A. TENDER DOCUMENTS

Contract No R 2015/5Drilling, Blasting, Stockpiling and De-rubbling of West Coast Regional Council Quarries.

A.1 REQUEST FOR TENDERS

The West Coast Regional Council wish to invite tenders for the above contract works.

The scope of the works is fully described in the attached tender documents, the key items of work are:

Drilling, Blasting, Stockpiling and De-rubbling of rock at four Council quarries as and when required;

Stockpiling rock and rubble; Managing quarry waste as and when required; Maintaining available rock stockpiles at each quarry; Carry out other activities as directed by Council staff;

The contract works will be for a period of three years from 20 July 2015.

Tender for the contract works shall be prepared in accordance with the attached conditions of tendering.

A valid tender requires the submission of Section B11 (Statement of Attributes) attached.

Tenders close at the Tender Box located at the West Coast Regional Council offices at 388 Main South Road Paroa, Greymouth AND via the New Zealand Government Electronic Tenders Service (GETS) under Purchaser – West Coast Regional Council.

Physical and electronic tenders close at 12.00pm 10 July 2015 and shall be enclosed in two sealed envelopes identified as a tender for the particular contract addressed to the Quarry Manager of the West Coast Regional Council with contract No R2015/5 marked on the top left hand corner of the envelope.

B. TENDER SUBMISSION

B.1 Conditions of Tendering

101.1 Except where modified below, the Conditions of Tendering shall be those included in the document published by Standards New Zealand and titled “Conditions of Contract for Building and Civil Engineering Construction, NZS 3910:2013”.

102. Tenders shall be submitted in the format prescribed in clauses B7, B8, B9, B10 and B11 herein.

107. Tenders will be evaluated generally in accordance with the Simplified Weighted Attribute Method as is described in the NZTA Procurement Manual.

Tenders will be evaluated using a weighting of 60% Price to 40% Attributes.

Attributes will be evaluated using the following weightings:

Methodology 30%Relevant experience and track record 20%Resources and technical skills 20%Health and Safety 20%Management skills 10%

Tenders shall be placed in two envelopes. Marked: Contract R2015 /5

Envelope 1 shall contain all tender information other than price. Envelope 2 shall contain the tender price information.

102.2Tender document deposit

A tender document deposit is not required.

103.1Inspection of the sites

A valid tender submission requires the appointment and viewing of the following quarry sites:

Kiwi Point (Stillwater) Camelback (Kowhitirangi) Inchbonnie

This will be conducted on 1 July 2015 commencing at Camelback Quarry at 10 am and moving on from there. It is a requirement as part of tendering to attend this site inspection. Hard hats, protective footwear and clothing are compulsory for this visit.

105.1 Submission of tenders

Tenders shall close at the time, date and place stated in the Request for Tenders (Part A of the Tender Documents).

Submission of electronic tenders can be submitted via the New Zealand Government Electronic Tenders Service (GETS) listed under Purchaser – West Coast Regional Council – Drilling, Blasting, Stockpiling and De-rubbling of West Coast Regional Council Quarries.

Submission of tenders by fax will not be acceptable. It shall be the sole responsibility of the tenderer to ensure their tender is received by the specified closing time.

B.11 Requirements for Submission of Statement of Attributes

1. Tenderers shall provide a Statement of Attributes with details of their relevant experience and track record, resources and technical skills, management skills and proposed techniques, methodology and Health and Safety. Submissions shall be limited in length to 15 pages of A4 size printed material which directly respond to the requirements listed below. If there is a conflict between the statement of attributes in the contractors tender, and any other part of the contract documents, then such other part shall prevail.

2. The relevant experience and track record shall include:

The statements of relevant experience and track record shall describe projects of a similar nature to the current contract, with details of location, size, contract price, client name. The projects shall all have been carried out within the last five years. For at least three such projects, the names and telephone numbers of a referee shall be included. Each such reference must be a part of the client organisation or a client adviser, be familiar with the tenderer’s capabilities and have confirmed willingness to provide substantiation of the capabilities.

3. The statements on resources and technical skills shall list:

The proposed subcontractors and the role proposed for each, The major items of plant which it is intended to use on the contract, The proposed sources of supply of materials, The qualifications and experience of the personnel involved with the

contract.

