    Location an dCharactero f tlie District:The 205.14 acre tract is located in the Pohick Planning District, Johnny MooreCommunity Planning Sector (PS), ofArea III in the Comprehensive Plan. Theproperty is zoned R-C and WS. Over 100 acres of the subject property areforested and maintained as an undisturbed, wooded conservation area (seeFigure 1). Thewoodedandopen landsof thesubject property help maintaintherural character of the Clifton area. The land provides scenic vistas from bothPopes Head Road and Newman Road. The mature hardwood forest exhibits acomplete lackofunderbrush, characteristicofareas with high deer populations.Approximately 90acresof the property isused as aworking farm,and consistsof open fields and pasture. Historically, th e primary product has been beefcattle, plus hay and corn as feed; however, eggs are now the main cultivatedproduct. Approximatelysixacresaredevotedto residential uses.Thefarmnowproduces approximately 300 dozen eggs annually, along with th e select

    harvestingoftimber. Several cows continuetograzeon theproperty, but are nolonger actively being raisedformeat.

    BACKGROUND:Thesubject propertyhasbeen ownedby theapplicants and/or membersoftheirfamily since1961 and hasbeen farmed since that time.T heWhitehall LocalAgriculturalandForestal Districtw asoriginally establishedfor aneight yearperiodonOctober31, 1983 and was renewedforadditional eight year periodsonOctober 14, 1991,October11, 1999, andOctober 15,2007. Uponthepassingof theapplicant's mother(LeeVazquez)in 2011,ownershipof theacreagehasbeen transferred amongthecurrent applicants, theirson, and anirrevocable family trust. Duringthe lifeo fthis district,thepropertyhas notbeensubstantially altered.Thecurrent application includesthesame parcelsas themost recent renewalfor alocal district in2007 whena 5.3acre parcelon thesouthernend of thepropertyw asadded. Theadditionofthose5.3acres (which bringsthetotalacreageto205.14)hasmadeth edistrict eligiblefor re-designationas an A&Fdistrictofstatewide significance. Theapplicants have stated they wishtoconvertto astatewide district inordertotake advantageof themore lenientpenaltyandroll back provisions; however, they have also verbally indicated thattheir ultimate desireis tomaintaintheacreage in itscurrent conditionastheyinvestigate optionstoutilizethe land in amanner that could help ensure itscontinued viabilityas anagriculturala ndforestal district.

    ANALYSISLand Use/Environmental Analysis (Appendix3)Theestablishmentof anagriculturala ndforestal district is inconformance withth ePlan goalso fpreservingtherurala ndscenic characterof thesurroundingarea.Thesubject property islocated in thePopes Head Creek watershedtributaryof theOccoquan River.T henorthernmost headwaterso fCastle Creekandfourof itstributariesare locatedon thesite. Castle Creek, which extends

    th e lengthof theproperty alongthewestern edge, isconsidered to bebothEnvironmental Quality Corridor(EQC) andResource Protection Area (RPA).Thecreekson thesite appear to be ingood condition. Ordinance Provisionsareproposed which requiretheapplicanttoconsidertheboundaryo fthese areasas the limitso fclearinga ndgradingfor the lifeof thedistrict.Transportation Analysis (Appendix4)Thecurrent application doesnotrepresentanyconflict withtheCountywide Planortransportation recommendations,andwouldno thaveanadverse trafficimpact.Parl< Authority Analysis (Appendix5)ThePark Authority generally supportstheestablishmentof A & FDistrictsa sthey further FCPA objectivestoprotectandpreservethenatural heritageof theCounty. Staff notes thattheproperty ishometo onedocumented architecturalsite,theWhitehall-Newman House. Thepropertyhas ahigh probabilityo fcontaining significant CivilWar andNative American archeological sites.If theproperty isever subjectto land disturbing activities,theFCPA requests thatCRMP staffbegranted accesstoconductaPhase Istudy.A nordinanceprovisionhasbeen proposedtothis effect.Urban Forestry Analysis (Appendix6)Thereare nourban forestry issues associated withtheapplication. Managementof thewooded areasof thedistrictareevaluatedanddiscussed in theForestManagement Plan preparedby theVirginia DepartmentofForestry, contained inAppendix7.Soila n dWater Conservation District Analysis/ Virginia Departmento fForestry Analysis (Appendix7 & 8)TheSoilandWater Quality Conservation Plan previously prepared for the2007renewal was updated for 2012 and is included as Appendix 8.Recommendations continue to include adhering to best management practicesfo r pesticide application and soil control. The previously prepared ForestManagement Plan prepared by the State Forester in 2007 is included asAppendix 7. The State Forester has indicated no updates are necessary. Thefollowing is asummaryof theForester's assessmentof theproperty:Thesite containsa mix ofthree different cover types. Approximately one-thirdofth esite ismaintainedasgrassy pasturagefor theapplicant's beef cattleandhorses.Theareahasscattered treesandoffers good edge habitatforwildlife.Atotalo fapproximately2 5acres inscattered clumps throughoutth esite exhibita

