Welcome to Witham Industrial Watch Limited’s Proposal for a Business Improvement District scheme (BID) in our industrial areas, between 2014 and 2019.

InJuly2009businessesonWitham’sindustrialestatesvotedtocreateaBusinessImprovementDistrict(BID)andpayannualcontributionstowardsafundusedforservices,projectsandeventsthatbenefitbusinessesandemployeesinthearea.Sincethen,wehaveembarkedonsomeambitiousprojectsreflectingtheneedsofourlevy-payingmembers.

ThisdocumentidentifiesthekeyproposalsinourBIDscheme,providesyouwithfulldetailsonhowtheBIDoperatesandillustrateshowthecontinuationoftheschemewillimprovefurtherthesecurityandworkingenvironmentforyourbusinessandyouremployees.

The estates are clean with little or no crime. Roads are gritted and there is a feeling of safety.

2. Business Improvement disTrict

2.1 WHAT IS A BUSINESS IMPROVEMENT DISTRICT (BID)?

A Business Improvement District (BID) is a five year scheme that enables improvement projects to be undertaken within a specific area; these improvements would not otherwise be undertaken due to a lack of drive, organisation or council funding. The projects relate to security issues, signage, parking, traffic flow, litter control etc. A BID also creates a strong sense of community.

BusinessImprovementDistrictsarevotedforandfundedbyratepayerswithinthesespecificareas.ManysuccessfulBIDschemesareinplaceacrosstheU.K.tothebenefitofthebusinessesandtheircustomersandemployees.Witham’sindustrialestateshaveenjoyedthebenefitsofaBusinessImprovementDistrictbetweentheyears2009-2014.AsaBIDlastsforonlyfiveyearsratepayersinthisareamustnowdecidewhethertovoteforafurtherfiveyears.

AYESvoteforWithamindustrialestates’BIDinJulywillresultinthecollectionofasmalllevy,1%ofrateablevaluewithacapat£2000,fromalltheindustrialarearatepayersintheBIDarea.Seepage25foramapofthearea.ThelevyiscollectedbyBraintreeDistrictCouncilandpassedtoWithamIndustrialWatchLtdtofundtheservicesandfacilitiesoutlinedinthisProposal.Thefundsareringfencedandcannotbeusedforotherprojectsoutsidetheindustrialareas.

2.2 WHY IS A BUSINESS IMPROVEMENT DISTRICT (BID) NEEDED ON OUR ESTATES?

A BID is needed because without funding and management the condition and reputation of Witham’s industrial estates will not improve; in fact things will deteriorate.

Crimeisaparticularconcernforbusinessesontheestates.BIDfundingplaysabigpartincrimepreventioninthearea.Theftofpersonalpropertyaffectsemployeesandcanbeveryupsettingbutthetheftofmachinery,vehiclesandequipmentpreventscompaniesconductingtheirbusinesseffectively;itcoststimeandmoney,disruptsproductionandcandelayorders,whichcouldevenresultinlostcustomers.

BIDfundingisalsousedtokeeptheestatestidy,keepthetrafficflowingandgenerallybuildconfidenceintheareasothatprospectivenewbusinessesandinvestorswanttocometoWitham.Athrivingindustrialareaattractsmoresuccessfulbusinessesandprovideslocalemploymentopportunitieswhichiscrucialforthetown.

LandlordsofpropertieswithintheBusinessImprovementDistrictderivegreatbenefitfromthescheme.Thelowcrimeratemakespropertieslessvulnerablewhenemptyandapropertyletsquickerwithinanareathatiswellcaredforandwellmanaged.

InaBusinessImprovementDistrictthesmallbusinessesbenefitasmuchasthelargercompanies.BIDfundinghelpstoprovideasafer,cleanerandgreenerenvironmentforeveryone.

2.3 HOW DO LOCAL COUNCILS & POLICE FIT INTO THE PICTURE?

Witham Industrial Watch uses its influence to ensure that Witham Town Council, Braintree District Council, Essex County Council and Essex Police provide the full range of services they are bound to provide within the Business Improvement District.

