Mark Van Wormer called the meeting to order at 6:00 p.m.

The first item on the agenda was to elect a Chairman and Vice Chairman. Larry Tichenor nominatedNorm Stanek to be the Chairman. Larry Tichenor moved that the nominations be closed and that thenominee be approved seconded by Carlos Holcomb. Carlos Holcomb nominated Kevin Riley to be ViceChairman. Norm Stanek moved that the nominations be closed and that the nominee be approvedseconded by Larry Tichenor,

A motion was made by Kevin Riley and seconded by Kevin Brueggeman to approve the minutes of theAptil t'Z,2077 meeting, Director of Public Works reports for May and June; Wastewater TreatmentOperation and Maintenance reports for April and May; Water Utility Operation and Maintenancereports for April and May, monthly bills for the Sanitation Dept., Street Dept. and Water Utility.Motion carried 5-0,

The Sparta School District is requesting that sidewalks be installed on Thayer Avenue and E. DivisionStreet. They are trying to work out some busing issues and installing sidewalks would help the situationThe Public Works Board would have to determine what side of the street would be best because oftrees, right-of-ways and where to place crosswalks. Right now there is 525,000 in the budget forsidewalks. The Board would like to see a design along what the cost would be and the footage amount.A motion was made by Kevin Riley and seconded by Kevin Brueggeman to hire an engineer firm to doa study for the two streets to get a cost and see what the best option for sidewalk placement wouldbe, Motion carried 5-1 with Bryan Jandt abstaining.

There was a request to place a No Parking sign on the 200 Block of East Franklin Street to help withtraffic congestion in that area. Years ago there were No Parking signs in this area but were taken down.Our Ordinance was never changed to reflect that. We are in the process of updating our ordinances and

this will be looked at. A motion was made by Kevin Riley and seconded by Kevin Erueggeman to takeno action on this request, Motion carried 6-0.

Mark Flock presented the Board with his annual CMAR report. He stated that if we can keep up withyearly repairs, we should be able to get an "A" every year. A motion was made by Kevin Riley andseconded by Carlos Holcomb to approve the Annual CMAR report as presented. Motion carried 6-0.

Todd Hanson gave an update on Well #4 and Well #9. Well #4 went down about a week ago and will be

down about 2-3 weeks. They will be performing an airburst procedure to clean the casing of debriswhich will allow better pumping performance. The pump will have to be rebuilt and the approximatecost will be s35,000 - 536,000. well f9 had a pressure surge and century Foods contacted us aboutsome issues with this. A Rep. from Tonka came and stated we will need to install a new surge tank that

will cost approximately 585,000. A VFD will be included on the well pump and replacing the media inthe filter

There have been several concerns/com plaints regarding yard waste and grass clippings so this topic wasaddressed. We do not have an ordinance that specifically deals with yard waste and grass clippings. Wewill be looking at creatinB an ordinance regardlng these issues. This will be brought back as a conditionat next month's meeting to set up an ordinance.

Chief Kuderer has received some concerns regarding the traffic on E. Main Street and Rusk Avenue.There is some confusion when you turn left, go straight to the park or turn right on Rusk Ave. We maywant to look at having the same type of intersection that we have on E. Oak Street where there is a rightturn no stop. This will be brought back again to create an ordinance.

Items mentioned for future consideration were:There was an update on the Dean Arcoraci hangar and that it was cleared out.The Board wanted to express thanks to Dennis Johnson and his crew for keeping the City looking good

A motion was made by Kevin Riley and seconded by Carlos Holcomb to adjourn at 5:59 p.m, to go intoclosed session per Wis, Stats, 19,85(1Xe) Deliberating or negotiating the purchasing of publicproperties, the investing of public funds, or conducting other specified public business, whenevercompetitive or bargaining reasons require a closed session. Regarding: Roberts Road Reconstruction,Motion carried 6-0. This meeting was adjourned for the night from closed session,

Airport- We are working with the State Bureau of Aeronautics to complete our Airport Layout

Plan and Master Plan. He will be advertising for Professional Services to complete both itemsthis year.

-Gunderson MedLink Air discussions are still ongoing for a long-term solution for their24/7 operations at the airport. I met with Sean Cain the construction representative fromGunderson and engineers from Brickl Brothers to determine the feasibility of modifying theexisting building 6082 hangar. Remodeling the existing hangar was determined to be very costlyand now Gunderson is looking at building a new facility at the airport.

-Hangar 6082(Neco hangar) has been vacated and repairs are being scheduled to correctwater issues in the mechanical room and other maintenance and repair items.

Project Updates

Paper Mill Dam Proiect

MSA and I are working with the Wisconsin DNR to finalize a plan to correctdeficiencies in the power house and dam structure. The plan is still to design the modificationsyet this year and make repairs and modifications in 201"8.

Central Ave. (Grace St to Black River St)

Gerke Construction is finishing up the underground utilities and will be startinB thestreet reconstruction shortly including sidewalks and curb and gutter.

