1 INTRODUCTION
1.1 BACKGROUND INFORMATION The Department of Trade and Industry (DTI) developed the SEZ policy to support and accelerate industrial development in targeted regions where socio-economic growth has been problematic. This would be achieved by the provision of special measures needed to develop targeted industrial and agricultural capabilities and attract targeted foreign and domestic direct investment. The SEZ policy has four (4) specific objectives:
— Support the development of targeted industrial capabilities and attract foreign and domestic direct investments in support of the Industrial Policy Action Plan (IPAP) and Provincial Industrial Development Strategies (PIDS’s), under the over-arching National Development Plan (NDP);
— Develop world-class industrial infrastructure in line with the requirements of the targeted industries and investments;
— Promote beneficiation and further value addition of the country’s mineral and agricultural resources; and
— Contribute to the creation of sustainable jobs and increase exports of beneficiated commodities in the targeted regions.
The Wild Coast Special Economic Zone (WCSEZ) is intended to address the under-development of industry and agriculture in the Wild Coast region, the elevated unemployment levels, particularly among the youth, and unacceptable high levels of poverty.
The viability of the proposed WCSEZ will depend on the suggested approach, which will be phased.
1) Phase 1 – mainly Sector development cluster (Agro-processing Sector) housing facilities to unlock the primary sector with the hub near Mthatha Airport.
2) Phase 2 – Services Sector that will focus on the support industries for Agro-processing. This could include Logistics and Distribution, Business Process Outsourcing (BPO), Call Centres and others. Further investigations need to be done to enhance the value proposition and viability of this Sector. This second Phase will also contain value added support infrastructure such as accommodation, skills and training centre, a commercial node and innovation and industrial services nodes.
It is envisioned that increased commercial activity in the area will assist in the development of the tourism sector.
The Coega Development Corporation (CDC) is a state-owned enterprise (SoE) based in the Nelson Mandela Bay Municipality with operations throughout South Africa. The CDC is mandated to develop and operate the 11 500 ha Coega Industrial Development Zone (IDZ), which was established in 1999. To this end, the CDC is tasked with the responsibility to create employment, provide training and development, and Small and Medium Sized Enterprises (SMME) support and development opportunities, in order to reduce unemployment, inequalities, and to eradicate poverty in the Eastern Cape (EC), with a focus on Nelson Mandela Bay Metro, in particular. Therefore, the CDC’s vision is to be the leading catalyst for the championing of socio-economic growth. Its mission is to provide a competitive investment location supported by value added business services that effectively enables socio-economic development in the EC and the rest of South Africa. In the 17 years since its establishment, the CDC has become South Africa’s most successful IDZ and has matured to become one of the biggest drivers of job creation and development of the EC economy. It is purpose-designed following the cluster model, which strategically positions related and synergistic industries and their supply chains in close proximity to one another in order to maximise efficiency and minimize turnaround times. The Coega IDZ is demarcated into 14 zones, with the focus being placed on the following sectors:
— Metals/Metallurgical;
— Automotive;
— BPO;
— Chemicals;
— Agro-processing;
— Logistics;

— Trade Solutions;
— Energy; and
— Maritime.
The CDC strives to improve the delivery of infrastructure in the EC by addressing skill shortages, unemployment, constrained planning and project management capacity, under-expenditure, sub-standard infrastructure, and inefficiencies that characterise delivery of infrastructure by government in South Africa generally and the EC in particular. In the process, the CDC advances socio-economic development and transformation within the EC and South Africa as a whole.
The proposed project site for the WCSEZ is directly adjacent to the Mthatha Airport, with boundaries at both the north and the south of the airport as shown in Figure 1-1 below. The site is north of the R61 and to the south of the Mtata Dam.

1.2 PUBLIC PARTICIPATION Public participation is understood to be a series of inclusive and culturally appropriate interactions aimed at providing stakeholders with opportunities to express their views, so that these can be considered and incorporated into the decision-making process. Effective public participation requires the prior disclosure of relevant and adequate project information to enable stakeholders to understand the risks, impacts, and opportunities of the Proposed Project.
Basic reasons why we involve public in the EIA:
— The environment is held in public trust, therefore use of environmental resources is everyone's concern.

