Who are the Commissioners for Community Pharmacy? Role of NHS England ( The National Commissioning Board)

Essential & Advanced Services are exempt from Procurement rules

Role of Clinical Commissioning Groups (CCGs) Locally Commissioned Services must comply with Procurement rules e.g. Anticoagulation

Role of Local Authorities ( Local Public Health) Locally Commissioned Services must comply with Procurement rules e.g. Smoking Cessation

Commissioning DecisionsTender Waiver Decision by commissioner not to procure a new service but

to award contract directly to a known provider Commissioner risks legal challenge to the decision Often adopted for short-term pilot projects Commissioner must justify each Tender Waiver on its own

merits. Justifications may include: - very short term nature of the project - very specialised nature of the project. i.e. no

market - Due to location, patient continuity of service only

really feasible for one provider to deliver.

Commissioning DecisionsFull Tender Decision by commissioner to procure a service; intention to

select a single or small number of providers for contract. Usually adopted for larger contracts which specify activity

levels & price, guaranteeing a contract value & outcomes. Legally secure provided strict adherence to the process. Selection process is resource intensive and can be

prolonged (3-6 months typically) Strategically useful if the commissioner wishes local services

which are coordinated by a single provider Probably lower price option because activity levels and

income can be guaranteed for the provider, reducing risk. Easier to maintain, monitor & performance manage

contract.

select a large number of providers for contract. Usually adopted for smaller contracts which do not specify

activity levels but price, no guaranteed contract value- less outcomes focus

Legally secure provided strict adherence to the process. Selection process is resource intensive but not as long as

full tender (3 months typically) Strategically useful if the commissioner wishes local services

which are provided by a large number of diverse providers. Probably higher price option because activity levels and

income cannot be guaranteed for the provider, increasing risk.