    pine/hardwoodmixwhich will continuetoprogress towards hardwoodsas thepines matureand die. Themajorityof thesite iscovered with upland hardwoodforest including oaks, beech, maples,andother species.T hewildlife benefitofthis forest land ismagnifiedby theadjacent properties, whicharealso inAgricultureandForestal Districtsand arealso protectedaswoodlands. Evenconsidered alone,thesite islarge enoughto beutilizedbywildlife species whichdependonundisturbed forest interiors. Becauseof thevarietyo fcover typesonth esite,theproperty worksas alink between different habitat types.Themulti-functional valueo fthis site increases itsecological value.Establishmento fAgricultural an dForestal Districts o fStatewideSignificanceSect. 114-1-3of theFairfax County Code permitstheBoardtoestablishagriculturalandforestal districtsofstatewide significance which shallbe aminimumo ftwo-hundred(200)acres insize. Theproposed district containsatotalo f205.14 contiguous acresand,thus, satisfiestheminimum area requiredto beeligiblefor astatewide district.Statewide Agricultural andForestal District Criteria Analysis (Appendix 10)Article 1 ofChapter114 of theFairfax County Code containsa set ofcriteriawhich isdesignedtoserveas aguidein theevaluationo fproposed StatewideAgriculturalandForestal Districts. It is importanttonote that these criteriaare aguide to beapplied when determining whethertoestablish, renew,oramendaDistrict; theyare notprerequisites.Thefollowing is anevaluationof theproposed district's conformance with these criteria:A. Al ldistrict acreage shouldbecurrently devotedtoagriculturaluse orforestaluse orshouldbe undevelopedandsuitableforsuch uses,except thatareasonable amounto fresidentialorotheruse,relatedtotheagriculturalorforestaluse an dgenerallyn otmore than five acresperdistrict,may beincluded.

    The subject property is 205.14 acres in size and is entirely in forestconservationandagricultural uses. This criterion ha sbeen satisfied.B. Alllandsin thedistrict shouldbezonedto the R -P, R-C, R -A, or theR -E District.

    Theproperty iszonedR-C.This criterion issatisfied.C. Ingeneral, thedistrict shouldbeconsistent withtheComprehensive Plan.The following land uses identifiedin thePlana reappropriatefor adistrict:0.1-0.2 dwelling unitsperacre; 0.2-0.5 dwelling unitsperacre; 0.5-1.0

Landsn otplannedassuchmay beconsideredfor adistricti fthey meeta tleast3 o fCriteriaGroupB .The property is planned fo r residential use at a density of 0.1 to 0.2dwelling units per acre (du/ac). Therefore, this criterion has beensatisfied.

    D. A majorityof thesurrounding land within one-quarter mileof thedistrictshouldbeplanned accordingto theComprehensive Planfo rusesidentifiedin Cabove.TheComprehensive Plan designatesamajorityof thesurrounding landwithin one-quarter mileof thedistrict for lowdensity residentialuse at 0.1to 0.2du/ac. Therefore, this criterionhasbeen satisfied.

    E. A majorityof theexisting surrounding land uses within one-quarter mileof thedistrict shouldbeagricultural, forestal, outdoor recreational,conservation,or lowdensity residential(0.5du/aco rless).A majorityof the land within one-quarter mileof thedistrict isagricultural,low density residential,o rforestal land. Therefore, staff believes thiscriterionhasbeen satisfied.

    F. Approximately2/3 o f thelandinagriculturaluse in thedistrict shouldcontain ClassI, II, III, or IVsoilsa sdefinedby the US DASoilConservation Service. Districts having more than 1/3 of thelandinagriculturalusecontaining Class V-VIII soilsmay beconsideredifsuchlands have been improvedand aremanagedtoreduce soil erosion,maintain soil nutrients,a ndreduce non-point pollution.Fifty-eight percentof thesite consistso fsoilsofCapability Classes I, II,III and IV. Th eeastern portionof thesiteis theonly portion usedforactive agriculture. Two-thirdsofthat area consistso fsoilsofCapabilityClasses I, II, III and IV.Therefore,the intentofthis criterion issatisfied.

    G. There shouldbeevidenceo f ahistoryo finvestmentinfarmo rforestimprovementso rother commitmentstocontinuing agriculturalorforestaluse(s)in thedistrict. Inparticular, districts withn ohistoryo finvestmentsin farmo rforest improvements must evidenceafirm commitmenttoagriculturalorforestal usesfor atleastthelifeo f thedistrict.Theapplicants' familyhasowned this property since1961 andsince thattimehasmade various investmentsin theprevious beef cattle operation

    andother farm activities. In thepast 10years, these investments haveincludeda newchicken coop,th eadditionof twometal barnsfo ranimalsandequipment storage, extensive fencing repairsandadditions,andwork inseveral fieldstocombat erosion.T heapplicant iscommittedtomaintainingth eforestalandopen space usesonthis propertyfor the lifeof thedistrict,and tofollowingthesuggestionsof theUrban Foresterandth eSoilandWater Conservation District. Staff believes that this criterionhasbeen satisfied.H. Thedistrict shouldnotunreasonably hinder acquisitiona ndconstructiono fpublic roads, utilities,andfacilities neededtoserve other areaso fplanned growth.

    This application shouldnotrepresentanyconflict with plannedimprovementstopublic roads, utilities,o rfacilitiesin thearea.I. Thedistrict's core acreage shouldbereasonably compactinshapeandshouldnotcontain withini tsperimeteralarge numbero fparcelsnotincludedin thedistrict.

    Thereare nooutletsin theproposed district; therefore, this criterion issatisfied.J. Al lnon-contiguous parcelsin thedistrict should containatleast five acreso fagriculturaluse or 20acresinforestaluse.