4. The statements on management skills shall include:

A list of key management personnel and qualifications, Description of the management structure, A description of systems developed for communication between

staff and the Quarry Manager, recording, reporting and invoicing, A description of any specific management methods to be applied to

successfully manage the project.

5. The statement of proposed methodology for carrying out of the works and services required under the contract shall include:

A description of the techniques and full methodology to be used to carry out the work,

A copy of the tenderer’s quality assurance policy.

6. The Health and Safety documentation shall include:

A copy of the tenderer’s updated health and safety policy including all acts and regulations arising from recent changes to the O.H. & S. Act 1992 and all legislation thereon particularly as it pertains to quarrying and mining activities.

C. BASIS OF PAYMENT

The Schedule of Prices shall be read in conjunction with the Contract Documents. Payments shall be made at the appropriate rates set out in the priced schedule for final quantities determined by the Quarry Manager.

Attention is drawn to Clause 2.3.2 of NZS 3910:2013 which requires the Contractor to allow for all costs in carrying out the work as specified in the documents, unless expressly excluded.

Per tonne amounts shall include all costs associated with completion of the work, including labour, materials, explosives, plant and equipment, transportation, overhead and profit.

The Contractor shall claim monthly. All claims shall include verification of the measurements and quantities making up the claim.

The drill, blast, breakout and stockpile rock rate is to be based on a per tonne of stockpiled rock (within 250kg-6000kg+) basis.

Muck-out waste removal rates are to be based on a per-tonne basis.

C.2 Clarification of Scheduled Items

C.2.2 Schedule of Rates

These rates shall be used when additional work is required as Dayworks carried out in accordance with Clause 9.4 of NZS3910:2013. Payment for these items shall only be made with written instruction and approval from the Quarry Manager prior to the work being carried out. The rates provided shall be exclusive of GST.

C.2.3 Labour Rates

Rates for labour shall include all overheads, overtime and other allowances payable, profit and the use of small hand tools and appliances, and ordinary non-mechanical plant and equipment (eg ladders, trestles, skips and consumables etc.) and any other emoluments and allowances payable to the workmen.

C.2.4 Plant Hire Rates

Rates for plant shall be for the time plant is employed in normal working use. The rate shall include all costs associated with the operations including the operator, overtime and profits.

C.2.4 Variations

The cost of preparing for and administering the paperwork associated with additional work/variations shall be included in the labour and/or plant rates.

C.2.5 Plant Hire/Labour Hire Docket Books

All Plant Hire/Labour Hire authorised by WCRC Quarry Manager shall be recorded in WCRC Daily Plant Hire Docket Books and signed by the operator/worker and countersigned by WCRC Quarry Manager or other duly authorised person.

D. CONDITIONS OF CONTRACT

D.1 General Conditions

Except where modified by the Special Conditions, the Contract shall be governed by the document published by Standards New Zealand and titled “Conditions of Contract for Building and Civil Engineering Construction, NZS 3910:2013.

Copies of this document are available for inspection at the office of the Quarry Manager and may be purchased from Standards New Zealand, Private Bag, Wellington.

Part A Special Conditions (from First Schedule of NZS 3910:2013)

1.2 Definitions

There are no Separable Portions in this contract.

Payment Schedule – means any Payment Schedule issued under the contract including a Progress Payment Schedule or Final Payment Schedule, and any reference in the Contract Documents to a payment certificate shall be deemed to be a reference to Payment Schedule.

2.3 Type of Contract

This contract is a:Measure and Value Contract

2.7.1 Number of Sets of Contract Documents

Two sets of Contract Documents shall be supplied free of charge to the Contractor upon acceptance of tender, in addition to tender, any consent and contract agreement sets.

3.2 Principal’s Bond

A Principal’s bond will not be provided

5.4.1 Possession of Site(s)

The Contractor will be given possession of the sites 10 working days after the Date of Acceptance of the Tender.

5.5.1 Separate Contractors

When necessary the Contractor is required to liaise with any service providers in the area prior to commencing work in any of the four quarries.

8.1.1 Insurance

The Contract shall have the same insurance provisions as Section 8 of NZS 3915:2013.

The Contractor shall insure as provided in 8.1 to 8.4.