E. Main St. Bridse Proiect

The Bridge construction is nearing completion. PavinB operations are complete and the bridgeis scheduled to be open on 14 July.

Hishwav 27 Proiect

The project is still on the current schedule we hired SEH to design decorative lightingand roundabout landscaping that the State has agreed to and will be added to the project

funded by the State. The property acquisitions for the Roberts Road portion of the project are inprogress and the appraisals have been completed.

OPERATION AND MAINTENANCE REPORT

JUNE 2017

The month of June was devoted to general plant maintenance and collectionsystem/liftstatio n work. Olson Electric made final connections on our newemergency stand-by generators at Hoeschler Dr. and Julie Ave. liftstations andNPower performed initial start-up and training. USEMCO cleaned and inspectedthe check valves at the Theater Rd. liftstation and Crane Engineering is scheduledto replace/repair a failed check valve at the Jane Dr. liftstation. We also pulled a

failed pump at the Osborne Dr. liftstation and sent in for repairs. B&M TechnicalServices performed our semi-annual calibrations on all flow measuring devicesand checked out our failed ferric chloride feed pumps which may have beenaffected by I

(PERS) chem

ghtening. LaMont Albers of Process Equipment Repair Servicescally cleaned our ceramic air diffusers in our activated sludge basin

with Hydrogen Chloride, Anhydrous gas. Submitted and certified our 201.6 CMARto the WDNR. WE collected semi-annual ground water monitoring well samples atthe Angelo Landfill #39 and shipped to Northern Lake Services for testing. Theplant is performing very well and we are in full compliance with our currentWPDES permit requirements. Listed below are some of the other operation andmaintenance tasks, which were completed during June 20L7.

r Continue to mow and trim grass around plant grounds and liftstations,along with restoring lawn and landscape from piping repairs.

. Temporary replaced a pillow block bearing for the draft fan on our sludgeheat exchanger.

r Replaced a pump saver/controller at the Riverwood liftstation.r lnstalled a new impeller, wear ring and rail flange on the south pump at

Jane Dr. liftstation.o Cleaned and inspected check valves at the Hoeschler Dr. liftstation.o Continue to flush weekly and whole city sewers.o Continue to run the sludge Gravity Belt Thickener (GBT) 3x a week.o L.W. Allen replaced an LEL sensor on our gas analyzer in structure 15 and

ca librated.

. Continue to clean weirs, launders and trickling filter arms weekly. Alsopumped primary scum to the digesters.

o Changed oil in the influent sampler pump.. Street Dept. assisted in restoring drainage ditch near the Osborne Dr.

ln June we pumped 42,775,OOO gallons of water compared to 38,778,000 gallons for the sameperiod last year.

The following is a list of what the Water Utility has been working on during the month of June:

Ran standby engines and generators for the monthly tests

We completed lead and copper sampling at 20 residences throughout the City. All samplerresults were under the maximum contaminate level for both lead and copper. This testingis required by the DNR every 3 years unless results are above the MCL.

Our well 4 has developed a problem, as the gallons per minute have dropped offconsiderably, in a short period of time. With well 9 and its filter issue and the hot weatherseason now here, this is an emergency situation as we need this well back up and runningas soon as possible. I have spoken to Mark and Mark for the go ahead to get a well crewhere to make repairs. The well was pulled on the 12th. Air burst technology was used as

part of the rehab process. This technique uses high pressure air to knock off any ironbuildup in the well. A new pump, column pipe and other components were also installed.It is looking like the well will be back on line, the week of July 10th.

A couple changes have come up as to how we proceed with our well g filter rehab projectAfter doing more research and consulting with Tonka, Springlake and USEMCO, thepressure surge that caused the media in the filter to be upset is related to the pneumaticbutterfly valves. lt is recommended that we replace these. The filter industry is nowtrending towards installing electric style valves instead of the pneumatic style. They openand close more consistently and smoothly, and there is less maintenance with them. We

will see what the cost difference is, and then make a decision, as to which ones to install.By changing these valves to reduce the water hammer, a surge tank is probably notneeded. This would save us around 520,000. Also it is recommended that we replace themedia in the other two cells. We do not know the condition of the under drain piping and

air wash grid, and I have concerns with the water hammer that has occurred, that themedia maybe upset as well. lt isn't that much more in labor costs to replace the media inthe other two cells, as a lot of the cost is mobilization of the contractor's equipment.

Lee and Brian attended a Western Wisconsin Water Professionals meeting in Tomah on

June 14th, Capitol Safety, Utility Services and BT Technical Services gave presentations tothe group.

a L.W. Allen installed our new scada trending master control computer. The conversionfrom the old to the new went very well. We are now able to monitor operations at eachwell more closely. lt also gives us the capacity to add sites as the water system grows.

We received a chemical delivery, from Hawkins Chemical Group at some of our wellho uses.

The Central Ave. street project is moving along well. We have been working with thecontractor turning valves etc. as needed. Water main and services have been installedThe pressure test passed and safe samples were collected.

