AND IN THE MATTER OF AN APPLICATION by the agent Don Robertson on behalf of the owners Al Ouimet & Penny Posta, for relief from the provisions of the Zoning By-Law No. 90-145-Z, as amended, under Section 45 of The Planning Act, R.S.O. 1990, c. 1. A minimum lot area of 0.29 hectares shall be provided for the property known as 3 Neptune Drive instead of the minimum required lot area of 0.4 hectares; and,

2. A minimum lot area of 0.27 hectare shall be provided for the property known as 21 Concession 8 Road East instead of the minimum required lot area of 0.4 hectares.

Section 4.12(d) of the Zoning By-law deems the lot area to comply as existing for any lot which existed on the passing of the effective date of the By-law. As the subject lands are no longer as existing on the effective date of the By-law, variances are required to permit a reduced lot area.

NOTES;

i. The required parking has been calculated based on 12 habitable rooms. The Hamilton Zoning By-law 6593 requires parking to be provided at a rate of two (2) parking spaces for the first eight habitable rooms plus 0.5 spaces for each additional habitable room. If the number of habitable rooms is increased, further variances may be required.

ii. Eaves and gutters are permitted into encroach into a required side yard 1.0m or one half the required width, whichever is lesser. Insufficient information has been provided in order to determine zoning compliance.

8. A minimum side yard of 1.5 metres shall be provided for a corner unit instead of the minimum required side yard of 2.0 metres;

9. A minimum rear yard of 0.0 metres shall be provided instead of the minimum required rear yard of 6.0 metres;

10. A maximum density of 71.8 units per hectare shall be provided for the entire development instead of the maximum permitted density of 40 units per hectare;

13. A minimum landscaped open space of 10% of the lot area shall be provided instead of providing landscaping in accordance with Section 6.10.3(m) of the Zoning By-law (please see note 3 below);

14. Two (2) parking spaces and 0.3 visitor parking spaces for each dwelling unit shall be provided instead of providing a minimum of two (2) parking spaces and 0.5 visitor parking spaces for each dwelling unit;

15. Visitor parking spaces and landscaping shall be permitted to be located with the common element condominium road deemed a street; and,

16. A maximum of 14 maisonette dwelling units shall be permitted in a building instead of a maximum of 8 maisonette dwelling units permitted to be located in a building.

NOTES:

1. The variances have been written as requested by the applicant. This property is subject to Site Plan Control; to date, no formal site plan application has been submitted and a full zoning review has not been conducted for the proposed development. Further variances may be required at such time that a formal zoning review is conducted in the proposed development.

2. The variance requested for a minimum distance between buildings is not required as 3.0 metres is permitted between end walls.

3. Pursuant to Section 6.10.2(m) of the Zoning By-law, minimum landscaped open space is required to be provided as follows:

1. Not less than 50 percent of the lot area for maisonettes, townhouses and dwelling groups shall be landscaped including privacy areas.

AND IN THE MATTER OF AN APPLICATION by the agent TCA/Their & Curran Architects Inc. on behalf of the owner 121 King (Hamilton) GP Inc. c/o Tyler Ross, for relief from the provisions of the Zoning By-Law No. 05-200, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the construction of a two and three storey addition to the existing building to establish a six storey building consisting of three (3) ground floor commercial units and 40 residential dwelling units, notwithstanding,

1. A maximum building height of 23.8 metres shall be provided instead of the maximum permitted building height of 22.0 metres;

2. Exterior building cladding for the first three storeys shall be permitted to consist of a combination of three (3) materials instead of the maximum combination of two (2) materials permitted to be applied to the exterior of a building for the first three (3) storeys (see note 2 below); and,

3. No on-site parking shall be provided instead of providing a minimum of 17 parking spaces required to be provided for the 21 dwelling units proposed to be provided within the new addition (see note 3 below).

1. Details regarding the proposed development have not been provided; as such, the variances have been written as requested by the applicant. The lands are subject to SPA-17-186; the applicant shall ensure all other applicable zoning regulations as noted in Building Division comments dated August 22, 2017 can be complied with otherwise further variances will be required.