— Public participation is proper, fair conduct in public decision-making activities. Focus on vulnerable and disadvantaged person and offer equitable participation due to historical issues.
— A way to ensure that projects meet the citizens' needs and are suitable to the affected public.
— The project carries more legitimacy, and less hostility, if IAPs are able to influence the decision-making process.
— Finally, the final decision is informed when local knowledge and values are included and when expert knowledge is publicly examined.
1.2.1 OBJECTIVES
The objectives of the public participation process can be summarised as follows:
— Identify relevant individuals, organisations and communities who may be interested in or affected by the Proposed Project;
— Clearly outline the scope of the Proposed Project, including the scale and nature of the existing and proposed activities;
— Identify viable Proposed Project alternatives that will assist the relevant authorities in making an informed decision;
— Identify shortcomings and gaps in existing information;
— Identify key concerns, raised by Stakeholders that should be addressed in the subsequent specialist studies;
— Highlight the potential for environmental impacts, whether positive or negative; and
— To inform and provide the public with information and an understanding of the Proposed Project, issues and solutions.
1.2.2 WHAT IS AN INTERESTED AN AFFECTED PARTY?
An I&AP is defined as any person, group of persons or organisations interested in or affected by an activity, and any organ of state that may have jurisdiction over any aspect of the activity.
The difference between an I&AP and a registered I&AP:
— An I&AP can be directly or indirectly impacted on by a proposed activity.
— A registered I&AP is a person whose name has been placed on the register of registered I&APs. According to the PPP Guidance document, 2017, only registered I&APs will be notified:
- Of the availability of reports and other written submissions made to the CA by the Applicant, and be entitled to comment on these reports and submissions; and
- Of the outcome of the application, the reasons for the decision, and that an appeal may be lodged against a decision.
For the purpose of this report, registered I&APs will be referred to as Stakeholders.
RIGHTS, ROLES AND RESPONSIBILITIES OF THE STAKEHOLDER
Registered stakeholders have the right to bring to the attention of the competent authority any issues that they believe may be of significance to the consideration of the application. The rights of stakeholder are qualified by certain obligations, namely:
— Stakeholders must ensure that their comments are submitted within the timeframes that have been approved by the Department of Environmental Affairs (DEA), or within any extension of a timeframe agreed by the Proponent, EAP or competent authorities;
— Serve a copy of the comments submitted directly to the competent authorities, the Proponent or the EAP; and
— Disclose to the EAP any direct business, financial, personal or other interest that they might have in the approval or refusal of the application.
The roles of stakeholders in a public participation process usually include one or more of the following:
— Assisting in the identification and prioritisation of issues that need to be investigated;

— Making suggestions on alternatives and means of preventing, minimising and managing negative impacts and enhancing Proposed Project benefits;
— Assisting in or commenting on the development of mutually acceptable criteria for the evaluation of decision options;
— Contributing information on public needs, values and expectations;
— Contributing local and traditional knowledge; and
— Verifying that their issues have been considered.
In order to participate effectively, stakeholders should:
— Become involved in the process as early as possible;
— Register as a stakeholder;
— Advise the EAP of other stakeholders who should be consulted;
— Contribute towards the design of the public participation process (including timeframes) to ensure that it is acceptable to all stakeholders;
— Follow the process once it has been accepted;
— Read the material provided and actively seek to understand the issues involved;
— Give timeous responses to correspondence;
— Be respectful and courteous towards other stakeholders;
— Refrain from making subjective, unfounded or ill-informed statements; and
— Recognise that the process is confined to issues that are directly relevant to the application.
1.3 APPROACH TO STAKEHOLDER ENGAGEMENT Our approach to stakeholder engagement is based on the following principles:
— Undertake meaningful and timely participation with stakeholders;
— Focus on important issues during the process;
— Undertake due consideration of alternatives;
— Take accountability for information used;
— Encourage co-regulation, shared responsibility and a sense of ownership over the Proposed Project lifecycle;
— Apply “due process” particularly with regard to public participation as provided for in the EIA Regulations; and
— Consider the needs, interests and values of stakeholders.
The Public Participation guideline in terms of NEMA EIA Regulations, drafted by the Department of Environmental Affairs, 2017, tabulates the level of Public Participation required for various levels of anticipated project impacts. This table has been used to identify additional Public Participation methods which are required for the project. Highlighted cells indicate the applicable response to the anticipated impacts. Results of the process are shown in Table 1-1 below.