We filled a pool on the Butter fest grounds for an event during the celebration

A squirrel got into Xcel's power line on Saturday the 17th at well 9, causing the well tosingle phase. A phase monitor within the well house was damaged, which prevented thewell from starting on automatic. The well to be out of service until Olson Electric came onMonday morning to make repairs.

We are doing some valve exercising of main line valves throughout the distributionsystem. The DNR requires us to actuate about half of them each year.

We continue to do some routine meter work, cross connection inspections, digger'shotline locates, flushing of dead end lines, lawn work etc.

We completed the monthly meter reading route for our large customers.

Raking Leaves Into Streets.

ln the interests of public safety, health and general welfare, community appearance and

efficiency of operation, it shall be unlawful to rake or place fallen tree leaves or grass clippings

onto the pavement or into the gutter of any public street or alley. No person shall permit grass

clippings from mower swaths to remain upon sidewalks or on abutting property owned or

occupied by him.

Unlawful Dumping on Streets.

It shall be unlawful for any person to deposit or cause to be deposited, dump, sort, scatter or

leave any rubbish, stone, wire, earth, ashes, cinders, sawdust, hay, glass, manure, filth, paper,

snow, ice, dirt, grass, leaves, construction waste, garbage or other offensive or noxious

material in any public street, sidewalk, alley, or upon any public property or upon any property

of another, without the express permission of the owner of occupant thereof.

Obstruction of Public Ditches.

No person shall In any manner obstruct or cause to be obstructed the free passage of water in any

public gutter, ditch, culvert, swale or drain or place or cause to be placed any rubbish, dirt, sand,

gravel or any other matter or thing so that the same is likely to be carried by the elements into

any public gutter, ditch, culvert, swale or drain.

The signatory City of Sparta, hereinafter called the Municipality, through its undersigned duly authorized officers or officials, hereby requests the State of Wisconsin Department of Transportation, hereinafter called the State, to initiate and affect this agreement to include the associated maintenance responsibilities hereinafter described.

The authority for the Municipality to enter into this agreement with the State is provided by Section 84.07(1) of the Statutes. Wisconsin statutes, Wisconsin Administrative Code, and State policy serve as the defining documents for State Highway maintenance responsibilities.

DESCRIPTION OF FACILITY:

As determined by project ID 5144-01-05, 21, 75 (for portion outside of connecting highway limits):

The proposed improvements will consist of two through lanes, a roundabout, curb and gutter, sidewalk, storm sewer, and appurtenances.

This request shall constitute agreement between the Municipality and the State; is subject to the terms and conditions that follow (pages 1 – 3); is made by the undersigned under proper authority to make such request for the designated Municipality and upon signature by the State, delivery to the Municipality and upon fully executed signature of associated, applicable State Municipal Financial Agreement for project 5144-01-05, 21, 75. The initiation and signature of the agreement will be subject to all the applicable federal and state regulations. No term or provision of neither the State/Municipal Maintenance Agreement nor any of its attachments may be changed, waived or terminated orally but only by an instrument in writing executed by both parties to the State/Municipal Maintenance Agreement.

TERMS AND CONDITIONS:

1. In order to guarantee the Municipality’s foregoing agreements to maintain the facility to State standards, the Municipality, through its above duly authorized officers or officials, agrees and authorizes the State to set off and withhold General Transportation Aids or monies otherwise due and payable by the State to the municipality, as determined by the State, for any maintenance the State must perform to the facility should the Municipality fail to comply with the agreement.

2. The State will not install any additional items, not necessitated for the safe and efficient flow of traffic, to a state highway facility without the Municipality agreeing to maintain those items. The State is responsible for maintaining the through travel way of any given highway facility under the State’s jurisdiction including:

(a) The energy, operation, repair and replacement of traffic signals and associated street lighting required for the signalized intersections within the limits of this agreement for:

1. Roundabouts None on this project. Maintained by municipality. (b) Signing and pavement marking necessitated for the safe and efficient flow of traffic except those items listed

in #3.

(c) Permitting authority of utilities and access control on all State Trunk, US and Interstate Highways.

3. The Municipality shall at its own cost and expense maintain all portions within the specified limits of this agreement that lie within its jurisdiction for such maintenance through statutory requirements in a manner satisfactory to the State and shall make ample provision for such maintenance each year to include:

(a) Maintain all items outside, and under, the travel way to include, but not limited to, parking lanes, curb and gutter, drainage facilities, sidewalks, multi-use paths, retaining walls, pedestrian refuge islands and landscaping features.

(b) Remove snow and ice from sidewalks, multi-use paths, and pedestrian refuge islands.

(c) Implement a street sweeping program to help prevent the accumulation of dirt, sand, leaves, paper, or other clogging debris.

