Kirkland Police Totem Lake Room June 8, 2018

1. Call to Order

The NORCOM Governing Board was called to order by Greg Ahearn, Governing Board Chair, at 9:35 a.m.

2. Roll Call Chair Ahearn requested a roll call of present Governing Board members. A quorum was established.

3. Open Communications from the Public There were no requests for communication from the public.

4. NORCOM Recognition

A. Executive Director Thomas Orr recognized Deanna Carkeek, who is retiring at the end of June after 30 years working in a 911 call center. B. Executive Director Thomas Orr recognized Clyde Hill Police Chief Bill Archer, who is retiring in June after 33 years in service as a police officer.

5. Action Items A. Consent Calendar

Chair Greg Ahearn called for a motion to approve the items on the consent agenda: minutes from the May 11, 2018 Governing Board meeting and the May 2018 accounts payable report (accounts payable total: $855,234.38). Bob Larson made a motion to approve the consent calendar. Nathan McCommon seconded the motion. Motion carried.

5. Old Business

A. Fire Projects Update IT Director Ron Tiedeman provided updates on TriTech CAD-X, King County Fire Asset Renumbering and the Joint Integrated Project Task List.

B. Police Projects Update IT Director Ron Tiedeman provided updates on outstanding Priority fix requirements for Tyler; the status of the selection process for the database administrator and system engineer positions; and a progress report on integration of the iBase crime analysis and Coplogic integration efforts.

C. IT Infrastructure IT Director Ron Tiedeman provided updates on the State 911 ESInet II switchover August 7th; RAADAR progress, and the new ASAP to PSAP protocol.

D. E-911 Strategic Planning Update

Executive Director Thomas Orr Director Orr noted there was a PSAP director meeting the first week of June, where ASAP to PSAP was reviewed.

6. New Business A. 2016 State Audit Complete

Finance Manager J.R. Lieuallen reports on the results of the State Auditor’s Financial Audit for 2016. The audit was clean with no findings or management letter.

B. Budget Update Finance Manager J.R. Lieuallen noted that the prior budget estimate of a 5.8% increase in fees billed to agencies has been reduced to an estimate of 3.3% PSERN costs will not incur until 2021.

C. Seattle University Efficiency Study Executive Director Thomas Orr presented the findings of the meeting efficiency study produced by Seattle University’s Criminal Justice Graduate Program. The Board determined to hold a study session at the July 13 Governing Board meeting.

D. Resolution 143: Kirkland IT Development ILA (PetData)

IT Director Ron Tiedeman reviewed Resolution 143, approving an agreement for IT support of PetData between NORCOM and the City of Kirkland. Chair Ahearn called for a motion to approve resolution 143, development of Pet Data interface for Kirkland Police. Ed Holmes made a motion to approve resolution 143. Marilynne Beard seconded the motion. Motion carried.

E. Resolution 145: Approval of TriTech CAD X Interface Contract Executive Director Thomas Orr reviewed the complexities of operating with two CAD systems. He spoke to the benefits of TriTech’s CAD X product, which would allow telecommunicators to use one CAD system. He noted one CAD system would shorten NORCOM’s current training time. There was a general discussion about the pros and cons of CAD X versus switching to one CAD. The Board tabled consideration for the July 13 meeting to allow for additional cost information to be researched.

F. Resolution 147: Authorizing Executive Director to Negotiate and Sign Basic Data Sharing Agreement with Agencies who Join RAADAR Executive Director Thomas Orr introduced attorney Rich Black of Foster Pepper.

Rich Black addressed the history of RAADAR and its current patent status. The Board discussed the extent to which NORCOM would provide free access to regional

partners and requested additional information regarding how NORCOM would support RAADAR and the plan for marketing RAADAR. The Board tabled the resolution for further consideration at the July 13th Governing Board meeting.

There were no comments or questions regarding the committee reports.

Resolution 145

A RESOLUTION OF THE GOVERNING BOARD OF NORCOM APPROVING AN AGREEMENT WITH TRITECH SOFTWARE

SYSTEMS.

WHEREAS, the Northeast King County Regional Public Safety Communications

Agency (“NORCOM”) is in need of certain technology products and services provided by TriTech Software Systems (“TriTech”); and

WHEREAS, the Governing Board (the “Board”) now desires to enter into a contract with TriTech for such products and services as provided herein;

NOW, THEREFORE, BE IT RESOLVED by the Governing Board of

NORCOM as follows:

Section 1. Authorization. The Board hereby approves the contract with TriTech (the “TriTech Contract”), in substantially the form attached hereto as Exhibit A and incorporated herein by this reference. Costs of the products and services paid by NORCOM under the terms of the TriTech Contract shall not exceed $__________ without additional Board approval. The Executive Director of NORCOM is hereby authorized to execute the TriTech Contract with such modifications and revisions as determined to be necessary by the Executive Director and legal counsel to NORCOM.

Section 2. Further Authority; Prior Acts. All NORCOM officials, their agents,

and representatives are hereby authorized and directed to undertake all action necessary or desirable from time to time to carry out the terms of, and complete the transactions contemplated by, this resolution. All acts taken pursuant to the authority of this resolution but prior to its effective date are hereby ratified and confirmed.

Section 3. Effective Date. This resolution shall take effect immediately upon

Summary Information & Project Notes

Assumptions:

- Items quoted are for the TriTech and EDC portions of the CAD to CAD project. Any cost incurred regarding

Services and configuration for the Tyler Technologies CAD system are the responsibility of NORCOM to obtain

pricing and purchase separately.

- The EDC License(s) for their software is granted under the same provisions as the TriTech Software license

between TriTech and NORCOM.

- Software Licenses in Quotation for TriTech Tiburon and Inform CAD clients is for budgetary purposes only.

Licenses will be owned by each individual client, though NORCOM can opt to be billed for the purchase if

necessary.

- As with the Assumption for Tyler Technologies, the 5th agency that is not a TriTech client will be responsible for

any Services associated with the configuration of their CAD system to the CAD to CAD implementation. Services

quoted are for the EDC Services only.

Terms and Conditions

Payment terms are as follows

50% of all Software, Services, Support and fixed travel fees are due at time of order -and- 50% of all Software,

Services, Support and fixed travel fees are due upon installation or completion of services (whichever comes

later).

Software License Terms:

The Software is licensed for use by Client in accordance with the software licensing terms of the System Purchase

Agreement currently in effect between TriTech and Client. Acceptance for the Software may be defined in the

Statement of Work ('SOW'), if not, the Software licenses shall be deemed accepted on delivery.

Acceptance for the TriTech Software licenses included in the Quotation will be governed by the standard terms

set forth in TriTech's System Purchase Agreement, which shall supersede any prior System Purchase Agreement.

Any changes to scope of testing may result in a price increase for services.