The results of the above assessment show that the following additional mechanisms would need to be employed for this project:
A public meeting with the landowners, the Link Community, was organised in order to present the EIA process and DSR. Members of the King Sabata Dalindyebo Local Municipality (KSDLM) were also invited to attend the meeting. The Link Community acquired the land following a successful land claim as explained in the FSR. This meeting was scheduled to be held on 24 April 2018, the day the EAP was also conducting distribution of the DSR and site notices at the public venues and the local authorities in Mthatha. On arrival at the venue, the EAP was informed that some members of the community were not happy with how the land claim process was proceeding.
It must be noted that the disagreement was not targeted at the project, but was related to leadership power struggles within the community. A faction of the community had formed a parallel committee to the existing one with regards to the land claim issue. The root of the problem can be linked to the fact that the project will generate income for the individuals listed on the land claim in the form of rentals paid by the eventual inhabitants of the project area. Due to this dispute, the public meeting to present the EIA process and the potential projects impacts was cancelled and was set to be rescheduled. The EAP and the CDC proceeded to have a meeting with the KSDLM members and the community leadership at the CDC Mthatha Office. A key output of the meeting was a suggestion to employ a Social Facilitator to assist in dealing with the key issues in the community as well as engage the Chief of the local area in order to resolve the community issue. The meeting minutes and the attendance register for this follow-up meeting are attached as Appendix D-1 of this report.
It must be noted that the conflict is related to the community leadership with respect to the client and is not related to the EIA Process. The CDC has since engaged the Chief of KwaNcise Community (Chief Makaula) in order to have the issue resolved. During this meeting, it was agreed that the Chief would be approached for any potential communication with the community. He would then be responsible for communicating the outcome to the community members so that the consultants do not directly engage with the community outside of the Chief’s presence. The meeting minutes for this follow-up meeting are attached as Appendix D-2 of this report.

2 PUBLIC PARTICIPATION TO DATE
2.1 SCOPING PHASE PROCESS There was no formal pre-application public participation process undertaken to obtain comments on the proposed project prior to submission of the S&EIA application. During the pre-application phase, the EAP used attendance registers of the community and landowner meetings to get stakeholder details and informally brief them on the proposed development. An advert was published in the Daily Dispatch Newspaper on 25 April 2018. Site notices were put up on 24 April 2018 at the following points:
— Mthatha High School;
— Mthatha Public Library;
— Fence on Site Boundary; and
— King Sabata Dalindyebo Municipality.
2.1.1 IDENTIFICATION OF KEY STAKEHOLDERS
Section 41 of the 2017 EIA Regulations states that written notices must be given to identified stakeholders as outlined in Table 2-1.
Relevant authorities (Organs of State) have been automatically registered as I&APs. In accordance with the EIA Regulations, 2017, all other persons must request in writing to be placed on the register, submit written comments or attend meetings in order to be registered as stakeholders and included in future communication regarding the project.

Appendix A provides a list of stakeholders registered on the project database. The stakeholders along with the date on which they registered and reference to comments received, where applicable are indicated in Table 2-4. The stakeholder database will be updated throughout the Scoping and EIA process.
2.1.2 NOTIFICATION PROCEDURES
DIRECT NOTIFICATION
Notification of the proposed project was issued to potential Interested and Affected Parties (I&APs) and stakeholders, via direct correspondence (i.e. site notices, email and sms) on 24 April 2018. The purpose of the notification was to offer potential I&APs and Stakeholders the opportunity to register on the project database and provide input into the process at a very early stage of the process (i.e. prior to the submission of the application forms) to ensure the major concerns had been considered adequately, reducing the potential for amendments to the report following formal commencement of the process.
All notifications distributed to registered stakeholders are included in Appendix C-3 of this report.
ADVERTISEMENT
Notification of the proposed project was issued to the general public via an advertisement on 25 April 2018. As above, the purpose of the advertisement was to notify the general public of the proposed application and provide an opportunity to register on the project database and provide input into the process. A copy of the advertisement is included as Appendix C-1. The advertisement publication details are provided in Table 2-2.

FINAL SCOPING REPORT
The Final Scoping Report (FSR) was submitted to the DEA on 8 June 2018 as well as on the WSP website on the link provided above. The DEA accepted the FSR on 17 July 2018 and allowed the application to progress to the environmental impact assessment phase.
AVAILABILITY OF THE DRAFT ENVIRONMENTAL IMPACT ASSESSMENT REPORT
The Draft Environmental Impact Assessment Report (EIAR) was placed on public review for a period of 30 days from 10 August 2018 to 10 September 2018 at the following venues:
Mthatha High School (55 Victoria Street); and
Mthatha Public Library (34 Owen Street).
Additionally, an electronic version of the report was placed on the WSP website to be accessed by the public at the link referenced above.
2.1.3 STAKEHOLDER REGISTRATION
The Application form was submitted to the DEA on 25 April 2018. This was the same day the advertisement notifying I&APs was published in the Daily Dispatch. Stakeholders have since called in or sent emails to the EAP requesting to be added to the stakeholder register as well as ask questions regarding the project. All the stakeholders who contacted the EAP are indicated in Table 2-4.
2.1.4 SCOPING PHASE COMMENTS RECEIVED
Comments received from registered stakeholders during the Scoping Phase have been captured and responded to within the comments and response tables included in Table 2-4. The original comments and responses are included in Appendix E.

