Roeland Park Public Works project update By: Bill Cunningham 02/14/11 RC12-012

• A meeting with City legal representation was convened on 12/30/10 to discuss the City position regarding warranty work on the sod. The project was also discussed at the Public Works meeting in January and continued until the February meeting.

RC12-14

• The project is complete. A final quantity change order and pay request has been prepared. CARS Program (2011)

• The 55th street project shared between Roeland Park and Fairway is ready for letting. The plans are being reviewed by utility companies and the County CARS representative.

• Contact has been made with business representatives of the business park along the south side in Fairway and they seem comfortable with the project, but want ample warning of the process.

• Strouds Restaurant has some concern about the driveway closures and we have made adjustments to the specifications that will control the closure to one half at a time. Additionally, we have the changed the specifications to call for “High-Early” concrete which can set quicker and allow traffic on the driveways sooner.

• This needs to be placed on a council agenda for approval of plans and specifications, and moving forward with setting a bid date.

• The project is well underway. Hydraulic calculations and preliminary design has been started. • The first Public Information Meeting will is scheduled for Tuesday March 22, 2011.

Re: Roeland Park City Property - ____________ Dear Property Owner: On February 21, 2011, the City Council adopted Resolution # . This action began the process of storm water improvements in your area including the design, engineering and construction of storm sewers, channels, retention basins, or drains. The entire project is known as RC12-018. (A copy of the resolution is available at City Hall or online at www.roelandpark.org.) This letter is to inform you that your property referenced above is located within the drainage area or "benefit district" of this project. A benefit district is an independent taxing district created solely to fund infrastructure improvements within a defined area. The properties that fall within a benefit district experience flooding and/or contribute to flooding within a certain project's boundaries. The purpose of this improvement project is to reduce flooding and potentially remove certain properties from residing in flood area. The costs of the improvements will be paid between the Johnson County Stormwater Management (SMAC) and the benefit district. At this time, construction is projected to begin in the spring of 2012. Only after construction has been completed and the total project costs finalized will the City be able to provide you with the exact amount of your assessment. Once calculated, that amount will be included within your 2013 property tax assessment. You will have the option to pay it all at once or have it remain on the property tax assessments for fifteen years. You will receive similar notices such as this in the mail that will inform you about future stages of the project and whether or not your property will qualify for an easement during construction. On March 22nd at 7:00 pm there will be a public meeting and overview of the RC12-018 project. It is hopeful that by this date City staff will have a rough estimate of what the assessments might be for homeowners. Re: warranty \vork on RC 12-12 project

Dear Mr. Talcott,

I am enclosing a copy of a letter that we passed out when we sodded the above referenced project. As you can see we made it perfectly clear that our warranty peliod was for the first thirty days as specified in the contract documents in section 02930-7 paragraph E. Please note that we also handed out the pamphlet as required by the contract documents. The letter was approved by the city as was the pamphlet Larkin gave us to ha!ld out. These were handed out on three different dates, October 13, October 16, and one was handed out some lime earlier but I'm not sure of the date.

I looked at the sod today, and it seems that a lot of it is coming back: especially in the areas where people are watering it. The problem is it was a very hot and dry summer, the residents didn't maintain and water the sod the way they should have, the result being the sad went dormant. Now that the weather has cooled off the residents could pour the water to the sad and most of it would come back. The problem is not the sad but the lack of maintenance and watering the sad.

This letter is to notify Rose-Lan Contractors, Inc. of work that needs to be performed as part of the hvo year maintenance period for this project Several areas of sod that were installed as part of the project have died and need to be addressed. TIle attached general layout shows area of sod to be addressed. We are open to alternative solutions to sod replacement, such as verticutting and overseeding the areas. In addition, the resident at 5000 Wells Drive has complained of standing water in his front yard behind the curb. This area was to be graded to drain to the street and it appears it may have settlcd. Additional fill needs to be placed behind the curb so that the area drains to the street. TillS area will need to be resodded after placement of the additional fill. In addition, curb cracks at 3818 48th Street and the island at Reinhardt & Pawnee need to be repaired.

Clippings need not always be remOVed. o Steep slopes, hard spots and hot areas require special attention: \[echanical aeration, holes b:; spading fork, extra slow watering and use of Vletting agents may all help get better penetration.