The annual Software Support Services for the TriTech Software licenses are provided for a period of twelve-

months from the Installation date and shall be governed by the existing Software support Agreement currently in

effect between TriTech and Client. Support fees will be prorated at renewal of the existing support term to

adjust to the term to be co-terminous with the existing support agreement term.

Sales Tax:

Any estimated sales and/or use tax has been calculated as of the date of quotation and is provided as a

convenience for budgetary purposes. TriTech reserves the right to adjust and collect sales and/or use tax at the

actual date of invoicing, at the then current rates. Your organization must provide TriTech with a copy of a

current tax exemption certificate issued by your state's taxing authority for the given jurisdiction, when your

order is placed, if you are exempt from sales tax.

General Terms:

The items in this quotation are based upon meetings and communications with the Client and unless attached to

a contract form the entirety of the deliverables from TriTech.

The scope of Deliverables for this order will be limited to the Software, Services, and Support and Maintenance

that is explicitly listed herein for the listed quantities.

This order provides Software licenses as well as required deployment services only for the environments that are

explicitly listed herein (Production, Test, Training, Disaster Recovery, etc.). These software licenses do not apply

to any other existing environments, or environments that may be implemented in the future.

Changes in the scope of certain components of the System may impact the cost and timelines for other areas of

the Project.

All services will be performed during normal business hours, unless otherwise stated in this quotation for specific

service deliverables.

Deployment and implementation of TriTech Software and Services are based upon Client's provision and

compliance with TriTech's System Planning Document.

TriTech reserves the right to adjust this Quotation as a result of changes including but not limited to project

scope, deliverables (TriTech Software, or third party software or hardware, including changes in the hardware

manufacturer’s specifications), services, interface requirements, and Client requested enhancements.

Standard Interfaces are developed and enhanced within TriTech's version process for the TriTech Software

applications (such as CAD). Changes to standard Interfaces will require adherence to the development life cycle

therein. Updates or upgrades to standard Interfaces that are delivered within this life cycle will require the

Client’s system to be on the current production release of the TriTech Software application(s).

A RESOLUTION OF THE GOVERNING BOARD OF NORCOM APPROVING A COLOCATION AGREEMENT BETWEEN THE CITY

OF BELLEVUE AND NORCOM

WHEREAS, the City of Bellevue (“Bellevue”) is a party to the October 2007

Northeast King County Regional Public Safety Communications Agency (“NORCOM”) Interlocal Agreement (the “Interlocal Agreement”) and is a Principal of NORCOM (as defined in the Interlocal Agreement); and

WHEREAS, NORCOM leases certain space and facilities from Bellevue, including physical space for NORCOM’s equipment and operations at Bellevue City Hall, located at 450 110th Avenue N.E. Bellevue, WA 98004 (referred to as “colocation space”); and

WHEREAS, NORCOM and Bellevue now desire to continue their arrangement

under which Bellevue will continue to provide colocation space and related services to NORCOM; and

WHEREAS, the Governing Board (the “Board”) now desires to enter into a

Colocation Agreement between NORCOM and Bellevue as provided herein; NOW, THEREFORE, BE IT RESOLVED by the Governing Board of

NORCOM as follows:

A RESOLUTION OF THE GOVERNING BOARD OF NORCOM APPROVING AN AGREEMENT FOR LICENSING SOFTWARE AND

SHARING DATA WITH OTHER AGENCIES

WHEREAS, the Northeast King County Regional Public Safety Communications Agency (“NORCOM”) seeks to license Real-Time Agency Activity Display and Reporting software (“RAADAR”), developed by NORCOM, to other agencies in Washington State, and share certain police, fire, and emergency medical services information with and between Agencies using RAADAR, for the mutual purpose of improving Police, Fire, and Emergency Medical Services provided to the public.

WHEREAS, the Governing Board (the “Board”) now desires to enter into an agreement with other Agencies in Washington State to allow them to use RAADAR and share police, fire, and emergency medical services information using RAADAR.

NOW, THEREFORE, BE IT RESOLVED by the Governing Board of

NORCOM as follows:

Section 1. Authorization. The Board hereby approves the form of the DRAFT of RAADAR (the “Software License and Data Sharing Agreement”) and authorizes the Executive Director to negotiate with outside agencies for an agreement to mutually exchange data via RAADAR with terms substantially in the form of DRAFT agreement. If negotiations result in a proposed final agreement between NORCOM and an outside agency, the Executive Director will bring the proposed final agreement before the Governing Board for approval.

Section 2. Further Authority; Prior Acts. All NORCOM officials, their agents,

and representatives are hereby authorized and directed to undertake all action necessary or desirable from time to time to carry out the terms of, and complete the transactions contemplated by, this resolution. All acts taken pursuant to the authority of this resolution but prior to its effective date are hereby ratified and confirmed.

NORTH EAST KING COUNTY REGIONAL PUBLIC SAFETY COMMUNICATION AGENCY (“NORCOM”)

SOFTWARE LICENSE AND DATA SHARING AGREEMENT

This Software License and Data Sharing Agreement (“Agreement”) is entered into this ___ day of , 2018, by and between North East King County Regional Public Safety Communication Agency (“NORCOM”), and ___________________ (“AGENCY”).

RECITALS

1. NORCOM has developed and owns software for providing and sharing Police, Fire, and Emergency Medical Services information known as Real-Time Agency Activity Display and Reporting (“RAADAR” or the “Software”).

2. AGENCY wishes to acquire and NORCOM wishes to grant AGENCY a license to use RAADAR, royalty free. The Parties agree that they have not negotiated this agreement to represent a “reasonable royalty.’ Instead, NORCOM wishes in return to have access to performance and usage data of AGENCY relating to use of RAADAR for purposes of improving and optimizing RAADAR.

3. AGENCY also wishes to share Police, Fire, Emergency Medical, Reporting, and Dispatching data, of its choosing, and reciprocate the same through RAADAR with NORCOM and ASSOCIATED AGENCIES for the mutual purposes of contributing to public safety interoperability, safety, situational awareness and regional mutual aid by providing accurate, comprehensive, and objective information regarding current call activity of agencies who participate, and to generally improve Police, Fire, and Emergency Medical Services provided to the public (“Reciprocal Data Sharing”).

4. Consistent with the North East King County Regional Public Safety Communication Agency Interlocal Agreement, dated October 23, 2007, and pursuant to RCW 36.01.010 and other applicable sections of the Revised Code of Washington, NORCOM and AGENCY desire to enter into this Agreement to provide Police, Fire, and Emergency Medical Services to the public.

