After your presentation at the meeting in Amherst on Monday, December 14, 1987, the town officials present remained to discuss the proposal you offered and the matter of development of the land in general. As a result of the meeting and the discussion afterward, I submit the following:

We all seem to be in agreement that a comprehensive plan showing the entire project in both Amherst and Shutesbury and on the land of Rostas/Gang and Kobin/Davidson is desirable. Such a plan would allow the respective boards in both towns to intelligently and cooperatively review the total impact of the development in order to fully address the many concerns previously raised by the proposed development . At the same time, we do not see how such a submission would prejudice the rights of either Rostas/Gang or Kobin/Davidson under the Wetlands Protection Act, the Subdivision Control Law or any other regulatory scheme. You suggested at the meeting that there were misunderstandings or inconsistencies between the boards of the two towns. We are confident that a comprehensive plan would go a long way in dispelling those perceived problems.

Please understand that this is simply an attempt by the municipal staff of the respective towns to try and work out long standing differences but that in the final analysis the decision on any plan will be made by the respective town boards with the appropriate legal authority and mandate. As you pointed out at the meeting, the staff members are unable to bind any municipal board with regard to the ultimate course of action. While they are, therefore, not in a position to anticipate what will be acceptable to each board, the staff members look forward to your

submission of a comprehensive plan and will act cooperatively with you and their boards.

As was the case with our meeting, we intend this letter as a non-binding effort to settle our differenc~s in an amicable fashion. We fully anticipate that you will accept it as such and that it will not be used for any other purpose.

I have reviewed the application for disposal works construction permit for Lot 2, so called, on East Leverett Road , Amherst, prepared for you by Fred Filios, Re9istered Sanit arian, dated March 5, 1987, and signed by . you on March 19, 1987.

I am, as of this notice, disapproving this application for the following reasons:

1. Title 5, Reg. 15.02 (17) Construction in Fill: Proper pl acement of and percolation data for fill material not specified (enc.t.

2. Title 5, Reg. 15.03 (3) Ground water elevation only 30" below grade (enc.) .

3. Design is not in conformance with Amherst Board of Health Regulations to Supplement Title 5 (enc.) .

. 4. The area is now a part of a preliminary Subdivision Plan presently

before the Board of Health and Planning Board for Consideration, The Subdivision Plan alters the configuration of the frontage and area of this "Lot".

You have a right to a hearing to show cause why this order should be modified or withdrawn. Your petition must be in writing and received in the Health Department office within seven (7) days of receipt of this notice.