ThecloserelationshipwhichhasdevelopedbetweentheseagenciesandWithamIndustrialWatch,duringthe2009-2014BIDperiod,hasledtoamutualunderstandingofeachothers’needs;thisresultsinamoreefficient,timelyprovisionofservices.

Witham Industrial watch has made a huge difference to security in the area. Simarco has noticed a large reduction in incidents since its implementation . Through Dave Cocker and the team we feel we have a true partnership with the Police secure in the knowledge that we are being listened to.

Witham Industrial Watch (WIW) has made the following improvements to the industrial estates:

3.1 WIW APPOINTED AN ESTATE MANAGER

Witham Industrial Watch made an immediate start in 2009 with the recruitment of an Estate Manager. In January 2010 David Cocker took up the post and immediately set about implementing the improvements that the businesses had asked for. The Estate Manager’s responsibilities and achievements are many and far reaching; they include:

Theft is an increasing problem on many industrial sites in the UK but thanks to Witham Industrial Watch and BID funding, the estates in the BID area are bucking the trend with reducing crimes rates.

3. What has BID 2009-2014 Achieved?

3.6 WIW HAS ENCOURAGED TRADING AND A SENSE OF COMMUNITY

Witham Industrial Watch has encouraged businesses on the estates to trade with each other and to feel part of a community. It is not unusual now for companies in the area to offer free pallets to their neighbouring businesses and secure parking over a Bank Holiday. This strong community spirit has been achieved by:

3.7 LOOKING FORWARD TO BID 2014-2019

The Witham Industrial Watch team has an enormous sense of pride in all the above achievements. The area is often held up as a model example of an industrial estate and has even been given recognition in Parliament. We feel we have made great inroads over the last five years, however, we are aware that there is more work to be done on the estates and with your ‘YES’ vote, we cannot wait to get started.

Witham Industrial Watch subscribes to the ‘broken window’ theory that litter leads to more litter and broken windows lead to more broken windows, which in turn lead to vandalism and breaking and entering etc. A tidy estate attracts new businesses to move in.

Until a few years ago it was dangerous to use the estate roads and even the pavements, during bad weather. When snow fell it became compacted by the weight of HGVs, creating deep ruts which were treacherous to drive on. A number of drivers reported near-misses on icy roads and even pedestrians feared for their safety with out of control vehicles mounting pavements.

WithamIndustrialWatch(WIW)lobbiedEssexCountyCouncilforaroadsaltingandgrittingservice.ItwasfinallyagreedtheywouldprovidetheserviceforFreebournesRoadonly.WithamIndustrialWatchthereforetookmattersintoourownhandsandappointedthecontractor,Mitie,tosaltandgritalltheotherestateroads.ItisabigexpensefortheBusinessImprovementDistrictandabigresponsibilityfortheEstateManagerandaDirectortodecideifovernightgrittingshouldtakeplace,butwellworthittokeeptheareasafe.Additionally,WithamIndustrialWatchhasmadetheareasaferby:

-averyhard-hittinglobbyingcampaigntoensuretheestates’lightsremainonovernight

-takingactiontoremoveimmediatehazardssuchasoilspills,fallentreesoroverheadcables

-takingactionwhenvehiclesareparkedinhazardouslocations-arrangingforovergrownhedgestobecutbacksothatpedestriansarenotforcedtowalkintheroadordrivers’visibilityobscured

4. Frequently Asked Questions

4.1 IS THE WITHAM INDUSTRIAL WATCH BID PART OF BRAINTREE DISTRICT COUNCIL?

No. WIW BID is managed by businesses and operates solely to deliver projects that are chosen by the businesses it represents within the BID area and which are paid for by the BID levy. These projects are additional to the baseline services provided by public agencies.

4.2 ISN’T THIS WHAT I PAY MY BUSINESS RATES FOR?

No. Business Rates are a national tax that is collected by the Council and then redistributed at a national level. The income from Business Rates is spent throughout Essex on statutory and discretionary services for residents and businesses but businesses have very little influence in how that income is spent. The BID levy is kept and spent locally, within the designated area. It is based on 1% of the rateable value of the business unit and the income will be used to fund additional services as decided by the businesses.