The Parties agree as follows:

1) DEFINITIONS. As used in this Agreement, the following terms shall have the following defined meanings:

a) “AGENCY” means __________________________.

b) “AGENCY DATA” means that information, data, materials, works, expressions or other content, which are selected by AGENCY for sharing with NORCOM, including data relating to providing Police, Fire, Emergency Medical, Reporting, and Dispatching Services within the service area of AGENCY and any data or content that are (a) uploaded, submitted, posted, transferred, transmitted or otherwise provided or made available by or on behalf of AGENCY for processing by or through the RAADAR Software, or (b) collected, downloaded or otherwise received by the RAADAR Software pursuant to this Agreement or at the written request or instruction of AGENCY, as may be further

specified in Exhibit B. For the avoidance of doubt, AGENCY DATA includes all Personal Information produced by or associated with AGENCY.

c) “ASSOCIATED AGENCIES” means those public agencies listed in Exhibit A.

d) “Confidential Information” means non-public information of NORCOM, AGENCY, or ASSOCIATED AGENCIES disclosed by either Party to the other Party, either directly or indirectly, in writing, orally or by inspection of tangible objects, or to which the other Party may have access, or any other information which a reasonable person would consider confidential and/or which is marked “confidential” or “proprietary” or some similar designation by the disclosing Party or which is of a confidential nature even though not specifically so designated, including but not limited to patient information (including, but not limited to, Personal Information), health information, information regarding a Party’s internal operations. Confidential Information shall not, however, include any information which the recipient can establish was or has become generally known or available or in the public domain without direct or indirect fault of the recipient; NORCOM DATA and RAADAR are NORCOM Confidential Information.

e) “Intellectual Property” shall mean any inventions, concepts, data, proprietary methods, algorithms, techniques, drawings, know-how, specifications, clinical measures, processes, transformed data results, writings, software, source and object code, protocols, mask work, including any Derivative Works thereof; whether or not patentable, copyrightable or subject to mask work rights or other forms of protection, and all patent filings, trademarks, trade secrets, and copyrights and other proprietary information.

f) “NORCOM MEMBER AGENCY” means the governmental agencies that are or that may become affiliated with NORCOM pursuant to the North East King County Regional Public Safety Communication Agency Interlocal Agreement, dated October 23, 2007.

g) “NORCOM DATA” means any and all information, data, materials, works, expressions or other content, including data relating to providing Police, Fire, Emergency Medical, Reporting, and Dispatching Services within the service area of any NORCOM Agency and any data or content that are (a) uploaded, submitted, posted, transferred, transmitted or otherwise provided or made available by or on behalf of NORCOM or any ASSOCIATED AGENCY for processing by or through the RAADAR Software, or (b) collected, downloaded or otherwise received by the RAADAR Software pursuant to this Agreement or at the written request or instruction of NORCOM, or any ASSOCIATED AGENCY, that NORCOM or any ASSOCIATED AGENCY, as applicable, selects to share. All output, copies, reproductions, improvements, modifications, adaptations, translations and other derivative works of, based on, derived from or otherwise using any NORCOM DATA are themselves also NORCOM DATA. For the avoidance of doubt, NORCOM Data includes all Personal Information produced by or associated with NORCOM or any ASSOCIATED AGENCY.

h) “Performance and Usage Data” means memory usage (both logical and physical), data search and return bandwidth speeds and usage, database query and statistical usage, IO performance, and other metrics associated with the operation of RAADAR.

i) “Personal Information” means any information provided by or accessed through RAADAR Software that does or can identify a specific individual or by or from which a specific individual may be identified, contacted or located, such as the individual’s name, address, social security number, etc., and any other information relating to an identified or identifiable individual, including without limitation “protected health information” as defined under the Health and Insurance Portability and Accountability Act (“HIPAA”) of 1996 (42 U.S.C. § 1320d) and updates or revisions thereof.

j) “Reciprocal Data Sharing” means the sharing of certain NORCOM DATA with AGENCY, and the sharing of certain AGENCY DATA with any ASSOCIATED AGENCY and NORCOM, if a NORCOM MEMBER AGENCY is an ASSOCIATED AGENCY.

2) PURPOSE. This Agreement establishes the basis for NORCOM to license RAADAR to AGENCY and to facilitate sharing of AGENCY DATA between AGENCY, ASSOCIATED AGENCIES as defined in Exhibit A, and NORCOM to the extent any NORCOM MEMBER AGENCY is listed in Exhibit A, and to facilitate sharing of NORCOM DATA between NORCOM and AGENCY for the purpose of improving public safety and emergency services provided to the public. Reciprocal Data Sharing will be performed under this Agreement for the sole purpose of contributing to public safety interoperability, safety, situational awareness and regional mutual aid by providing information regarding current call activity of agencies who participate, and to generally improving Police, Fire, and Emergency Medical Services provided to the public, in accordance with, and to the extent permitted by, applicable law.

3) GRANT OF LICENSES.

a) LICENSE TO AGENCY. NORCOM grants AGENCY a non-assignable, non-exclusive, royalty-free license (with no right to sublicense) to access and use RAADAR in Washington State during the Term solely in connection with AGENCY’S governmental operations and as permitted under this Agreement only for the PURPOSE. NORCOM’s intent is to continue to provide RAADAR, royalty free to AGENCY in the foreseeable future. If conditions change, AGENCY has the option to terminate this Agreement, as described below in section (5).

b) LICENSE TO NORCOM. AGENCY grants to NORCOM a worldwide, non-assignable, non-exclusive, royalty-free, sublicensable license to access, use, and monitor, with the assistance of AGENCY as determined by NORCOM, the Performance and Usage Data for purposes of improving and optimizing RAADAR.

4) DATA SHARING.

a) RECIPROCAL DATA SHARING. NORCOM agrees to share NORCOM DATA, commensurate in scope with AGENCY DATA, for which AGENCY agrees to share with NORCOM, through RAADAR, as may be defined in Exhibit B. AGENCY acknowledges and agrees that NORCOM may limit any data shared through RAADAR in order to comply with applicable laws. AGENCY also expressly agrees to allow NORCOM to share AGENCY DATA with ASSOCIATED AGENCIES, defined in Exhibit A for the PURPOSE. Each Party may modify the data shared, and with whom, by providing Notice to the other Party, as described below in section (12). AGENCY and NORCOM agree that all unique identifiers, if present in the data, will be protected and kept strictly confidential.

