* The Board is the official regulating authority for the estate agency profession, and every estate agent must, by law, be registered with it. * The Board is a statutory body which generally means a board, council or body of persons established by or under an Act. * The Board falls under the jurisdiction of the Ministry of Trade and Industry.

The primary function of the Board is to protect the public’s interest (consumers) in their dealings with agents while maintaining and promoting the integrity of estate agents by overseeing the compulsory qualification and admittance of estate agents as well as the issuance of Fidelity Funds Certificates to qualified agents;Administering the Estate Agents' Fidelity Fund, from which consumers who have suffered loss as a result of theft of trust monies by estate agents are reimbursed; It could be said that the Board maintains and promotes the activities and standard of conduct of estate agents in general.

In order to obtain registration with the Board, the estate agent will have met the requirements of the Act which include passing or exemption of the Board's examination. In return The Board will issue a Fidelity Fund Certificate to a qualified estate agent. Every registered agent must further comply with the provisions of a special Code of Conduct framed in terms of the Act and should you - as a buyer or seller of a property - feel unhappy about the improper conduct of a particular estate agent, a written complaint should be lodged with the Board for investigation and possible disciplinary action.

The Association is a professional volunteer organisation which supports its members, and membership is voluntary. The Association looks after the interests of its member estate agents and agencies, and is a prominent spokesman for the agent and profession. The Association offer property related training and guidance which are specifically designed to provide agents with the knowledge and skills necessary to conduct their business in the most professional manner to ensure that member agents will provide a high standard of service to the public and amongst each other as professionals.

Proper registration with both the Board and Association immediately establishes an estate agent's credibility with both potential clients and fellow estate agents.

The architect's training and experience has equipped him/her to guide you through the entire building process from the first design proposals to the construction and completion of the project. Architects minimize your risk & maximize your investment

The architect is both a designer and an adviser who is able to translate your requirements into reality. He/she will blend the ingredients of your needs – the restrictions of your budget, the desired program for completion, legal and statutory requirements, building regulations and conditions imposed by the nature of your site, with creative abilities to produce a building that incorporates good design and functionality.

The architect occupies the focal point of the complete building operation and is knowledgeable in the many related fields such as principles of building construction, engineering structures and systems, building economics and construction law. All building projects from a single dwelling unit to a complex commercial or industrial project have the need for various combinations of these professional skills.

When you appoint an architect, The principal objective is to clearly define in writing the services that your architect will provide, and the basis upon which you will make payment for these services.

The standard services offered by an Architect are divided into five work stages as set out below, and the total tariff of fees charged is broken up between these work stages:

Receive, appraise and report on the client's requirements with particular regard to site information, planning and statutory requirements.

Advised by any consultants appointed, prepare a design showing space provisions, planning relationships, proposed appropriated materials and suitability of services, in sufficient detail to enable the design to be approved by the client. After approval of design, develop if sufficiently to co-ordinate the work and the services of consultants and specialists who have been appointed, Compile documentation to best inform the client of the proposed design, sketch plans, sections and elevations, proposed materials, doors, windows, sanitary fittings and finishes to be used.

Prepare drawings and documentation for the submission to local authorities for approval, schedules and any other technical documentation necessary for the execution of the project,

Get more than one quotation, preferably three, from different contractors

Personally meet with the prospective contractors and discuss your building plans with them to ensure they understand your needs

Ask them what experience they have, how long have they been in the building industry

Ask for references and speak to the people the contractors have built for previously

Discuss a tentative building program so that both parties know when building can commence and when the building will be finished and handed over to you

Find out who is on the builders' team.

When considering the quotations/tenders, price is not the only factor to look at. Consider price, building program, experience, team, references you have phoned, and professionalism when making your final decision on who to appoint.

BUYING IMMOVABLE PROPERTY? WHAT TO DO

1. Get a properly drawn Deed of Sale prepared by a Legal Practitioner or Estate Agent.

2. Obtain documentary proof of your marital status. If you are married in community of property this will be your marriage certificate only. If you are married out of community of property this will be your marriage certificate as well as your marriage contract. If you are divorced this will be your final order of divorce.

3. Obtain certified copies of your identity document and that of your spouse, if applicable.

4. Go to your bank for a loan application, if necessary, and take the document referred to in paragraphs 1, 2 and 3 above along with you. Your bank will also require proof of your income and expenses, and your assets and liabilities.