A copy will be sent to Mr Andre de Vries of the DoT who is responsible for the Mthatha Airport. Mr Paullin Naidoo from Airports Company South Africa (ACSA) is the Mthatha Airport Manager. Both parties were added to the stakeholder database.
SAHRA and DAFF had not received copies of the DSR during the public review period. Copies of the FSR will be submitted to both entities when distribution is done.

commercial farming operations that are located, but not limited to the King Sabata Dalindyebo (KSD) local municipality.
Our intended farming operations fall within the scope of the 14-sector development projects identified in Page 32 of the Draft Scoping Report.
Issue 1
As the document was read, we were weary of making offside comments as there was some degree of confusion as to whether solicited comments were on the Environmental Impact Assessment (EIA) aspects covered in the report or the WSEZ project scope and its feasibility. The confusion arose due to the fact that, it seems, the Final Scoping Report purpose is the required approval by the Department of Environmental Affairs (DEA) on the environmental impacts of this project.
Issue 2
There is a need to tightly align the Wildcoast Special Economic Zone (WSEZ) Final Scoping Report with the King Sabata Dalindyebo (KSD) local municipality's Integrated Development Plan (IDP) 2017/18 - 2022 programmes that are related to or have an impact on this project.
As a key stakeholder, KSD IDP programmes speak of the development of Mqanduli as an agricultural node with AGRO processing capabilities, Viedgesville as a Logistics hub and Mthatha Airport as a spatial economic zone for linking business opportunities.
On the other hand, this project speaks of Phase 1 as focussing on 14 sector development projects (agro-processing sector) housing facilities to unlock the primary sector with the hub near Mthatha Airport. Reference is to Page 32 of the WSEZ Draft Scoping Report. Its Phase 2 speaks of developing the Services Sector within the hub, including but not limited to Logistics and Distribution.
At face value there seems to be a duplication of efforts between the two entity initiatives, i.e. KSD IDP high impact programmes and this Coega Development Corporation (CDC) initiative. The needs to be a clear

Issue 2
There has been a series of meetings that were between the KSD and the District Municipality about the WCSEZ. This means that the KSD Municipality is aware of the WCSEZ.
Issue 3
This issue is more of the strategic stance in the province that has to be directed to Coega when the individual activities are to be considered. This phase only covers land clearance to allow for future development.
Following this email trail, Mr Nyati contacted the EAP via telephone and it was further clarified that the current EIA process was separate from specific projects as it targeted getting the EA to clear the area before any future projects on the area are then individually authorised.

resolution, - or a mapped way forward towards such a resolution, of this apparent overlap between the KSD IDP and the WSEZ Final Scoping Report. This will ensure that limited financial resources will not be spread thin on projects seeking to achieve the same goal.
Issue 3
There seems to be a gap in understanding the production capacity of current primary sector players within the Wild Coast region. Will that capacity be able to provide enough production input to profitably drive the agro-prosessing facilities at full capacity or will the intended production within the allocated 164ha be able to fill the production gap? Are there initiatives and budget allocations, perhaps by the Department of Rural Development and Agrarian Reform (DRDAR) and/or KSD local municipality to capacitate local players within the Wild Coast region.

We are still in the scoping phase of the EIA process. We have since submitted the final scoping report to the authorities so that they give their decision. If they accept our scoping phase findings, we will proceed to the EIA phase. We will then submit another draft EIA report for authorities and public review for 30 days. After this stage, we then submit the final EIA report to the authorities for them to grant the authorisation or not.
I will add you to the stakeholder database in the meantime so that you will be in our correspondence in the EIA phase. We are operating as the Environmental Assessment Practitioner on behalf of the CDC to acquire the Environmental Authorisation for the clearance of the area and the setting up of service infrastructure. However, the individual businesses that will set up will then run their individual environmental authorisation processes depending on the activities they will conduct. With regards to your project, you will need to approach the CDC as we are only responsible for the EIA process.

10.1.1 According to the Eastern Cape Biodiversity Conservation Plan (ECBCP), aquatic conservation priorities highlighted for the project area and planned development site include the catchment draining north towards the Mthatha Dam which has been identified as an aquatic Critical Biodiversity Area (CBA) 1 and 2; therefore the land-use planning must take into account the linkages between catchments, important rivers and sensitive estuaries, with a key focus around limiting transformation in CBA catchments.
The wetland habitat impact assessment report attached as Appendix E-3 of the EIR takes into account the linkages between catchments, important rivers and sensitive estuaries. It provides mitigation measures to limit transformation in CBA catchments and these have been included in the EMPr to ensure they are binding when the authorisation is issue.