Any other use or disclosure of any NORCOM DATA in any form whatsoever other than as specified herein is expressly prohibited without the prior written consent of an authorized representative of NORCOM.

b) FIRE AND MEDICAL SERVICES. To the extent AGENCY provides fire or medical services, or handles Personal Health Information (“PHI”), as defined by 42 USC §1320d et seq. (“HIPAA”), AGENCY agrees to certain restrictions on data sharing, as provided in Exhibit C, in order to ensure compliance with HIPAA and the Health Care Information Act, Chapter 70.02 RCW. To the extent AGENCY improperly receives any PHI, AGENCY agrees to immediately notify NORCOM of such sharing and agrees to comply with HIPAA and the Health Care Information Act.

c) POLICE SERVICES. To the extent AGENCY provides police or other law enforcement services, or handles criminal justice information, AGENCY agrees to certain restrictions on data sharing, as provided in Exhibit E, in order to ensure compliance with the Criminal Justice Information Services Security Policy (“CJIS Security Policy”). To the extent AGENCY improperly receives any information in violation of the CJIS Security Policy, AGENCY agrees to immediately notify NORCOM of such sharing and agrees to comply with the CJIS Security Policy.

d) AGENCY DATA. NORCOM acknowledges that AGENCY has the right to select what data it shares with NORCOM as AGENCY DATA. However, if after signing this Agreement, AGENCY changes what data it selects to share as AGENCY DATA, it must provide notice to NORCOM thirty (30) days before making any such change.

5) TERM AND TERMINATION.

a) TERM. The term of this Agreement will begin on the Effective Date and expire December 31 on the same year of the Effective Date (“Initial Term”) provided, however, that upon expiration of the Initial Term and any Renewal Term(s), the Agreement shall automatically renew for successive one (1) year terms (each a “Renewal Term”) unless either Party gives written notice to the other Party of its intention not to renew the Agreement at least thirty (30) days prior to the expiration of the Initial or Renewal Term.

b) TERMINATION. Each Party may terminate this Agreement at any time and for any reason or no reason at all, by giving the other Party written notice of termination at least thirty (30) days prior to the termination date. NORCOM may immediately terminate this Agreement if (i) any portion of RAADAR provided to AGENCY is prohibited by applicable law or has become impractical or unfeasible, or (ii) if AGENCY materially breaches this Agreement or commits several immaterial breaches that together constitute a material breach. Upon termination of this Agreement for any reason: (i) AGENCY will remain liable for AGENCY’s obligations under this Agreement; (ii) all of AGENCY’s rights that do not survive this Agreement shall immediately terminate; and (iii) AGENCY shall immediately return, or if instructed by NORCOM, destroy (and provide certification of destruction of) all NORCOM DATA then in AGENCY’s possession.

6) CONFIDENTIALITY; PUBLIC AGENCY, CJIS AND HIPAA COMPLIANCE.

a) CONFIDENTIALITY. Each of the Parties agrees: (i) not to intentionally disclose any of the other Party’s Confidential Information to any third parties except as mandated by law

and except to those who agree to be bound by confidentiality obligations no less stringent than those set forth in this Agreement as authorized in writing by NORCOM; (ii) not to use any of the other Party’s Confidential Information for any purpose except carrying out such Party’s rights and responsibilities under this Agreement; and (iii) to keep the other party’s Confidential Information confidential using the same degree of care such Party uses to protect its own confidential information; provided, however, that such Party shall use at least commercially reasonable care. These obligations shall survive termination of this Agreement. Notwithstanding anything to the contrary in this Agreement, NORCOM may maintain and use general, anonymous, non-personally identifiable, aggregated statistical data and information based on AGENCY Performance and Usage Data for the purposes of benchmarking and making improvements to RAADAR.

b) PUBLIC AGENCY. The Parties agree that no action taken by either Party in compliance with its legal obligations, including but not limited to disclosure of AGENCY DATA or NORCOM DATA in response to a Public Records Act request, judicial order, or other legally justified production request, will be deemed inconsistent with any provision of this Agreement. Any records request AGENCY receives “specific to NORCOM” will be treated as a records request for NORCOM, whereby AGENCY will forward the request to NORCOM to handle appropriately. Similarly, any records request NORCOM receives “specific to AGENCY” will be treated as a records request for AGENCY, whereby NORCOM will forward the request to AGENCY to handle appropriately. NORCOM and AGENCY are not permitted to use the RAADAR Software to obtain data in response to a Public Records Act request. The Parties understand and acknowledge that NORCOM and AGENCY are public agencies and subject to the Public Records Act, Chapter 42.56 RCW, and other regulatory requirements that may necessitate disclosure of this Agreement or records related to it. AGENCY agrees to take reasonable steps to ensure that the RAADAR software is not used to respond to Public Records Requests, including, as determined by AGENCY, to train its employees in using the RAADAR Software within the bounds of this Agreement.

7) OWNERSHIP AND INTELLECTUAL PROPERTY. AGENCY acknowledges and agrees

that: (i) NORCOM owns all right, title and interest in RAADAR and any related software, and any modifications, updates, releases or Enhancements thereto, whether made by AGENCY OR NORCOM and whether or not provided to AGENCY pursuant to this Agreement, and any related Intellectual Property, including the sue of marks and names, this includes any updates or modifications to RAADAR suggested or created by AGENCY and (ii) nothing in this Agreement shall confer in AGENCY any right of ownership or use in such items, other than the limited licenses set forth herein. AGENCY will not assert, nor will AGENCY authorize, assist, or encourage any third party to assert, against NORCOM or any of NORCOM’s customers, end users, vendors, business partners (including third party sellers on websites operated by or on behalf of NORCOM), licensors, sublicensees or transferees, any patent infringement or other intellectual property infringement claim with respect to RAADAR.

8) PUBLICITY. Neither Party will use the name of the other Party or refer to the existence of the Agreement or services in publicity releases, advertising or communication of any type without the other Party’s prior written permission.

9) REPRESENTATIONS AND WARRANTIES.

a) By licensing and providing access to the RAADAR Software and sharing NORCOM DATA, NORCOM does not warrant or represent that: (a) the NORCOM DATA is accurate, complete, up-to-date or current; (b) NORCOM has any obligation to update any NORCOM DATA; (c) the NORCOM DATA is free from technical inaccuracies or typographical errors; (d) that the NORCOM DATA does not infringe on the intellectual property rights of any third party; (e) that the NORCOM DATA is free from changes caused by a third party; (f) AGENCY’s access to the RAADAR Software will be free from interruptions, errors, computer viruses or other harmful components; and/or (g) any information obtained in response to questions asked through the RAADAR Software is accurate or complete.

b) AGENCY agrees to train and obligate its users of RAADAR to use RAADAR in a way that is at least as restrictive as this agreement.

10) INDEMNIFICATION. Each party will indemnify the other Party for a breach of its obligations under this agreement.

11) INSURANCE. Each Party shall obtain and provide insurance, to the extent practicable, against loss or liability for the actions of that Party.

12) NOTICES. Notices made by NORCOM under this Agreement will be provided for AGENCY via the email address provided to NORCOM in AGENCY’s registration for RAADAR or in any updated email address AGENCY provides to NORCOM in accordance with standard procedures established by NORCOM. Notices made to NORCOM under this Agreement will be directed to the following unless all parties are otherwise notified in writing: Chair, NORCOM Governing Board, c/o his/her Principal agency's address. Notices may be given by mail, overnight delivery, facsimile, telegram, email (with confirmation of transmission) or personal delivery.