(d) Maintain the storm sewer system to provide a free flow condition throughout the life of the facility including, but not limited to, annual inspection of inlets, catch basins, manholes, pipe; annual cleaning and removal of blockages, replace broken or malfunctioning castings, grates, grit covers, risers, covers and frames; repair top slabs along with bottom and walls of basins. Routine mortar repairs such as tuck pointing and plastering to the inlets, catch basins, and manholes.

(e) Maintain and accept responsibility for the energy, operation, maintenance, repair, and replacement of the street lighting system.

i. The Municipality shall obtain a permit from the State.

ii. The Municipality shall accept responsibility for locating utilities for Digger’s Hotline.

iii. If at any time the Municipality should choose to turn off or remove street lighting, in part or in whole, funded with federal/state dollars, the State will determine potential conflicts and approve/disapprove such request. If removal is approved by the State, the Municipality will reimburse to the State an amount determined by Federal and State coordination.

(f) Maintain clear right-of-way of all encroachments.

(g) Maintain crosswalk pavement markings. The municipality shall obtain a permit with the State.

(h) Maintain signs and pavement markings not necessary for the safe and efficient movement of traffic (no parking signs, wayfinding signs, etc). The municipality further agrees to maintain signs and pavement markings per the attachment which defines the municipal responsibilities with respect to the roundabout.


(i) Maintain and accept responsibility for the following as applicable to this agreement:

1. All portions of the storm sewer system that extend beyond the limits of the urban (curb &gutter) cross section.

2. Roundabout landscaping and appurtenances. Landscaping and appurtenances need to be reviewed and approved by the State.

3. Facilities associated with Municipality side roads and access locations as shown on attachment.

4. Fiberglass medallion and appurtenances.

(a) In the event that the State deems it necessary to remove the medallion and appurtenances on the basis of a need to expand capacity or improve safety, the State reserves the right to give notice regarding the removal of the medallion and appurtenances. The State may terminate permission for the medallion to be in the right of way upon (30) days written notice to the Municipality. The Municipality shall remove the medallion and appurtenances within the time specified in the notice.

(b) If the State determines that the installation of the medallion and appurtenances increases the difficulty of road maintenance, creates conditions adverse to the best interest of the highway users, the general public, or presents a threat to road safety, then the Municipality, upon notification by the State shall promptly remove the medallion and appurtenances from the road right of way.

4. The Municipality, within the specified limits, agrees to:

(a) Prohibit angle parking.

(b) Regulate parking along the highway. The Municipality will file a parking declaration with the State.

(c) Regulate and prohibit, by ordinance, parking at all times on STH 27.

(d) Regulate and prohibit by ordinance, parking at all times on W. Averill Street between Roberts Road and STH 27.

(e) Regulate and prohibit by ordinance, parking at all times on River Road between Roberts Road and STH 27.

5. The Municipality will coordinate with the State to obtain any necessary Work on Right-of-Way Permits for maintenance performed on or within the state highway facility or state right-of-way.

6. This agreement does not remove the current municipal maintenance responsibility.

7. The State or Municipality may request an amendment to this agreement to include specific features later requested by the Municipality throughout the design process.

8. Upon completion of construction project, 5144-01-75, the Municipality will assume all afore mentioned maintenance responsibilities.

The signatory City of Sparta, hereinafter called the Municipality, through its undersigned duly authorized officers or officials, hereby requests the State of Wisconsin Department of Transportation, hereinafter called the State, to initiate and effect the highway or street improvement hereinafter described.

The authority for the Municipality to enter into this agreement with the State is provided by Section 86.25(1), (2), and (3) of the Statutes.

NEEDS AND ESTIMATE SUMMARY:

Existing Facility - This segment of STH 27 is a major link between Interstate 90 and the City of Sparta. The project area has current traffic volumes between 12,000 and 16,000 vehicles per day and continuous commercial development. The existing two-lane cross-section has a crash rate above the state-wide average, poor operating conditions and a pavement that has reached the end of its useful life.

Proposed Improvement - The proposed improvement will consist of reconstructing the roadway to two through lanes and a two way left turn lane. The intersection with STH 16 will be improved and a roundabout will be constructed at the River Rd. intersection.

The connecting highway limits on STH 27 are proposed to be extended southerly to the roundabout after the completion of the project.

Describe non-participating work included in the project and other work necessary to finish the project completely which will be undertaken independently by the municipality: The Municipality has expressed the need to upgrade sanitary sewer, upgrade old water lines and adjusting sanitary manholes, water valves and fire hydrants. The Municipality is responsible for Concrete Curb & Gutter, water lines and sanitary lines at Roberts Road. The design and construction of the non-participating work is 100% funded by the Municipality. Funding for aesthetics (CSD) exceeding the capped amount is 100% responsibility of the Municipality.