The PPP has been conducted in terms of the relevant regulations as required. Prior to the submission of the application, the CDC conducted stakeholder consultation, specifically landowner consultation as the proposed project site was part of a land claim that was awarded to local community members (Link community) in order to get approval to use the land for the project.
During the scoping phase, site notices were put up at the project site boundary fence, the local High School (Mthatha High School), Mthatha Library and at the King Sabata Dalindyebo Local Municipality. An advert was placed in the Daily Dispatch on 25 April 2018 as required. The site notices and the advert invited any member of the public interested to register on the stakeholder database. I&APs were added to the database through the scoping phase as required. The site notices and the advert also indicated the locations of the draft scoping report for their perusal in order to provide comments as well as the duration of the comment period.
Notifications in the form of email and sms were sent to the I&APs on the existing database before new additions were made in order to alert them on the availability of the draft scoping report. When the final scoping report was submitted to the DEA and the commenting authorities, the original I&APs as well as the new additions made during the registration

A Biodiversity Offset Plan will not be developed as it is typically a complex and costly exercise. As a result, a compromise has been made to conserve part of the site (a third of the site) to protect the wetlands and biodiversity on the site and only make use of the rest. Furthermore, due to site limitations, this is the best available site for productive use of land considering lack of available land close to the airport and for access to main roads (R61 and N2) for logistics linkages.

3.6 Following a conversation with Mrs Gertze over the phone, she indicated that the Protected Areas map indicating the Nature Reserves (Nduli and Luchaba Reserves) in the report was wrong. She pointed out that on the actual GIS layers, the site was not within the Nature Reserve boundary and that this would be indicated in the comments. She also indicated that she would send the correct layers to use for the maps as indicated below:

78 of the Draft BAR is incorrect. Please correct the map with the spatial data provided to WSP on 5 October.
We note that the Special Economic Zone comprise of two preferred sites, namely Phase 1 North and Phase 1 South. Based on our spatial information only the preferred site for Phase 1 North falls within 5 km buffer of our nearest protected area, Luchaba Nature Reserve which fall within the Mthatha Moist Grassland in the Grassland Biome (Mucina and Rutherford). Due to the different land uses in between Luchaba Nature Reserve and proposed preferred site for the Special Economic Zone, we foresee no negative impact on the Luchaba Nature Reserve.

3.6.1.2 The ECPTA is also the custodian of the Eastern Cape Protected Area Expansion Strategy (ECPAES). None of the proposed development sites does not fall in any of the priority expansion areas identified by the ECPAES. However, based on the landscape characteristics and different land uses between the proposed Special Economic Zone and priority expansion areas, we foresee no threat to the priority expansion areas identified within the ECPAES.

Thanks for the attendance register.
Will be speaking for the regional Environmental Impact Management (EIM) section.
Apart from other Biodiversity issues, one major concern was the issue of wetlands around and on the proposed site for the SEZ. However, it was comforting to note that this issue is covered in the studies conducted and submitted to your offices. Would also advise for consultation with Department of Water Affairs, just to get their stand on the issue, and maybe considering recreational facilities for one of the least degraded wetlands as part of compensating for the severely degraded wetlands. Municipality was part of the site visit and meeting, so will not talk to availability of infrastructure, I believe the issue was tackled during the meeting.

BACKGROUND AND LOCATION
The Coega Development Corporation (CDC) proposes to develop a Special Economic Zone (SEZ) in the Wildcoast area of Mthatha around the Mthatha airport. The SEZ will be for commercial and industrial development and will be occupied by various types of businesses, which in turn, will require their own individual authorisations when they intend to develop. Due to the nature of the construction, the CDC is required to follow a Scoping and Environmental Impact Reporting (S&EIR) process to gain environmental approval prior to the commencement of the Proposed Project.
ENVIRONMENTAL APPLICATION
The following legislative requirements are applicable: — NEMA: GNR 327, Activities 9, 10, 12, 19 and 24; — NEMA: GNR 325, Activity 15; and — NEMA: GNR 324, Activities 4, 12, 14 and 15.
The following legislative requirements are applicable for triggered water use activities: — NWA: Section 21(c) impeding or diverting the flow of water in a watercourse and Section 21(i) altering the bed, banks,
course or characteristic of a watercourse. REGISTRATION
WSP Environment and Energy (WSP) has been appointed as the independent Environmental Assessment Practitioner (EAP), to manage the S&EIR process. Parties wishing to formally register as stakeholders in order to offer their comment on the Proposed Project are requested to forward their full contact details to the EAP at the details provided below. Registered stakeholders will be forwarded all future correspondence, and notified individually of additional opportunities to participate in the process.