    A llparcelso fland withintheWhitehall Districtarecontiguous; therefore,this criterion doesnotapply.Aspreviously noted, these criteria serveas aguide indetermining whetheror not anagricultural district shouldbeestablished; theyare not aprerequisiteforestablishingadistrict. Based upon staff analysis,theapplicationfor theestablishmentof theWhitehall Statewide AgriculturalandForestal District meetsall of theapplicable criteriaestablished inChapter114 of theFairfax County Code.

TheWhitehall Statewide AgriculturalandForestal District shallbereviewed afteraperiodof ten (10)years fromth edateofestablishmentby theBoardofSupervisors.TheBoardmay byordinance renewthedistrictor amodification thereoff oranotherten-year period. Noowner(s)ofland shall beincluded in anyagriculturalandforestaldistrictoflocal significance without such owner's written approval.2. Noparcel included withinth edistrict shall bedevelopedto amore intensiveusethanitsexistinguse at thetimeof theadoptionof theordinancefor tenyears fromthedateofadoptionof thedistrict. Land used inagriculturalandforestal production withinth eagriculturalandforestaldistrictofstatewide significance shall qualifyfor anagriculturalorforestal valueassessmentonsuch land pursuanttoChapter4,Article19 of the Fairfax CountyCodeand toSection 58.1-3230et seq. of theCodeofVirginia, if the requirementforsuch assessment contained thereinaresatisfied.5. Theapplicants shall implementandabideby the recommendationsof theSoilandWater Conservation Plan dated October31, 2012 , for the lifeof theWhitehallStatewide Agriculturaland Forestal District.TheSoilandWater Conservation Planmay beupdated from timetotimeasdetermined necessaryby theSoilandWaterConservation District.6. Theapplicants shall implementandabideby the recommendationsof theForest Management Plan dated September25,2007,for the lifeof theWhitehall Statewide Agriculturaland Forestal District.The ForestManagement Planmay beupdated from timetotimeasdetermined

Surveysandother similar activitiesof theResourceManagement Division shall beconducted only with prior permissionof theproperty ownerand atterms mutually acceptabletoboth partiesandestablishment before each occurrence.9.     Wildlife; Thewoodland habitat isidealfordeer (observed)andturkey (reported)aswellas coyote,fox,raccoon, skunk,andother small mammalsandbirds. Themeadowin theabandoned corn field providesarich sourceofberriesandseeds that combine withtheforest nutstocreateavaried dietforbirdsandother animals. Theflowering plantsin theold corn field also provideanectar sourceforbees, butterfliesandother pollinators. InVirginia, this typeofmeadow habitat,and itsdependent plantandanimal species,isincreasingly threatenedbydevelopmentandsuccessiontoforest. Several areas thatmight support vernal pools,animportant habitat componentformany woodlandamphibians, were observed. Theoverall landscape mosaicofmature hardwoods, openfieldandwater suggests tremendous possibilitiesfordiverse wildlifeon theproperty.

    One drawbackfo rwildlife isthat lackofsignificant stratification. Thegeneral lackofunderstory, possibly relatedtodeer browse, reducesthewildlife valueof thepropertyformany specieso fbirds that relyon theunderstory.Deer Management. Themost pressing problemofsound forest management inFairfaxCountyismanaging deer herds. Due todeer browsingwe aremissinganentireageclassoftrees throughouttheCountyand theyoungest canopy treesinmost forestparcelsareabout30yearsold. That equatestomore damage than gypsy moths(andprobablyallother mortality sources combined) have been abletoinflict. Whilethedeerdo notthreatenourexisting trees, theydomake regenerationof theforest impossibleandleadto theprospect that forests will disappear from Fairfax County overthenexthundred years.Thereare twosolutions. Firstthepropertycan befencedand thedeer removed. Thesecondis toreducethenumberofdeeron theproperty through hunting. Relocationisnotpossible sincea llwhite tail deer habitatisfull,sothere isnowheretosend them.Managing fertilityhasproven effective onlyincaptive deer herds. I am enclosingabrochureondeer managementinFairfax County.Invasive species:Anumberofnon-native plant species have become aggressivespreaders that displace native plantsin thelandscape. These plantsa retypicallyunpalatabletonative herbivoresand soescape predationand canfocusongrowthandreproduction. While many produce fruit thatiseatenbynative wildlife,thefruitisusuallyless nutritious than thato fdisplaced native plants. Theresult is alandscape with lessplantandanimal diversity. Ofparticular concerntoforestrya reinvasive vines, whichcanover-growandkill mature treesandthus representathreatto thecurrentaswellasthefuture forest.Th efollowing known invasives were observedon theproperty: Oriental Bittersweet[Celastrus orbiculata); Porcelain-berry {Ampelopsis brevipedunculata); Japanese stiltgrass (Microstegium vimineum); Autumn olive (Elaeagnus umbellate); Tree-of-heaven{Ailanthus altissima). I am enclosing fact sheets with informationonidentificationandcontroloneachofthese species.Water Quality; Th egenerally forested natureof theproperty provides excellent waterquality protectiontoCastle Creek,thePotomac Riverand theChesapeakeBay.Recreation: Thewildlife potentialof theproperty makesit anexcellent sitefo rhikingandwildlife viewing. Convertingtheexisting pasturetonative warm season grasseswould provide additional wildlife viewing opportunitiesbyattractingavarietyo fmeadowvertebrate, invertebrateandwildflower species. Withtheadditionoftrails,thepropertywould alsobeidealforbikingandhorseback riding.Forest Health:Forest diseases prevalentin theNorthern Virginia area: Gypsy moth(oaktrees), Woolyadelgid (hemlock trees), Anthracnose (dogwoodandsycamore trees)andEmeraldAshBorer(ashtrees). Thebestway tocombat outbreaksofthese diseasesis toknow yourforest. Walk itfrequentlyandnote trees thatarelooking sickly. Different diseases/infestations manifest themselves indifferent ways, someof thecommon characteristicstonoteare:severe defoliation, curling discolored leaves (look moldy), massesofinsectspresent inlarval forms (worms)orinsect fecal matter (massesofblackorwhite