8.5.1 Public liability insurance

Public liability insurance shall be effected for an amount of not less than $2,000,000.

8.5.2 Motor vehicle third party liability insurance

Motor vehicle third party liability insurance shall be effected for not less than $1,000,000.

10.1.1 Due Date for Commencement

The period(s) to be used for calculating the due date for commencement at the specified site:

Within two weeks of notification from Council to the commencement of physical works at the specified site.

Contract work for drilling and blasting will only be required at one site at any time.

The Contract period is three years.

10.2.1 Completion

The Contractor shall commence the works on the commencement date, shall diligently continue with the works until such time as the required rock volume has been achieved.

10.3 Extension of time

This contract work must commence within the allowed period, work will not be affected by weather conditions.

10.5.1 Liquidated damages

Liquidated Damages shall be applied as follows:

Following notification from the Council of work required at the specified site: After 2 weeks; $500.00 per working day that contract work has not

commenced.

10.6 Bonus for early completionThere is no bonus for early completion of the Contract Works.

11.1 Defects

The Contractor shall at its cost correct all defects in the Works and damage arising from such defects notified by the Council within the Defects Liability Period.

The Period for Defects Liability shall be: In respect of the Contract Works: 4 weeks.

11.2.1 All defects shall be corrected promptly. Defects not corrected within 60 days of notification may be corrected by Council at the Contractor’s cost.

11.6.1 Guarantees

The Contractor shall provide guarantees as listed in the Specification.

The contract has been prepared in the knowledge that the Construction Contracts Act 2002 (‘the Act”) came into force on 1 April 2003. The Act shall not be treated as change of law under NZS 3910:2013 clause 12.8.

The following additional conditions shall apply:

(a) The payment provisions of NZS 3910:2013, especially Section 12 shall apply in lieu of the default provisions for progress payments in sections 16 to 18 of the Act.

(b) Any Progress Payment Certificates issued by the Quarry Manager under NZS 3910:2013 shall be an interim payment schedule for the purpose of Section 21 of the Act. The interim payment schedule shall apply unless the Principal sets off any liquidated damages and other amounts otherwise due to the Principal under the contract by issuing an amended payment schedule within the time required under the Act.

12.1 Contractor’s claims – Advances

Advances for temporary works, plant or materials not yet on site shall not be made to the Contractor.

12.8 Cost fluctuations

Cost fluctuations adjustments shall not be paid.

12.9 Provisional sums

Any Provisional Sums to be included in this Contract are listed in the Schedule of Prices.

12.11 Prime cost sums

No Prime Cost Sums to be included in this Contract.

12.12 Contingency sum

15.1 Service of notices

For the purpose of service of notices, the address of the Contractor is that named in the Tender Form.

D.2 Other Conditions of Contract

D.2.1 Extras

No extras will be paid unless authorised, in writing, by the Quarry Manager, prior to the work being carried out.

9.1 Variations

Council may amend the nature of the Works, include further work or omit work,change the timing or sequence of the Works or the hours that the Works can becarried out (a Variation).

Variations shall be instructed by the Council by a written Variation order.

The Contract Price shall be adjusted by the value of the Variation.

Where reasonable the Variation shall be valued on the basis of the Contractor’s pricingas set out in the Payment Schedule (where attached).

Otherwise the value of the Variation shall be the net value of the extra costs andexpenses incurred by the Contractor in carrying out the Variation plus a reasonablemargin for profit.

Where the scope of the Works is decreased the Contract Price adjustment shallexclude the Contractor’s margin (to the intent that the Contractor still receives its fullmargin for negative variations).

The value of each Variation shall as far as possible be determined by agreementbetween the Contractor and Council prior to the work proceeding.

14. Termination

Either the Council or the Contractor may terminate this contract immediately by notice in writing if the other party commits any material breach of this Contract and fails to remedy the breach within 15 Working Days of receiving written notice of such breach (and advising that termination might follow if the breach is not remedied).