2. Section 6.2.3©(iii)(4) of the Zoning By-law restricts exterior building cladding to a maximum of two of the following materials: brick; concrete panels; stone block, stone veneer or artificial stone; stucco; or metal and metal panels, excluding aluminum siding or any metal variant thereof. Pursuant to SPA-17-086, the applicant proposes to install brick, stone veneer and metal panels.

3. Section 5.6(a)(b) .o f the Zoning By-law states that additional parking is only required to be provided for an addition or expansion to an existing building. The applicant has indicated 21 dwelling units requiring 17 parking spaces are to be provided within the proposed addition. Parking at a rate of 1 space per dwelling unit is required except where the gross floor area of the dwelling unit is 50 square metres or less then parking at a rate of 0.3 spaces per unit is required. Details regarding the gross floor area of the individual dwelling units have not been provided.

NOTES:

i. A third kitchen is shown on the submitted drawing labelled ‘Building Section’. The applicant shall ensure that only two self-contained units are intended. The use of a three family dwelling is not permitted in the current zoning designation.

ii. No parking spaces have been illustrated on the submitted site plan. As such, variances respecting parking have been written as requested by the applicant. There is insufficient detail on the site plan to determine if any additional variances are required with respect to Section 18A (Parking).

iii. It appears that a third storey dormer would be intended on the northerly side to accommodate an interior stairway to access the third storey. No information has been submitted with respect to this addition therefore, the side yard setback for this addition cannot be determined. It appears a variance would be required to accommodate this dormer, variance #1 has been written to reflect the furthest possible projection into the side yard. The applicant shall also ensure this dormer is 10.5m from the rear lot line.

1. Details regarding the basement/cellar have not been provided. A basement, defined as having more than one-half of its clear height above grade is considered a storey. A cellar, defined as having more than one-half of its clear height below grade, is not considered a storey. A further variance will be required if a basement is proposed.

2. The proposed roofed-over unenclosed porch, including the eave and gutter, is required to maintain a minimum setback of 1.5 metres from the street line. A further variance will be required if a minimum setback of 1.5 metres is not provided to the street line.

3. A further variance may be required if a minimum of 50% of the gross area of the front yard is not provided as landscaped area.

4. A further variance will be required if greater than eight (8) habitable rooms are to be provided within the proposed dwelling.

5. A further variance will be required if a minimum of 50% of the gross area of the side yard abutting the street is not provided as landscaped area.

This application is necessary to facilitate Site Plan Application DAB-16-044.

Please note that no elevations have been provided with this application showing height from grade as defined in the By-Law; therefore, applicant shall ensure that the maximum permitted height is not exceeded; otherwise, further variances may be required.

No floor plans have been provided with this application; however, A studio (home occupation) is being proposed within the single family dwelling as per comments provided for DAB-16-044 and dated October 27, 2017; however, no details have been provided with regards to the total gross floor area devoted to the home occupation and/or details of the nature of the home occupation in order to determine zoning compliance; therefore, further variances may be required.

Please note that the setbacks provided on the site plan for the proposed balconies are 3.96 m for balcony # 1 and 5.33 m for balcony # 2; however, the applicant had requested under item # 6 of the application a 3.03 m for balcony # 1 and 1.96 m for balcony # 2. The design can be interpreted differently. The front portion of the house is 2 stories. The attic is not habitable. The attic

ceilings are low. Attic storage is necessary as there is no basement or garage . The back portion.of-the house shows 3

stories however, the 1st/grade level consists of a stair well & mechanical room which is not habitable.

Appendix A.2

Requesting .76m front set back for ‘pass-through’ access to parking. Allowed-1.5m.

The title ‘car-port’ has been renamed ‘pass-through’. This is a drive-through/breeze-way access passage to the parking area in the rear of the house. During a meeting on Sept 15/17, Maria Romano suggested that if thfe name was changed from car port to drive-through, it would solve the problem.