Northof thefencetheundergrowth consistsmainlyoflowbush blueberryandgreen briar. Southof thefencetheforest floor iscovered with Japanese stiltgrassandinterspersed with Japanese barberry. Thisdifferencemay be due to thecattle, whicheat thestilt grassand canspreadtheseedintheir manure; deerdo not eatstilt grass.RECOMMENDATIONS:Th emost critical management considerationfo rthis parcelis torestoreth eunderstoryinthis parcel. Restoringtheunderstory will improvethewildlife habitatandensurecontinued diversityin theforest. Keepingthecattleout of theforestis onestep thatcanhelptheunderstory managingth edeerandinvasive populations will also improvetheunderstory.The parcelhas theopportunitytoproduce good quality timber, however oncethetimberisremovedit islikelytosucceedto amonocultureofbeech. Itconsistsofthree parcels, which can beidentified in theFairfax County taxm apsystem as 75-2 ((1)) -5Z & -19Z and 66-4 ((1)) -21Z.Forty-five acres iskept in hayproduction, pasture an dresidential use. Theremaining 160acres is inmanaged woodland whereselective timber harvesting andwildlife preservation practices are conducted.Thirty acresof theproperty w as recently bequeathed to afamily member Jeremy Vazquez.Multiple natural drainages flow through th eproperty, including Castle Creek,afirst order creekthat eventually discharges Popes Head Creek. These channels have approximately 6,400 linearfeeto fChesapeake BayResource Protection Area (RPA). Extended portionsof the tributariesleading into Castle Creek, that have slopes 15% orgreater have been delineated by theDepartment ofPlanning an dZoning asEnvironmental Quality Corridor (EQC).Soil types on thenorthern one-fifthof theproperty consist oforange soils which arecharacteristically soils with th epotential tooverlay naturally occurring asbestos material. Thisarea also hassome soils containing clays with high shrink-swell potential. Theremaining largerportion of the property consists ofsoil type (mainly Glenelg) with highly erodible potential.Considering th eoverall sensitivity ofthis property (i .e. RPA, EQC,potential fo rrocks tocontainasbestos, an dhighly erodible soils) th eland owners must beaware that: i)Excavations inbedrock orearthmoving activities within th enorthern one-fifthof theproperty m ay expose

    4)Upland a n d Riparian Forest ManagementNatural resource preservation practices fortrees, wildlifeandtheir habitats within these zonesmust beimplemented. Theforest management plan provided by the VADepartment ofForestryprovides most of thebasic practices toprotect andenhance this natural open space.Regarding th eriparian zone, th estream corridor must bewalk atfrequent intervals; especiallyafteramajor storm event to be sure atoppled tree orother drifted objectsare not lodged suchthat they enhance erosive conditions within th echannel.     58.1-3233. Determinations to bemade by local officers before assessment of real estate under ordinance.Priorto the assessment of anyparcel ofreal estate under an yordinance adopted pursuant tothis article, th elocal assessingofficer shall:1.Determine that th ereal estate meets th e criteria se t forthin 58.1-3230 and thestandards prescribed thereunder toqualify for one of theclassificationss etforth therein, and he may request anopinion fromth eDirectorof the Department ofConservation an dRecreation, th e State Forester or the Commissioner ofAgriculture an dConsumer Services;2.Determine further that real estate devoted solely to (i)agricultural orhorticultural us econsists of aminimum of fiveacres; except that fo rreal estate used forpurposes ofengaging inaquaculture asdefinedi n 3.2-2600or for thepurposes ofraising specialty crops asdefinedb ylocal ordinance, th egoverning body may byordinance prescribe that these uses consistof aminimum acreage of less than five acres, (ii) forestu se consists of aminimum of 20acres and (iii) open-space useconsists of aminimum of five acres orsuch greater minimum acreage as may be prescribed bylocal ordinance; except thatfo rreal estate adjacentto ascenic river, ascenic highway, aVirginia Byway orpublic property in theVirginia OutdoorsPlan or for anyreal estate in anycity, county ortown having adensity ofpopulation greater than 5,000 pe r square mile, forany real estate in anycounty operating under th eurban county executive formo f government, or theunincorporated TownofYorktown chartered in 1691, thegoverning body may byordinance prescribe that land devoted toopen-space usesconsist of aminimum of onequarter of anacre.T he minimum acreage requirements fo rspecial classificationso freal estate shall be determined byadding together th e totalarea ofcontiguous real estate excluding recorded subdivision lots recorded after July 1, 1983, titled in thesame ownership.However, fo rpurposes ofadding together such total area ofcontiguous real estate, an ynoncontiguous parcel ofrealproperty included in anagricultural, forestal, or anagricultural and forestal district oflocal significance pursuant tosubsection B of 15.2-4405 shall be deemed to becontiguous to anyother real property that islocated in such district. Forpurposes ofthis section, properties separated onlyb y apublic right-of-waya reconsidered contiguous; and