The Council may immediately terminate this Contract, by giving written notice of termination to the Contractor, if any of the following events occur:

the Contractor having a petition presented or an order made or an effective resolution passed or analogous proceedings taken for its

bankruptcy, liquidation, dissolution or winding up (except for purposes of solvent reconstruction);

the Contractor having an encumbrancer, receiver, liquidator, trustee or similar officer take possession of or be appointed with respect to all or any part of its business, assets, or undertakings;

the Contractor abandons or repudiates this Contract; the Contractor is unduly late in commencing or completing the work,

or the work is not completed to the required standard.

IT IS AGREED as follows:

1. THE CONTRACTOR shall complete, deliver and remedy defects in the works and things described in the Contract Documents.

2. THE PRINCIPAL shall pay the Contractor the Contract Price, or such greater or less sum as shall become payable under the Contract Documents together with Goods and Services Tax at the times and in the manner provided in the Contract Documents.

3. EACH PARTY shall carry out and fulfil all other obligations imposed on that party by the Contract Documents.

G.SPECIFICATION/WORK DESCRIPTION

G.1 Preliminary and General

G.1.1 Preamble

This contract is for the operation of four nominated West Coast Regional Council (WCRC) quarries with the specific purpose of producing Armour- Grade protection rock in a safe, timely and cost effective manner.

All operational aspects of the nominated WCRC quarries must be in accordance with all current Health and Safety in Employment legislation, Worksafe NZ guidelines and best industry practice at all times.

It must be emphasised that all WCRC quarries are operated for the exclusive production of Armour Grade - protection rock and any individual rock weighing less than 250kg is regarded as waste.

Therefore it is important for the contractor to ensure that the production of Armour Grade Protection rock larger or heavier than the above specification is maximised at all times.

G.1.2 Location of Work

The four nominated quarries are located at Kiwi Point (Stillwater) Camelback (Kowhitirangi) and Inchbonnie.

G.1.3 Explosives

The contractor shall supply all explosives required to carry out the work in a safe and cost effective manner.

If required, Council owned and licensed explosive magazines can be made available at a nominal rental for use as a central storage point for explosives.

The Contractor must comply with all relevant legislative requirements in regard to the storage, transport and use of explosives.

The Contractor shall furthermore have a verifiable and ongoing training programme in place to ensure that the Contractor and key staff are holders of the necessary Certificates of Competency as required under existing and any proposed legislation/regulations that pertain to explosives and their use in quarries.

G.1.4 Drill and Blast Plan and Blast Report

Shot plans and post- blast reports are required for all blasting operations although in the situation where secondary blasting is being carried out one report giving the required detail will be sufficient. Primary blast plans shall have such details as blasthole location,depth, length, burden, spacing etc including explosive type, charge weight priming and initiation method. All explosive details must also be recorded in a fit-for-purpose quarry diary.

G.1.5 Description of Work

The main components of this contract include the supply of all labour, materials, plant and equipment (excluding explosives) to complete the following works:

a) Drilling and blasting at four Council Quarries as and when required,

b) Stockpiling Armour Grade protection rock,

c) Managing/disposal of quarry generated waste including rubble to maintain clear, level working surfaces on each bench to allow safe turnaround for truck and trailers during loadout of product.

d) Carry out other activities as directed by Council staff.

G.1.6 Breakout,Grading and Stockpiling of Armour Grade Protection Rock

Prior to breakout commencing ensure that a suitable stockpile site has been identified and agreed to by the Council’s Quarry Manager,

The stockpile shall be as close as practicable to the working face while allowing sufficient room for safe truck/trailer access and turnaround during loadout.

All Armour Grade protection rock placed in stockpile shall be weighed by the methodology as set out in G.2.26 Armour Grade Protection Rock Tally Verification Requirements.

Stockpiles shall be constructed in such a way that will facilitate physical measurement should this be required ,i.e. parallel even sides, consistent height, consistent slope angle etc.,

Stockpiled Armour Grade Protection Rock must be between 0.25 tonne and 4.5 plus tonne + within the following (approximate) Quarried Rock Size Guidelines:

 Individual site conditions may dictate variations to the percentage totals in each grade from time to time with this variation being limited to 10% in any one grade without a change in rate

Any requested variation to the tendered percentage grading in excess of 10% in any one grade will be subject to negotiation between WCRC and the Contractor with an acceptable rate being agreed upon by both parties before proceeding.

G.1.7 Quarry Waste Removal/Management

Reject material and waste smaller than 250kgs shall be carted to waste dumps/tip heads/bunding situated within the quarry.