13) CONFLICTS WITH INTERLOCAL AGREEMENT, NORCOM MOU, OR LAW.

a) In the event this Agreement conflicts with, or is otherwise inconsistent with, the North East King County Regional Public Safety Communication Agency Interlocal Agreement, dated October 17, 2007, the Memorandum of Understanding (MOU), as between NORCOM and NORCOM MEMBER AGENCIES, dated April 10, 2015, or applicable law, including but not limited to the Criminal Justice Information Services (“CJIS”) Security Policy, the Interlocal Agreement, MOU, applicable law, or CJIS, as applicable, will control.

14) ADDITIONAL AGREEMENT TERMS. Additional standard software license terms are included in Exhibit F, which form part of this Agreement.

EXHIBIT C

The following terms form part of the SOFTWARE LICENSE AND DATA SHARING AGREEMENT (“Agreement”), as if included in that Agreement.

1) TECHNICAL RESTRICTIONS. NORCOM may implement technical restrictions, which may be modified from time to time, on what portions of AGENCY DATA and NORCOM DATA may be shared and between whom, through RAADAR, in order to comply with 42 USC §1320d et seq. and its implementing regulations as currently existing and as amended (collectively, “HIPAA”) and the Health Care Information Act, Chapter 70.02 RCW if applicable, or other applicable law, and be consistent with the North East King County Regional Public Safety Communication Agency Interlocal Agreement, dated October 23, 2007, and the Memorandum of Understanding (MOU), as between NORCOM and its Member Agencies, executed by NORCOM Member Agencies on April 10, 2015. The scope of data shared, including the number and types of data fields, as may be defined in Exhibit B, via this Agreement shall be limited by the scope of AGENCY DATA and NORCOM DATA on an ASSOCIATED AGENCY basis, as set forth below.

a) To the extent AGENCY is not a “Health Care Provider” as defined in 45 C.F.R. 160.103, NORCOM will allow any non “Health Care Provider” ASSOCIATED AGENCY to access AGENCY DATA and allow AGENCY to access NORCOM DATA pertaining to that ASSOCIATED AGENCY, subject to the requirements of CJIS, if applicable (as illustrated in Figure 1 below). To the extent AGENCY is collecting and providing protected health information (as defined by 45 C.F.R. § 160.103) (“PHI”) through RAADAR, NORCOM will allow sharing of the PHI for “Treatment” purposes only with that ASSOCIATED AGENCY, as defined by HIPAA (as illustrated in Figure 2 below). To the extent AGENCY requests access to PHI of that ASSOCIATED AGENCY, NORCOM will allow AGENCY to access the PHI for “Treatment” purposes only.

b) To the extent AGENCY is a “Health Care Provider” as defined in 45 C.F.R. 160.103, NORCOM will restrict any ASSOCIATED AGENCY that is not a “Health Care Provider” as defined in 45 C.F.R. 160.103 from accessing AGENCY DATA through RAADAR (as illustrated in Figure 3 below).

2) HEALTH INFORMATION PRIVACY. To the extent required by law and as applicable,

each Party shall comply with all applicable laws regarding the privacy or confidentiality of health information, including but not limited to 42 USC §1320d et seq. and its implementing regulations as currently existing and as amended (collectively, “HIPAA”) and the Health Care Information Act, Chapter 70.02 RCW. To the extent the Parties are required to comply with HIPAA, the Parties’ obligations with respect to HIPAA are more specifically described in Exhibit D to this Agreement. To the extent AGENCY is required to comply with HIPAA, AGENCY undertakes to comply with all the obligations of the NORCOM MEMBER AGENCIES, as set forth in Exhibit D, which is incorporated herein by reference, as if a party thereto. NORCOM undertakes to comply with all the obligations of NORCOM, as set forth in Exhibit D, as if AGENCY were a NORCOM MEMBER AGENCY as defined in Exhibit D; provided that NORCOM will have no obligation to indemnify AGENCY pursuant to Section II.m of Exhibit D.

a) To the extent required by law, AGENCY agrees to take reasonable steps to ensure that the RAADAR Software is not used in a way that violates HIPAA and the Health Care Information Act, including, as determined by AGENCY, to train its employees in using the RAADAR Software within the bounds of this Agreement.

b) Notwithstanding anything to the contrary herein, AGENCY agrees to access protected health information (as defined by 45 C.F.R. § 160.103) (“PHI”) available through RAADAR Software only for purposes of “Treatment” as defined by HIPAA. If upon initial assessment of available NORCOM DATA that includes PHI, AGENCY determines that it will not be a responding agency and/or will not be anticipated to provide “Treatment” services, AGENCY shall not further access such PHI. AGENCY agrees to promptly notify NORCOM of any instances of which it becomes aware in which the confidentiality of PHI has been breached.

c) The Parties shall negotiate in good faith any additional agreements or amendments to this Agreement that may become necessary to ensure compliance with HIPAA, if applicable. If after good faith negotiations the Parties are not able to agree to the terms necessary to comply with HIPAA, NORCOM may terminate this Agreement upon

NORCOM will restrict the sharing of criminal justice information between AGENCY and any ASSOCIATED AGENCY where AGENCY, ASSOCIATED AGENCY, or both, are not subject to the requirements of the CJIS Security Policy.

1) ADDITIONAL REPRESENTATIONS AND WARRANTIES.

a) Each Party to this Agreement represents and warrants to the other Party that: (i) such Party has the full corporate right, power and authority to enter into this Agreement and to perform the acts required of it hereunder; (ii) the execution of this Agreement by such Party, and the performance by such Party of its obligations and duties hereunder, do not and will not violate any agreement to which such Party is a party or by which it is otherwise bound; (iii) when executed and delivered by such Party, this Agreement will constitute the legal, valid and binding obligation of such Party, enforceable against such Party in accordance with its terms, and (iv) such Party acknowledges that the other Party makes no representations, warranties or agreements related to the subject matter hereof that are not expressly provided for in this Agreement.

