The Problem
➢ Cigarette smoking in the modern world has been
seriously increasing, and so are the deaths
associated with it.
➢ Cigarette smoke contains over 7,000 chemicals.
➢ Over 69 of them have been identified to cause
cancer.
➢ Tobacco is also bad for health.

The Problem
➢ Cigarette smoking is directly responsible for
90% of lung cancer deaths.
➢ Cigarettes are the most prominent source of
preventable deaths or illnesses every year.
➢ Cigarettes are also responsible for over 80% of
emphysema and chronic bronchitis deaths.

The Problem➢ Smoking-related diseases claim over 443,000
American’s lives every year.
➢ Smokers die
about 10 years
earlier than
non-smokers.

Cincinnati #18 for
smoking.
➢ 19.6% of adults in
Cincinnati are
smokers.
➢ About 20% of adults

Government➢ These reasons force us to believe that if the
government does not get involved, smokers could
petition the government for a change of laws in the
next few years.
➢ This is unlikely, granted, but it is possible. If this
happens, then smoking related deaths could
increase severely.

Government➢ The government must be involved.
➢ If the government is not involved, then addiction to
nicotine could also severely raise deaths related to
smoking.

not a good idea.

Our Goal
➢ Our goal is to ban smoking completely in Ohio.
➢ We hope to either
■ Modify the current ban of smoking.
■ AND/OR create a new ban, which restricts
smoking in all places.

This document states the exceptions to the smoking ban in Ohio.
Private Residences, Hotel room’s designated for smoking and Family owned and operated places of
employment, are some of the exceptions to the smoking ban.
Nursing homes, Retail tobacco stores, outdoor patios and Private clubs without employees are also

The Current Law
No proprietor of a public place, or a place
of employment shall permit smoking,
except as permitted in section 3794.03 of
this chapter.

The proprietor of any public place or place of
employment shall ensure that tobacco smoke
does not enter any area in which smoking is
prohibited under this chapter through any
means.

in any manner retaliate against an individual
for exercising any right, including reporting a
violation.

when requested to do so by the proprietor or

Disagreements
➢ There have been some disagreements about the
effect of the ban on e-cigarettes.
➢ One disagreement is that students at Ohio State say
e-cigarettes, cigarettes that do not contain tobacco,
should not be banned.
➢ These cigarettes heat up nicotine, an extremely
addicting chemical, and turn it into mist that the
user inhales.
Alternative Policy Examples
➢ E-cigarettes must be banned because they can
cause an addiction to nicotine.
➢ We insist that e-cigarettes be banned for kids under
18 years old.
➢ The policy in Ohio does not govern e-cigarettes.

Alternative Policy Examples➢ Since the Ohio ban does not govern e-cigarettes,
even a 11 year old can go to the store and purchase
an e-cigarette!
➢ Since e-cigarettes contain nicotine, using them
could create severe addiction to cigarettes in the
future.
➢ Those kids could even smoke at their own house if
the current law is not changed.
➢ This is our possible solution to the problem.

- Organizationally you should also put your advantages/disadvantages with your policies. So it looks something like

○ The 21 year old ban will spark controversy,
which will be addressed later in the
presentation.

○ The 21 year age ban may spark controversy.
○ We will resolve this by simply stating that the
age ban is for the good of people.
○ If children get addicted
to nicotine in e-cigarettes,
then they are more likely to
smoke in secret, like some teenagers do every
day.

➢ Another alternative policy is to ban smoking in
all areas except specifically designated ones.
➢ Designated areas will have smoking cabins.
➢ People may smoke 2 times per month.
➢ Children are not allowed in designated areas.

except designated areas.
○ These buildings must also have special signs,
so children will not be allowed.
○ These places will purify tobacco smoke.

○ This policy will have the main problem of cost.
○ Many people might want there to be more smoking
areas in a city.

○ As addressed before, the 18 year old age ban
will be a problem.
○ People would want to smoke more, but the ban
has to be strict to control smoking.

➢ Yet another alternative policy is to ban tobacco
completely.

Public Policies➢ Since Ohio is one state, we have to choose only
one policy that can fulfill all requirements.
➢ The requirements are:
○ Policy must sufficiently reduce smoke.
○ Policy must relate to e-cigarettes.
Decision Time➢ We have gone through all the advantages and
disadvantages of all proposed policies.
➢ We have picked the first policy, because it fulfills
the requirements, and it controls e-cigarettes
sufficiently.
➢ We will explain the advantages and
disadvantages again.
Proposed Public Policy➢ We have chosen Policy 1
○ This does not ban other products that contain
tobacco, so people will not be irritated.
○ This policy will also effectively set up an age ban
to e-cigarettes, so there will be a lower chance of
early addiction to nicotine.
➢ The state and the government are the only ones that
can enact a policy, so they are responsible for this.

person caught smuggling cigarettes.
○ All airports and places of entry in Ohio will be
monitored for bringing cigarettes.
Prohibition➢ People believe that no country can ban anything
completely.
➢ We believe that we can ban smoking completely.
➢ Bhutan is the only country in the world to
completely ban smoking.
Prohibition
➢ New Zealand and Finland are looking forward to
ban smoking by 2040.
➢ We believe that if Bhutan can do it, then
America-- one of the most powerful countries in
the world-- can let its states ban smoking.
Advantages➢ For our chosen policy, these are the advantages:
○ This policy bans smoking tobacco in Ohio, so
the 443,000 deaths that occur each year will
severely decrease.
○ This policy has the advantage
of adding a new ban, specifically
for e-cigarettes, since there is no
ban controlling them currently.
Disadvantages➢ For our first policy, these are the disadvantages:
○ This policy has only one major disadvantage.
○ The 21 year old ban might spark conflict,
requesting to change the age to 18.
○ The 21 year old ban is good because it helps
keep children, and young adults off cigarettes.
○ This keeps them safe from
nicotine addiction.
Constitutional?➢ According to the article: “The Constitutionality of Laws,”
our law is constitutional.
➢ The 4 ways for a law to be unconstitutional are
○ The law violates a specific right explicitly.
○ The law violates a specific law implicitly.
○ The law violates a general right explicitly.
○ The law violates a general law implicitly.
➢ Our proposed law do not meet any of the above criteria.
Constitutional?
➢ According to “Gallup Poll”, 22% of Americans want to ban
smoking completely in the United States.
➢ If smoking can be banned in the entire U.S., then we have
to believe that it can be banned in its states.
➢ If this law can be created, then it must be constitutional.