The decorative elements for the roundabout lighting are above and beyond the standard costs and would be the responsibility of the Municipality. The decorative lighting items for the roundabout lighting are eligible for CSS funding. Federal/State CSS funding for decorative lighting in the roundabout limits is capped at $71,000. All CSS costs (including inflation and delivery) exceeding $71,000 for this category are the responsibility of the Municipality. 4The cost for placing new continuous lighting designed to accepted WisDOT standards and installed at the time of construction within the connecting highway is 50% eligible for Federal/State funding. The Municipality may request decorative lighting in place of standard lighting within the connecting highway. The decorative elements for the new lighting within the connecting highway are above and beyond the standard costs and would be the responsibility of the Municipality. The decorative lighting items for the new lighting within the connecting highway are eligible for CSS funding. Federal/State CSS funding for decorative lighting in the connecting highway limits is capped at $84,000. All CSS costs (including inflation and delivery) exceeding $84,000 for this category are the responsibility of the Municipality. 5Non-participating estimated item costs have a delivery cost of 1%. 6Storm Sewer, Driveway, and Curb & Gutter work on Roberts Roads are the responsibility of the Municipality.

This request is subject to the terms and conditions that follow (pages 3 – 8) and is made by the undersigned under proper authority to make such request for the designated Municipality and upon signature by the State, upon fully executed signature of applicable State Municipal Maintenance Agreement and delivery to the Municipality. The initiation and accomplishment of the improvement will be subject to the applicable federal and state regulations. No term or provision of neither the State/Municipal Financial Agreement nor any of its attachments may be changed, waived or terminated orally but only by an instrument in writing executed by both parties to the State/Municipal Financial Agreement.

1. The initiation and accomplishment of the improvement will be subject to the applicable Federal and State regulations.

2. The Municipality shall pay to the State all costs incurred by the State in connection with the improvement that exceed Federal/State financing commitments or are ineligible for Federal/State financing. Local participation shall be limited to the items and percentages set forth in the Summary of Costs table, which shows Municipal funding participation. In order to guarantee the Municipality’s foregoing agreements to pay the State, the Municipality, through its above duly authorized officers or officials, agrees and authorizes the State to set off and withhold the required reimbursement amount as determined by the State from any moneys otherwise due and payable by the State to the Municipality.

3. Funding of each project Phase is subject to inclusion in an approved program and per the State’s Facility Development Manual (FDM) standards. Federal aid and/or state transportation fund financing will be limited to participation in the costs of the following items as specified in the Summary of Costs:

(a) Design engineering and state review services.

(b) Real Estate necessitated for the improvement.

(c) Compensable utility adjustment and railroad force work necessitated for the project.

(d) The grading, base, pavement, curb and gutter, and bridge costs to State standards, excluding the cost of parking areas.

(e) Storm sewer mains, culverts, laterals, manholes, inlets, catch basins, and connections for surface water drainage of the improvement; including replacement and/or adjustments of existing storm sewer manhole covers and inlet grates as needed.

(f) Construction engineering incidental to inspection and supervision of actual construction work, except for inspection, staking, and testing of sanitary sewer and water main.

(g) Signing and pavement marking necessitated for the safe and efficient flow of traffic, including detour routes.

(h) Replacement of existing sidewalks necessitated by construction and construction of new sidewalk at the time of construction. Sidewalk is considered to be new if it’s constructed in a location where it has not existed before.

(i) Replacement of existing driveways, in kind, necessitated by the project.

(j) New installations or alteration resulting from roadway construction of standard State street lighting and traffic signals or devices. Alteration may include salvaging and replacement of existing components.

4. Work necessary to complete the improvement to be financed entirely by the Municipality or other utility or Facility Owner includes the following items:

(a) New installations of or alteration of sanitary sewers and connections, water, gas, electric, telephone, telegraph, fire or police alarm facilities, parking meters, and similar utilities.

(b) New installation or alteration of signs not necessary for the safe and efficient flow of traffic.

(c) Roadway and bridge width in excess of standards.

(d) Construction inspection, staking, and material testing and acceptance for construction of sanitary sewer and water main.

(e) Parking lane costs.

(f) Coordinate, clean up, and fund any hazardous materials encountered during construction. All


hazardous material cleanup work shall be performed in accordance to state and federal regulations.

(g) Damages to abutting property due to change in street or sidewalk widths, grades or drainage.

(h) Conditioning, if required and maintenance of detour routes.

(i) Repair of damages to roads or streets caused by reason of their use in hauling materials incidental to the improvement.

5. As the work progresses, the Municipality will be billed for work completed which is not chargeable to federal/state funds. Upon completion of the project, a final audit will be made to determine the final division of costs.

6. If the Municipality should withdraw the project, it shall reimburse the State for any costs incurred by the State in behalf of the project.

7. The work will be administered by the State and may include items not eligible for federal/state participation.

8. The Municipality shall at its own cost and expense:

(a) Maintain all portions of the project that lie within its jurisdiction for such maintenance through statutory requirements, in a manner satisfactory to the State and shall make ample provision for such maintenance each year. This agreement does not remove the current municipal maintenance responsibility.

(b) Maintain all items outside the travel lane along the project, to include but not limited to parking lanes, curb and gutter, drainage facilities, sidewalks, multi-use paths, retaining walls, pedestrian refuge islands, landscaping features and amenities funded by Community Sensitive Solutions (CSS).