The cost of Waste material cartage shall be included in the Armour Grade protection rock rate up to a distance of 150m from the working breakout face.

The designated tiphead or quarry floor site should be no more than 150m away from the breakout area,

It should be tipped over the designated tiphead and/or,

Tipped onto and levelled at a designated site within the quarry,

No more than 5% of material transported as waste shall comprise rock larger than 250kgs,

Weighing/measurement of waste material shall be as set out in G.6.4 Armour Grade Protection Rock Tally Verification Requirements.

A separate rate is required for waste material that is required to be carted to waste dumps/tipheads/bunding sites situated beyond 150m and up to 250m from the working breakout face.

G.1.8 Extra Ancillary Work

Extra ancillary work as requested by the Quarry Manager shall be paid for on an authorised hourly rate specified in the attached Schedule of Prices.All authorised hourly work must be accompanied by a WCRC hourly plant hire docket that has been signed by the Operator and co-signed by the WCRC Quarry Manager or other duly authorised Council Officer.

G.1.9 Site Possession

The Contractor will have exclusive possession of the quarry sites as marked by Council. The Contractor shall be responsible for health and safety matters within the quarries and are required to keep the quarries secure using the locks supplied by Council.

The Contractor shall comply with the Council’s instructions as to care of the site and shall take all reasonable precautions as to the care and protection of the Works.

G.1.10 Resource Consents

All work carried out within any quarry must be in accordance with the relevant Resource Consent. A copy of the Resource Consent will be provided by the Quarry Manager prior to work commencing.

G.1.11 Documents

The following documents/specifications shall be read with or form part of this contract document:

G.1.12 Standard Specifications

Lists of standard specifications applicable to these Contract Works are given in the relevant sections of this specification. Unless modified elsewhere in the specification, all of the works specified herein shall be executed in accordance with these requirements.

G.1.13 Contradictions between specifications

The Contractor shall take this specification, the Conditions of Contract and the drawings referred to herein, including all amendments and related documents, and shall read them together and as referring to each other and what is omitted in one and included in the other shall be read as included in all.

In the event of ambiguity or contradictions between this specification, the drawings or any of the standard specifications, it shall be the Contractor’s responsibility to bring any ambiguity or contradictions to the Quarry Manager’s notice for a decision.

G.1.14 Drawings

The Schedule of Drawings in Section F of this document lists the drawings that show the nature and extent of the work to be executed and shall form part of the contract documents. No deviation shall be made from them without the written authority of the Quarry Manager.

The Contractor is warned against scaling dimensions from the drawings supplied.

G.2 General Contract Requirements

G.2.1 Advice Notices

The Contractor shall advise adjacent landowners of blasting activities noting any precautions that should be taken and advising the period during which these activities will occur.

G.2.2 Notification of Commencement of Activities

The Contractor shall inform the Quarry Manager in writing at least 2 working days prior to any work commencing on site.

G.2.3 Resources

The Contractor shall dedicate sufficient resources to undertake the Contract work and meet the performance criteria and standards set.

G.2.4. Contract Management/Personnel Resources

The contractors Quarry Manager must hold an A Grade Certificate of competence.

Key positions within this contract are expected to be the Contract Manager and the contractors Quarry Manager.

Only competent and experienced people shall be employed in the positions.

There shall be no alteration to the persons nominated to these positions without the prior written consent of the Council’s Quarry Manager.

Any persons operating within the Council’s quarries are not permitted to use explosives unless they hold, at a minimum, a current B Grade Quarry Managers Ticket with explosives and a current Shot Firers’ Certificate.All other staff operating in the quarries work under the direction of the Quarry Manager.

G.2.5 Plant

The Contractor will provide and maintain in good and reliable order and condition, all plant and tools necessary for the successful completion of the contract works. The plant and tools must be suitable for the size and task it is performing.

All excavators in use in the quarries must be fitted with certified Roll-over Protective Structures (ROPS) and Falling Object Protective Structures (FOPS) cabs.

Vehicles and mobile plant used by the Contractor for the works shall not, while operating outside the immediate location of any work, exceed any restriction as to weight, size or other matter imposed by Traffic Regulations.