The Coega Development Corporation (CDC) proposes to develop a Special Economic Zone (SEZ) in the Wildcoast area of Mthatha around the Mthatha airport. The SEZ will be for commercial and industrial development and will be occupied by various types of businesses, which in turn, will require their own individual authorisations when they intend to develop. Due to the nature of the construction, the CDC is required to follow a Scoping and Environmental Impact Reporting (S&EIR) process to gain environmental approval prior to the commencement of the Proposed Project. ENVIRONMENTAL APPLICATON
The following legislative requirements are applicable:
— NEMA: GNR 327, Activities 9, 10, 12, 19 and 24;
— NEMA: GNR 325, Activity 15; and
— NEMA: GNR 324, Activities 4, 12, 14 and 15.

Thank you for the response. I will confirm with the team regarding the date so that they can make their travelarrangements. I will send a formal meeting request to ensure we are all on the same page. As shown in the kmz, thetwo proposed land parcels are directly adjacent to the Mthatha Airport with one on the north and the other to thesouth. For security reasons, we arrange all site visits in conjunction with the Mthatha Airport Security Manager toarrange for access to the land parcels, hence, we will congregate at the airport security desk first so that we all moveas a group.
At this point, my assumption is that the DEA personnel and myself will be using the first flight out of Johannesburgand arrive at 07:30. In order to accommodate those traveling from East London, we can set the meeting to start at10:00 as this will give your team enough time to drive back during the day, although we will have to wait 2,5 hoursfor your arrival and after your departure. If Ms Makeleni is from the Mthatha office of the ECPTA, please let meknow so that we can set travel times that allow for more flexible travel. I will send a formal meeting requesttomorrow to Ms Makeleni after I find out how the DEA personnel intend to travel so that we do not assumeanything.

Thanks for the attendance register.
Will be speaking for the regional Environmental Impact Management (EIM) section.
Apart from other Biodiversity issues, one major concern was the issue of wetlands around and on the proposed sitefor the SEZ. However, it was comforting to note that this issue is covered in the studies conducted and submitted toyour offices. Would also advise for consultation with Department of Water Affairs, just to get their stand on theissue, and maybe considering recreational facilities for one of the least degraded wetlands as part of compensatingfor the severely degraded wetlands. Municipality was part of the site visit and meeting, so will not talk to availabilityof infrastructure, I believe the issue was tackled during the meeting.

Thank you for providing us a platform to raise issues on this very important initiative by the CoegaDevelopment Corporation (CDC).
Who we are:
We represent Embo Farms (Pty) Ltd (reg no. 2018/081989/07), which is a 100% black woman-ownedcompany. It has intentions of establishing commercial farming operations that are located, but not limited tothe King Sabata Dalindyebo (KSD) local municipality.
Our intended farming operations fall within the scope of the 14-sector development projects identified inPage 32 of the Draft Scoping Report.

Issue 1
As the document was read, we were weary of making offside comments as there was some degree ofconfusion as to whether solicited comments were on the Environmental Impact Assessment (EIA) aspectscovered in the report or the WSEZ project scope and its feasibility. The confusion arose due to the fact that,it seems, the Final Scoping Report purpose is the required approval by the Department of EnvironmentalAffairs (DEA) on the environmental impacts of this project.
Issue 2
There is a need to tightly align the Wildcoast Special Economic Zone (WSEZ) Final Scoping Report withthe King Sabata Dalindyebo (KSD) local municipality's Integrated Development Plan (IDP) 2017/18 - 2022programmes that are related to or have an impact on this project.
As a key stakeholder, KSD IDP programmes speak of the development of Mqanduli as an agricultural nodewith AGRO processing capabilities, Viedgesville as a Logistics hub and Mthatha Airport as a spatialeconomic zone for linking business opportunities.
On the other hand, this project speaks of Phase 1 as focussing on 14 sector development projects (agro-processing sector) housing facilities to unlock the primary sector with the hub near Mthatha Airport.Reference is to Page 32 of the WSEZ Draft Scoping Report. Its Phase 2 speaks of developing the ServicesSector within the hub, including but not limited to Logistics and Distribution.
At face value there seems to be a duplication of efforts between the two entity initiatives, i.e. KSD IDP highimpact programmes and this Coega Development Corporation (CDC) initiative. The needs to be a clearresolution, - or a mapped way forward towards such a resolution, of this apparent overlap between the KSDIDP and the WSEZ Final Scoping Report. This will ensure that limited financial resources will not bespread thin on projects seeking to achieve the same goal.
Issue 3
There seems to be a gap in understanding the production capacity of current primary sector players withinthe Wild Coast region. Will that capacity be able to provide enough production input to profitably drive theagro-prosessing facilities at full capacity or will the intended production within the allocated 164ha be ableto fill the production gap? Are there initiatives and budget allocations, perhaps by the Department of RuralDevelopment and Agrarian Reform (DRDAR) and/or KSD local municipality to capacitate local playerswithin the Wild Coast region.

