1. INTRODUCTION
Terratest (Pty) Ltd has been appointed by Afri-Infra Consulting Engineers and Project Managers (Pty),
on behalf of the Zululand District Municipality, to undertake the environmental service required for the
authorisation of the P700 Nodal Development, Ulundi Local Municipality, KwaZulu-Natal. This
Notification Sheet aims to inform Interested and Affected Parties (I&APs) of the Environmental Impact
Assessment (EIA) and Water Use Licence Application (WULA) processes that are being conducted
for this development. All issues and comments raised by IAPs during this process will be documented
in the Basic Assessment Report. This will assist in the identification of environmental issues that could
have a negative and / or positive impact on the site and the community.
2. PROJECT DESCRIPTION AND LOCALITY
The P700 Nodal Development is a Zululand District Municipality community upliftment project aimed
at servicing the communities surrounding the site. The proposed development is located
approximately 26 km from Ulundi town, at the intersection of the P700 and the P701, within Ward 14
of the Ulundi Local Municipality. Please see Appendix 1: Site Map.
The proposed P700 Nodal Development will include the following:
The clearance of land, exceeding 1ha in extent (Including laydown areas required during the
construction process) for the construction of 27 institutional and business stands; and
A waste water sewerage package treatment plant with a total capacity of 490m³ /month. The
waste water sewerage package treatment plant will be situated approximately 225m from the
Nhlungwane River. The outfall sewer line will be 200mm in diameter and will discharge into
the Nhlungwane River.
The business stands and package treatment plant will tie into the existing on-site infrastructure. The
operation of the proposed waste water package treatment plant will result in water containing waste
being discharged into a water resource, thus requiring the need to undertake a Water Use Licence
Application as listed within Section 21(f) and (g) of the NWA of 1998.
An insignificant amount of material will be required for layer works of the package plant. This material
will be obtained from excavated material where the structure is to be built or will be imported from
commercial sources via the Contractor. As such, a Mining Permit is not required as part of this
Application.
3. LEGISLATION
3.1. Basic Environmental Impact Assessment
In order to obtain Environmental Authorisation for the P700 Nodal Development, a Basic
Environmental Impact Assessment (EIA) is to be undertaken as per the National Environmental

Management Act (Act 107 of 1998): EIA regulation (2014, as amended 2017). In this regard, the
following Listed Activities as noted in the EIA Regulations (2014) as amended (2017), are triggered by
the proposed P700 Nodal Development:
The aim of the EIA will be to assess the possible environmental impacts that may arise from the P700
Nodal development to enable the Department of Economic Development, Tourism and Environmental
Affairs (EDTEA) to make an informed decision on the proposed development. After the review of all
the documentation provided by Terratest (Pty) Ltd, EDTEA will provide a decision on Environmental
Authorisation. The estimated timeframe for the Basic EIA Process is 7 months.
3.1 Water Use Licence
The operation of the proposed waste water package treatment plant will result in water containing

The proposed development is to take
place on land which was previously
used for grazing and growing of crops.
Although the site has been partially
transformed through the construction
of water, electricity and drainage
infrastructure, it is considered that this
Listed Activity still applies, thus
requiring the undertaking of a Basic
Impact Assessment.