4.3 WILL MY RATES INCREASE?

Business Rates are set by national and local governments so if your rateable value increases your rates will increase. However, the BID levy has been agreed at 1% of the rateable value at the time of the ballot and will be fixed for the 5 year term of the BID.

4.4 IF I VOTE NO WILL I STILL PAY THE LEVY?

Yes. If the ballot is successful, with the majority voting in favour of the BID, the levy is mandatory and will be collected from all businesses within the designated area by Braintree District Council on behalf of Witham Industrial Watch.

4.5 WHAT SERVICES WILL BE PROVIDED BY THE LOCAL AUTHORITIES?

It is understood that baseline services currently provided by Braintree District Council and Essex County Council will continue at existing levels:

4.6 HOW IS THE BID MANAGED?

Witham Industrial Watch Ltd. is a not for profit company which currently consists of five Directors, representing the BID levy payers, who meet regularly to ensure that the designated projects are fulfilled, to liaise with local authorities, and to oversee the efficient management of the company.

4.7 HOW IS THE WORK OF THE COMPANY MONITORED?

A Monitoring Committee comprising representatives from different parts of the BID area regularly attend meetings of the Board of Directors and are fully informed of their discussions and activities.

4.8 WILL I BE KEPT INFORMED?

Yes. Information about the projects, crime reports, alerts and other relevant communications are relayed by email, website news, Twitter and quarterly meetings which all levy payers can attend for updates and discussion.

4.9 WHO PAYS THE BID LEVY IF A PROPERTY IS UNOCCUPIED?

Where a property is unoccupied the registered business ratepayer will be responsible for paying the BID levy so that all businesses in the area make a contribution towards making Witham industrial estates a safer, greener place to work.VOTE

5. Consultation & Communication

5.2 PUBLIC MEETINGS

Businesses within the Business Improvement District are invited to quarterly meetings. At these meetings levy payers receive updates on the improvements to the area from the Witham Industrial Watch Board and from the Estate Manager. Baverstocks Chartered Accountants provide management accounts and answer any financial questions. The meetings are attended by partners Braintree District Council and Essex Police who provide an update on crime in the area. Specialist speakers attend as the need arises, such as CCTV installers and parking/traffic consultants.

Themeetingsprovideanopportunityforthelevypayingbusinessestodiscussproblems,getinvolvedwiththesolutionsandmeettheneighbours!Thosethatcannotattendreceiveminutesofthemeetings.

On14thMarch2014businessesintheBIDareawereinvitedtotheLaunchofBID2014-2019atTiptreePatisserie.TheeventwassupportedbyPritiPatelMP,ChiefInspectorRichardMelton,theMayorofWitham,Cllr.Mrs.CorinneThompsonandrepresentativesfromBraintreeDistrictCouncil.Thismeetingwaswellreportedinthepress.

5.3 WEBSITE

The WIW website includes the latest crime prevention advice, news of meetings and updates on Business Improvement District activities. A directory of businesses on the estates with links to their websites is available on the site and there is the opportunity to post promotional offers.

Earlier this year we asked what improvements you would like for the estates in 2014-2019. We received three important messages from this survey, which are:

We, as a local business, feel part of the community, and much more secure, knowing we have WIW just a call and email away. David has assisted many companies with thefts on the industrial estates and attempted thefts, sharing CCTV footage and information . We have greater visibility to deter such instances. Witham Industrial Watch’s Spring 2013 Satisfaction Survey gave us the clear message that you are very satisfied with the work currently undertaken, including crime prevention measures, the Estate Manager, David Cocker, road gritting and lobbying for improvements. So we will keep on doing what we are doing on those fronts!

In the years 2014-2019 WIW will:

Road GrittingWIWwillarrangeforsaltingandgrittingoftheroadsduringsnowyweather.

Arrange for More Estate SignageWIWwillarrangefortheinstallationofadditional,clearersignageontheestates.

Improve the Estates’ Appearance WIWwillcarryoutworktohelpmaketheestateslooktidier,suchashedgetrimming,plantingandtheremovalofunauthorisedsigns.WIWwillalsoengagewithbusinesseswhohaveundulyscruffypremises.