We are still in the scoping phase of the EIA process. We have since submitted the final scoping report tothe authorities so that they give their decision. If they accept our scoping phase findings, we will proceed tothe EIA phase. We will then submit another draft EIA report for authorities and public review for 30 days.After this stage, we then submit the final EIA report to the authorities for them to grant the authorisation ornot.
I will add you to the stakeholder database in the meantime so that you will be in our correspondence in theEIA phase. We are operating as the Environmental Assessment Practitioner on behalf of the CDC toacquire the Environmental Authorisation for the clearance of the area and the setting up of serviceinfrastructure. However, the individual businesses that will set up will then run their individual

Thank you for the response. I will confirm with the team regarding the date so that they can make their travelarrangements. I will send a formal meeting request to ensure we are all on the same page. As shown in the kmz, thetwo proposed land parcels are directly adjacent to the Mthatha Airport with one on the north and the other to thesouth. For security reasons, we arrange all site visits in conjunction with the Mthatha Airport Security Manager toarrange for access to the land parcels, hence, we will congregate at the airport security desk first so that we all moveas a group.
At this point, my assumption is that the DEA personnel and myself will be using the first flight out of Johannesburgand arrive at 07:30. In order to accommodate those traveling from East London, we can set the meeting to start at10:00 as this will give your team enough time to drive back during the day, although we will have to wait 2,5 hoursfor your arrival and after your departure. If Ms Makeleni is from the Mthatha office of the ECPTA, please let meknow so that we can set travel times that allow for more flexible travel. I will send a formal meeting requesttomorrow to Ms Makeleni after I find out how the DEA personnel intend to travel so that we do not assumeanything.

We acknowledge had not added you to the stakeholder database at the beginning of the project, hence there wasno communication to you during the scoping phase. The draft EIAR was submitted on 10 August 2018 to thestakeholders, commenting and competent authorities that were identified during the scoping phase. This was donevia publication of a Newspaper advert, The Daily Dispatch, which was published on 25 April 2018 as well as sitenotices that were put up at the Mthatha Library, Mthatha High School, King Sabata Dalindyebo Local Municipalityand at the site fence on 24 April 2018.
The hard copies of the draft EIAR for public engagement were made available at the Mthatha Library and MthathaHigh School as well as our company website under the link below on 10 August 2018:

Stakeholders were informed of the availability of the report via email and sms. Please note that the report is available on the link above, however, due to sizeconstraints all appendices are available on request as will be indicated on the website.

As discussed over the phone, we are the Environmental Assessment Practitioner on the proposed development of aSpecial Economic Zone on 2 land parcels adjacent to the Mthatha Airport. The project is now in the EnvironmentalImpact Assessment (EIA) phase as the scoping phase passed and was approved by the Department of EnvironmentalAffairs (DEA). Please find the attached copy of the draft EIA report for your perusal. Due to size requirements, I haveonly put up the report and any appendices will be available on request.
The DEA: Biodiversity Conservation Unit have requested for a site visit and have asked us to ensure that you are alsopart of the meeting. We have proposed that the meeting be held in the week of the 17th of September. The actualdate is still to be decided but it will be for that week. You have indicated that you are not available from the secondweek of September until October, but you can link us to another person who can attend. Please provide his/herdetails after your internal discussion. I will also add your details to the stakeholder database. (a) The attendance register was circulated and signed by all present.
3 BACKGROUND AND DISCUSSION
(a) Environmental Impact Assessment (EIA) Public participation meeting that was
scheduled to take place at Link Location on the day.
(b) The WCSEZ Program team spent about an hour 30 minutes on open area talking to
the members of the community.
(c) The aim of the meeting was for the Environmental Specialists consultants (WSP) to
present to kwa Link community the environmental impacts by the project and the
community be given a period of thirty days to express their comments on the
information provided to them regarding the work.
(d) Upon arrival we the team was welcomed by the Members of the large number of
community who claimed to have appointed new leadership in the community.
(e) We were told by these members that if we want to talk about development in their
land we must talk to them and disregard the leadership we know.
(f) Secondly, if we want to meet they are prepared to meet on one condition that we go
to kwa Bhodi (community leader) and not where we usually hold our meetings at Mr.
Tinzi’s.