    3.Determine further that real estate devoted to open-space use is (i)within anagricultural, aforestal, or anagricultural andforestal district entered into pursuant toChapter 43 ( 15.2-4300 et seq.) ofTitle 15.2, or (ii) subjectt o arecorded perpetualeasement that isheld by apublic body, an d promotes th e open-space use classification,a sdefinedi n 58.1-3230.or (iii)subjectt o arecorded commitment entered intoby the landowners with th elocal governing body, or itsauthorized designee,not tochange the use to anonqualifyinguse for atime period stated in the commitment of notless than four years nor morethan 10years. Such commitment shall be subject touniform standards prescribed by theDirectorof the Department ofConservation an dRecreation pursuant to theauthority set out in 58.1-3240. Such commitment shall ru nwith th e land forth eapplicable period, and may be terminated in themanner provided in 15.2-4314 fo rwithdrawal ofland froma nagricultural, aforestalor anagricultural an d forestal district.

    58.1-3232. Auth ority ofcity to provide f o rassessment a n d taxation of real estate in newly annexed area.Thecouncil of anycity m ayadopt anordinance toprovide fo r the assessment and taxation ofonly th e real estate in anareanewly annexed to such city inaccord with th e provisions ofthis article. All of the provisions of this article shall beapplicable tosuch ordinance, except that if thecounty from which such area w as annexed has inoperation anordinancehereunder, th e ordinance of such city may be adopted at anytime prior toApril 1 of theyear fo rwhich such ordinance willbe effective,andapplications from landowners may be received at anytime within thirty daysof theadoption of theordinance in such year. Ifsuch ordinance isadopted afterth edate specified in 58.1-3231.t he ranges ofsuggested valuesmadeby theState Land Evaluation Advisory Council for thecounty from which such area w as annexed are to beconsidered th e value recommendations fo rsuch city. A nordinance adopted undert heauthority ofthis section shall beeffective only for the taxyear immediately following annexation.

    58.1-3233.     58.1-3234. Applicat ion by property owners f o rassessment, etc. , under ordinance; continuation ofassessment, etc.Property owners must submit anapplication fortaxation on thebasisof a useassessment to the local assessing officer:1. Atleast sixty days preceding the taxyear fo rwhich such taxation issought; or2. In anyyear inwhich ageneral reassessment isbeing made, th eproperty owner m ay submit such application until thirtydays have elapsed afterh isnotice ofincrease in assessment ismailed inaccordance with 58.1-3330. or sixty dayspreceding the taxyear, whichever is later; or3. In anylocality which hasadopted afiscalt axyear under Chapter 30 ( 58.1-3000 et seq.) of this Subtitle III, butcontinues toassess as ofJanuary 1,such application must be submitted for anyyear atleast sixty days preceding theeffective date of the assessment fo rsuch year.T hegoverning body, byordinance, m aypermit applications to befiled within nomore than sixty days afterthe filingdeadline specified herein, upon th epayment of a late filing fee to beestablished by thegoverning body. A n individual whoisowner of anundivided interest in aparcel m ayapply onbehalf ofhimself and theother owners ofsuch parcel uponsubmitting anaffidavit that such other owners ar eminors orcannot be located. A napplication shall be submitted wheneverthe use oracreage ofsuch land previously approved changes; however, noapplicafionfee may berequired when achangeinacreage occurs solely as aresult of aconveyance necessitated bygovernmental action or condemnation of aportion ofanyland previously approved fo rtaxafionon thebasis of use assessment. T hegoverning body of anycounty, city ortownmay,however, require an ysuch property owner torevalidate annually with such locality, on orbeforet hedate onwhich thelast installment ofproperty ta x prior to theeffective dateof theassessment is due, onforms preparedby thelocality, anyapplications previously approved. Each locality which hasadopted anordinance hereunder m ayprovide for theimpositionof arevalidation fe eevery sixth year. Such revalidation fe eshall not,however, exceed th e application fe ecurrently chargedby thelocality. Thegoverning body m ayalso provide fo r late filing ofrevalidation formson orbeforetheeffective date ofth e assessment, onpayment of a late filing fee.Forms shall bepreparedby the State TaxCommissioner an d supplied to thelocality fo r use of the applicants an dapplications shall be submitted onsuch forms.A n applicafionfee may be required toaccompany al lsuch applications.In theevent of amaterial misstatement offactsin theapplication or amaterial change insuch facts prior to the date ofassessment, such application fo rtaxation based on useassessment granted thereunder shall bevoid and the tax forsuch yearextended on thebasis ofvalue determined under 58.1-3236 D .Except asprovided bylocal ordinance, no application forassessment based on use shall be accepted orapproved if, at thefime th eapplication is filed, the tax on the land affectedisdelinquent. Upon th epayment of alldelinquent taxes, including penalties andinterest, th eapplication shall betreated inaccordance with th e provisions of this section.Continuation ofvaluation, assessment andtaxation under anordinance adopted pursuant to this article shall depend oncontinuanceof the real estate in a qualifyinguse,continued payment oftaxes asreferred to in 58.1-3235, andcompliancewith th eother requirements of this articleand theordinance and notupon continuance in thesame owner oftitle to the land.In theevent that th elocality provides for a sliding scale under anordinance, th eproperty owner and the locality shallexecute awritten agreement which sets forththeperiod oftime that th eproperty shall remain within th e classes ofrealestate se t forthin 58.1-3230. T hetermof thewritten agreement shall be for aperiod notexceeding twenty years, and theinstrument shall be recorded in the officeof theclerk of the circuit court for thelocality inwhich th esubject property islocated.

