2 The Horton Headlight Thursday, May 30, 2019 Unofficial minutes The Commissioners of the City of Horton met for a regular meeting on Monday, May 20 at 5:15 p.m. at City Hall. Mayor Stirton called the meeting to order and the prayer was led by John Calhoon. The Pledge of Alle- giance was recited by all. Present: Mayor Bryan Stirton, Commissioners Wade Edwards, Rex West, Bobby Bacon, and Ken Krug. City Attorney Kevin Hill and City Administrator John Calhoon were also present. Motion by West to adopt the agenda. Seconded by Bacon. All aye. Motion by Edwards to approve the minutes from the May 6, 2019 regu- lar meeting after requesting a revision to the minutes. Seconded by Krug. All aye. Motion by Edwards to approve Ap- propriation Ordinance #3558 (Pay- roll) for the amount of $35,357.56. Seconded by Krug. All aye. Motion by Edwards to approve Ap- propriation Ordinance #3559 (Dis- bursements) for the amount of $241,791.86. Seconded by Krug. All aye. Public Comments--None. Request to be placed on Agenda Connie Werner shared that the Big Kansas Road Trip will be in Brown, Doniphan, and Nemaha counties on May 7 th – 10 th 2020. The planning is in the infant stages right now, but ev- ery city will promote their own county by coming up with ideas to endorse restaurants, attractions, and events. Connie will keep the Commission updated as things progress. Casey Bratton would like to pur- chase the lot north of the water tower all the way to the alley. Bratton has been maintaining the property. The Commission tasked Bratton with go- ing to the county to get a legal de- scription of the property, make sure there are no back taxes owed, and get an aerial of the property. Commis- sioner West also recommended that the administrator get with the water tower company to make sure they don’t use the land. Zoning Change Request Kevin Hill stated that the rezoning of 1400 5 th Avenue West would have to be adopted via Ordinance, and that he could prepare for the first reading at the next Commission meeting. Motion by Edwards to accept the rec- ommendation of the Planning Com- mission to approve the zoning change. Seconded by West. All aye. APPA Annual Fee Edwards finds the proposal is minimally beneficial to the city and not worth the monthly fee. Motion by Commissioner Edwards to decline the proposal from KMEA regarding joining APPA. Seconded by Commis- sioner West. All aye. McAfee earns academic honors Carissa McAfee of is one of 12 students named Shepherd Scholars for the 2019-20 academic year at Emporia State University. Eligible students have maintained a cumulative grade point average of at least 3.0, at least 60 credit hours. McAfee, a Marketing major, is from Valley Falls, Kansas. Bike Fun Run for cancer June 1 Fun Run Bike Ride on June 1st to benefit cancer patients. It starts in Effingham, Ks at the Doves Nest on Main St. with registration from 10:30am-12:30pm & kickstand up @ 12:30pm. The participants of the Fun Run will be going to Ozawkie, Tonganoxie, Lawrence, Atchison, & ending in Muscotah. There will be games for all, vendors, music, Pulled Pork meals, dance in the evening. Even a car show on main street! Disposi- tion of one count identity theft, a se- verity level 8 non-person felony, is not indicated. Sentencing is July 8. Sentencing on Roy Keighley, Hiawatha, KS., has been rescheduled to July 8, 2019. He plead no contest to driving under the influence, a class A misdemeanor amended from a non- person felony; and interference with law enforcement, a class A misde- meanor amended from a level 9 non- person felony. Andrew V. Armstrong, Robinson, KS., was sentenced on interference with law enforcement, a class A non- person misdemeanor, to 12 months in the Brown County Jail with credit for 2 days served; and on driving while license canceled, suspended, or re- voked, a class B non-person misde- meanor, to 6 months in the Brown County Jail. Sentence was stayed un- til May 15, to allow him to enter House Arrest or report to jail on a 90- day commitment. He was placed on 12 months supervised probation and ordered to pay $112 court costs. Bond appearance on Scott A Gray, Topeka, KS., has been rescheduled to June 24, 2019. He is charged with possession of methamphetamine, a drug severity level 5 felony; and pos- session of drug paraphernalia, a class B non-person misdemeanor. Carolyn A. Barrie, Kansas City, MO., entered a plea of no contest to possession of methamphetamine a drug severity level 5 felony. Sentenc- ing is scheduled for July 8, 2019. Jami J. Weeks, Hiawatha, KS., was sentenced on possession of metham- phetamine, a drug severity level 5 felony, to 14 months in prison with credit for 5 days served. Sentence was suspended. She was placed on 12 months supervised probation and or- dered to pay $193 court costs, $45 booking fee, $100 indigent defense fee, $400 KBI Laboratory fee, $200 KBI DNA database fee and $120 pro- bation fee. Arraignment on Lonnie Coker, Fairview, KS., has been rescheduled to June 3, 2019. He is charged with fleeing or attempting to elude a po- lice officer, a level 9 person felony; no insurance, a class B non-person misdemeanor; driving while license canceled, suspended, or revoked, a class B non-person misdemeanor; driving beyond restrictions, a class B non-person misdemeanor; and im- proper registration, an unclassified misdemeanor. Jordan Kahbeah, Horton, KS., en- tered a plea of no contest to battery, a class B misdemeanor, amended from aggravated domestic battery, a level 7 person felony; and was sentenced to 6 months in the Brown County Jail with credit for time served. One count each criminal restraint, a class A per- son misdemeanor; and intimidation of witness or victim, a class B person misdemeanor, were dismissed. He was ordered to pay $158 court costs. Arraignment on Lonnie Coker, Fairview, KS., has been continued to June 3, 2019. He is charged with do- mestic battery, a class B person mis- demeanor. Sissy Wilson, Hiawatha, KS., en- tered a plea of no contest to traffic contraband in correctional facility, a level 6 felony. One count possession of methamphetamine, a severity level 5 drug felony was dismissed. Sentenc- ing