(c) Maintain and accept responsibility for the energy, operation, maintenance, repair, and replacement of the lighting system.

(d) Prohibit angle parking.

(e) Regulate parking along the highway. The Municipality will file a parking declaration with the State.

(f) Regulate and prohibit, by ordinance, parking at all times on STH 27 between B-41-12 (Over the La Crosse River) and STH 16.

(g) Use the WisDOT Utility Accommodation Policy unless the Municipality adopts a policy which has equal or more restrictive controls.

(h) Provide complete plans, specifications, and estimates for sanitary sewer and water main work. The Municipality assumes full responsibility for the design, installation, inspection, testing, and operation of the sanitary sewer and water system. This relieves the State and all of its employees from the liability for all suits, actions, or claims resulting from the sanitary sewer and water system construction.

(i) Maintain all Community Sensitive Solutions and/or enhancement funded items.

(j) Coordinate with the State on changes to highway access within the project limits.

(k) Assume general responsibility for all public information and public relations for the project and to make a fitting announcement to the press and such outlets as would generally alert the affected property owners and the community of the nature, extent, and timing of the project and arrangements for handling traffic within and around the projects.

9. Basis for local participation:

(a) Design Engineering (5144-01-05):

The Municipality is responsible for 25% of the design engineering costs for improvements on a Connecting


Highway. The Municipality may be responsible for the design of decorative lighting and other enhancement items.

(b) Real Estate Acquisition (5144-01-21):

a. All real estate acquisitions necessitated by the roadway improvement are 100% eligible for Federal/State funding. The State will reimburse the Municipality for real estate and all eligible acquisition costs necessitated by the roadway construction if the real estate is being acquired where roadway improvements are needed. Costs not eligible for State reimbursement include real estate purchased for parking and excess remnants not associated with the roadway project.

b. Cost eligible for State reimbursement includes access rights on STH 27 (South Black River Street) between North Abutment of Structure B-41-12 (Over the La Crosse River) and Hill Street as indicated in the Transportation Project Plat No: 5144-01-21. Access control has been included in this segment for safety and operational needs. Any future alteration to acquired access rights will require review and written consent from the Department, and will require the Municipality to reimburse the State any property value increase resulting from access alteration as determined by a State approved appraisal.

(c) Construction (5144-01-75):

a. CSS: The CSS funding is 100% Federal/State with a maximum of $180,000. The Municipality will be responsible for 100% of the costs of the aesthetic items over the Federal/State maximum set for each category. CSS funding for all Categories combined is capped at $180,000. All CSS related aesthetic treatment must be finalized six(6) months prior to the PS&E date. The CSS funding has been split up within three categories as detailed below (b-d).

b. Medallion & Landscaping: A Medallion, to be placed in the roundabout island, and the Landscaping for the roundabout island, both requested by the Municipality, and are designed to accepted WisDOT standard and installed at time of construction is 100% eligible for Federal/State funding. However, costs exceeding the maximum CSS funding of $43,000 for the Medallion and Landscaping in the roundabout island are the responsibility of the Municipality. All future maintenance and operation costs of the Medallion and the Landscaping are the responsibility of the Municipality.

c. Roundabout Lighting: New Standard Street Lighting within the roundabout limits are 100% eligible for Federal/State Funding. The Municipality may request decorative lighting in place of standard street lighting within the roundabout limits. The decorative items are eligible for CSS funding. However, the added costs for decorative street lighting exceeding the maximum CSS funding of $62,000 for standard street lighting are the responsibility of the Municipality. All future maintenance and operation costs of the continuous street lighting are the responsibility of the Municipality.

d. New Continuous Lighting: New Standard Street lighting necessitated by the roadway construction, designed to WisDOT standards and installed at time of construction is 50% eligible for Federal/State funding. The other 50% of the standard lighting cost is the responsibility of the Municipality and is not eligible for CSS funding. The Municipality may request decorative lighting in place of standard lighting. The decorative items are eligible for CSS funding. However, the added costs for decorative street lighting exceeding the maximum CSS funding of $75,000 for standard street lighting are the responsibility of the Municipality. All future maintenance and operation costs of the continuous street lighting are the responsibility of the Municipality.

(d) Non Participating Costs (5144-01-76):

The Municipality shall pay 100% of the cost of installing Sanitary Sewer Systems (including manhole(s)) adjustments, Water Main, Water valves adjustments, Fire Hydrant adjustment(s) and relocation(s). The Municipality shall pay 100% cost of installing Sanitary Sewer System, Water Main, Storm Sewer and


Concrete curb and gutter on Roberts Road. These costs are not eligible for Federal/State funding.

(e) Connecting Highway Extension:

The Municipality agrees to an extension of the connecting highway limits on STH 27 from the existing south termini (0.25 miles south of Wisconsin Street (STH 16)) to a new south termini (0.07 miles South of the STH 27 & W Averill Street Intersection; North of the Roundabout). The net center line length of approximately 740 LF will be added to the existing connecting highway limits. Connecting highway aid payments will be adjusted accordingly and the connecting highway status will become effective upon the completion (open to traffic) of this construction project.