    58.1-3235. Remova l ofparcels from program iftaxes delinquent.If onApril 1 of anyyear th etaxes for anyprior year on anyparcel ofreal property which has aspecial assessment asprovided for inthis article ar edelinquent, th eappropriate county, city ortown treasurer shall forthwith send notice ofthatfactand thegeneral provisions ofthis section to theproperty owner by first-class mail. If ,afterth enotice hasbeen sent,such delinquent taxes remain unpaid onJune 1, thetreasurer shall notifythe appropriate commissioner of the revenue w hoshall remove such parcel fromth e land useprogram. Such removal shall become effectivefor thecurrent ta x year.

    58.1-3236. Valua tion of real estate under ordinance.A. Invaluing real estate fo rpurposes oftaxation by anycounty, city ortown which hasadopted anordinance pursuant tothis article, th ecommissionerof therevenue orduly appointed assessor shall consider only those indicia ofvalue whichsuch real estate has foragricultural, horticultural, foresto ropen space use, and real estate taxes fo rsuch jurisdiction shall beextended upon th evalue sodetermined. Inaddition to use of hispersonal knowledge, judgment an d experience as to thevalue ofreal estate inagricultural, horticultural, foresto r open space use, he shall, inarriving at thevalue ofsuch land,consider available evidence ofagricultural, horticultural, foresto ropen space capability, and therecommendations ofvalueof such real estate asmade by theState Land Evaluation Advisory Council.B. Indetermining th e total area of real estate actively devoted toagricultural, horticultural, foresto ropen space use thereshall be included th e area of allreal estate under bams, sheds, silos, cribs, greenhouses, public recreation facilitiesa nd likestructures, lakes, dams, ponds, streams, irrigation ditches andlike facilities;b ut real estate under, an d such additional realestate as may beactually used inconnection with, th efarmhouseorhome or any other structure notrelated to such specialuse, shall be excluded indetermining such total area.C. Allstructures which ar elocated on real estate inagricultural, horticultural, forestoropen space use and thefarmhouseorhome or any other structure notrelated to such special use and the real estate onwhich th efarmhouseorhome orsuch otherstructure islocated, together with th e additional real estate used inconnection therewith, shall bevalued, assessed an dtaxedby thesame standards, methods an d procedures asother taxable structures an dother real estate in the locality.D. Inaddition, such real estate inagricultural, horticultural, forestoropen space use shall be evaluated on thebasis offairmarket value asapplied toother real estate in thetaxing jurisdiction, and land book records shall be maintained toshowboth the usevalue and thefair market value of such real estate.

    58.1-3237. Cha nge in use or zoning of real estate assessed under ordinance; roll-back taxes.A .When real estate qualifiesf orassessment an d taxation on thebasis of useunder anordinance adopted pursuant tothisarticle, and the use bywhich itqualified changes to anonqualifying use, or thezoning of the real estate ischanged to amore intensive use at therequestof the owner or hisagent, itshall be subjectt oadditional taxes, hereinafter referred to asroll-back taxes. Such additional taxes shall onlybeassessed against that portion of such real estate which no longerqualifiesf orassessment an d taxation on thebasis of use orzoning. Liability fo rroll-back taxes shall attach and bepaid toth etreasurer only if theamount of tax dueexceeds te ndollars.B. Inlocalities which have not adopted asliding scale ordinance, th e roll-back ta x shall beequal to the sum of the deferredtax foreach of the five most recent complete ta xyears including simple interest onsuch roll-back taxes at arateset by thegoveming body, nogreater than th erate applicable todelinquent taxes insuch locality pursuant to 58.1-3916 fo reach ofthe taxyears. Inlocalities which have adopted asliding scale ordinance, th eroll-back ta x shall beequal to the sum of the deferredtaxfromtheeffective date of thewritten agreement including simple interest onsuch roll-back taxes at arateset by thegoveming body, which shall not begreater than th erate applicable todelinquent taxes insuch locality pursuant to 58.1-3916, foreachof the taxyears. Liability to theroll-back taxes shall no tattach when achange in ownership of thetitle takes place if the newowner does not rezone th e real estate to amore intensive use andcontinues th e real estate in the use forwhich it isclassified under th econditions prescribed inthis article and in theordinance. T he owner of anyreal estate which hasbeen zoned tomore intensive use at therequest of theowner or hisagentas provided insubsection E, orotherwise subject to or liable fo rroll-back taxes, shall, within sixty days following suchchange in use orzoning, report such change to the commissionerof the revenue orother assessing officeronsuch formsa smay beprescribed. T hecommissioner shall forthwith determine an dassess th eroll-back tax, which shall beassessedagainst an dpaidby theownerof thepropertyat thetime th e change in use which nolonger qualifies occurs, or at thetimeof thezoning of the real estate to amore intensive use at therequest of the owner or hisagent occurs, an d shall bepaid to