Road & Path RepairWIWwillcontinuetolobbythelocalauthoritytoensureroadandpathrepairsarecarriedoutinatimelyfashion.

Litter PreventionWIWwillcontinuethegoodworkwiththelocalauthoritytopreventlitteringontheestatesandremovelitterquickly.

Improved Traffic Flow & Addressing Parking ProblemsWIWwillimplementtheactionpointsthatarosefromthetrafficsurveyandconsultancymeetingswiththeestatebusinesses,thatwerecarriedoutbyCapitalTraffic.

7. FINANCIAL PROJECTIONS

The Witham BID will raise a minimum of £119,000 per annum through its BID levy. This levy will be 1% of the rateable value of each defined rate payer in the BID area. A maximum contribution will be capped at £2,000 per annum. There are approximately 350 eligible businesses in the proposed BID area. The levy will be utilised exclusively in the defined BID area to deliver as far as possible the wishes of the businesses paying the levy.

INCOME

BID Levy Income: Theincomeiscalculatedbasedupon1%oftheestimatedyearlyrateablevaluewithacapof£2,000forbusinesseswiththelargestrateablevalue.Thecapisrelevantwheretherateablevalueofthepropertyismorethan£200,000.Therearecurrentlyanumberofpropertieswitharateablevalueofmorethan£200,000withincomecappedat£2,000.Estimatedincomeisadjustedtotakeintoaccountthehigherrateablevaluesofpropertieswhicharecapped.

Other Income:Itisassumedthattherewillbeadditionalsourcesofincomeat£3,000perannum;examplesofthesourcesofincomearedetailedtotheright(theanalysisisnotcomprehensiveandmaybesubjecttochangeoverthecourseoftheproject).

Estate ManagementThesecostsrelatetothemanagementoftheWithamIndustrialEstate.ItisassumedthatthecurrentemployeewillcontinuetocarryoutthistaskforthedurationoftheBID.Employers’nationalinsuranceisassumedpayableatarateof13.8%.

Telephone, Broadband & Closed Circuit Television LinesTheserelatetotherentalcostsandcallchargesforthevarioustelephonelinesrequiredfortheoffice,broadbandandtheCCTVsystems.

Automatic Number Plate Recognition (ANPR)ThemonthlycostsofmaintainingtheANPRsystems.

Closed Circuit TelevisionThesecostsrelatetothemonthlymaintenanceandpowersupplycostsofrunningtheCCTV

GrittingThisrelatestothecostofgrittingthedesignatedindustrialareasduringthewintermonths.

WebsiteThecostinyear1relatestotheupgradingofthewebsite,whereascostsinfutureyearsareforthemaintenanceofthewebsite.

GENERAL OVERHEADS

Anoverheadbudgethasbeenincludedintheincomeandexpenditureprojections.Thisbudgetisbasedonthecurrentassessmentofoperatingoverheadsandisintendedtocovergeneraladministrationoverheads,examplesofwhicharedetailedabove(theanalysisisnotcomprehensiveandmaybesubjecttochangeoverthecourseoftheproject).

FIXED ASSETS

FixedassetsacquiredduringthefirstBIDtermwerebynecessityfullydepreciatedattheendoftheterm.ThiswasduetothefactthattherewasnocertaintythattherewouldbeasecondBIDterm.

Theseassetshoweverhadaresidualvalueat30September2014andithasbeenassumedthatifthesecondBIDvoteissuccessfulthefixedassetsat30September2014willberevaluedat50%oftheiroriginalvalue.Theseassetswillthenbedepreciatedoverthe5yearsofthesecondBIDterm.

Anyadditionstofixedassetsinthesecondtermwillbedepreciatedover5yearssothatallfixedassetvaluesarereducedtonilby30September2019.AgainthisisduetothefactthatthereisnocertaintythattherewillbeathirdBIDterm.