Federal/State CSS funding for decorative lighting in the connecting highway limits is capped at $84,000. All CSS costs (including inflation and delivery) exceeding $84,000 for this category are the responsibility of the Municipality. 5Non-participating estimated item costs have a delivery cost of 1%. 6Storm Sewer, Driveway, and Curb & Gutter work on Roberts Roads are the responsibility of the Municipality.

This request is subject to the terms and conditions that follow (pages 3 – 8) and is made by the undersigned under proper authority to make such request for the designated Municipality and upon signature by the State, upon fully executed signature of applicable State Municipal Maintenance Agreement and delivery to the Municipality. The initiation and accomplishment of the improvement will be subject to the applicable federal and state regulations. No term or provision of neither the State/Municipal Financial Agreement nor any of its attachments may be changed, waived or terminated orally but only by an instrument in writing executed by both parties to the State/Municipal Financial Agreement.

1. The initiation and accomplishment of the improvement will be subject to the applicable Federal and State regulations.

2. The Municipality shall pay to the State all costs incurred by the State in connection with the improvement that exceed Federal/State financing commitments or are ineligible for Federal/State financing. Local participation shall be limited to the items and percentages set forth in the Summary of Costs table, which shows Municipal funding participation. In order to guarantee the Municipality’s foregoing agreements to pay the State, the Municipality, through its above duly authorized officers or officials, agrees and authorizes the State to set off and withhold the required reimbursement amount as determined by the State from any moneys otherwise due and payable by the State to the Municipality.

3. Funding of each project Phase is subject to inclusion in an approved program and per the State’s Facility Development Manual (FDM) standards. Federal aid and/or state transportation fund financing will be limited to participation in the costs of the following items as specified in the Summary of Costs:

(a) Design engineering and state review services.

(b) Real Estate necessitated for the improvement.

(c) Compensable utility adjustment and railroad force work necessitated for the project.

(d) The grading, base, pavement, curb and gutter, and bridge costs to State standards, excluding the cost of parking areas.

(e) Storm sewer mains, culverts, laterals, manholes, inlets, catch basins, and connections for surface water drainage of the improvement; including replacement and/or adjustments of existing storm sewer manhole covers and inlet grates as needed.

(f) Construction engineering incidental to inspection and supervision of actual construction work, except for inspection, staking, and testing of sanitary sewer and water main.

(g) Signing and pavement marking necessitated for the safe and efficient flow of traffic, including detour routes.

(h) Replacement of existing sidewalks necessitated by construction and construction of new sidewalk at the time of construction. Sidewalk is considered to be new if it’s constructed in a location where it has not existed before.

(i) Replacement of existing driveways, in kind, necessitated by the project.

(j) New installations or alteration resulting from roadway construction of standard State street lighting and traffic signals or devices. Alteration may include salvaging and replacement of existing components.

4. Work necessary to complete the improvement to be financed entirely by the Municipality or other utility or Facility Owner includes the following items:

(a) New installations of or alteration of sanitary sewers and connections, water, gas, electric, telephone, telegraph, fire or police alarm facilities, parking meters, and similar utilities.

(b) New installation or alteration of signs not necessary for the safe and efficient flow of traffic.

(c) Roadway and bridge width in excess of standards.

(d) Construction inspection, staking, and material testing and acceptance for construction of sanitary sewer and water main.

(e) Parking lane costs.

(f) Coordinate, clean up, and fund any hazardous materials encountered during construction. All


hazardous material cleanup work shall be performed in accordance to state and federal regulations.

(g) Damages to abutting property due to change in street or sidewalk widths, grades or drainage.

(h) Conditioning, if required and maintenance of detour routes.

(i) Repair of damages to roads or streets caused by reason of their use in hauling materials incidental to the improvement.

5. As the work progresses, the Municipality will be billed for work completed which is not chargeable to federal/state funds. Upon completion of the project, a final audit will be made to determine the final division of costs.

6. If the Municipality should withdraw the project, it shall reimburse the State for any costs incurred by the State in behalf of the project.

7. The work will be administered by the State and may include items not eligible for federal/state participation.

8. The Municipality shall at its own cost and expense:

(a) Maintain all portions of the project that lie within its jurisdiction for such maintenance through statutory requirements, in a manner satisfactory to the State and shall make ample provision for such maintenance each year. This agreement does not remove the current municipal maintenance responsibility.

(b) Maintain all items outside the travel lane along the project, to include but not limited to parking lanes, curb and gutter, drainage facilities, sidewalks, multi-use paths, retaining walls, pedestrian refuge islands, landscaping features and amenities funded by Community Sensitive Solutions (CSS).

(c) Maintain and accept responsibility for the energy, operation, maintenance, repair, and replacement of the lighting system.

(d) Prohibit angle parking.