On clay or silt-type soils or any turf receiving constant traffic, soil sealing and compaction C3n seriously impair turf growth. Grass roots are injured because air, water and fertilizers cannot reach them in sufficient quantity. Aermion to break through this barrier is essential for continued turf health.

.-\.er3.tion is best done by pov,er equipment which pulls out snnll cmes of soil or b:; cutting vertical grooves to provide openings every 3--1 inches. Power equipment is usually too e'<pensive for home r~vms, but might be purchased coopera­tively. It is aVJ.ilable on rental basis from many deCllers in lavin supplies or from lawn service firms. For small areas, suitable hand equipment is available, but using it is hard work. Even an ordinary spading fork plunged into the soil at 2-3 inch interv::!ls when the soil is slightly moist-not wet-is farbetter than nothing at all.

Aeration should be done at least once each 'ie3r 'khere compaction is a problem. Early' fall is the best time for bluegrass type la'Nns, but it will be highly benefici::!1 3nytime the grass is actively growing e.\cept possibly during mid­summer heat.

I hate to bother you, but we are still having problems with the sod between our houses. It is the worst near our gate to the backyard, on the south side of our house. The new neighbors who bought Grauberger's house also mentioned this. I realize winter has just ended, but that area has never been dry since it was laid last fall. It is always muddy. We put up a small wire fence to keep the mailman from walking on it

Please do what you can to solve this muddy issue.

The dead sod on the west side was added to a list to be verticut and overseeded (The project has several areas of sod that have stressed to dormancy this summer). The pine tree was discussed several times and the Contractor said it was out of easement. The City elected to not remove it at additional cost to the project. I was not aware of any planter ( the preconstruction photos can be referenced), but bushes are not typically covered in replacement cost

I still have some open issues with the City Storm Drain Project #RC1212. I'm confident that you can help Janet and I resolve these. As our neighbor we know that you have a vested interest in maintaining property values.

For the record our address is 5234 Reinhardt Drive.

I met with Bill Persons, President of Rose-Lan regarding the open items I still had late last year and he said he would get back to me. He never called me so I called his office about a month ago. I'm not sure who I spoke with but was advised they were finished with the project unless something needed to be fixed. The person I spoke with recommended I contact the City administrator to address any concerns. I decided to write to you in hopes of bringing closure to this entire event.

His team did correct some items but I still have some open issues

• Pine Tree - Our pine tree in the back yard has been destroyed. When the project started the guy that was removing the elm tree on the west side of the drive told me he was told explicitly he could not touch a limb on the pine tree. Later in the project the workers came to the door and asked Janet if it was ok if they removed the lower limbs of the tree in order to accommodate their heavy equipment. This was all limbs below 10-15 feet from the ground. Additional limbs were broken off the west side of the tree by the large equipment. The tree originally had limbs about four feet off the ground and provided privacy for our back yard. Now we have no privacy in our back yard and the tree looks absolutely terrible. It needs to be removed.

" Planter with bushes - We had a round planter on the west side of our driveway that had four huge pine bushes in it. The planter was in the shape of a circle and made with railroad ties. The ties were cut diagonally. inserted into the ground about a foot and the diagonal end was about a foot high. The planter was about 15 wide and the bushes were huge, about six feet tall and completely filled the planter. We priced these bushes and the cost is $65 at Suburban Nursery and that was for a plant that is about a foot tall.

II Lawn - the lawn on the west side of our driveway is dead as is the front corner of the yard. The part that is the most unsightly is where the construction company parked their equipment then dumped their gravel. It is obvious the ground was not prepped for the sod and grass will not grow on these sections of our lawn.

" Janet's knee - The construction company blocked our driveway for 3 weeks and we had to cross the construction area which had 18-30 inch ruts from the land mover. Janet fell into one of the tracks and couldn't get out. I pulled her out but she banged up her knee and couldn't walk for almost a week. She has seen a chiropractor for her knee and her lower back.

We were told our property would be in "as good or better" condition than before the project. This project has totally changed the appearance of our property and there is no way we can restore the privacy afforded by the mature trees in the back yard. We ended up removing the rock garden in our front yard since we couldn't anything within the easement. At this point I am asking that the city make good on their promise and at least bring resolution to the issues still pending

I want the tree removed, lawn fixed and compensation for the planter, bushes and trees, As far as Janet's accident I'm not sure what the solution should be, I can't stand to look at the pine tree any longer and want it removed in the next couple of weeks so I can plant some new stuff, Please let us know what will be done within the next two weeks,