is scheduled for June 3, 2019. Sentencing on Anna L. Swogar, Hiawatha, KS., has been continued until further order of the court. She plead no contest to possession of methamphetamine with intent to dis- tribute, a drug severity level 4 felony. A jury trial on Robert A. Hendricks, Hiawatha, KS., has been scheduled to begin August 28, 2019. Pretrial conference is scheduled for July 8, 2019. He is charged with pos- session of methamphetamine with intent to sell, a drug severity level 3 felony; possession of drug parapher- nalia, a drug severity level 4 felony; possession of methamphetamine, a drug severity level 5 felony; and taxa- tion; drugs; no drug tax stamp payment for marijuana or controlled substance, a drug severity level 10 felony. Dock Requests Motion by Commissioner Bacon to approve the three dock installation requests that were presented to the Park Board and allow them to sign the Boat Dock Agreement. Seconded by Commissioner West. All aye. The dock requests were submitted by Jer- emy Becker, Jerry & Loretta Fitzgerald, and Cary Stone. Sale of Surplus Property on Purple Wave Calhoon would like to place big ticket items such as vehicles, scrap iron, and asset forfeiture items for sale on Purple Wave. Krug mentioned giving the bikes away to local kids in town. Motion by Commissioner Krug authorizing the sale of asset forfei- ture and surplus property with Purple Wave. Seconded by Commissioner West. All aye. Calhoon will provide a list of items for sale to the Commissioners. Razo Property 10 Minute Executive Session to Discuss Attorney-Client Privilege Motion by Commissioner West to go into a 10 minute executive session to discuss attorney client privilege to include Mayor Stirton, Commission- ers Edwards, Krug, West, and Bacon, John Calhoon, Kim Knudson, and Kevin Hill. Seconded by Commis- sioner Edwards. All aye. After executive session, Motion by Edwards for the city attorney to draft a Resolution for abatement of the property referred to as The Razo Property. Seconded by West. All aye. Motion by Edwards to appoint Lynn Marie Allen to the library board per the recommendation of the library board and Mayor Stirton. Seconded by Bacon. All aye. Lynn will replace Kristin Fassnacht. Calhoon thanked Bobby Bacon and his wife for dedicating their time to paint the dugouts at the ballfields. Chasity Sinclair, one of the fulltime dispatchers submitted her res- ignation effective 06/05/2019. Jim Martin announced his retire- ment effective 06/14/2019. Calhoon stated that Randy Mayfield, current Public Works Su- pervisor is very limited in being able to do what he needs to help with as far as motivating his team and getting things done. Calhoon feels that it takes time away from him performing his Administrator duties since he is spending a lot of time in the field go- ing back over what was asked of the team to do. Calhoon suggested that the city post for a Street/Public Works Supervisor in hopes of getting more productivity. Motion by West to allow Brad Farr to hay the open field located to the east of Mission Village and borders Hwy 73 for this year. Seconded by Bacon. All aye. Chuck Oswald proposed that the city limit sign on the west entrance of town be moved to the city limits. After discussion the Commission decided to leave it where it is at be- cause there is not a better place to place it. Lanter SPS LLC has looked at doing repairs on the roof at Mission Village. Lanter SPS LLC is asking to make a claim with the insurance pro- vider for Mission Village, or plan B would be for them to bid the repairs on the roof. West wants to make sure that the roof is even covered under the insurance policy. The Commission recommended that Mission Village contact their in- surance provider for a copy of the policy and provide it to the city and see if the roof is covered. Dr. Richard Brown made an an- nouncement to the news that the clinic is tentatively set to open on July 1st and the hospital itself in August. Bacon gave updates about the progress and current conditions of the dugouts at the ballfields that he and his wife have been painting. Bacon asked the Commission that since he is down to one vehicle in his household, if he could use the city admin vehicle to do his rounds around the city. The Commission was not in favor. West asked if the core drilling has been done at Hwy 73 near 18 th Street. Calhoon said that Terracon should get to it by the end of the month. West would like to see the re- placement of corner electric poles in town be considered during the 2020 budget prep. West is concerned by the lack of preparation for chip seal that is com- ing up in June. Edwards inquired about the Park Board being established in the 70’s as a Recreation Commission that morphed into an advisory board. His concern is that if the public vote es- tablished the board, what was the au- thority to change it? He feels the Commission should be doing what the public wanted them to do. Mo- tion by Edwards to authorize the city attorney to review the issue regard- ing the Park Board as it standing as a Recreation Commission or as an Ad- visory Board. Seconded by Bacon. All aye. It was the general consensus to allow Kim Knudson to perform lim- ited duties pertaining to Mission Vil- lage during work hours since she is on the Board of Directors. Krug recommended that the city provide Glen Obbards and Matt Howell packet information for the upcoming Commission meetings since they have their names in the hat for the upcoming election. Edwards inquired about the ParkBoard being established in the 70’sas a Recreation Commission thatmorphed into an advisory board. Hisconcern is that if the public vote es-tablished the board, what was the au-thority to change it? He feels theCommission should be doing whatthe public wanted them to do. It was the general consensus toallow Kim Knudson to perform lim-ited duties pertaining to Mission Vil-lage during work hours since she ison the Board of Directors.

Krug recommended that the cityprovide Glen Obbards and MattHowell packet information for theupcoming Commission meetingssince they have their names in the hatfor the upcoming election.
