SUBJECT: AMENDMENT #2 - ENGINEERING AGREEMENT COURTHOUSE PLAZA RENOVATION & SECURITY MEASURES PROJECT
BACKGROUND
The Board of Commissioners entered into an agreement with Moorman, Kizer & Reitzel, Inc., (MKR) in August 2005, to provide engineering and architectural services for the Courthouse Plaza Renovation & Security Measures Project. Amendment #1 was approved by the Board in August 2008.
Attached for the Board's consideration is Amendment #2 of the engineering agreement with MKR for the above referenced project. This amendment includes additional engineering services provided by MKR both prior to and during construction of the work. The additional services are identified in Exhibit B of the amendment and are summarized as follows:
Repackaging and rebidding the original project Value Engineering to identify cost cutting options Design and construction observation of temporary handicap ramp in fiont of LEC along Dick Street Design and construction observation of new handicap ramp fiom parking lot along Dick Street Evaluate wall sealant alternatives and construction observation of application Design and construction observation of ramp at South Entrance Redesign of crash gates per City Fire Marshall requirements Evaluation of air monitoring devices Design and construction observation of new ramp at Person Street Parking Lot (PhaseV) Additional reimburseable expenses fbr printing and postage
Compensation is based on time and materials with a total amount of $22,122.56. Suficient monies are available in the project budget to fund this amendment. The amendment has been reviewed by the County Attorney's Office for legal sufficiency.

RECOMMENDATIONIPROPOSED ACTION
The recommendation of the County Engineer and management is to approve Amendment #2 to the Engineering Agreement with MKR for the Courthouse Plaza Renovation & Security Measures Project in the amount of $22,122.56 and increase the total not-to-exceed contract amount fi-om $31 1,375 to $333,497.56.
The proposed action by the Board is to follow the staff recommendation.

The Agreement for engineering services for the Cumberland County Courthouse Plaza Renovations and Security Measures Project by and between the County of Cumberland and Moorman, Kizer & Reitzel, Inc., (MK&R) dated August 15,2005, shall be amended as follows:
Add ~Gic le 8.2.4. to read:
8.2.4. The Engineer shall provide additional services for design and construction administration of the Courthouse Plaza Renovations and Security Measures Project as described in Exhibit B and attached herein. Compensation for said services shall be a stipulated sum of $22,122.56. The total not-to-exceed amount for engineering services for said project shall be increased from $31 1,375.00 to $333,497.56.

LOT 9A BLOCK E ECCLES PARK REV SEC 1 (LOCATED ON REGAN AVE. OFF MCLAMB DR.) PIN 0428-88-5674; CROSS CREEK TOWNSHIP
BACKGROUND: On or about March 12, 2008, the County acquired by tax foreclosure the above property. The amount currently owed on the foreclosure judgment including interest and cost for the propesty is $2,587.62.
Gerald Wright has offered to purchase the County's interest in the propesty for $2,587.62 and has deposited $259.00 in the Finance Office. The tax value of the property is $9,000.00.
This property is surplus to the needs of the County and, according to N.C.G.S. 153A-176 and N.C.G.S. 105-376, the County has the autholity to sell such property. Management has reviewed this offer and it is now being submitted for the Board to consider whether or not to accept Mr. Wright's bid. The property has been advertised and this office has not received any upset bids. The bid period is now closed.
RECOMMENDATION AND PROPOSED ACTION: That the Board of Commissioners consider whether to accept the offer of Gerald Wright to purchase the above property for the sum of $2,587.62, plus costs, and authorize the Chairman to execute a deed upon receipt of the balance of the purchase*priae.

The Child Homicide ldentification and Prevention (CHIP) Council has a vacancy for an unexpired term for A Representative of the Cumberland Countv Board of Commissioners.
The CHlP Council meets the third Thursday of every month at 6:00 p.m. in the Board Room at the Mental Health Center, 651 Executive Place.
The CHlP Council Mission Statement: To identify conditions in families and in our community that are associated with child homicides by parents or caretakers and to change those conditions.