    th etreasurer within thirty days of the assessment. If theamount due is not paid by the due date, th etreasurer shall impose apenalty and interest on the amount of theroll-back tax,including interest fo rprior years. Such penalty an d interest shall beimposed inaccordance with 58.1-3915 an d58.1-3916.E.Real property zoned to amore intensive use, at therequest of theowner or his agent, shall be subject to and liablefo r theroll-back tax at thetime such zoning ischanged. Theroll-back ta x shall belevied an dcollected fromth eowner of therealestate inaccordance with subsection D.Real property zoned to amore intensive usebefore July 1, 1988, at therequest of theowner or hisagent, shall be subject to andliable for theroll-back tax at thetime th equalifyinguse ischanged to anonqualifyinguse.Real property zoned to amore intensive use at therequest of the owner or hisagent after July 1, 1988,shall be subject to andliable for theroll-back tax at thetime ofsuch zoning. Said roll-back tax,plus interest calculated inaccordance with subsection B, shall belevied an dcollected at thetime such property w as rezoned. Forproperty rezoned afterJuly 1, 1988, butbefore July 1, 1992, nopenalties orinterest, except asprovided in subsection B , shall beassessed, providedth esaid roll-back tax ispaid on orbefore October 1, 1992. Noreal property rezoned to amore intensive use at therequest ofth e owner or hisagent shall be eligible fo rtaxation andassessment under this article, provided that these provisions shall notbe applicable to anyrezoning which isrequired fo r theestablishment, continuation, orexpansion of aqualifyinguse. If theproperty is subsequently rezoned toagricultural, horticultural, oropen space, itshall beeligible fo rconsideration forassessment andtaxation under this article only after three years have passed since th e rezoning w as effective.However, th e owner of anyreal property that qualified fo rassessment and taxation on thebasis of use, andwhose realproperty w as rezoned to amore intensive use at theowner's request prior to 1980, may be eligible fo rtaxation andassessment under this article provided th eowner applies fo rrezoning toagricultural, horticultural, open-space orforestuse.The real property shall beeligible fo rassessment an dtaxation on thebasisof thequalifyinguse for the taxyear followingth eeffective date of the rezoning. If any such real property issubsequently rezoned to amore intensive use at theowner'srequest, within five years fromthedate th eproperty w asinitially rezoned to aqualifyingu seunder this section, th eownershall be liable fo rroll-back taxes when th eproperty isrezoned to amore intensive use.Additionally, th eowner shall besubjectt o apenalty equal tofifty percent of theroll-back taxes due asdetermined under subsection B ofthis section.F. Ifreal estate annexed by acity an dgranted usevalue assessment an d taxation becomes subjectt oroll-back taxes, an d suchreal estate likewise hasbeen granted us evalue assessment an dtaxationby thecounty prior toannexation, th ecity shall collectroll-back taxes an dinterest for themaximum period allowed under this section an d shall return to thecounty ashare of suchtaxes andinterest proportionate to theamount ofsuch period, if any, forwhich th e real estate w assituated in the county.

    58.1-3237.1. Authority of counties to enact additional provisions concerning zoning classifications.A ny county no torganized under th eprovisions ofChapter 5 ( 15.2-500 et seq.), 6 ( 15.2-600 et seq.), or 8 ( 15.2-800etseq.) ofTitle 15.2,which iscontiguous to acounty with th eurban executive formo fgovernment and anycounty with apopulation of noless than 65,000 and nogreater than 72,000 m ay include th efollowing additional provisions in anyordinance enacted under th eauthority ofthis article:1. Thegoverning body m ayexclude land lying inplanned development, industrial orcommercial zoning districts fromassessment under th e provisions ofthis article. This provision applies only tozoning districts established prior toJanuary 1,1981.2. Thegoverning body m ayprovide that when th ezoning of theproperty taxed under th e provisions ofthis article ischanged toallow amore intensive nonagricultural use at the request of theowner or hisagent, such property shall not beeligible forassessment an d taxation under this article. This shall notapply, however, toproperty which iszoned agriculturaland issubsequently rezoned to amore intensive usewhich iscomplementary toagricultural use,provided such propertycontinues to be ownedby the same owner w ho owned th eproperty prior torezoning an d continues tooperate theagricultural activity on theproperty. Notwithstanding anyother provision of law,such property shallbesubject to andliable fo rroll-back taxes at thetime th ezoning ischanged toallow any usemore intensive than the use forwhich itqualifiesf orspecial assessment. Theroll-back tax, plus interest, shall becalculated, levied and collected fromth eowner ofth e real estate inaccordance with 58.1-3237 at thetime th eproperty isrezoned.

    58.1-3238. Fail ure to report change in use; misstatements inapplications.A nyperson failingtoreport properly any change in use ofproperty fo rwhich anapplication for usevalue taxation hadbeenfiled shall be liable for all such taxes, insuch amounts and atsuch times as if he hadcomplied herewith and assessmentshadbeen properly made, and he shall be liable fo rsuch penalties an dinterest thereon as may beprovided byordinance.A nyperson making amaterial misstatement offact in anysuch application shall be liable for allsuch taxes, in suchamounts and atsuch times as ifsuch property hadbeen assessed on thebasis offair market value asapplied toother real

    estate in thetaxing jurisdiction, together with interest andpenalties thereon. Ifsuch material misstatement w asmade withth e intent todefraudthelocality, he shall befurther assessed with anadditional penalty of 100percent ofsuch unpaid taxes.For purposes of this section and 58.1-3234, incorrect informationon thefollowing subjects will beconsidered materialmisstatements offact:1. The number an d identitiesof theknown ownersof thepropertyat the time ofapplication;2. The actual use of theproperty.The intentional misrepresentationof the number ofacres in theparcel or the number ofacres to betaxed according to useshall also be considered amaterial misstatement offactfor thepurposes of this section and 58.1-3234.