waste being discharged into a water resource. As such, the National Water Act (Act No. 36 of 1998)
notes that a Water Use Licence in terms of Section 21 of the National Water Act (Act No. 36 of 1998)
is to be obtained prior to construction commencing in terms of:
Section 21(c) – “Impeding or diverting the flow of water in a watercourse;”
Section 21 (f) – “Discharging waste or water containing waste into a water resource through a
pipe, canal or sewer, sea outfall or other conduit;”
Section 21 (g) – “Disposing of water in a manner which may detrimentally impact on a water
resource” and
Section 21 (i) - “Altering the bed, banks, course or characteristics of a watercourse.”
The estimated timeframe for the required Water Use Licence is 300 days from the date of submission
of the application to the Department of Water and Sanitation.
The EIA and Water Use Licence Application processes will be undertaken concurrently.
3.2 Waste Management Licence
In terms of the NEM: WA, there are certain Listed Activities related to the re-use, storage, treatment
and disposal of waste that requires a Basic Assessment (Category A), an EIA Process (Category B)
or Norms and Standards as gazetted by the Minister to be adhered to (Category C). In this regard, the
listed activities were assessed, but it was determined that no thresholds were triggered, and as such,
a Waste Management Licence Application is not required.
4. SPECIALIST STUDIES
The following Specialist Studies will be conducted, the result of which will be presented in the draft
and final Basic EIA Reports:
Heritage Impact Assessment;
Geotechnical Assessment;
Hydrogeological Assessment; and
Wetland and Riparian Assessment
5. HOW DO I PARTICIPATE
IAPs are invited to participate by providing comments and raising issues of concern regarding the
proposed project. In order to register in the EIA Process and to be kept informed of progress, please
complete the Registration Form attached as Appendix 2 and forward onto Terratest (Pty) Ltd as per
the details provided.
All key stakeholders and IAPs registered in this Application are hereby informed of Section 3(4) of GN
R 326 of the EIA Regulation (2014) as amended which state, “When State Department is requested to
comment in terms of these regulations, such State Department must submit its comment in writing
within 30 days from the date on which it was requested to submit comment, and if such State
Department has no comments.“ This regulation will be enforced when the draft Basic Assessment
Report is submitted to State Departments for comment. Further, all IAPs are notified of Section 3(8) of
GNR 326 of the EIA Regulations (2014) as amended which states, “any public participation process
must be conducted for a period of at least 30 days.” In this regard, all registered IAPs will be afforded
the opportunity to comment on the Draft Basic Assessment Report for a period of 30 days.

2. Environmental Process and Project Description
2.1 Mr Nkomonde started by greeting and thanking everyone who attended the meeting. He
explained his position in Terratest (Pty) Ltd company as an Environmental Assessment
Practitioner.
He noted that Zululand District Municipality has appointed JG Afrika (Pty) Ltd as an
independent environmental consultant to assist with the Environmental Authorisation
Application which is to be submitted to the Department of Economic Development, Tourism
and Environmental Affairs for the proposed development of 27 Business stands and a waste
water package treatment plant.
Mr Nkomonde explained that lavatory facilities would be developed together with the
business stands. The effluent waste from the lavatories would be treated at that treatment
plant. Treated water would then be discharged from the treatment plant into the nearby
Nhlungwane River.
He noted that the proposed waste water package treatment plant would have a capacity of
490m3/month and will be situated approximately 225m from the Nhlungwane River. The
operation of the proposed waste water package treatment plant will result in water containing
waste being discharged into the water resources.
Mr Nkomonde explained that the application for environmental authorization is being
conducted in accordance with the requirements of NEMA regulations, as the establishment of
a waste-water treatment plant is a listed activity that requires authorization prior to its

development. Terratest is assisting the District Municipality to obtain the Environmental
Authorization for this project, by conducting the basic environmental assessment.
He further noted that as per requirements of the NEMA regulation, the Environmental
Authorisation Process requires that a public participation be undertaken as part of the process.
This process is aimed at informing the public about the proposed development and invited
them to participate in the Environmental Authorisation process.
2.2 Mr Nkomonde explained that the environmental assessment process requires a public
participation component to allow the receiving community to comment on the proposed
development. He explained that through this meeting, his role is to: firstly, inform the
receiving community about the proposed project, and; secondly, collect/record all comments,
queries and responses from the community regarding the proposed project. He encouraged
the community to consider how they think the proposed development would impact on the
o u it ’s e i o e t. He e plai ed that he e the e a e uestio s that he ould ot e in a position to answer, these would be noted and the relevant stakeholders would be engaged
for clarity.
He further noted that the background information is available to anyone who requests it.
Further, he noted that a form is available at the meeting to those who wish to Register as
Interested and Affected Party (IAP). He notified the community that the form may be used to
submit written comments or queries if they are uncomfortable with speaking up at the
meeting. Written submissions may be anonymous and in any language.