(g) The EIA meeting was arranged with the assumption that the WCSEZ Committee will
invite the community and by judging by the number of people who were there on our
arrival, it was clear that the community was indeed invited.
(h) The community refused to allow the meeting to continue, claiming that the meeting
must take place in kwa Bodi. Their conduct was threatning, saying that if we don’t
do their way, we must go.
(i) It was mentioned that the public participation process is legislative and must take
please, so that public views must be noted and documented.
(j) The community suggested that we consult with their Chief (Chief Makawula) who is
responsible for that area.
(k) It was noted that the project team already met with chief Makawula who gave a go
ahead to operate on the land.
(l) Before the meeting with the chief, the project team would have had a meeting with
Mr. Chifadza (WSP) to explain the implications of not proceeding with the
community meeting.
(m) It was mentioned that Public participation process was to be advertised on the
Mthatha express and The Daily Dispatch the following day, 25th April 2018. The
members of the community has thirty days to comment, then they can comment via
email, letter.
(n) Mr. Chifadza to assure the team that the relevant documentation have been lodged
with the relevant statutory authorities such as municipalities, schools, library.
(o) The community present was guaranteed that the at that moment there was nothing
stoping the project.
(p) It was explained that the thirty days (30) period is for the lodging and noting of the
comments by the members of the public on environmental implications. The EIA
consultants (WSP) will then compile a Comments and Responses Report which will
be submitted together with Final Scoping.
(q) No technical issues regarding the EIA, only the community issues that needs to be
sorted out.

4 WAY FOWARD
(a) Attendees from the Link community were asked to report any invaders to the land
intended for SEZ.
(b) The WCSEZ Project team to write the letter requesting the meeting with Chief
Makawula to discuss a way forward on this matter.
(c) The letter to the Chief to include a request for a permission to invite the Councilor
for Ward 12 (Mrs Rhori) and KSD representatives.
(d) A suggestion to employ the Social Facilitator to deal with social issues which seem
to be the burning issue was noted.
(e) The community committee was encouraged to involve everybody, when there’s a
scheduled meeting, they must not exclude anyone.
(f) The community of Kwa Link was encouraged to sit down, talk and resolve their
differences/ issues.
(g) The Community committee must meet with the Department of Rural Development
and arrange a Community Property Association (CPA).
(h) After the formation of CPA, Department of Rural Development needs to create a
transactional advisor which will act as commercial arm to be the link between the
community and the SEZ.
5 CLOSURE
(a) The chairperson thanked everyone in attendance.

2 SIGNING OF ATTENDANCE REGISTER
(a) The attendance register was circulated and signed by all present.
3 PURPOSE OF THE MEETING AND DISCUSSION
(a) The meeting was to inform the Chief of KwaNcise Location about the progress in the
Mthatha Wild Coast SEZ project and to report back about the EIA Public
Participation meeting that was scheduled to take place at Link Location on the 24th
April 2018.
(b) Report back on progress made on compliance issues around environmental impact
and the progress of the Mthatha WCSEZ project.
(a) The Project Executive briefed the Chief regarding the EIA Public particition meeting
that was scheduled to take place on the 24th April 2018. Explaining what transpired
on the day.
(b) The presentations on WCSEZ Master plan was presented and explained, the need
for a long term lease agreement and how the community will benefit from the
project.

4 WAY FOWARD
(a) It was suggested that the EIA Public participation meeting was supposed to have
been organized via Chief then the Chief would spread the word to all the locations
involved.
(b) The meeting that will involve all the stakeholders was to be organized, it was
suggested that all the signed agreements pertaining the Mthatha WCSEZ must be
tabled in that meeting.
(c) The chief must be present in that meeting and not send a representative.
(d) It was suggested that the Mthatha WCSEZ Team must seek guidance and
assistance from Komkhulu especially with issues involving the community.
(e) The corporation from all stakeholders involved was encouraged.
(f) It was mentioned that the EIA Process is anticipated to be concluded by November
2018.
(g) The need for social facilitator to act as a link between the community and all involved
stakeholders was raised.
(h) It was mentioned that the EIA for Phase 2 of the project will start soon.
5 CLOSURE
(a) The chairperson thanked everyone in attendance.
(b) There being no further business discussed, the meeting was adjourned at 10H05.