5. Make sure that your Deed of Sale allows you enough time to provide guarantees. Your bank must first process your application and will only provide guarantees after they approved your loan. You therefore need to give them sufficient time to process your application. Under normal circumstances 21 days should be sufficient time to provide guarantees to the Seller’s conveyancers.

6. Consult your Legal Practitioner.

7. Ascertain that you are not paying too much. Ask your Legal Practitioner to do a Deeds Office search to ascertain if there are any adverse conditions or servitude against the property and what the prices paid for adjoining properties were, if possible.

8. Ascertain what the transfer cost to you will be. Ask your Legal Practitioner for a quotation. These costs are prescribed by law and are therefore fairly standard.

9. Ascertain that all rates and taxes are paid up to date. Obtain a building compliance certificate from the municipality to ascertain this.

10.The single best tip is to always consult your Legal Practitioner. The fee he charges is not nearly what you stand to loose if things go wrong.

11.Expect that the process of transferring the property you wish to buy into your name can take anything from four to eight weeks. This time period is mostly determined by how long your bank will take to process and approve your loan as well as the time necessary to obtain the building compliance certificate.

As a basic principle, Property Developers buy land, finance real estate deals, build or have builders build projects, create, imagine, control and orchestrate the process of development from the beginning to end. They take the greatest risk in the creation or renovation of real estate. Typically, developers purchase a tract of land, determine the marketing of the property, develop the building program and design, obtain the necessary public approval and financing, build the structure, and lease, manage, and ultimately sell it. Developers work with many different counterparts along each step of this process, including architects, city planners, engineers, surveyors, inspectors, contractors, leasing agents and more.For a Property Developer to be successful is really difficult and it requires time, research, patience, to understand the needs of the environment/customers, be visionaries and have a willingness to take calculated and sometimes huge risks.``Essentially it's somebody who is going to take a financial risk with respect to the purchase, construction, marketing and selling of real property. That ranges from an individual home right up to a major CBD building,'' said Mr Jackson, who is also executive general manager at AVJennings in SA.

The outlook for the property sector remains “very positive” in Namibia, especially in Windhoek. Property is still the best investment for any investor with the least risk and highest Return on Investment. The reason is that there is still a strong demand - our population growth numbers are strong and people are moving to Windhoek and we do have an imbalance of supply versus demand - there is a huge need for more land for housing, especially in the Windhoek area. Residential property in Namibia is an excellent investment and we all are aware that property prices have not taken a dip, but as an investor you can expect at least a 10% per annum increase and depending on the location and can increase into the twenties.

A deposit is money you need to pay upfront, should you not qualify for a 100% home loan. In a case where the valuation is not high enough to warrant a 100% loan, e.g. only 80% of the loan might be approved. Some employers who have a staff home loan scheme with the bank provide a 20% collateral security in form of a written guarantee to assist their staff to obtain a 100% loan from the bank. By paying a deposit you confirm to Home Loans that you are serious about buying a home and about borrowing money from the bank.Note: Do not pay deposits to estate agents, sales agents, builders or developers. The bank will notify you when to pay the deposit to an attorney once you have applied for a home loan.

If it happens that the selling price of the property you want to buy is higher than the amount of the loan you qualify for (even with a deposit), we may ask if you can obtain additional collateral (security) for the loan, or whether you can increase your deposit.

There are additional once-off costs you will have to pay when purchasing a home:1. Other Bank costs: Initiation Fee, Valuation Fee, Administration Fee2. Legal Fees, which include: Transfer Fees, Bond Registration Costs,VAT/Transfer Duty, Electronic Fee (LAW)

Documentation required when applying for a Building Loan from FNB HomeLoans, signed by both you and the builder:* A signed Building Agreement* Approved Home Plans* Specification List* A Tender Document* Waiver of Builders Lien* All Risk Policy

You can pay the builder in one of two ways:1. The builder can complete the home and then ask for payment. In this case you will have to obtain a completion certificate (from the town council / municipality), sign a progress payment and write a letter of satisfaction, which states that you are satisfied with the work the builder has done. OR2. The builder may choose to be paid for each completed stage of the building process (normally there are 3 progress payments). This means that each time the builder has completed a section of the home, you must sign a progress payment request form which implies that you are satisfied with the quality of the building work up to that stage.