    58.1-3239. State Lan d Evalu ation Advisory Comm itte e conti nued as State Land Evaluation Advisory Council;membership; duties; ordinances to befiled with Council.TheState Land Evaluation Advisory Committee iscontinued an dshall hereafterb e known as theState Land EvaluationAdvisory Council. TheAdvisory Council shall becomposed of the Tax Commissioner, th edeanof theCollege ofAgriculture ofVirginia Polytechnic Institute an dState University, th eState Forester, th e Commissioner ofAgriculture andConsumer Services and the Director of theDepartment of Conservation an dRecreation.T heAdvisory Council shall determine an dpublish arange ofsuggested values fo reachof the several soil conservationservice land capability classificationsf o ragricultural, horticultural, foresta ndopen space uses in thevarious areasof theCommonwealth asneeded tocarry out the provisions ofthis article.On orbefore October 1 o feach year th eAdvisory Council shall submit recommended ranges ofsuggested values to beeffectiveth efollowing January 1 orJuly 1 in thecase oflocalities with fiscal year assessment under th eauthority ofChapter 30 ofthis subtitle, within each locality which has adopted anordinance pursuant to theprovisions ofthis articlebased on theproductive earning power of real estate devoted toagricultural, horticultural, foresta ndopen space usesandmake such recommended ranges available to thecommissionerof the revenue orduly appointed assessor ineach suchlocality.T heAdvisory Council, indetermining such ranges ofvalues, shall base th e determination onproductive earning power tobedetermined by capitalization ofwarranted cash rents or by thecapitalization of incomes of like real estate in the localityor areasonable area of thelocality.A nylocality adopting anordinance pursuant tothis article shall forthwith fileacopy thereof with th eAdvisory Council.

    58.1-3240. Duties of Director of the Department ofConservation a n d Recreation, th e State Forester and theCommissioner ofAgriculture a n d Consumer Services; remedy ofperson aggrieved by action o rnonaction ofDirector, State Forester o r Commissioner.

    T heDirectorof the Department of Conservation and Recreation, th eState Forester, and theCommissioner ofAgricultureandConsumer Services shall provide, after holding public hearings, to the commissioner of the revenue orduly appointedassessor ofeach locality adopting anordinance pursuant to this article, astatementof the standards referred to in 58.1-3230 an d subdivision 1 of 58.1-3233, which shall beapplied uniformly throughout th eCommonwealth indeterminingwhether real estate isdevoted toagricultural use,horticultural use, forest use or open-space use for thepurposes ofthisarticle and the procedure to be followedb ysuch officialtoobtain th e opinion referenced in subdivision 1 of 58.1-3233.Upon th e refusalof theCommissioner ofAgriculture and Consumer Services, th e State Foresteror the Director of theDepartment ofConservation an dRecreation toissue anopinion or in theevent of anunfavorable opinion which doesnotcomport with standards se tforthin thestatements filed pursuant tothis section, th eparty aggrieved m ayseek relief in thecircuit court of thecounty orcity wherein th e real estate inquestion islocated, and in theevent that th ecourt finds in hisfavor,it may issue an order which shall serve in lieu of anopinion for the purposes of this article.

    58.1-3241. Sepa rati on ofpart of real estate assessed under ordinance; contiguous real estate located in morethan on etaxing locality.A.Separation or split-offo flots, pieces orparcels ofland fromth ereal estate which isbeing valued, assessed an dtaxedunder anordinance adopted pursuant to this article, either by conveyance orother action of theowner of such real estate,shall subjectt he real estate so separated to liability for theroll-back taxes applicable thereto, but shall not impair th e rightofeach subdivided parcel ofsuch real estate toqualifyf o rsuch valuation, assessment an dtaxation in any and all future

    years, provided itmeets th eminimum acreage requirements an dsuch other conditionsofthis article as may beapplicable.Such separation or split-offo f lots shall not impair th erightof theremaining real estate to continuance ofsuch valuation,assessment andtaxation without liability fo rroll-back taxes, provided itmeets th eminimum acreage requirements andother applicable conditions of this article.N o subdivision ofproperty which resultsinparcels which meet th eminimum acreage requirements ofthis article, andwhich th eowner attests is for one ormore of thepurposes se t forthi n 58.1-3230, shall be subjectto theprovisions ofthissubsection.B.Where contiguous real estate inagricultural, horticultural, foresto ropen-space use in one ownership islocated inmorethan onetaxing locality, compliance with th eminimum acreage shall be determined on thebasisof the total area ofsuchreal estate and not thearea which islocated in theparticular taxing locality.

    58.1-3242. Taki ng ofreal estate assessed under ordinance by right ofeminent domain.The taking ofreal estate which isbeing valued, assessed andtaxed under anordinance adopted pursuant tothis article byright of eminent domain shall not subject th e real estate sotaken to theroll-back taxes herein imposed.

    58.1-3243. Applica tion ofother provisions ofTitle 58.1.The provisions ofthis title applicable to local levies andreal estate assessment an dtaxation shall be applicable toassessments an dtaxation hereunder mutatis mutandis including, without limitation, provisions relating to taxliens, boardsof equalization and the correction oferroneous assessments and forsuch purposes th eroll-back taxes shall be considered tobedeferred real estate taxes.

    58.1-3244. Article not inconflict with requirements f o rpreparation and use of true values.Nothing in this article shall be construed to be inconflict with th e requirements fo rpreparation and use oftrue values whereprescribed by the General Assembly for use in anyfund distribution formula.
