 carries fines, imprisonment and disqualification of office. If your county attorneytold you not to file any documents like mine, you are still responsible, as I do not accept anythird party interveners. Any attorney, district attorney, or anyone from the lawyering craft are allthird parties and do not have a license to make a legal determination in the matter as they do notrepresent Me and you. The county clerk, do not have the authority to represent Me. Should youfail to uphold your sworn oath and perform your duty, I will have no choice but to record acriminal affidavit of complaint against you and a copy into your bonding company.

    Title LXXCRIMES--- CH.4. CRIMES AGAINST JUSTIVCE

    (Destroying, & c., public records)

    SEC. 5403. Every person who willfully destroys or attempts to destroy, or, with intent to stealor destroy, take and carries away any record, paper, or proceeding of a court of justice, filed ordeposited with any clerk or officer of such court, or any paper , or document, or record filed ordeposited in any public office, or with any judicial or public officer, shall, without reference tothe value of the record, paper, document, or proceeding so taken, pay a fine of not more than twothousand dollars, or suffer imprisonment, at hard labor, not more than three years, or both. [See 5408, 5411, 5412.1]

    (Conspiracy to defeat enforcement of the laws)

    SEC. 5407. If two or more persons in any State or Territory conspire for the purpose ofimpeding, hindering, obstructing, or defeating, in any manner, the due course of justice in anyState or Territory, with intent to deny to any citizen the equal protection of the laws, or to injurehim or his property for lawfully enforcing, or attempting to enforce, the right of any person, orclass of persons, to the equal protection of the laws, each of such persons shall be punished by afine of not less than five hundred nor more than five thousand dollars, or by imprisonment, withor without hard labor, not less than six months nor more than six years, or by both such fine andimprisonment. [See 1977-1991, 20042010, 5506-5510.1]

    (Destroying records by officer in charge)

    SEC. 5408. Every officer, having the custody of any record, document, paper, or proceedingspecified in section fifty-four hundred and three, who fraudulently takes away, or withdraws, ordestroys any such record, document, paper, or proceeding filed in his office or deposited withhim or his custody, shall pay a fine of not more than two thousand dollars, or sufferimprisonment at hard labor not more than three years, or both-, and shall, moreover, forfeit his

    office and forever afterward disqualified from holding any office under the Government of theUnited States.

    18 USCS Section 2071 (2002)

    Section 2071. (Concealment, removal, or mutilation generally)

    (a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, ordestroys, or attempts to do so, or, with intent to do so, takes and carries away anyrecord, proceeding, map, book, paper, document, or other thing, filed or depositedwith the clerk or officer of any court of the United States, or in any public office,or with any judicial or public officer of the United States, shall be fined under thistitle or imprisoned not more than three years, or both.

    (b) Whoever, having the custody of any such record, proceeding, map, book,document, paper or other thing, willfully and unlawfully conceals, removes,mutilates, obliterates, falsifies, or destroys the same, shall be fined under this titleand imprisoned not more than three years, or both; and shall forfeit his office and

    be disqualified from holding any office under the United States. As used in thissubsection, the term office does not include the office held by any person as aretired officer of the Armed Forces of the United States.