2) DISCLAIMERS.

a) NO ADDITIONAL WARRANTIES. EXCEPT AS EXPLICITLY STATED HEREIN, NEITHER PARTY MAKES, AND EACH PARTY HEREBY SPECIFICALLY DISCLAIMS, ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND SERVICES CONTEMPLATED BY THIS AGREEMENT, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

b) EXCLUSION OF CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EITHER PARTY BE LIABLE TO ANYONE FOR LOST PROFITS OR REVENUE OR FOR INCIDENTAL, CONSEQUENTIAL, PUNITIVE, COVER, SPECIAL, RELIANCE OR EXEMPLARY DAMAGES, OR INDIRECT DAMAGES OF ANY TYPE OR KIND HOWEVER CAUSED, WHETHER FROM BREACH OF WARRANTY, BREACH OR REPUDIATION OF CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL CAUSE OF ACTION FROM OR IN CONNECTION WITH THIS AGREEMENT (AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

3) MISCELLANEOUS PROVISIONS.

a) GOVERNING LAW; JURISDICTION; VENUE. This Agreement and all acts and transactions pursuant hereto and the rights and obligations of the Parties hereto shall be governed, construed and interpreted in accordance with the laws of the State of Washington, without giving effect to principles of conflicts of law. each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding.

b) INJUNCTIVE RELIEF. AGENCY acknowledges that in the event of a breach, monetary relief will be inadequate and injunctive relief will be appropriate.

c) ATTORNEY FEES. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, each Party shall be responsible for its own costs.

d) SEVERABILITY. If any portion of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining portions of this Agreement will remain in full force and effect, and any invalid or unenforceable portions shall be construed in a manner that most closely reflects the effect and intent of the original language. If such construction is not possible, the provision will be severed from this Agreement and the rest of the Agreement shall remain in full force and effect.

e) SURVIVABILITY. The Parties' obligations under Sections (6), (7), (9), (9), and (10) of the Software License and Data Sharing Agreement will survive the expiration or termination of that Agreement.

f) ASSIGNMENT. Except as otherwise set forth in this Agreement, neither party may assign any of its rights or duties under this Agreement without the prior written consent of the other party, such consent not to be unreasonably withheld. The Agreement shall inure to the benefit of and be binding upon the parties to this Agreement and their respective successors and permitted assigns.

g) ENTIRE AGREEMENT. This Agreement including Exhibits hereto constitutes the entire agreement between such Parties pertaining to the subject matter here of and merges all prior negotiations and drafts of the Parties with regard to the transactions contemplated herein. Any and all other written or oral agreements existing between the Parties hereto regarding such transactions are expressly canceled.

h) FORCE MAJEURE. NORCOM shall not be liable hereunder for any failure or delay in the performance of our obligations under this Agreement if such failure or delay is on account of causes beyond NORCOM’s control, including labor disputes, civil commotion, war, fires, floods, inclement weather, governmental regulations or controls, casualty, government authority, strikes, or acts of God, in which event NORCOM shall be excused from its obligations for the period of the delay and for a reasonable time thereafter.

i) COMPLIANCE WITH RULES AND LAWS. Each Party shall comply, at its expense, with all applicable Federal, state, county, and local laws, ordinances, regulations, and codes in the performance of its obligations under this Agreement (including procurement of required permits and certificates), including but not limited to HIPAA, the Fair Labor Standards Act and the Occupational Safety and Health Act.

j) NO WAIVER; MODIFICATIONS. No amendment or modification of this Agreement, nor any waiver of any rights, will be effective unless assented to in writing by the Party to be charged, and the waiver of any breach or default will not constitute a waiver of any other right hereunder or any subsequent breach or default. This Agreement may be modified at

A RESOLUTION OF THE GOVERNING BOARD OF NORCOM APPROVING AN AGREEMENT FOR SERVICES RELATED TO

IBM’S IBASE APPLICATION.

WHEREAS, the cities of Bellevue, Mercer Island, Kirkland, and Redmond

(the “Participating Agencies” and each a “Participating Agency”) receive emergency communication services from the Northeast King County Regional Public Safety Communications Agency (“NORCOM”) pursuant to the terms of the October 2007 NORCOM Interlocal Agreement; and

WHEREAS, NORCOM has agreed to manage the administrative tasks associated with the procurement of licensing, to hold the software license(s), and to maintain the International Business Machines Corporation (“IBM”) Company of Design’s iBase application (“iBase”) for use by the Participating Agencies through the 3rd party IBM vendor “Blue Light, LLC”; and

WHEREAS, the Governing Board of NORCOM now desires to authorize the execution and delivery of an agreement for services relating to the iBase application as provided herein;

NOW, THEREFORE, BE IT RESOLVED by the Governing Board of

NORCOM as follows:

Section 1. Authorization. The Governing Board hereby approves the Agreement for Services among NORCOM and the Participating Agencies (the “Agreement”), in substantially the form attached hereto as Exhibit A and incorporated herein by this reference. The Executive Director of NORCOM is hereby authorized to execute the Agreement with such modifications and revisions as determined to be necessary by the Executive Director and legal counsel to NORCOM. In lieu of a single agreement among NORCOM and the Participating Agencies, the Executive Director of NORCOM is authorized to execute one or more agreements for such services between NORCOM and each Participating Agency so long as such agreements are substantially in the form attached hereto as Exhibit A.

Section 2. Further Authority; Prior Acts. All NORCOM officials, their agents,

and representatives are hereby authorized and directed to undertake all action necessary or desirable from time to time to carry out the terms of, and complete the transactions contemplated by, this resolution. All acts taken pursuant to the authority of this resolution but prior to its effective date are hereby ratified and confirmed.

AGREEMENT FOR SERVICES

THIS AGREEMENT FOR SERVICES ("Agreement") is entered into by and among the CITY OF BELLEVUE ("Bellevue"), the CITY OF MERCER ISLAND (“Mercer Island”), the CITY OF KIRKLAND (“Kirkland”), and the CITY OF REDMOND (“Redmond”) and the NORTHEAST KING COUNTY REGIONAL PUBLIC SAFETY COMMUNICATION AGENCY ("NORCOM", and together, the "Parties").

WHEREAS, NORCOM has agreed to manage the administrative tasks associated with the procurement of licensing, to hold the software licensing and to manage the maintenance of International Business Machines Corporation (“IBM”) Company of Design's iBase application for use by Bellevue, Mercer Island, Kirkland, and Redmond (the “Participating Agencies” and each a “Participating Agency”) through the 3rd part IBM vendor “Blue Light, LLC”; and

WHEREAS, NORCOM has agreed to provide software, storage and hosting of the application and connectivity to the application for the Participating Agencies as provided herein; and

NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties do agree as follows:

Section 1. Agreement of the Parties. NORCOM agrees to manage the administrative tasks associated with procuring and managing licensing and annual maintenance of iBase for the Participating Agencies. NORCOM further agrees to provide technical management and hosting of the iBase application and system administration and backup of data. NORCOM shall provide on an annual basis, or as requested, the costs of associated software licenses, maintenance, and ongoing use as identified in the recitals of this Agreement allocable to Participating Agencies. Each Participating Agency agrees to pay, or cause to be paid, such costs at the time of the annual maintenance period billing cycle as defined in Exhibit A.

