Your application of January 12, 1987 has been approved in accordance with Chapter III of our Rules and Regulations for the Protection, Development and Conservation of Water Resources in the City and County of Honolulu.

You are hereby granted a permit to drill a well at TMK: 8-1-01: Por. 07 and at the location and manner as shown on the plans.

This permit is granted subject to the Rules and Regulations of the Board of Water Supply and the following conditions:

1. Notify Chester Lao of the Board of Water Supply at 527-5276 before commencement of any work covered by this permit.

2. Provide the Board of Water Supply all pertinent geologic and hydrologic data ~ncountered during construction of the well.

3. Provide the Board of Water-Supply with as-built construction drawings upon completion of the well.

The application fee and permittee bond requirement shall be waived for this permit.

5. The Owner hereby agrees to install, operate, and maintain control of the well in accordance with the laws of the State of Hawaii and the Rules and Regulations of the Honolulu Board of Water Supply and the State Department of Health.

The O''''ner hereby understands that a fee of One Hundred Dollars ($100.00) and a permittee bond of the amount not greater than Twenty-five Thousand Dollars ($25,000.00), said amount of the bond to be set by the Engineer, are required for the drilling or excavation of each new well. The $100.00 fee per well shall be payable to the Board and shall accompany this application. The amount of the permittee bond shall be stipulated when the well owner is notified that his permit has been granted.

The well was successful in locating a non-potable source of water supply for the Kaena State Park at ~'!akuA Beach end is capable of producing 80 to 100 gallons per minute of water having a chloride content of 170 parts per million.

The recommended pump capacity for the Makua exploratory well is 80 to 100 gpm. The top of pump bowls should be set at mean sea level (60 ft. below ground surface).

Pertinent well data include:

Ground Elevation: 59.75 ft., msl Casing Diameter: 8-inch Depth of solid casing: 55 ft. (+4.75 ft., msl) Depth of shutter screen casing: 65 ft. (-5.25 ft., msl) Total depth of well: 80 ft. (-20 ft., msl) Static water level: 6.8 ft., msl Water Temperature: 74°F Chloride Content: 175 ppm Drawdown at 100 gpm: 4.2 ft.

The Department of Health has been notified of your well drilling permit for Makua Well, State Well No. 3213-07, Kaena Point State Park, Oahu. Please be aware that use of this well as a source of water will require compliance with the State's Drinking Water Regulations, Chapter 20, Title 11, Administrative Rules.

The Department of Health is vested with the responsibility to assure that public water systems in the State are providing water which is in compliance with the State's drinking water regulations known as Chapter 20, Title 11, Administrative Rules, and are in compliance with all other applicable terms and conditions of Chapter 20. A public water system is defined as a system serving 25 or more individuals at least 60 days per year or having a minimum of 15 service connections. In the event that the new well is intended to serve these minimum numbers of persons or service connections, please be advised that the well and distribution system will be subject to the terms of Section 11-20-29 and Section 11-20-30 of Chapter 20 respectively.

Section 11-20-29 of Chapter 20 requires all new sources of potable water serving public water systems to be approved by the Director of Health prior to their use to serve potable water. Such approval is based primarily upon the satisfactory submission of an engineering report which adequately addresses all concerns as set down in Section 11-20-29. The engineering report must be prepared by a registered professional engineer and bear his or her seal upon submittal.

Section 11-20-30 requires that new or substantially modified distribution systems for public water systems be approved by the Director of Health. Such approval depends upon the submission of plans and specifications for the project prior to construction and the demonstration that the new or modified portions of the system are capable of delivering potable water in compliance to all maximum contaminant levels as set down in Chapter 20 once the distribution system or modification is completed.

THE SECRETARY OF THE ARMY (hereinafter Secretary) or duly

authorized representative under the general administrative

power of the Secretary of the Army, grants to the State of

Hawaii, Department of Land and Natural Resources (hereinafter

Secretary or duly authorized representative. The license is

for the premises (hereinafter premises) shown on Exhibit "A",

which is attached and made a part of this instrument.

THIS LICENSE is granted subject to the following

conditions:

1. That the exercise of the privileges hereby granted shall be:

a. without cost or expense to the united States;

b. under ~he general supervision of the officer executing this license or duly authorized representative (hereinafter said officer), i.e., subject to rules and regulations which said officer may prescribe from time to time and subject to approval of said officer, including prior written approval for alterations, modifications or additions or the use of any herbicide or pesticide on the premises;

c. subject to the right of the united States to construct, use, and maintain facilities on the premises without unreasonably interfering with the licensee's privileges;

d. subject to other outgrants of the united States on the premises which do not unreasonably interfere with the licensee's privileges; and

e. without liability of the ,united States for failure to supervise or inspect activities or facilities of the licensee.

2. Under a separate agreement with the installation commander, the licensee shall pay the cost of the United States to produce or supply utilities or services to the licensee. Such costs shall include the licensee's proportionate share of the operation and maintenance costs of United States facilities involved. The United States has no obligation to furnish utilities or services.

3. The licensee at its own expense shall maintain the premises in good order.

4. The licensee shall at its own expense promptly repair or replace to the satisfaction of said officer any United States property damaged or destroyed by the licensee incident to the exercise of the privileges granted. Instead and if required by said officer, the licensee shall pay the United states money in an amount sufficient to compensate for the loss sustained by the United States for damage to or destruction of United States property.