The Contractor shall use machinery that creates significant noise or fumes only between the hours of 6.30 am and 6.00pm, Monday to Friday inclusive. Excavation, earthworks and the like, shall be kept dampened down where appropriate to avoid any dust nuisance to the local residents.

All machinery shall be operated in such a manner as to minimise to the greatest extent practicable any spillage of fuel, oil and similar contaminants to water or land, particularly during machinery refuelling, servicing or maintenance.

All motorised mobile plant shall have an approved fire extinguisher of an adequate capacity.

G.2.6 Materials and Workmanship

All materials supplied under this project will be new and suitable for use in the application required. Materials will be of a quality that assures reliable performance, and be from a manufacturer who can provide after sales support and service, and supply spare parts when necessary.

G.2.7 Accessibility of the Contractor

The Contractor’s Contract Manager shall be available on call to the Council’s Quarry Manager. The whereabouts of this person shall be made known to the Quarry Manager so that communications can be made whenever necessary.

In the event that the Contract Manager is unavailable, the Council’s Quarry Manager shall be informed and given information to enable similar communication to be maintained with an alternative representative.

The Contractor shall ensure that these lines of communication remain open at all times including hours outside normal working hours.

The Contractor will ensure that at all times while any work is in progress, a Site Agent is nominated to be responsible for operations. This Site Agent shall make themselves known to the Council’s Quarry Manager in the event that it is necessary for the Quarry Manager to direct operations in the field. The Site Agent must ensure that the instructions given by the Quarry Manager are at all times actioned.

Such site instruction will generally only be given in relation to matters affecting traffic or public safety. Instructions issued to Site Agents will always be confirmed to the Contract Manager at the earliest convenient time.

During public holidays, weekends and after normal working hours, the Contractor will remain accessible by a suitable communications system which will be available to the Council’s Quarry Manager, through the West Coast Regional Council after hours service provider.

G.2.8 Direction to the Contractor by Others.

No additional payment will be made to the Contractor for complying with the directions given by the New Zealand Police or the general public in regard to safety or any other matters.

G.2.8 Health and Safety in Employment Act 1992 and all Acts, Regulations and amendments thereon

The Health and Safety in Employment Act 1992 requires that the Principal and the Contractor take all practical steps to prevent harm to anyone in the workplace.

The Contractor shall take all necessary precautions in connection with the works in order to ensure the safety, health and welfare of the personnel of the Council, the Contractor and third parties. The Contractor shall acknowledge the Council’s strong commitment to safety and confirm it has a written statement as to safety policy and which has been signed and is actively supported by the Contractor’s management.

It is strongly pointed out that as Contractors are using the Council’s Quarries, they must at all times adhere to Council’s OSH requirements and ensure that their employees are fully conversant with the Council’s safety requirements before entering onto the site.

The Contractor shall in execution of the service comply with the relevant local, national and international laws and regulations in respect to health and safety.

The Contractor shall ensure that all persons carrying out works under this Contract are adequately and regularly trained in safe procedures and made fully aware of the potential hazards associated with the work.

The Contractor shall immediately notify the Quarry Manager of all accidents resulting in:

a) Fatal or lost time injuries to the personnel, subcontractor or third parties.

b) Actual or potential damage to the environment.c) Actual or potential contamination of the water reticulation system

or other network services.

Immediate notification shall be followed by a full written report within 24 hours.

Any failure by the Contractor to comply with the requirements specified above may be regarded as a breach of this Contract and the provisions in these conditions as to remedy in the event of default, suspension or discontinuance of the works shall fully apply to such a failure.

In particular, the Council shall be entitled to order immediate suspension of the works at the Contractor’s expense until any such failure has been remedied.

The successful tenderer shall supply prior to commencing work a completed Site Specific Health and Safety Management Plan that meets the requirements of the Health and Safety in Employment Act 1992 and ACC Acts and Regulations there on.

The Contractor shall without limitation:

a) Take all reasonable precautions to prevent accidents while undertaking the contract works by erecting barriers, signs or devices to cause traffic to slow down, or fences (or similar barriers) across any such road or waterway or around any dangerous place herein, or otherwise, and shall cause any such dangerous place to be sufficiently lighted by night.

b) Where there is any structure, hole, well, excavation or other place dangerous to persons passing along the site forthwith to fill in, cover or enclose the same.

c) Whenever the public safety or convenience renders it expedient, enclose the contract works by a fence or floating barrier to the satisfaction of the Quarry Manager.