Section 2. Notice. The following individuals are designated as representatives of the respective Parties. The representatives shall be responsible for administration of this Agreement and for coordinating and monitoring performance under this Agreement. In the event such representatives are changed, the Party making the change shall notify the other Parties. Any notice or other communication given hereunder shall be deemed sufficient , if in writing and delivered personally to the addressee, or sent by certified or registered mail, return receipt requested, addressed as follows, or to such other address as may be designated by the addressee by written notice to the other Parties:

between the Parties and supersedes any prior understandings and agreements between them regarding the subject matter hereof. There are no other representations, agreements, or understandings, oral or written, between the Parties hereto relating to the subject matter of this Agreement. No amendment of, or supplement to, this MOU shall be valid or effective unless made in writing and executed by the Parties hereto.

Section 4 Prior Acts. All acts taken by the Parties concerning the initial purchase and consolidation of the iBase software licenses hereto but prior to the effective date of this Agreement are hereby ratified and confirmed.

Section 5. Duration. This Agreement shall take effect on _________ (the “Effective Date”) and shall remain in effect for five years from the Effective Date. Any Party may terminate its participation in this Agreement by providing at least 180 days written notice to NORCOM prior to the end of the annual maintenance billing period. Any Party may terminate this Agreement at any time prior to the Effective Date by giving written notice to NORCOM.

Section 6. Miscellaneous. (a) Equal Opportunity. No Party to this Agreement shall discriminate against any

person based on any ground prohibited under federal, state or local law including race, creed, color, religion, national origin, sex, age, marital status, sexual orientation, veterans and military status, political affiliation or belief or the presence of any sensory, mental or physical handicap in violation of any applicable federal law, Washington State Law Against Discrimination (chapter 49.60 RCW) or the Americans with Disabilities Act (42 USC 12110 et seq.) in connection with this Agreement.

(b) Governing Law. This Agreement shall be governed by and construed in accordance

with the laws of the State of Washington. If any dispute arises under the provisions of this Agreement, resolution of that dispute shall be available only through the jurisdiction, venue and rules of the King County Superior Court, King County, Washington.

(c) Attorney’s Fees. In any claim or lawsuit for damages arising from the Parties’ performance of this Agreement, each Party shall be responsible for payment of its own legal costs and attorney’s fees incurred in defending or bringing such claim or lawsuit; however, nothing in this subsection shall limit the each Parties’ right to indemnification under this Agreement.

(d) Non-Waiver of Breach. The failure of any Party to insist upon strict performance

of any provision of this Agreement or to exercise any right based upon a breach thereof or the acceptance of any performance during such breach shall not constitute a waiver of any right under this Agreement.

(e) Severability. If this Agreement, or any portion of this Agreement, is held invalid

by a court of competent jurisdiction, the remainder of the Agreement shall remain in full force and effect.

(f) No Joint Venture or Partnership. No joint venture, separate administrative or

governmental entity, or partnership is formed as a result of this Agreement. (g) Compliance with all Laws. The Parties hereto shall comply with all federal, state

and local laws, rules, regulations and ordinances applicable to the performance of this Agreement. (h) Entire Agreement. This Agreement contains the entire understanding between the

Parties and supersedes any prior understandings and agreements between them regarding the subject matter hereof. There are no other representations, agreements, or understandings, oral or written, between the Parties hereto relating to the subject matter of this Agreement. No amendment of, or supplement to, this Agreement shall be valid or effective unless made in writing and executed by the Parties hereto.

(i) Assignment. The Parties shall not assign this Agreement or any interest, obligation

or duty therein without the express written consent of NORCOM. (j) Continuation of Performance. In the event that any dispute or conflict arises

between the Parties while this Agreement is in effect, the Parties hereto agree that, notwithstanding such dispute or conflict, they shall continue to make a good faith effort to cooperate and continue work toward successful completion of assigned duties and responsibilities. Provided that if a Participating Agency fails to pay for the services provided by NORCOM under this Agreement, NORCOM can cease providing such services until payment is made.

(k) Prior Acts. All acts taken by the Parties hereto but prior to the effective date of this

Agreement are hereby ratified and confirmed. Section 7. lndemnity. Each Participating Agency shall protect, defend, indemnify

and save harmless NORCOM, its successors and assigns together with its officers, directors, employees, and agents only from and against any and all liabilities, damages, costs, expenses, causes of action, claims, suits, proceedings and judgments (collectively "Claims") which they may incur or suffer or be put to by reason of or in connection with or arising from any breach, violation or non-performance by such Participating Agency of any

obligation contained in this Agreement, including its addenda, to be observed or performed by such Participating Agency, or any wrongful act or negligence of such Participating Agency or its agents or employees which relates to this Agreement, including its addenda, howsoever arising. For this purpose, each Participating Agency, by mutual negotiation, hereby waives, as respects NORCOM only, any immunity that would otherwise be available against such claims under the Industrial Insurance provisions of Title 51 of the Revised Code of Washington. In the event NORCOM incurs any judgment, award, and/or cost arising therefrom including attorney's fees to enforce the provisions of this article, all such fees, expenses and costs shall be recoverable from the Participating Agency.

NORCOM shall protect, defend, indemnify and save harmless each Participating Agency, its successors and assigns together with its officers, directors, employees, and agents only from and against any and all Claims which they may incur or suffer or be put to by reason of or in connection with or arising solely from any breach, violation or non-performance by NORCOM of any obligation contained in this Agreement, including its addenda, to be observed or performed by NORCOM or any wrongful act or negligence of NORCOM or its agents or employees which relates to this Agreement, including its addenda (and subject to the Software License Agreement), howsoever arising. For this purpose, NORCOM, by mutual negotiation, hereby waives, as respects the Participating Agencies only, any immunity that would otherwise be available against such claims under the Industrial Insurance provisions of Title 5 l RCW. In the event a Participating Agency incurs any judgment, award, and/or cost arising therefrom including attorney's fees to enforce the provisions of this article, all such fees, expenses and costs shall be recoverable from NORCOM.

Section 8 Execution. This Agreement shall be executed the Parties hereto by their duly authorized representative. The Parties hereto represent and warrant that they are authorized to enter into this Agreement in its entirety, and duly bind their respective city by their signatures below. This Agreement may be executed in one or more counterparts. This Agreement shall be dated as of __________________, 2018.

LICENSING/MAINTENANCE PAYMENT STRUCTURE

Each Participating Agency shall pay pro-rated share of licensing fees based on the total number of “concurrent licenses” shared.

Each Participating Agency shall pay for a portion of the total maintenance cost, allocated to each agency based on all Participating Agencies.

In the event a non-participating agency wishes to participate, the joining agency shall pay the appropriate licensing fee based on the proportionate share total. The first annual maintenance cost shall be pro-rated for the remainder of the annual maintenance period and those funds shall be reimbursed to each participating agency based on their prorated reduction in share.

In the event a Participating Agency wishes to withdraw from the Agreement, said agency shall notify NORCOM of their intent to withdraw not less than 180 days prior to the end of the annual maintenance billing period.