5. The United States and its officers, agents, servants and employees (lithe released parties") shall not be responsible for damages to property, injuries to persons, or any other cause of action ("released actions") which may arise from or be incident to this license or the licensee's exercise of the privileges herein granted. Released actions include, without limitation, damage to the licensee's property, injury to the licensee's person, or other cause of action of the licensee, or such damage, injury or other cause of action of the licensee's officers, agents, servants, employees, invitees of any of these, or anyone else otherwise on or near said premises incident to the license. The licensee shall hold harmless and indemnify the released parties for released actions which may arise from or be incident to this license or the licensee's exercise of the privileges herein granted.

6. The licensee shall not discriminate against any person{s) because of race, color, age, sex, religion, handicap, or national origin in the conduct of its operations hereunder.

7. The licensee shall not unlawfully pollute the air, ground, or water or create a public nuisance. The licensee shall at no cost to the United States promptly comply with present and future Federal, state and local laws, ordinances, regulations, or instructions controlling the quality of the environment. This does not affect the licensee's right to contest their validity or enjoin their applicability. The licensee shall not be responsible for pollution caused by others.

8. The licensee shall not remove or disturb, or cause or permit to be removed or disturbed, any historical, archaeological, architectural or other cultural artifacts, relics, vestiges, remains or objects of antiquity. In the event such items are discovered on the premises, the licensee shall immediately notify said officer and protect the site and the material from further distur~ance until said officer gives clearance to proceed.

9. That the licensee being aware that the Ukanipo Heiau complex is on the Register of Historic Places and in close proximity of the said exploratory well site, agrees to take the following actions, at its own expense, to protect the said Ukanipo Heiau complex during the construction and operation of said exploratory well:

a. Establish a 50-foot wide buffer zone on the west side of the heiau complex to prevent damage to the heiau complex and a 20-foot wide buffer zone along the south side of the Ukanipo Heiau complex fenceline in the 60-foot wide access corridor;

b. The fenceline will be cleared of vegetation and flagged prior to any construction and the buffer zones will also be flagged. The construction crew shall be made aware of the access route, fenceline and buffer zones and the requirements of this license;

c. No construction equipment, construction activity or dumping will be allowed within the buffer zones or the Ukanipo Heiau complex. Leveling, ground disturbance and back fill for the exploratory well site will be directed away from the said heiau complex; and

d. An archaeologist will monitor initial construction activity to insure that machinery and construction activity is clear of the buffer zones and the heiau complex. The archaeologist will also visit the site during construction of the exploratory well to determine if any other cultural remains are exposed during construction.

10. The licensee will use all reasonable means available to protectt-he environment and natural resources from damage arising from this license or activities incident to it, and where damage nonetheless occurs, the licensee shall be liable to restore the damaged resources.

11. If the licensee discovers military contamination on the premises, the licensee shall immediately stop work and request said officer for help.

12. On or before the date this license expires or the licensee relinquishes this license, the licensee shall vacate the premises, remove the licensee's property and restore the premises to a condition satisfactory to said officer, except for damages beyond the licensee's control or for fair wear and tear. If this license is revoked, the licensee will do the same within the time designated by said officer. If the licensee fails or neglects to remove the property and to restore the premises, at the option of said officer:

a. said property shall become the property of the United States without compensation therefor, or

b. said officer may have the property removed and the premises restored at the expense of the licensee, and no claim for damages against the United S~ates or its officers or agents shall be created by or made on account of the removal and restoration work.

13. The licensee may terminate this license by giving ten (10) days written notice by certified mail to the Secretary through said officer.

14. This license is effective only insofar as the rights of the United States in the premises are concerned. The licensee shall obtain any further permission necessary on account of any other existing rights.

15. This license may not be transferred or assigned.

This license is not subject to Title 10, United States Code, Section 2662, as amended.

Since parcel 7 is leased to the United states government for military purposes under the terms of State General Lease NO. S-3848, the lease needs to be amended to have the

·portion released to the state for recreational purposes. It is our understanding that under paragraph 14 of the current lease, public recreation is allowed on that portion of the land except when the public will interfere with training activities or the training will endanger the public. By setting aside this area for public recreation use through an executive order, DOCARE will be able to enforce state Park rules.

An existing well (3213-06) is presently being used for toilet facilities at the cable terminal building (see attached map) operated by the Air Force. Pertinent data follows:

SUBJECT: Water Source Explcration/Development, Makua-Kaena Point State Park, Makua, Oahu, Hawaii

The Division of State Parks is planning to develop Hakua Beach of Makua-Kaena Point State Park, Makua, Oahu, Hawaii for public recreation use. Accordingly, we would appreciate assistance from your tlater Resources Branch to seek and develop a viable water source as part of the planning effort. The water would be required for comfort stations, showers, landscaping and other park facilities. The quantity and quality of water will determine the extent of recreational facility development.

~later exploration and development wi thin ~~akua Valley should be coordinated with Land Management Division and the u.s. Army (phone 655-4954, Bob Rourke) since the area is State land and closed for military training (RP 200). The water would be utilized within State Beach lands TMK 8-1-01:13: 8-2-01: 22 and 01 with possible source from State Lands 8-1-01:19 and/or 8-2-01:20.

Funds have been appropriated through Act 301, SLH 1983, Ite~ H-ll in the amount of $60,000 for design and $150,000 for construction. No funds have been allotted however, an allotment will be requested should you need the funds. Please have your staff coordinate this project with Clyde Y. Hosokawa, Planner, Phone Extension 2696.