Where any such precautions substantially increase the Contractor’s costs, and do not arise by virtue of any default of the Contractor and could not reasonably have been foreseen by an experienced Contractor when tendering, there shall be a Variation.

The Contractor shall give all notices required and shall appoint a Safety Officer and take all other steps necessary to ensure that the works are carried out in accordance with the requirements of the Act.

The name of the Safety Officer shall be supplied with the Health and Safety Management Plan.

The Contractor shall be responsible for any notification to the Occupational Safety and Health Service of the Department of Labour of any “Notifiable Work”

required under the Health and Safety in Employment Act 1992 and Regulations 1995. In addition, the Contractor shall advise the Quarry Manager of any “Notifiable Work”.

The attention of the Contractor is drawn to the provisions of the Health and Safety in Employment Act 1992, which requires all trenches greater than 1.5m deep to be either supported or benched.

G.2.9 Risk Assessment

The contractor shall initiate, carryout and maintain an individual Risk Assessment Programme for each WCRC Quarry prior to commencing quarry operations.

This Risk Assessment Programme must be maintained for the term of the contract as an integral part of the contractors Health and Safety Plan.

G.2.10 Traffic Management

The Contractor shall take all steps necessary to reduce to a minimum the inconvenience caused to motorists, pedestrians, commercial operators and nearby residents.

Closure of State Highway is a mandatory requirement at Kiwi Quarry while primary blasting is carried out.The contractor should always refer to the relevant Quarry Development Plan prior to commencing any quarry activity.

Traffic flow to and from the sites shall be maintained at all times and the Contractor shall provide temporary crossings or other methods in order to achieve this. This may include Traffic Management Plans from the relevant territorial authority for each site.

The Contractor shall provide and maintain, at their own expense, all lights, warning signs etc as required and shall keep emergency services informed of any restriction to any roadways.

G.2.11 Cleanliness of Site/ Access Road Maintenance

The Contractor shall maintain access roads within the Quarry to a safe standard free from debris and mud.

Note: Work will be stopped if the Contractor does not comply with these requirements and will not recommence until the road and plant are cleaned.

G.2.12 Site Clean Up

The Contractor’s attention is drawn to Section 5.15 of NZS 3910:2013.

At the completion of each contract works, the Contractor shall ensure the affected areas are suitably tidy for handing over to the Principal.

G.2.13 Control of Noise

The Contractor shall carry out the work in accordance with the Health Act 1978 and the Noise Control Act 1982 and other local authority regulations. The

contractor shall adopt the best practicable option for dealing with noise in each quarry to ensure reasonable levels are not exceeded.

G.2.14 Site Measurements

Failure to check any measurements will not constitute an excuse for failure to perform to the agreed programme or give rise to variation claims.

G.2.15 Timing of Works

In addition to the requirements of NZS 3910:2013 the hours of work adopted for any portion of the work shall be such that they do not cause unreasonable nuisance to members of the public.

Works shall only occur between the hours of 6.30 am and 6.00 pm.

G.2.16 Record Material Placed in Stockpiles or Waste Dumps

The Contractor shall provide a daily record of all materials loaded and carted to stockpiles on waste dumps, information provided from an approved weighing device as set out in G.6.4 and G.6.5. Such records should include the day, month, actual time and measured weight of every load carted to stockpile and/or dump sites.

G.2.17 Access

West Coast Regional Council staff or agents are to be permitted access to the relevant parts of the site at all reasonable times for the purpose of carrying out inspections, surveys, investigations, tests, measurement or taking samples.

G.2.18 Dust Nuisance

The Contractor shall be responsible for ensuring that adjacent residents or other members of the public suffer no reasonably avoidable inconvenience or hardship from dust arsing by any means whatsoever from the works during the course of the Contract.

G.2.19 Public Relations

The Contractor has a specific obligation to each private property owner adjoining the work. The Contractor is responsible for carrying out liaison with each affected resident to ensure that they are fully aware of the timing of any blasting.