3. Comments & Responses
3.1 Pollution of the river system.
It was understood that the water from that would be discharged from the treatment plant
would have been treated. However, what is the quantity of water that will be discharged into
the river? Other sources such as water tankers and boreholes are not reliable as they
sometimes contain water that is not fit for human consumption. The river system is the only
source the community trusts to provide them with clean water. Is there no other alternative
discharge point other than the Nhlungwane River? What are the mitigation measures
proposed to ensure that no waste from the Treatment plants ends up in the river?
The Basic Assessment process involves multiple stakeholders that include government
departments, including the Department of Water and Sanitation (DWS). All information and a
data collected in the assessment is shared with the stakeholders for them to comment, query
and approve/reject the proposed development. The Environmental Impact Assessment that is
being conducted will identify all negative impacts that the Wastewater Treatment Plant will
have on the environment as well as the river system. Mitigation measure for all identified
impact will be provided and implemented during the construction and operation phase of the
development to ensure that the river system is not polluted. A Water Use License Application
(for the discharging of water into the river) is also being processed with the DWS. It is not only
the quantity of the discharged water that is important, but also the quality. There are water
quality standards that are established by stakeholders like the DWS that the treatment plant
would need to meet. Therefore, the quality of the discharged water would be monitored
continually during the operational phase of the plant to ensure that the quality of the river
water is not compromised.

3.2 Air Pollution

would be a closed system.

We appreciate the proposed business stands. However, the filling station is stagnant; it is not
providing any goods/services for the community. Vendors from the proposed business stands
will not be successful if the filling station is in a dysfunctional state because the filling station
will draw people towards the vendors. We need a police station, an ATM and a community
hall. But the filling station is the main priority.
A Contractor that was building the existing commercial complex told us that there would be
this sewage treatment plant. He added that there would be vegetable gardens and other
developments. The Contractor built a sewage pipe that stops a short distance from the
complex. He then explained that one day there would be a project to build a water treatment
plant that would connect to this pipeline. He said he had to stop the pipeline there because
the community had to come together to decide where the cattle dip should be relocated to
because it is in the way of the pipeline.
The Traditional Council is in discussions with various stakeholders regarding the filling station.

• An operation and maintenance plan needs to be developed for the sewage treatment work to address plant down time and associated loss of containment, especially during power failures.
• As per the Geohydrological Assessment, suitable collector systems for major loss of containment should be considered in the engineering design;
• Where possible, solar power should be used as a back-up energy source for the WWPTP so as to limit down time and possible leaks.

Please be advised that Eskom objects as the proposed development encroaches into Eskom Ulundi NB59 11k-V Underground Cable Servitude. Since this is at an authorisation stage with various departments, Eskom Sub Transmission has conditions that need to be met along with any comment we give. The location of all existing Eskom infrastructure has been taken into account in the engineering design drawings and the relevant precautionary distances have been taken into account in the layout of the proposed development. As such it is not anticipated that Eskom infrastructure will be impacted upon in any way. In addition, if the
- No excavations may be effected within 1.5m from any underground electricity cable.
- Eskom shall retain unobstructed access at all times.
- Statutory ground to conductor clearance must be maintained.
- The clearance between Eskom’s live electrical equipment and the proposed construction work shall be observed as stipulated by the relevant regulations.
- The height of laden vehicles crossing infrastructure is not to exceed 6m.
- No construction work or excavations shall be executed within 14m of any Eskom power line, 2m from any stay / steel structure and 6m from any foundation.
- The wayleave storage area is not to be used for the storage of material or equipment.
- No material may be dumped in the wayleave area and the applicant shall be liable for any cost of remedial action that may need to be carried out by Eskom.
Should this Application be successful, a formal application must be submitted to Eskom’s offices prior to construction a ctivities.
Proposed P700 Nodal Development does not materialise, then the Eskom infrastructure established on site will not service anything. The conditions listed by Eskom have been included in the recommendations of this report as well as in the EMPr.