(e) Regulate parking along the highway. The Municipality will file a parking declaration with the State.

(f) Regulate and prohibit, by ordinance, parking at all times on STH 27 between B-41-12 (Over the La Crosse River) and STH 16.

(g) Use the WisDOT Utility Accommodation Policy unless the Municipality adopts a policy which has equal or more restrictive controls.

(h) Provide complete plans, specifications, and estimates for sanitary sewer and water main work. The Municipality assumes full responsibility for the design, installation, inspection, testing, and operation of the sanitary sewer and water system. This relieves the State and all of its employees from the liability for all suits, actions, or claims resulting from the sanitary sewer and water system construction.

(i) Maintain all Community Sensitive Solutions and/or enhancement funded items.

(j) Coordinate with the State on changes to highway access within the project limits.

(k) Assume general responsibility for all public information and public relations for the project and to make a fitting announcement to the press and such outlets as would generally alert the affected property owners and the community of the nature, extent, and timing of the project and arrangements for handling traffic within and around the projects.

9. Basis for local participation:

(a) Design Engineering (5144-01-05):

The Municipality is responsible for 25% of the design engineering costs for improvements on a Connecting


Highway. The Municipality may be responsible for the design of decorative lighting and other enhancement items.

(b) Real Estate Acquisition (5144-01-21):

a. All real estate acquisitions necessitated by the roadway improvement are 100% eligible for Federal/State funding. The State will reimburse the Municipality for real estate and all eligible acquisition costs necessitated by the roadway construction if the real estate is being acquired where roadway improvements are needed. Costs not eligible for State reimbursement include real estate purchased for parking and excess remnants not associated with the roadway project.

b. Cost eligible for State reimbursement includes access rights on STH 27 (South Black River Street) between North Abutment of Structure B-41-12 (Over the La Crosse River) and Hill Street as indicated in the Transportation Project Plat No: 5144-01-21. Access control has been included in this segment for safety and operational needs. Any future alteration to acquired access rights will require review and written consent from the Department, and will require the Municipality to reimburse the State any property value increase resulting from access alteration as determined by a State approved appraisal.

(c) Construction (5144-01-75):

a. CSS: The CSS funding is 100% Federal/State with a maximum of $180,000. The Municipality will be responsible for 100% of the costs of the aesthetic items over the Federal/State maximum set for each category. CSS funding for all Categories combined is capped at $180,000. All CSS related aesthetic treatment must be finalized six(6) months prior to the PS&E date. The CSS funding has been split up within three categories as detailed below (b-d).

b. Medallion & Landscaping: A Medallion, to be placed in the roundabout island, and the Landscaping for the roundabout island, both requested by the Municipality, and are designed to accepted WisDOT standard and installed at time of construction is 100% eligible for Federal/State funding. However, costs exceeding the maximum CSS funding of $25,000 for the Medallion and Landscaping in the roundabout island are the responsibility of the Municipality. All future maintenance and operation costs of the Medallion and the Landscaping are the responsibility of the Municipality.

c. Roundabout Lighting: New Standard Street Lighting within the roundabout limits are 100% eligible for Federal/State Funding. The Municipality may request decorative lighting in place of standard street lighting within the roundabout limits. The decorative items are eligible for CSS funding. However, the added costs for decorative street lighting exceeding the maximum CSS funding of $71,000 for standard street lighting are the responsibility of the Municipality. All future maintenance and operation costs of the continuous street lighting are the responsibility of the Municipality.

d. New Continuous Lighting: New Standard Street lighting necessitated by the roadway construction, designed to WisDOT standards and installed at time of construction is 50% eligible for Federal/State funding. The other 50% of the standard lighting cost is the responsibility of the Municipality and is not eligible for CSS funding. The Municipality may request decorative lighting in place of standard lighting. The decorative items are eligible for CSS funding. However, the added costs for decorative street lighting exceeding the maximum CSS funding of $84,000 for standard street lighting are the responsibility of the Municipality. All future maintenance and operation costs of the continuous street lighting are the responsibility of the Municipality.

(d) Non Participating Costs (5144-01-76):

The Municipality shall pay 100% of the cost of installing Sanitary Sewer Systems (including manhole(s)) adjustments, Water Main, Water valves adjustments, Fire Hydrant adjustment(s) and relocation(s). The Municipality shall pay 100% cost of installing Sanitary Sewer System, Water Main, Storm Sewer and


Concrete curb and gutter on Roberts Road. These costs are not eligible for Federal/State funding.

(e) Connecting Highway Extension:

The Municipality agrees to an extension of the connecting highway limits on STH 27 from the existing south termini (0.25 miles south of Wisconsin Street (STH 16)) to a new south termini (0.07 miles South of the STH 27 & W Averill Street Intersection; North of the Roundabout). The net center line length of approximately 740 LF will be added to the existing connecting highway limits. Connecting highway aid payments will be adjusted accordingly and the connecting highway status will become effective upon the completion (open to traffic) of this construction project.