G.2.20 Fences

In removing fences, the Contractor is to maintain existing paddocks stockproof as necessary. Any fencing costs to be built into the quoted per tonne rates

G.2.21 Protection of Property and New and Existing Works

The Contractor must protect adjoining properties, fences, or other facilities and all new and existing work on the site from damage through negligence or by reason of his operations under this contract. Any such damage must be made good at the

Contractor’s expense and to the entire satisfaction of the Quarry Manager and the property owner.

G.2.22 Monthly Claim

The Contractor shall submit the monthly claim in a similar format to that of the Contract Schedule of prices. The Contractor’s monthly claim shall be supported by a written statement from the Contract Manager that all work has been performed in compliance to the specifications.

G.2.23 Access Road

The existing quarry access roads are to be repaired and maintained during the site works. At the completion of the works the quarry access roads are to be left in a levelled, graded and finished condition to the satisfaction of the Council’s Quarry Manager.

G.2.24 Contractors Personnel

The contractor shall name the following key personnel who are to be employed on the Contract works:

Contract Manager Quarry Manager Health Safety Personnel

The Council’s Quarry Manager may at any time by notice in writing to the contractor object on reasonable grounds to the continuation of any person that is responsible for the above positions.

The notice shall state the grounds upon which the objection is based. The contractor shall appoint another competent person in place of the person to whom the objection has been made.

G.2.25 Non-compliance of Materials or Workmanship

Should any inspection by the Council’s Quarry Manager find any evidence of non – conforming materials, workmanship or variance to methodology approved the contractor on request from the Quarry Manager, supply within 5 working days a written explanation for the variance and details if appropriate of what remedial action should be taken.

G.2.26 Armour Grade Protection Rock Tally Verification Requirements

The contractor shall nominate the weighing method intended to be used for the contract and provide details of the load docket system that will be used to track individual loads.

The proposed weighing method for loadout and cartage to stockpile areas within in the quarry must:

Have a current Certificate of accuracy issued by an accredited person in terms of the requirements of Regulation 15F of the Weights and Measures Regulations 1987.

Have a capacity, location and docket issue system suitable for the purpose, to the satisfaction of the WCRC Quarry Manager.

Have the ability to be independently audited and verified.

Each vehicle load delivered to the Stockpile area or dump site shall be certified by a docket provided by the weighing operator or an approved weighing device.

Dockets shall clearly indicate the following:

Date and time of issue The delivery vehicle (company name and number or other clear

identification) Tare weight of vehicle, Gross weight of vehicle.

The contractor shall supply copies of the dockets with the relevant payment claim. PLEASE NOTE: NO PAYMENT WILL BE MADE WITHOUT THE SUPPORTING DOCKETS.

The contractor shall be responsible for the accuracy of the Quarry weighing/weighbridge dockets.

The WCRC Quarry Manager/Engineer reserves the right to randomly verify tare and load weights at any time by diversion to an alternative weighbridge or other suitable weighing methodology/mechanism to check measurement.Such random weightings are to be paid for by the Principal.Any diversion of loads facilitated by the Principal, or their representative, will not unduly disrupt the turnaround time for that load.

G.2.26 Waste Material Tally Verification Requirements

The contractor shall nominate the weighing method intended to be used for the contract and provide details of the load docket system that will be used to track individual loads.

The proposed weighing method for loadout and cartage to stockpile areas within in the quarry must:

Have a current Certificate of accuracy issued by an accredited person in terms of

the requirements of Regulation 15F of the Weights and Measures Regulations 1987.

Have a capacity, location and docket issue system suitable for the purpose, to the satisfaction of the WCRC Quarry Manager/Engineer.

Have the ability to be independently audited and verified.

Each vehicle load delivered to the Stockpile area shall be certified by a docket signed by the weighing operator. Dockets shall clearly indicate the following:

Date and time of issue, The delivery vehicle (company name and number or other clear

identification) Tare weight of vehicle,

Gross weight of vehicle.

The contractor shall supply copies of the dockets with the relevant payment claim. PLEASE NOTE: NO PAYMENT WILL BE MADE WITHOUT THE SUPPORTING DOCKETS.

The contractor shall be responsible for the accuracy of the Weighing/Weigh Bridge/Dockets.