DIRECTORS’ REMUNERATION

WithamIndustrialWatch(WIW)isoperatedbyahighlyprofessionalboardofdirectors,mostofwhomhavebeeninvolvedsinceWIWwasformedovereightyearsago.Duringthistimemanythousandsofhoursoftheirtimehavebeengivenonavoluntarybasisaswellasgiving,freeofcharge,theresourcesoftheircompanies.ItisproposedthatduringtheBID2014-2019termsometokenremunerationfortheBoardofWIWmaybeintroduced.ThiswillensurethatpositionsontheBoardcancontinuetobefilledbyprofessional,experiencedcompanydirectorstomakesuretheBusinessImprovementDistrictremainsinthebestpossiblehandsgoingforward.

Cash Surplus

Thecashflowprojectionshavebeenpreparedtoensurethattheprojectremainscashpositiveduringitslifetime.Atcertaintimesthecompanywillhavesurpluscashandpossiblyacashbalanceattheendofyear5.Itisproposedtodealwithcashsurplusesasfollows:

1. Usedwhenpossibletobringforward,reviseordealwithadditionalrequirementsfromthemembersduringthelifetimeoftheproject.

2. IftheBIDceasedtoexist,thenreturnedbywayofarebatetobusinessespayingthelevyattheendofthe5thyear.Therebatewillbeapportionedproratatothetotalcontributioneachbusinesshasmadeintermsofthelevyovertheprevious5years.

8. bid arrangements

The Business Improvement District ballot, levy and collection and alterations of arrangements.

8.1 THE BUSINESS IMPROVEMENT DISTRICT BALLOT

Ballot papers will be despatched by Electoral Reform Services, on behalf of Braintree District Council, on or after the 1st July, 2014. The ballot will close on the 30th July, 2014.

Aratepayerwillbeentitledtovoteiftheywerelistedasanon-domesticratepayeronthedatethenoticeofballotispublished.Inthecaseofanempty,partlyrefurbishedproperty,thepropertyownerwillbeentitledtovote.

Eachbusinessratepayerentitledtovoteshallhaveonevoteinrespectofeachhereditament(premises/buildingwithanindividualrateablevalue)inthegeographicalareaoftheBusinessImprovementDistrict.

For the BID to proceed there must be:

1. Amajorityinnumberofthosevotingyes2. Amajorityinproportionofrateablevalueofthosevotingyes

8.2 COLLECTION OF THE BUSINESS IMPROVEMENT DISTRICT LEVY

The Business Improvement District levy will be charged from October, 2014 and annually from 2014 until 2019 (the last year when a charge will be levied from this proposal). Braintree District Council will be responsible for billing and collecting the levy on behalf of the Business Improvement District and have agreed not to pass on the cost of providing this service to the BID.

AllpremisesintheroadsontheWithamIndustrialEstates,detailedonpage24,asidentifiedonBraintreeDistrictCouncil’srateslistingwillreceiveademandforthelevyfortheBusinessImprovementDistrict.WherepremisesareunoccupiedtheregisteredbusinessratepayerwillbeentitledtovoteandwillberesponsibleforpayingtheBIDlevy.AnynewratepayermovingintoanexistingpropertywithintheBIDareawillbechargedthelevyupuntiltheendofthefiveyeartermeventhoughtheydidnotvoteonthe2014proposal.Likewise,anynewrateablepropertycreatedduringthelifetimeoftheBIDwillbeobligedtopaythelevyprovidedtheyarewithintheBIDarea.

Therearetwoareasinthe2014BIDballotadditionaltothe2009ballot:RosewoodBusinessParkandColemansBridge.Rosewoodwascompletedduringtheinitial5yearBIDtermandomissionofColemansBridgewasanadministrativeerror;botharewithintheexistingdesignatedBIDarea.

8.3 ALTERATION OF ARRANGEMENTS

The BID area and the overall BID percentages and bandings can only be altered via an alteration or renewal ballot.

AllotherarrangementsmaybealteredwithintheconstraintsoftheoverallBIDbudgetwithouttheneedforaballot.

8.4 BID COSTS

The costs involved in developing the BID proposal will be recovered through the BID levy. The cost of the BID ballot will not be recovered through the levy.