Steve will hold a session with NORCOM management on July 17-18. A session with the Governing Board will be planned at this time and is tentatively scheduled for the September, 2018 meeting.

This completes Phase One of the NORCOM Leadership and Strategic Planning Effort. Phase Two will eventually include all of NORCOM’s staff and the NORCOM Governing Board. The first step of Phase Two will involve a Director level retreat with Steve Kent that is scheduled for mid-July. NORCOM Associated Guild Contract Negotiations NORCOM Management and the NORCOM Associated Guild has had their first contract negotiation meeting at the end of last month. A high level of collaboration and positive relationships have continued to lead to a productive negotiation in the spirit of interest-based bargaining. The good labor relations enjoyed by NORCOM have allowed negotiations to be conducted without the added cost of a facilitator. HUMAN RESOURCES Telecommunicator Recruitment On July 2, 2018, NORCOM hired two new telecommunicators. They will be part of NORCOM’s 25th Call Receiving Academy (CRA25). These two hires will be the first in what is believed will be a steady line of new recruits thanks to the work of the Recruitment Cross Team. NORCOM is currently staffed at 51 out of 62 authorized telecommunicator positions. Information Technology Recruitment NORCOM has identified a strong applicant for its Database Administrator position. This applicant is currently completing backgrounding and will be scheduled for polygraph testing shortly. NORCOM is also hiring for a Systems Engineer position. NORCOM continues to interview qualified applicants. Fire Liaison NORCOM has posted the permanent position of Fire Liaison. While it is still early in the process, NORCOM has already received a small number of applications from qualified persons both internally and externally. The anticipated time to fill this position is by mid-September.

Police Liaison Report

The mission and tasks of the Police Liaison has been modified to provide for increased customer centric service, to include collaborative problem solving and effective communications. Bill Hamilton began his duties as the Police Liaison on June 4th, 2018 and has been very active, collaboratively seeking internal and external input in support of site visits to each NORCOM police agency. In addition to general introductions, the primary goal of such visits is to gather candid feedback regarding agency specific needs, concerns, ideas or to simply share kudos for a job well done.

2. Technology and Operational Update The Police Liaison and NORCOM technology staff recently attended a meeting hosted by the Mercer Island Police Department. Eric Burnson, Tyler Technologies, Senior Client Executive was in attendance. The intent of the meeting was to clarify and reinforce our expectations regarding a more aggressive implementation schedule for Tyler’s parking software solution, Brazos. The meeting went well and the project appears to be back on track as evidenced by several recent action steps by Tyler. NORCOM IT and the Police Liaison attended an iBase planning meeting hosted by the Bellevue Police Department. This analytical software allows for the shared use of multi-agency data to create detailed crime reports, crime mapping, link analysis and rich visualization capabilities with robust dissemination tools. The project is on track and a draft user agreement is currently in legal review. The NORCOM administrative staff recently attended a teleconference with the owner of Firsttwo.com. Firsttwo was designed by a Mercer Island resident and is marketed as a law enforcement intelligence gathering tool which provides real time visual access to a great deal of open source information. Firsttwo is a subscription-based application and the cost is set on a sliding scale by agency size. NORCOM is researching this application as a potential tool for our customers. Our police agencies have worked closely with the Police Liaison to finalize their agency specific protocols for July 4th, to include dispatching July 4th “fireworks” calls for service. NORCOM is very appreciative of the agencies advanced planning and coordination, as this allows for timely staffing decisions in support of various agency needs and operational plans.

Police Liaison Report

The Police Liaison is currently working with our police agencies to increase awareness of the applicability of Caller Location Query (CLQ) in a policing environment. CLQ has already proven to be a very useful tool to the Fire Service, to include search and rescue applications. To better serve and support police commanders at various tactical and special events, the Police Liaison is partnering with the Tactical Dispatch team to help share information regarding response capabilities.

Work continues to progress making this operational change to how requests for Strike Teams and Task Forces are handled. NORCOM IT and Operations are putting the final touches on the necessary changes before training for the dispatchers will begin. The new go-live goal is August 2018.

2. SNOQUALMIE PASS FIRE & RESCUE ON-BOARDING After meeting on June 6th, NORCOM is waiting on two major components to be answered before moving forward with a proposal to the board. Namely, how call routing will function in Kittitas County and what the communications infrastructure plan is in the Kittitas County areas.

3. AUTO AID (RENUMBERING) On June 22nd, the three dispatch centers met again and continued discussion to identify the scope of work necessary to accomplish the renumbering of fire apparatus across King County. It has been determined that any change in one of the three zones will affect each of the other dispatch centers. The go-live goal is still January 1st, 2019 and the representatives for each zone and their dispatch centers will continue to meet and work cooperatively toward achieving this.

4. ePASS

NORCOM IT is developing an incident command feature associated with calls in RAADAR. The Passport System utilizes a digital version of fixed or removable helmet shield, primary, back and reserve passports, nametags and portable status boards and associated radio IDs. This has been designed in collaboration with Fire staff and is planned to move into a testing phase next.

ePASS (employee accountability) - Development is now complete and entering a “test phase.” The Passport System utilizes a digital version of the fixed or removable helmet shields, primary, backup and reserve passports, nametags and portable status boards and associated radio IDs. With the design and workflow expertise of Assistant Chief Dahl, Nathan has created a robust, interactive solution.

RAADAR – RAADAR development continues. IT is preparing a business plan strategy to present in draft form to Executive Director and governing board. We hope the business plan will identify direction, and proposed direction for the software application but also the use of resources, income, revenue and potential revenue as approved by the board. Rapid SOS – A new 911 location accuracy software service has hit the market with significant improvement to 911 caller location accuracy, utilizing 3-5 second automatic updates. Apple has announced implementation in their IOS 12 release, and Android discussions are underway. Due to NORCOM’s business model, as well as agencies and population served, Rapid SOS sees NORCOM as a pivotal installation in the region and state. Automatic Aid Renumbering – IT has been attending these multi agency meetings led by King County Fire Chief representative, Deputy Chief Wallgren. A work plan is being formulated to coordinate the numerous agencies affected and technology changes required with a common goal of January 1. TriTech – Business discussion scheduled July 9th. The discussion will be specific to their Technical Director, and senior level engineers and product development representatives. This is our attempt to market RAADAR and its one of a kind features for situational awareness and mutual aid enhancements to the Tri-Tech portfolio. Tyler - Systems are running efficiently with minimal support tickets being triaged. June 26th , we had two brief outages two hours apart caused by a GIS update, and mobile server service error resolved immediately. Three priority issues remain, all associated with GIS addressing. We have received a “fix” for two of those GIS issues and are testing them now.

PSERN – PSAP ILA version 2 final exhibits are being drafted by PSERN and have not been completed. Console and dispatch equipment installation delayed and now scheduled to begin in August 2018.
